The Mayor oalled the meeting to order. The Pledge of Allegianoe was
led by Police Chief Klein. The invocation was given by Father Joseph

ITEM 17 - MIA Resolution 181-86 - Supporting Action for the Release of
Prisioners of War Missing in Aotion in Southeast Asia.
Commissioner Kelly requested that oopies of the Resolutions be
forwarded to other munioipalities for their support.
Commissioner Kelly moved to pass and adopt Resolution 081-86 and to
authorize the appropriate offioials to execute same. Motion was duly
seoonded. Upon roll oall the vote was:

Eight servioe pins were presented to City employees.
ITEM 15 -Minutes of the Regular Meeting of September 17. 1961.
Commissioner Hatohett moved to approve the minutes of the regular
meeting of September 17, 19B1, as reoorded and submitted in written
summation by the Clerk to eaoh Commissioner. Motion was duly seconded and
oarried unanimously.
ITEM 16 - Citizens to be Heard re Items Not on the Agenda.
Don Mains of Jazz Holiday and his oommittee of ohildren requested
approval from the Commission to establish and promote a oity masoot for
the Jazz Holiday festivities. An offioial search will be started with an
ad in the Clearwater Sun requesting oitizen input. The masoot will ride on
the Clearwater Sun float in the Christmas Parade.
Frank Morrow requested oitizens be allowed to express their opinions
without time limits. He requested repairs be made to a sidewalk on Island
Estates and questioned the need for a quit olaim deed to Allied Stores.

ITEM '6 - Agreement Between the City of Clearwater and the Communioation
Workers of Amerioan and Benefits for Certain Other Non-Union Employees.
Commissioner Hatohett moved to approve the three-year oolleotive
bargaining agreement between the City of Clearwater and the Communioation
Workers of Amerioa effeotive 10-1-61 and extend applioab1e fringe benefits
to all employees who are not members of a bargaining unit. and 8-peroent
wage increases effeotive 10-1-61 and 10-1-82, for all employees except
those who are members of another bargaining unit or the Executive Pay Plan,
and that the appropriate officials be authorized to execute same. Motion
was duly seconded Dnd carried unanlmously.
ITEM 09 - Appointments - Advisory Boards.
a. Beautifioation Committee - Commissioner Garvey moved to appoint
Louise M. Keppie. Motion was duly seoonded and oarried unanimously.
b. Clearwater Housing Authority - The Mayor reoommended that Robert
H. Levison and Riok Hall be reappointed. Commissioner Garvey moved to
approve the Mayor's reoommendation. Motion was duly seoonded and oarried
unanimously.
o. Mobile Home Park Board - Commissioner Kelly moved to approve
reappointment of Constanoe Groth and John W. Oty. Motion was duly
seoonded. Charles Glover, Chairman of the Clearwater Mobile Home
Assooiation, requested Dorothy DeVries be appointed. Upon the vote
being taken, motion carried unanimoulsy.

ITEM 117 - Publio Hearing on the Reoommended Budget 1981/82.
Jeff Butler, Aoting City Manager, gave an overview of the requirements
of the Trimm Bill and reported that the City's increase to the millage was
7.77J. The primary reason for the inorease is inflation's impaot on the
cost of City servioes and in addition Federal funding has been reduoed ie:
Ceta and Planning Grant revenues. Several oomparison oharts of millage
rate inoreases of Pinellas County. the Sohool Board, and the City were
presented.
Citizen oomments were heard from 13 citizens expressing ooncerns about
the overall inorease in the budget over the past several years, requesting
deletion of some programs and a reduotion in the millage. They suggested
better supervision of City employees and citizen partioipation in drafting
the budget. Two sooial agencies, UPARC and the Pinellas Comprehensive
Alooholio Servioes, requested funding.

The Aoting City Manager reported Salary savings did not materialize as
projeoted and the large third quarter inorease in the 1980-61 budget was
due to salary adjustments. Clearwater is a growing area with many servioe

Commission requested the Aoting Budget Director review expenditures
and the drainage millage uses, park oosts, overtime, automobile use and
mileaget and reduotion in City work orews. Suggestion was made to limit

Land Use Plan and Zoning Atlas Amendments.
a. LUP from low density residential to high density residential and
Zoning Atlas Amendment from RS-50 (single family residentlalj zoning to
RM-28 (high density multi-family use) for Lots 1, 2 and 3. Block 9.
Mandalay Subdivision. Section 5-29-15 (Georgilas) LUP 61-54, Z81-6S.
The property is located on the east side of Eldorado, west of Bruoe.
and south of Kipling Plaza. It is ourrent1y vaoant.
Harry Cline, attorney representing the applioant. stated the property
is currently used as a parking lot by beaoh goers. The area is oontiguous
to RM-28 and RS-50 zones and will aot as a buffer as construotion would be
in one building with two stories above parking. It will be an adult
oondominium.
A petition of protests had been submitted by 87 residents within 500
feet of the subject property and 33 names were oertified, as property
owners by the City Clerk. Section 131.013(6) of the Zoning Code,
requires: "A protest be signed by 20 peroent of the owners in the area
proposed to be ohanged, afte~ which Buch request shall not beoome effeotive
exoept by the favorable vote of not less than four members of the City
Commission.
One property owner spoke in support of the request. citing it as an
improvement to the neighborhood.
Joshua Magidson, attorney representing a property owner, and two
residents spoke in opposition, oiting the area as being single family
residential in nature, with the exoeption of the Mandalay Shores
Apartments, spot zoning, and a manufactured hardship.
John Riohter, Planning Offioial, reported the property had been
rezoned to RS-50 in 1978 to remove a spot zone. The configuration of the
property makes it diffioult to work with, but it oould be developed by the
owner under the RS-50 classification.
Attorney Cline' stated his client would aooept an RM-16 zoning
olassifioation.
Commissioner Kelly moved to deny the request. Motion was duly
seoonded. Upon the vote being taken, Commissioners Garvey, Calderbank,
Kelly and the Mayor voted "aye"; Commissioner Hatchett voted "nay.t1 Motion
oarried.

eaoh from the partiolpants.

