October 15, 1981
The City Commission of the City of Clearwater met in regular session
at the City Hall, Thursday, October 15, 1981, at 5:00 p.m. with the

The Mayor called the meeting to order. The Pledge of Allegiance was
led by Major Albert Vellucci. The invocation was given by the Rev.
Patricia Daniels of the First United Methodist Church.

Commissioner Garvey moved to approve the minutes of the
regular meeting of October 1, and special meeting of October 8, 1981, as
recorded and submitted in written summation by the Clerk to each
Commissioner. Motion was duly seconded and carried unanimously.
ITEM #6 - Citizens to be Heard re Items Not on the Agenda.
Charles Shank requested an ordinance be drafted to tax church
properties and suggested a non-taxpayer-user fee be established for use of
library and parks and recreation facilities.
Barbara Birenbaum requested a sidewalk on Nursery Road.
By unanimous consent, the Commission agree to deviate from the regular
agenda order during the evening.
ITEM #10 - Downtown Redevel02ment_Plan.
The redevelopment plan for downtown Clearwater includes tax-increment
financing to aid in the development efforts. It is a flexible guideline to
be used in implementing the Downtown Development Ordinance.

Redevelopment Policies, page 91, has been revised. (Paragraph 4,
relating to development of parcels of one acre or more to be consistent
with the overall Downtown Land Use Plan, which is included as a guide in
this text). The last sentence in Paragraph F, page 92, was deleted and now
reads, "Upper levels of multi-story buildings are encouraged to be
developed for other usage. 1' Paragraph G, the wording, "no less than," was
replaced with, "approximately." Paragraph K was added to the page and
states, "Restaurant/entertainment establishments shall be considered retail
use for purposes of interpreting the downtown redevelopment plan."
Chris Papandreas reported the Downtown Development Hoard
had accepted the changes. The plan will be reviewed by the Board of County
Commissioners and the Pinellas County Planning Council and is expected to
be returned within a 60-day time frame. Adoption hearings will be held by
the City Commission in December of 1981, and the 1980 tax roll can be
adopted as the base year.

Commissioner Garvey moved that the Downtown Redevelopment Plan be
forwarded for review. Motion was duly seconded and carried
unanimously.
ITEM #7 - Clearwater's Proposed Legislation.
The Cities of Clearwater and St. Petersburg employ Jim Massie as a
lobbyist. The Pinellas Legislative Delegation has established November 16,
1981, as the deadline for submitting proposals for their consideration.
Clearwater's proposed legislation will deal with special acts that
F}='YK apply only to Pinellas County, general (new) legislation that would apply
statewide, amendments to existing Florida Statutes and suggested positions
that the City will take on potential legislation.
One of the priorities of the City of St. Petersburg was continued
support for a growth-revenue source, specifically through a local option
:•`'r sales tax.

Commissioner Kelly moved to delete support for a local option sales
tax, and instead, request other alternative revenue sources of funding.
Motion was duly seconded. Upon the vote being taken, Commissioners Garvey,
Kelly and the Mayor voted "aye", Commissioners Hatchett and Calderbank
voted "nay." notion carried.
Commissioner Kelly moved to approve Clearwater's proposed legislation
and to render support for St. Petersburg's proposed legislation but not to
support a local option sales tax and that the appropriate officials be
authorized to execute same. Motion was duly seconded. Commissioner Garvey
stated, for the record, a local option sales tax could be considered along
with other alternative revenue sources. She requested that Jim Massie, the
lobbyist, advise the City on proposed County legislation. Upon the vote
being taken, Commissioners Garvey, Kelly and the Mayor voted "aye";
Commissioners Hatchett and Calderbank voted "nay." Motion carried.
ITEM #8 - Proposal for Leasing of City Property Located at 56 Causeway
Boulevard - Clearwater Beach.
The City Manager reported that over 50 requests for information had
been received relating to the leasing of this City property. A proposal
for leasing of the property for a 15-year period was developed and three
;z;;_•' proposals were received, one of which has since been withdrawn. The two
` proposals were in general conformance with the City specifications and
fix. _• both bidders proposed to use the property
for an essentially similar
purpose.
The bidders will expend considerable funds to renovate the existing
building and will dedicate a portion of the leased
???r?"•,?,•r.??;.f;r;5s',';?;. premises to
itM•;3rz'fJ4 ;?:? informational services for tourists. The City Manager reviewed the
proposal from Howard Johnson Company and Jackson and Oleson.

Paul Jackson, Kenneth Oleson and Jim Graham, architect, raviewed their
proposal and presented an artist's rendering of a two-story, open air,
garden pavilion. The existing premises would be modified by the addition
of a two-story structure to the east. A limited partnership would be
established to fund the requirements of the contemplated project and would
present an investment opportunity for qualified local residents to invest
in the future of Clearwater. The limited partnership proposed to recover
the cost of any improvements up to a limit of $200,000, by deducting from
rental fees to the City on gross sales on the basis of 10-percent a year or
$20,000 per year, until costs of improvement are recovered up to $200,000.
They were also requesting approval for an alcoholic beverage zone
designation for beer and wine consumption on the premises.
George Greer, attorney for Howard Johnson Company, presented their
proposal and stated the existing structure would be modified internally as
well as have external cosmetic improvements at an approximate cost of
$200,000. Space will be available for a tourist information center. An
artist's rendering was presented with most of the traditional orange roof
removed from the building. However, the building would remain one-story
and would be a family restaurant.
Commission questioned the applicants and discussed the proposals.
Commissioner Garvey moved to accept the proposal of Jackson and Oleson
subject to the conditions and reservations outlined in a summary prepared
by staff. Motion was duly seconded and upon the vote being taken,
Commissioners Garvey and Kelly voted "aye"; Commissioners Hatchett,
Calderbank and the Mayor voted "nay." lotion !ailed.
Commissioner Hatchett moved that the proposal of Howard Johnson
Company be accepted with the recommendation a lease be negotiated and
brought back to the City Commission for approval. Motion was duly
seconded. Upon the vote being taken, Commissioners Hatchett, Calderbank
and the Mayor voted "aye"; Commissioners Garvey and Kelly voted "nay."
Notion dried.
ITEM #9 - Alcoholic Beverage Zoning - 56 Causeway Boulevard.
An application had been accepted from Jackson and Oleson for The
Beaehhouse, 56 Causeway Boulevard, contingent on award of the lease to
Jackson and Oleson. The lease was awarded to Howard Johnson Company and
the alcoholic beverage request was withdrawn.
Commission recessed from 8:15 to 8:35. Major Vellucci was replaced by
Police Officer Vicki Hare.
By unanimous consent, the Commission agreed to consider the Consent
Agenda at this time.

Gary Sizemore, attorney for the applicant/owner, stated an average of
3 cars use the street daily. There have been many reports of prowlers,
robbery and theft, and he requested the street be vacated as the
applicant/owner owns the property on both sides and would have greater
control of the area.
James Clodfelter, attorney representing the residents, requested the
vacation be denied as it would not be in the public interest. The other
residents of the street traverse it daily.
