lands hae: drafted proposed new rules tor the management 'of Dovere1gnty
lands. The proposed draft, lIh1eh deals prlmarUy with permitted
usage and lease ~ees for Stat.e-o~~ed sUbnerged land, will be presented
to the State Cabinet. en November 9, 198:1..
A aeries of tour public meetings to obtain public input is being eon-
ducted in VerlOUlS parts of t.he State. I attended the first. hearing held
last evening at the Department of Natural Resources Bulllililg in St.
Petersburg. The hearing was conducted by Ms. L:inda 5\J1larlldason and
Mr. Casey Fitzgerald of the Bureau of Lands Management.
The most praninent end controversial feature of the proposed rules is a
revised fonnuls ~or conputation of lease fees for ~e of sovereignty
subnerged land by -revenue generating/incane re1ated activities includ:ing
marinas. Under eJd,el:.ing rul.es, the leue fee charged by the State is
a fiat $.037 per square foot of pre-empt.ed sovereignty aul::merged land.
The propoeed rules ....'OUl.d establish a variable 1eaee fee predicated
upon the tmdl5'Veloped assessed value or the upland propert.y abutting

'The existing city marina faciJ.i.ties ere constructed on eity-owned sub-
merged land and ,,:ou1d not be arfected. If, ho\>rever, the city Mould
decide to develop another facility utilizing sovereignty subnerged lands,
the proposed roles ",'o~d Bpply. Under the present rules, developnent
or a 130 slip marina at the Mandalay Marina;tRecreation Complex would
require payment. or approximately $3,000.00 per ;year to the State in
lease fees. Under the proposed rules, the fee would increase to appro~
:l.mate1y $l6,CXX) per ;year, much would severely impact the potential
for developnent at that sUe.
The public hearing was ~~ell attended by a large group of concerned
persons representi.',g aJJ. :seglllents of ,the local marine cammmity,
including waterfront reridenh, boat owners, marina operators and cther:s.
All expressed st..TOng opposition to the proposed ruJ.es draft. State
Representative Dorothy SMlple attended the hearing and stated her intent
to work agErlnst adoption of the proposed rules.
