A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA, REQUESTING
THE FLORIDA LEAGUE OF CITIES TO SUPPOR T
AND SEEK SPONSORS FOR THE GROUP OF GENERAL
BILLS PREPARED BY THE CITY OF CLEARWATER.
WHEREAS, the City Commission of Ule City of Clearwater, Florida,'
has directed that a series of general bills be prepared, copies of which
are attached to this Resolution; and
WHEREAS, the City Commis Dion has supported each of the attached
bills; and
WHEREAS, the City Commission wishes to urge the Florida League
of Cities to support and seek sponsors for each bill;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER. FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater hereby
urges the Florida League of Cities to support and find sponsors for each
of the general bills contained in the packet attached to this Resolution as
Exhibit A.
z. That a copy of this Resolution and packet shall be forwarded to
the Florida League of Cities and to the Speaker of the House and President
of the Senate of the State of Florida Legislature.
3. That this Resolution shall take effect immediately upon its
adoption.

Be It Enacted by the Legislature of the State of Florida:
Section 1. Chapter 166, Florida Sta.tutes, is hereby
aniended by enacting two new sections to read~
Section 166.233 MuniCipalities; Servic::e
Charge; Deiinition.
The term Ifservice charge" means a charge, other than
an ad valorem levy or special assessment, imposed upon real
property by or on behaU of a municipality to defray the cost of
services, and inlprovements necessary or convenient in providing
such services for the following purpos es: police protection; !ire
protection; street and highway construction, ma.intenance and
lighting; sanitation; and water supply.
Section 166.234 Municipalities Service Charges.
(a) All real property owned by a corporation or association
organized Or conducted exdusively [or religious, charitable,
education or hospital purposes shall be subjltct to service cha.rges
imposed by the municipality pursuant to ordinance computed as
provided in subsection (b) of this section which cha~ge shall be a

(4) The declaration mu,t contain or provide tar the

(e). A ,urvey of the lan'd which shall contain all existb1R'
eaeements of every kind and a graphic description of the improve-
in which units are located and a plot plan thereof that, together
with the declaration, are in sufficient detail to ident'Uy the
common elements and each unit and their relative locations and
approximate dimensions. In addition a drawinp; shall be included
which will dillclose the location of proposed easements for utility
purposes. The survey, graphic description, utility easement
location drawin~, and plot plan may be in the form of exhibits
consisting of building plans, floor plans, maps, ,surveys, or
sketches. II the constru~tion of the condominium is not
substantially completed, there shall be a statement to that effect,
and, upon substantial completion of construction, the devoloper
or the alSsociation shall amend the declaration to include the

The cunendrnent may be accomplished
by referring to the recording data of a survey of the condominium
that complies with the certificate. A certificate of a surveyor
authorized to practice in this state shall be included in or attached

to the declaration or the surveyor graphic description as recorded
under s. 718.105 that the construction of the improvements i.s
l!ubstantiaUy complete 50 that the material, together with the
provisions of the declaration describillg the condominium property,
is an accuratr: representation of the location and dimensions of

diInensions oi the conunon elements and of each unit can be
determined from these materials. Completed units within each
substantially completed building in a condominium development
may be conveyed to purchasers, notwithstanding that other

in the declat'ation, are first completed and the declaration of
condominium is first recorded and that as to the units being
conveyed there is a certificate of a surveyor all required above,
including certiiication that all planned improvements, including
hut not lhnited to landscaping, utility services and acceu to the
unit, and common element facilities, lIerving the building,in which
the units to 'be conveyed, are located have been substantially
completed, and such certificate is recorded with the original
declaration or as an amendn1ent to said declaration. This section
shall not, however, operate to require development of improve-
ments and amenities declared to be included in future phases
pursuant to s. 718.403, prior to conveying a unit as provided
herein. For the purposes of this section, a certi1icate of
surveyor shall mean certification by a surveyor in the form pro-
vided herein and may include, along with certification by a
lIUl'Veyor, when appropriate, certification by an architect or
engineer authorized to practice in this state. Notwithstanding
the requireunents of substantial completion provided in this IS ection,
nothing contained herein shall prohibit or impair the validity of a
'mortgage encwnbering units together with an undivided interest
in the conunon elements as described in a declaration of
condominiuxn recorded prior to tbe recording of a certificate
of a surveyor as provided herein.
Section Z. All laws or parts of laws in conflict herewith
are to the extent of such conflict hereby repealed.

A bill to be entitled
An Act to amend Chapter 171, Florida Statutes,
by amending subsection (Z) of Section 171. 06Z to
provide that if the area annexed was subject to
a county land USe plan that such regulations shall
continue to apply until such time as the annexation
has become eUective and the annexing municipality
has pas s ed an ordinance making the property
subject to municipal land use, zoning and sub-
division ordinances; providing for the severability
of the provisions hereof; providing for the repeal
of all laws in conflict herewith; and providing for
the effective date hereof.
Be It Enacted by the Legislature of the State of Florida:
Section 1. Subsection (2) of Section 171.062, Florida
Statutes, is hereby amended to read as follows:
171.06Z Effects of annexation or contractions.
(2) If the area annexed was subject to a county land-use
plan and county zoning or subdivision regulations, -e&ie. such

declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of this act as a whole or any
part thereof other than the part declared to be invalid.
