Notion was seconded by Commissioner Rankin and carried unanimously. ITEH fl5 - A PUblic Hearing on Amendments to City Zoninp, La\ols, Appendix A, ClearHatcr City Code. (Continued from December 16, 1971\.) The City Hanap,cr prnsented the recommendation to approve 17 changes in the zoning ordinance, as advertised; this includes a gO-day p,race periOd and covers the deletion of certain hinh density zoninR districts (RM-34,. 44, 54 and 51~-A) and modification of CTF, PS and CG distl'icts. The Planninp, Director related the chronological history of events as background to this action. He explained that on June 6, 197~, the City Commission directed that the City Comprehensive Plan be amended to brinF, it into conformity Hith the County Comprehensive Plan density ranges; further, that the zoning ordinance be amended to establish a maximum height of 80 feet and a maximum of, 2 n c.h-lcllinr. units per acrc in the City except in the Central Business District. The Haster Plan amendment and height restrictions have beon adopted. The Planning and '1.oninR Board has held three public hearings; a map has been published shOt-ling the zoninr; changes; and approxi- mately fifty letters requasting response to density reduction were mailed to various civic, business, professional and neighborhood groups. Approximately ,600 households petitioned for down 7.oninr,. Fifty persons attended the public hearings and fifteen expressed vieHs. The Planning and Zoninp; Board and the P1anninr; Director support the recommendations t-lith the further clarification' that plans Gubmitted to the Building Department during the grace period be complete and accompanied by propel' specifications 00 as not to require major amendment or chanr;e. The Central Business District, or core area from Myrtle Avenue to the Bay, is exempt from the down ~oninr;. Discussion followed on the chan~cs as advertised, a roll back to Greenwood Avenue for the Central Busincss District, grace periods to file intent to apply for building permit, a $50,000 to $100,000 downto\.m development study, and residential property in the core area. Jim Palmer of the Dawntm-ln Development Board explained that when the taxing district bill was drawn, all residential property with homestead exemption was excluded from the tax and is the only exception. He stated a resolution was passed by the DOHntown Development Board which asked the Com- mission to withhold its decision on the roll back of the area between !1yrtle and Greemolood until they have the study made. nick Karay, representing Dr. Georr;e 11. Karay (the owner of Lots 4, 5, 6, 7 and 6, Columbia Subdivision, C1ear\o1ater Beach on Coronado Drive), stated they had addressed the Commission in November on the height restriction and \o1ere again requesting consideration as the ne\ol zoning change would make it ' economically unfeasible to do anythinR \oli th tlle property. All surrounding property has been developed as hir.h-rise and it seems to them to be discrim- inatory to lower this property again and they are aSking for relief. The Planninr. Director replied that all property in like zoning should be handled in like manner and Florida Statue 73.59 states the County Land Use Plan is the law and that has a maximum of 30 residential units per acre and we must comply with that restriction. The City Attorney stated the Pinel1as Planning Council is the final authority and the courts can be applied to for relief. . -'. . The City Attorney questioned the Planninp; Director for the purpose of demonstrating that extraordinary measures have been taken to comply with the Pinellas County Comprehensive Plan, that due notices in the papors have notified as many people in the City of Clearwater as possible, and that many letters were sent. Letters of opposition were received from the Clearwater-Largo-Dunedin Board of Realtors and a realtor. Commissioner DaBlaJ:er moved to approve the 17 changes in' the Zoning Ordinance, as advertised, and to include a OO-day grace period regarding the density reduction so that applications for bui1dinR permits can be made for pending projects under the present code requiremento and to authorize the City Attorney to prepare an ordinance to bring back to the City Commission for approval or revision at the earliest possible date. Motion was seconded by Commissioner Rankin.
