RESOLUTION
No. 81 - 94
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA, AUTHORIZING
THE ISSUANCE OF CER TIFICA TES OF INDEBTEDNESS
FOR PROPER TIES ASSESSED PURSUANT TO THE
SANITARY SEWER IMPROVEMENT MADE TO SERVE
PROPERTIES ON SOUTH SIDE OF FAIRMONT STREET
FROM ROLLEN ROAD WEST TO BETTY LANE.
WHEREAS, Section 117.04 of the Code of Ordinances of thtl City
of Clearwater establishcs the procedure to be utilized in repairing or
installing paving, drains, curbs or sanitary sewer".!n the streets of the
City of Clearwater; and
WHEREAS, pursuant to Section 117.04 of the Code of Ordinances,
the City Commission of the City of Clearwatcr adopted Resolution No. 81-2.8
determining to proceed with the sanitary sewer project to serve properties
on South side of Falrmont Street from Rollen Road West to Betty Lane; and
WHEREAS, pursuant to the provisions of Section 117.04, and other
pertinent provisions of the Code of Ordinances, the City Commission adopted
Resolution No. 81-83 assessing the properti~s benefited by such improvement
as demonstrated by the exhibit attached to Resolution No. 81-83; and
WHEREAS, thirty days have passed since the date of such
assessment and not all of such assessments have been paid within such
time pcriod~ and
WHEREAS, pursuant to Section 117.05 of the Code of Ordinances,
the City Commission may issuc cer'tificates of indebtedness for those
assessments that remain unpaid;
NOW, THEREFOR;E, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEAR WATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That pursuant to Section 117.05 of the Code of Ordinances, the
City Commission hereby authorizes certificates of indebtedness to be issued
for those propel'tiC$ listed on Exhibit A, attached hereto, in each case
where the assessment is shown to be unpaid.