Various oommodities used by the City are purohased daily to meet
immediate needs not subject to long-range, detailed planning. The
oummulative amount of these orders to each oontraotor will exoeed $5,000,
but it is impraotioa1 to purchase these oommodities competitively under
sealed bid prooedures for various reasons. The commodities listed inolude
special/general purpose vehiole repairs, legal advertising, hardware
supplies, building materials, eleotrioal supplies, uniforms and ohemioal
and gas distribution supplies.
Commissioner Garvey moved to award the oontraots to purohase
commodities as identified on the attaohed commodity and oontraotor list
during the period from 10-1-81 to 9-30-82, from respeotive oontraotors on
individual orders. not to exoeed $5,000 eaoh, except for fuel orders whioh
may exceed $5,000, with total contract expenditures not to exceed amounts

ITEM 112 - Areawide Zoning Atlas and Land Use Plan Amendments for Area 7.
Known as the Tampa Bay Area in Sections 16. 17 and 20-29-16.
These properties are looated generally from U.S. 19 east to Tampa Bay
and from Gulf-to-Bay Boulevard south to Tampa Bay. There are a mixture of
land uses ranging from oommeroial retail activities to single-family
residential. The requested ohanges recognize the desirable land use
pattern whioh has developed and seeks to control the future development
along the waterfront where feasible. There are a total of 14 requests with
13 zoning atlas amendments and four land use plan amendments.
Commissioner Hatohett moved to reoeive the requests and refer them to
the proper departments, but to delete request 111 relating to Lot 12 and a
portion of Lot 11, William Brown's Subdivision in the SE~ of Seotion 17-29-
16. Motion was duly seoonded and oarried unanimously.
Request 111 is a City-initiated applioation for change in zoning on
Lot 12 and a portion of Lot 11, William Brown's Subdivision and a portion
of Rogers Street right-of-way in the SE~ of Seotion 17-19-16. The owner of

Thornton Road fronting on Tampa Bay. The present zoning is CTF-28 and the
requested zoning, RM-12. The requested zoning of RM-12 would maintain
the medium density development potential along the bayfront.
Disoussion ensued on the appropriate zoning oategory.
Commissioner Calderbank moved to amend the applioation to request
RM-28 zoning in lieu of the present CTF-28 zoning. The Land Use Plan for
the area is high-density residential and an amendment will not be required.
Motion was duly seoonded. Upon the vote being taken, Commissioners
Hatchett, Calderbank. Kelly and the Mayor voted "aye"; Commissioner Garvey
voted "nay." Motion oarried.
ITEM 114 - Verbal Reports.
The Aoting City Manager reported the Pier Pavilion renovations are
projeoted to be oomplete by the end of Ootober, 1981.
He reported an inorease in the cost of authorized dredge bulldozer
repairs. oontraot awarded to Crawler Rail and Roller Company, in the amount
of $5,600 on September 17, 1981.
Commissioner Calderbank moved to authorize repairs not to exoeed
$7,500. Motion was duly seconded and oarried unanimously.
The Florida League or Cities notified the City that Clearwater is now
the tenth largest oity in the state of Florida and may appoint a member to
the League Nominating Committee and a oandidate for appointment to the
Board of Direotors.
Commissioner Calderbank moved to appoint Commissioner Hatohett as the
City's representative to serve on the Florida League of Cities Nominating
Committee. Motion was duly seoonded and oarried unanimously.
Commissioner Garvey moved that Mayor LeCher be designated as the
candidate representing Clearwater to be considered for appointment to the
Florida League of Cities' Board of Direotors. Motion was duly seoonded and
oarried unanimously.
A memo, dated September 29, 1981, from Keith Crawford. Direotor of
Traffic Engineering, sUbjeot - Harn Boulevard Traffic, was distributed to
the Commission for disoussion at a future work session.
Disoussion also ensued on the alooholio beverage zoning of the
Cooonuts Night Club in Morningside. Staff will researoh the deed

Commissioner Garvey moved to aooept the instruments and to direot the
City Clerk to record same in tho Publio Reoords of Pine1las County.
ITEM
The City Attorney reported on reoent litigation and requested approval
to satisfy a judgment against the City in the oase of Roy v. the City of
Clearwater.
Commissioner Hatohett moved to approve the City Attorney's request.
Motion was duly seoonded and oarried unanimously.
ITEM '54 - Other Commission Aotion.
Commissioner Garvey - suggested conservation of paper and reoyoling
for sohools.
Commissioner Hatchett - reported the intent of the MPO is to support
unified mass transportation and the Pinellas County Transit Authority,
during this interim period, will be the provider of transportation for the
disadvantaged and elderly.
Commissioner Calderbank - reported there will be no radio
broadcasting by looal independent stations of the Phillies plaYOffs or
World Series games. A CBS affiliate station may be allowed to carry the
broadoast. He requested a letter of protest from the City to Commissioner
of Baseball, Bowie Kuhn.
He requested a presentation before the City Commission of the revised
Clearwater Yaoht Club dook request within 90 days.
He requested the status of an easement for right-of-way dedioated by
the Holiday Inn Surfside, that would shift Mandalay Boulevard for a mall-
type area with landsoaping.
Commissioner Kelly - expressed oonoerns that all the viewpoints of
the oitizens be heard and the resolution be so drafted.
By unanimous oonsent, the City Commission set a speoial budget work
session for Wednesday, Ootober 7, at 9:30 a.m.
