ITEM #2 - A Public Hearing on Zoninp; Appeals regarding Variances:
a., Lots 13 and 14, section SA, Island Estates of Clearwater. -
Smiley Corporation.
The City Manap,er read the appeal by the Smiley Corporation from the
decision of the Board of Adjustment and Appeal on Zoning be denied. Mr. James
Smiley, representinp, the Smiley Corporation, withdre\o1 his roequest as his
architect believed that the amended plans complied to the zoning law. The
request had called for setbacks of 16 ft. and 17 ft. 6 in. from the south
prooperty line and the east property line respectively and permission for
parking in both, setbacks. Commissioner Rankin moved that the withdrawal of
the request be accepted. Commissioner Carwise seconded the motion which
carried unanimously.

b. Lot 220, I~oodgate of Countryside Unit 1. - W. Joy.
The City Manager read the appeal of Mr. William W. Joy for a 7 ft.
setback from his west lot line to construct a screen enclosure on a
presently installed concrete slab. Mr. Jack Cooke, representing Hr. Joy,
noted there was a 10 ft. easement at the rearo of M~. Joy's property and
the same in his neighbor's lot to the rear. Mr. Cooke noted that there were
no objections from General Telephone or Florida Power Corporations, nor from
surIlounding neighboros.t1ro. Paul Derogmann, Director of Planning, noted, howevet:',
that the slab enclosure could easily be converted to a room, thereby ,
violatin~ the building code. City Engineero Battle noted that the Commission
had granted a vacation of the easement but that the Board had denied the
setback and that the survey card regarding this property would contain
,information that could prevent the buildinR of a 'room. ,
Commissioner Williams moved that the setback be granted with,the
restriction that the slab could not be permanently enclosed. Commissioner
DeBlaker'seconded the motion. Upon the votebeinR taken, Commissioners
\o1illiams and DeBlaker voted "'ies"; Commissioner'S Rankin, Carwise and Mayor
Hougen- voted "Noll. The l'equest was denied.

The City Manager recommended approval of rezoninp, of the above properties
to IS? (institutional semi-public), noting that the Commission had established
ISP zoning for sites of churhes and/or related non-profit institutional ,
organizations and that the Planninp, Department recommended rezoning all
present church property to ISP. He also noted that six churches in the East
area have aereed to this arrangement. The Faith United Church of Christ
had formally objected and a tentative verbal objection had been recieved from
the Greek Orthodox Church.
Commissioner Williams left the meetinp. at this time as he is a
member of one of the e2P,ht churches.
Mr. James Baxter, moderator of the Faith United Church of Christ, showed
a site plan of the property and said his church board opposed rezoning since
,it did not want to bind future boards, and if financial difficulties arose,
the Church could develop multi-family dwellings under the present zoning.
Mr. Bergmann 'said present zonin~ would lead to excessive pop~~ation
pressures. He noted that fund raisinR activities, such as bingo, could
continue under ISP zoni~g. , '
Commissioner Carwise moved to approve ISP (institutional semi-public)
zonin~ for the seven churchs, excluding Faith United Church of Christ and
that the City Attorney be instructed to include this in an ordinance to be
brought back to this Commission for approval as soon as possible. Commissioner
Rankin seconded the motion which carried unanimOUSly. Commissioner Rankin
then moved that the Faith United Church of Christ property be rezoned to
ISP (institutional semi-public) on the recommendation of the City Manager
and Planning and Zoning Board and that the City Attorney be instructed to
include this in an ordinance to be brought back to this Commission for
approval as soon as possible. Commissioner Carwise seconded the motion
for discussion. Upon the vote beinp, taken, the motion carried unanimOUSly.
Commissioner Williams returned at this time.
ITEM ifl~ - A Public Hearing on Proposed Amendments to the City Zoning
Laws:
1. Amend Section 20.04 Area and Dimension regulations in PS
(prOfessional services) District.
(A) Add Subsection (2) (d) to read "maximum height in stories
and feet --150 ft."
(B) Change (3) to read residential development as regulated
in the RM 24 District Section 12.04.

displays in prescribed areas exoept under certain conditions.
I.. Amend Section 30.07. Waterfront Property Setbaok.
(A) Change RM 10 to RM B in first paragraph.
. (8) Add notes to drawings to clarify eligibility for bonus,
and change dimensions for vari~us lot types.
(C) Change (1) oefinitions (a) "Waterfront property" by adding
certain wordage to clarify the definition.
CD) Change (1) (b) "Narrow Parcel" by deletinp; 330 ft. and
replacing with 295 ft. and adding the wordo "See drawingu.
(E) Add to (1) (c). lI\olide Parcel" the words "See drawingll.
(F) Change (1) (e) "Transition Dimension" to read as follot-1s:
"That mean width dimension which is 296 ft. ,to 329 ft.
inclusive within which transitional standards between the
wide and the narrow parcel shall prevail. See drawing."
(G) Add to (3) lISpecific setback criteria" a subsection (e)
titled lIClear Space Requirement", which will inciude the
two paragraphs now shown with sinp,le and double asteriks
and add to second paragraph the words, "however,; the clear
space, as one continuous space must be 20% of the width
of the property", also add third parap,raph which states
condition in Which a parking lot may be considered for
meeting Clear Space Requirement.
(H) Add to (3) IISpecific setback criteria II a subsection (f)
to clarify non-eligibility conditions for height and density
bonuses.

