The Hayor called the meetinr; to order. The purpose of this meeting io
to consider Item H10 a. - Bids: Harshall Street Pollution Control Facility
Expanaion - E.P.A. Grant C-120405010.
The ,City Manap,er presented the recommendation for consideration of the
tentative award of the contract on bids received January 28, 1975, at 1:30
p.m., as reviewed and certified by Briley, Wild and Associates and the City
Enp,ineer.
A letter from Briley, Wild was read into the record, which stated the
low bid was by Biltmore Construction Co., Inc., in the amount of $6,5'~9,000.
They recommend awardinr; a tentative contract to Biltmore Construction Co.
subject to approval by the I;nvironmental Protection Agency.
A letter to the Environmental Protection Agency, Atlanta, Ga. from
H. ft. Baskin, Jr., Attorney, 'and Jack F. Hhite, Jr., Attorney, repl"esenting
Harry Pepper and Associates, Inc., was read into the record. The letter
stated the bid of Biltmore Construction was unresponsive and should have been
disqualified as four vendors listed in their bid did not supply equipment in
accordance with specifications and no vendors were listed in some instances.
Biltmore also was permitted to substantially modify their bid after it was
opened by the City and their surety bid bond did not meet the" requirements.
Max Battle, City Enp,ineer, and John F. Dennis of Briley, Wild and
Associates, Consultinr, Engineers, refuted the items listed in Mr. Baskin's
letter. Mr. Battle specifically referred to the first paragraph on page one
and stated that in the opinion of the City Attorney, the Consulting Engineer,
and the City Engineer, aftel" extensive review of tlle documents submitted and
the tabulation of bids, thdt the Biltmore Construction Co. was the lowest,
responsive, responsible bidder. In item 00ne on page two, referring to the
clause to do SOt of the total dollar value of the work themselves, he stated
the Biltmore Construction Co. is fully aware of this requirement. He also
stated modifyine bid after openinp., is allowable, according to the specifica-
tions as long as there is no increase in the bid pl'ice. Mr. Dennis stated
that items 1, 2, 3, l~, and 5 on pages land 2 were true but the contractol'
had named vendors meetinB specifications on January 29, 1975, and also pro-
vided names foJ" the blank spaces.

H. H. BaSkin, Jr., asked to have the record show they objected to making
an amendment to the bid after openinr" and asked that the Commission not con-
sider the Biltmore bid.
The City Attorney repol"ted Harry Pepper and Associates, Inc., also left
some items blank and did, not file the required minutes of the stockholders.

Mr. Ed Parker, Vice President of Biltmore Construction Co., Inc.,
ans\'lered questions regardinr; the company, including the statement that they
have $20,000,000 in buildine under construction and are bondable to $40,000,000.
H. H. Baskin, Jr. then elaborated on the items mentioned in the letter
to the E.P.A. Discussion followed. Their position is that the defect in the
Biltmore Construction Co. bid was a p,ross irregularity. Mr. Harry Pepper
further confirmed the discrepancies on the 8il tmore bid. Nr. Jack White, Jr. ',.
Attorney, questioned l1ax Battle about the modifications to the bid'.

Commissioner' Hil1iams moved that a tentative a\'lnrd of the contract foro
the Marshall Stroeet Pollution Control racility Expansion be made, to Biltmore
Construction Co.t Inc., in the amount of $6,SIJ9,OOO as recommended by the
City Engineer, Consulting Engineert City Attorney and City Manager, SUbject
to the approval of the EPA Regional Office. Commissioner De Blaker seconded
the motion which carried unanimously.

The Ci~y Attorney reported he was notified at 11:45 a.m.t about an 11:30
'a.m. hearing on February 3rd, 1975, in which suit was being brought ap,ainst
the City. He promptly reported to the Court. The hearing lasted until 4:30
p.m., and JUdp;e t'lilliam \'1alker ruled that the petition of Harry Pepper and
Associates for a temporary injunction be denied., '
The City Attorney presented Resolution il? 5-2 3 authorizinp, the Legal
Department to pursue this matter in Court and actively pursue any remedy for
damages that may be incurred in this litigation. Commissioner Williams moved"
that Resolution 075-23 be paGsed and adopted and that the appropriate
officials be authorized to execute it. Commissioner De Blaker seconded the
.motion which carried unanimously.
Commissioner Carwise left the meetinp; at 2:15 p.m.
Commissioner DeBlaker moved to instruct the City Attorney to contact
Mr. ,Bleakley or his attorney, requesting the covenants granted at the Public
Hearing held November 18th, 1974, with regard to the property located on Palm
Bluff Street and Clearwater Bay, (Palm Bluff Subd.) and requestinp; that the
necessary papers be supplied within thirty (30) days. Commissioner Williams
seconded the motion which carried unanimously.
