THe Planning Director summarized the purpose of this public hearing, a continua tion of earlier consideration now focused on two aspects of tho reCOln- mended classification: reduction in minimum area requirements for redevel- opment from 40 to 20 acres 'Section 24.03A). and a reduction of the periphery distance for 44 units per net acre from 300 to 100 ft. 'Section 24. 09A). ' Hr. ilt E. 'Jim) Palmer. Executive Director of tho Uowntown Development aoard~ spoke in favor of tho above chanp,es as recommended by the Planning and Zoning Board. stating that the minimum redevelopment area of 2U acres con- stituted a practical approach in the redevelopment of the downtown area where land values are high and redevelopment involves the additional cost of removing existing structures. He urged the City to create an atmosphere encouraging redevelopment of the central business district. Commissioner Hall questioned the desirability of increasing density to the extent permitted by the urban centor classification, noting that the Commission has been committed to a general policy of reducing density wherever possible in the public interest. I1r. Lowis H. Homer. Chairman of .the Downtown Development Board, stated that the City now faces a choice between redeveloptl\ent of down- town areas or a pGriod of deterioration of the existing properties. He emphasized the need for a progressive plan in redevelopment, recognizing a continuing responsibility for promoting higher and better uses of land in the redevolopment process. He observed that the Commission retains control of redevelopment under the proposed uruan center classification through its . responsibility for reviewing a developer's project plans. Hr. James Leach of Justice Development and ar. James Limbaugh. developer. spokQ in support of the zoning plan. stressing the basic incentive of the profit motive and the need to encourage developers who otherwise would not riSk their funds in projects inVOlving the purchase of numerous pieces of property. :The reduction of the minimum area requirement to 20 acres was cited as signif- icant in facili ta ting the redevelopment procGss. j-Ir. Chat'les Finton. 310 South Naywood Avenuc. commented favorably on the 20 acre minimum, but noted the contin\ling problem of adequa'to parking. ;lr. Application WaS presented on a hardship basis because a mortgage could not be outained until the lendor was assured that the complete project had City approval and could be developed in toto, Partial occupancy of the project on thc basis of certificates of occ~pancy 'CO's) would constitute 'a legal basis for apportioning City utility reSOUrCCS and the developer would assume the economio burden of tvi thholding occupancy pending City release of additional CO's. The developer has now committed more than $100,000 in the planning for this project and is not asking for mo~e than a fair share of sewer hookup allocations. The City Encineer stated that the Permit Review Committee had followed the guidelines specified by the Commission; this project did not fall within these parameters inasmuch as new construction is tied in with building permit quotas and not oertificates of occupancy. lie stated that the staff has been oareful to avoid approval recommendations that might commit the Commission beyond the scope of the guidelines which have been established. Commenting on .1r. BonncI"s representations, the City Attorney stated that an agreement with the City on the basis of certificates of ocoupancy would be legally binding, that eaoh application on a hardship basis must be considered on its own mcvits, and that there appeared to be a.dcquate control of neW construction through appropriate rcstrictions in the release of cots, The Building Director oommented on an administrative p~oblem, stating that control of oocupancy becomes difficult once utilities have been installed. There exists the likelihood that building units tvill be occupied under those circumstances, even without the proper occupancy authorizations. The Assistant City Hanager, Duane_Zussy, summarized the sequence of problems confronting the City with respect to sufficient supplies of potable water and adequate treat- ment of effluent and stated that allocation of building permits oonstituted a desirable method of rationing available utility services. In further comment, XI'.
