' CITY COHliISSIOll MEETING October 21, 1971~ The City Commission of the City of Clearwater met in regular session at the City Hall, Hondny, October 21, 1971f, at 1:30 p.m., with the following members present: H. Kennedy, Jr. Max Battle Frank Daniels City Manager Assistant City Attorney City Enp,ineer Police Chief The Mayor called the meetinp, to order. The invocation was given by Chief Daniels. Commissioner Rankin moved that the minutes of the regular meetings of Septem- ber 16th and October 7th and the special meetinp, of September 26th, be approved as recorded and as submitted in written summation by the Clerk to each Commissioner. Motion was seconded by Commissioner DeB lakeI' and carried unanimously. The Mayor awarded twelve employees service pins for various years of service. The City Manager noted total years of service to the City was 95 years. The Em- ployee of the Month Award, includinr, a plaque and savin~s bond, was awarded to Mrs. Jane Craig, Secretary to the Personnel Director in the Civil Service Depart- ment. ITEM #5 - A Public Hearing on Lot Mo\-dnr, Resolution #74-120. The City Attorney explained the purpose of this public hearing and requested the City Inspector to report on the status of lot Clearing actions. The' City Inspector reported that the lots remaininp, to be cleared constituted a menace to public health, safety and welfare. There were no objections. Commissioner Rankin moved that Resolution #74-120 passed on October 7, 1971., be confirmed and made effective as to all persons and parcels listed thereon, except for those whose lots have been verified as beinr, cleared and those who have paid the City for the clearing, and that the proper City officials and employees be directed to proceed in accordance with law to see that the lots are cleared. Motion,was seconded by Commissioner Carwise and carried unanimously. ' ITEM #6 - A Public Hearinr, on Violations of Minimum Housing Code: a. B19 Pinellas St. - Lots 3 & II, Block 15, Hilton Park Subd. - W. Norvell. The City Manager concurred in the recommendation of the Building Department to remove or demolish the building. Photos by the Housing Inspector were intro- duced as evidence. The o'~ners or their representatives were not present. The Housing Inspector recommended the building be demolished. Commissioner Carwise moved that Resolution #74-121 be passed and adopted and that the appropriate officials be authorized to execute it. Commissioner Rankin seconded the motion which carried unanimously. b. l172~ Drownell St. - Lot B, Block 1, W. F. Hughey's Subd. - W. Ensign & F. r:ldridge. Attorney of Fact: Jack Kennedy. The Housing Inspector reported that the property was in bad condition even before a fire had occurred to the building. He offered photos as a record of the condition of the buildings both before and after the fire. Neither the owners nor their representative were present. Numerous complaints have been received about the condition of the property from abutting property owners. The Housing Inspector recommended demolition of the building. Commissioner Rankin moved that Resolution #74-122 be passed and adopted and that the appropriate officials be authorized ,to execute it. (City application.) (Contd. from Sept. 16.) and . Lot 6 and Southerly 15 ft. M.O.L. of Lot 5, Block A, J. J. Eldridge's Subd., from RM-SIIA (multi-family) to RM-12 (duplex-apartment.) - D. Hadell. (Cityappli- cation.) (Contd. from Sept. 16.) As directed by the City Commission to rezone property within 500 ft. of the waterfront, the Planning Department recommended rezoning of this property to RSSO to conform to the City and County Comprehensive Plans. The owner of Lot 33, Palm Bluff Sub., Demetrios Panoutsakos, spoke in objection. Commis- sioner Rankin stated the streets in that area are not wide enough to handle ' 511 units per acre and the sewer plant would also be unable to handle the density of the present zoning. Discussion followed. Commissioner Williams suggested the property be rezoned CG (general business). Attorney Norman Bie, Jr., speaking as a concerned citizen and on behalf of Mr. Panoutsakos, stated that there had been no major changes in that area in the last 50 years and suggested rezoning the entire area to one zoning code. He felt that a replat of the area could be worked out that would be beneficial to the City and the property owners, and that the area should be dealt with as a comprehensive whole rather than a lot for lot basis. The Planning Director stated that in April, 1973, the City Commission directed the staff to examine all property zoned p,reater than 34 units to the acre. The Planning Department came back with a plan \~hich was adopted to amend the Compre- hensive Plan. A pUblic hearing was held and the Commission amended the Compre- hensive Plan to a cap of 18 in the area. Prior to this, the County adopted their Land Use Plan at 15~ units per acre, medium density area. The staff will present a new plan for 16 units per acre for this area at the Uovember ~th meeting. Mavor Hougen left the meetinp,. Commissioner Williams assumed the chair. Discussion ensued. Mr. Finton agreed with the sur,gestion to rezone the entire area under one zoninr.. Mayor Boup,en returned. Commissioner Rankin moved to continue Items 7aa and 7b to November 4th at 1:30 P.M. Motion was seconded by Commissioner DeBlaker. Upon the vote being taken, Commissioners Williams, DeBlaker, Rankin and Mayor Houp,en voted yes; Com- missioner Carwise voted no. Motion carried. c. The Assistant City Attorney reported the Turner property on Rogers Street (Lot 1, ? and 3, Block 7, A.C. Turner's Subdivision Uo. 3) purchased in 1971 by Purchase J10ney Mortf,age over a period of ten years, is now involved in the Loop rip,ht-of-Nay ner,otiations between the City and Pinellas County. The City must convey a clear title to this property and the Turners have agreed to execute to the City a full release of mortgaf,e but in exchange are asking for an Addendum Agreemont acJmowledp,ing the present mortgage balance of $111,737.50 in the form of an unsecured note and that the City continue to make the payments for the balance of the time period as agreed. He requested a tcrtiary treatment cost report which will be forthcoming in Januarv as he did not think tertiary treatment was worth the cost. She also sup,p;ested the City check for additional revenUe sources as there is much talk of abolishing the utility tax. Functional consolidation of services is also being advocated.
