A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA SUPPORTING
AMENDMENTS TO THE PINELLAS COUNTY SOLID
WASTE DISPOSAL AND RESOURCE RECOVERY ACT,

WHEREAS. Pinellas County has already preflled a bUt to amend
Chapter 75-487 LawB of Florida, as amended by Chapter 78-604, Laws of
Florida the Pinellas County Solid Waste Dlsposal and Resource Recovcry
Act; and
WHEREAS. the City Commission oC the City of Clearwater. Florida,
wishes to urge the Legislative Deiegation to add the amendments contained
in the attached bill to the bill already preIiled by Pinellas County; and
WHEREAS, the proposed amendments would clear up problem areas
in the law and make the disposal system a better functioning system; and
WHEREAS since the municipalities of Pinollas County will ha.ve to
work with and utilize the system for many years to come thereby making
it important that amendments to the law be considered prior to the time that
the system is in full operatlon.
NOW. THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA.
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
I, That the City Commission of the City of Clearwater, Florida,
hereby requests the Legislative Delegation to support the amendments
contained in the attached bill amending the Pinellas County Solid Waste
Disposal and Resource Recovery Act and to add such amendments to the
bill which has been prefiled by Pinellas County.
z, That caples of the Resolution shall be forwarded to the Chairperson
and members of the Pinellas County Legislative Delegation, to the Mayors
of Pinellas County and the Chairman of the Pinellas County Commias~on,
3, That this Resolution shall become effective immediately upon its
adoption,

Section 1.
Section 2 of Chnpter 75-487, (.aws of Florida, as amended
by Chapter 78-604, Laws of Florida, is amended by adding a sub-section to read:
(11) 'fhe term'lmincorpornted area" shall not include any area of
Pincllns County which has bl!en annexed by 11 municip111ity as of the effective
date of this Act: or which shall be annexed at any time thereafter.
Section 2.
Section 4(3) of Chapter 75-487, Laws of Florida, as
amended by Chapter 78-604, Laws of Florida, is amended to read:
(3) To compel throunh the enforcement procedures specified in thill

(5) To finance. in ....hole or in part, as authorized by the
Constitution of the State of Florida. the cost of the construc~ion. acquisition
or improvement of such solid waste disposal and resource recovery system,
including the construction. acquisition and operation of electrical energy
generating facilities, by any means and subject to such limitations as mny be
provided by law. including but not limited to the issuance of bonds. revenue
certificates and other obligations of indebtedness.
The issuance of such
bonds. revenue certificates. or other obligations of indebtedness by Pioellns
County may bear interest at a rate not to exceed 9-1/2% per annum.
Section 5.
Section 4(13) of Chapter 75-487. Laws of Florida. as
amended by Chapter 78-604, Laws of Florida. is hereby repealed.

Petersburg Beach. and Tarpon Springs.
Each of the above members shall serve
at the pleasure of the appointing body.
Further. one (1) member shall be appointed by the combined city corn-
rois sions of Bellanir. llellenir nlu ffs. OldslIlllr and Safety Harbor i one (1)
member shall be appointed by the combined city commissions of SemInole, Kenneth

and disposal. utility management. health. public administration. engineering,
accounting, economics, auditing, or environmental resources: how~ver,
the
cOllllllittee shall be so composed that no field of specialization shall have more
than three (3) members on the committee.
(c)
The committee shall elect one of its members as chairman and one
as a vice-chairman to serve for one (1) year in that capacity or until theit
successors arc elected.
(d) The committee shall meet periodically to review and make
re'co1llll\endations to the governing body concerning rates. formation. impleUlenta-
tion and revision of policies and progrlllnsj locatiun nnd cstnblishment of solid
waste disposal and resource recovery system facilities: introduction and
integration of now technologics. major equipment acquisition: selection of
consultants; approval and submission of grunt applications and any otlier manage
ment Dr operational policiell.. Till! committee shall, within thir ty (30) days
from receipt of the annual certified audit, recommend to the governing body, a
schedule of rates. fees, and charges for users of the facilities and scrvices

the reasons therefor. Thereafter, the committee shall, within ninety (90) days
from the date'of the Allministrutor's notification. either respond in writing
as to the rensons why the origin:}l recommendatlon was made or provide alternate
recommendutions. In the event the governing body elects not to adopt any
recommendation or the committee after, the expiration of the ninety (90) llay
waiting period, upon request by the committee, the governing body sh~ll
establish a public hearing date for tha purpose of taking t~stimony and the
receipt of evidence as to determinntion of an appropriate de~ision. At any
sueh public heuring, the public. inclulling the municip.llities herein, shall be
afforded nn opportunity to present witneS6es in evidence and the recoll1l1lendation
made by the committee mny be submitted in evidence at such hearing. In those
matters reluting to the rate structures, the governing body shall present the
rate structure it proposes to adopt and evidance in support of such rate
structure. l~ollowlng any such hcnring. thl:! governIng body shall mak.e whatever
decision it deems appropriate in the matter based upon competent and substantia
evidence \)resented at the hearing.
Section 7. Section 6 of Chapter 75-L.87, Laws of Florida. as amended
by Chapter 78-604. ~aws of Florida. is amended to read:
Section 6. Rates. Fees and Charges. The solid waste disposal and
resource recovery system shall be operated on a self-supporting cost-recovery
basis. Revenues generated from rees, rentals or other charges for till.! servic.es
and facilities of the aaid system, including the sale of resources recovered
from the operation of the system, shall be used only for the expenses set forth
hereinbelow, requirell to be sufficiently provided [or from the schedule of
rates and c.har~e5 fot' the utilization of the said system. No such revenues
shall be paid into, directly or indirectly, the general fund of the governing
body or shall be used to pay salaries. expenses or benefits of any kind to
any person other than full-time employees of the system. All revenues
generated by the system in excess of those required for the operation and

The schedule of rates. fees or other charges prescribed shall
be sufficient to produce revenueR thn t, wl~,cn tnken together with other revenue
sources and pledged funds. will be adequate to: provide for all expenses of
land acquisition, construction. operation. maintenance and renewal, and
neceasa.ry expansion of such solid waste disposal and resource recovery systelll.
including reasonable reserves therefor. pay when due all obligations and inter-
cst thereon for the payment of which such revenues ure, 1'1' shall have been,
pledged or encumbered, including reserves therefor. and provide for any other

Section 12.
Establishment of Transfer Stations.
Where economically
feasible or advantageous. the governing body m.1y. with the recomme!ldation of
the Technical Management Committee, construct a transfer station in a
deolgnnted district ~lthin the County [or the purpose of receiving solid ~aBte
collected municipally or privately so that it may bo transported from the
transfer station to the disposal site more efficiently.
Such special districts
shall be on a solf-supporting, cost-recovery bash in the same manner as is

Section g.
Severability of Provisions.
If any section, clause.

sentence or provision to any persons, bodies or circumstances, shall be held
to be inoperative, invalid or unconstitutional. the invalidity of such section,
clause, sentence or provision shall not be held. deemed or take into effect
the validity or constitutionality of any of the remaining parts of this Act.