5. ' (A) Amend Section 32.01. Fences, Halls and Screening, General
Requir>ements, by rewriting first paragraph to clar>ify'and,
and restatinp, new requirement under (1) which will provide
for height limitations of fences on interior lots and
corlller lots.
(8) Amend Section 32.01 (2) by adding a statement to Clarify
hei~ht limitations of fences in non-residential zones.
(C) Add (5) to Section 32.01 to prohibit barbed wire and
electric fences.

Amend Article XXXIII. Off~Street Parking Requirements,
Section 33.02 Definitions, change "Floor Area" to "Retail
Floor Ar>eall and use word "retail" in place of "groGs".
eB) Add new difinition for "Gross Leasable Area (GLA)".
7. (A) Amend Section 33. Ol.i (1) TABLE OF HINIt1UM PARKING SPACES
REQUIRED. Change title of right hand column from
, "Parking Spaces Required" 'to "Parking Spaces or Area
Required".

(B) Amend Section 33.0~ (1) to chanp,e the parking requirements'
for "Shopping centers".
The Planning Director summarized the proposed amendments. The Commission
,discussed the proposed fence amendments.
The Mayor polled the Commissioners about requiring permits for building
of fences. The Commission favored this requirement. It was a~reed that such
a permit,would require a 'property survey to insur>e against encroachment on
'adjoining properties. After hearinR a recommendation by Keith Crawford,
Traffic Engineer, and a discussion being held relation to height of fences,
it was'agreed that fences could be built up to G ft. on the interior portions
of ' ,the lot and 30" high from right-of-way to the setback line with corner
lot fences to be approved by the Traffic Engineer. , It was also agreed that
vegetation and walls would come under the sarne restrictions,as fences.

such as barbed wire-on Sand Key, we1"'e also unattractive as well as dangerous.
The City Enl7,incer montionert that such fences we1"'c sometimes used for security
purpOGes. It was agreed by consent to add dangerous materials to the '
prohibited list.
A discussion ensued resultinp, in aBI'Ieement relating to side yard park-
ing undeX' the waterfront portion of the ordinance which would rlcquiX'e
depressed space of 3 ft. below the highest point of the road or street.
Commissioner Rankin moved foI'l approval of th~ 7.oninp, amendments as
recommended and amended, and that the City Attorney be instructed to inco~-
porate these amendments in the Zoninp, Ordinance to be brought back to this
Commission for approval as soon as possible. Commissioner Williams seconded
the motion. Upon the vote beinp, taken Commissioner Carwise voted "No";
Commissioners Williams, DeBlaker, Rankin and Mayor Hou~en voted nYes."
Motion oarried.
Commissioner Williams moved that the Planning and 7.oningBoard be
instructed to remove the waterfront bonus at the earliest opportunity.
Commiosioner DeBlaker seconded the motion. Upon the vote being taken~
Commissioner Carwise voted "Noll; Commissioners l'lilliams, DeBlaker, Rankin
and Mayor Hougen voted "Yes.1I Motion cat-ried.
Clearwater Advent Christian Church - National Day Of Humiliation, Fasting
and Prayer.
The City Manager read a request submitted by this church that the City
allow the steps of City Hall to be used by the church for a reliRious gathering
on April 30th with no soliciation of money involved. The City Mana~er
recommended support of the concept but declining use of the City property
citing the traditional separation of Church and State. Commissioner DeBlaker
moved to dany the request. Commissioner Rankin seconded the motion. Upon
the vote beinp; taken Commissioner williams voted "No"; Commissioners DeBlaker,
Rankin, Carwise and Mayor Houp;en voted "Yes." Request was denied.
Pierce StI'leet Extension
Mr. Mike Paroby, Assistant City Manager, displayed an aerial map which
showed on it a proposed new route for the ,Pierce StI'leet Extension with the
portion from the present Pierce Boulevard to Haven Street being considerably
widened. It also showed a more or less triangular piece at the end of Haven
Street which could be used fo~ a park and/or marina purposes. He indicated
that it mi~ht require an exchange of property with the County, and some
additional private upland. The City Enp,ineer noted that const~uction of the
new route could be less expensive than the old route. Mr. Duane Zussy,
Assistant County Administrator, requested that action be deferred as the
County Administrator has some serious' reservations about the new proposal
but thinks that an agreement can be reached. Mr. Zussy also mentioned that
app~oval harl already been given to sharinR the cost with the City of appraising
and acquiring the needed private property. He noted, however, that Gordon
Gray, County Engineer, has questioned the necessity for the road. Commissioner
Williams moved that the City staff be authorized to proceed and negotiate
further with the County. Commissioner Rankin seconded the motion which
carried unanimously.
Assistant City Manager Paroby requested Commission expression as to
obtaininp, marina facilities on the mainland side of the bay. Commissioner
,Williams moved for a staff study regarding a mainland marina. Commissioner
Carwise seconded the motion Which carried'unanimously.
Summer Enrichment Program.
Commissioner Carwise noted that State Revenue Sharing Funds were available
for the Summer Enrichment Program. City Manager Floyd expressed an, opinion
that the program is a county-wide activity rather than a concern of the City
and understood that the request was made in September whereas revenue sharing
was' considered in June. Commissioner Williams said that the intent behind
the State Revenue Sharing Funds was that the City assume some of the programtB
responsibilities. The City Manager said he had interpreted this intent to mean
that the City'was responsible for a Summer 'Recreation rather than Summer '
Enrichment Program, but that a staff study of this is under way. Commissioner
Carwise noted that the City mip.ht have decided by default against the program
by not addI'lessinp, itself to the program.
