The City Commission of the City of Clea~wate~ met in renular session at
the City Hall, Honday, October 16, 1972, at ls30 P.M., with the following

The Mayor called the meet in? to order. The invocation was given by Dt". ,
John A. HaleYl Peace Memorial Presbyterian Church. Service pins were awarded to
a numbet" of C tv employees for vat"ious years of employment. The employee of the
month award was awarded to Mrs. Lucille Allen, Tt"affic Engineering Dept. Commissioner
Cat"wine moved that the minutes of the meetings of Sept. 18, as t"evised and the
minutes of Octo bet" 2, 1972 be approved as recorded and as submitted in ~itten
summation by the Clerk to each Commissionet". Motion was seconded by Commissioner
Hall and carried unanimously.
ITEM #1 - Lot Mowing Resolution #72-126. The City Attorney explained the
resolution. The lots were considered a menace to pUblic health! safety and welfare
by the inspector. There were no objections. Commissioner Carw~se moved that
Resolution' ~72-l26 nassed on October 2, 1972, be confirmed and made effective as
to all persons and Parcels listed thereon, except for those whose lots have been
ve~ified as bein? cleared and those who have paid the City for the clearing and
the proper City officials and employees are hereby directed to proceed in accordance
with law and see that the lots are cleared. Motion was seconded by Commissioner
Hall and carried unanimously.
ITEM "2 - A public heat"in?, on TOPICS - Location & Construction of pierce
Boulevard Extension. The City i1anaget" explained this was the second ~public hearing
and then outlined the loop alignment plan explaining this procedure was ~equired
pursuant to the Federal TOPICS program which provides either matching or 100\ monies
for the construction of roads and it is necessary that the alignment be carefully
evaluated for public reaction. He reported the Traffic EnRineer and City Engineer
had met with several people to answer questions asked previously. The hospital
traffic was also being studied. The City Clerk read a letter from the First Church
of Christ, Scientist, ob;ecting to closinR off of Oak & Bav Avenues. The Traffic
Engineer had a meeting with the church group and anparently there iano further
objection. Mr. Cedio Salterelli, president Harbor Oaks Association, spoke of the
increase in traffic thoUp,ht to be due to the hospital construction and recommended
that Druid Rd. be closed to all through traffic aftet" construction is completed,
if not before. Mr. Norman Bie, attorney representing Highpoint Corp., Major Otto
Bie and himself objected to the project and criticized the cuvves, grade and
retaining wall. The City Engineer concurred in a statement by the Mayor that the
road would be constructed in compliance with ~igid state standards. Mr. John
Chesnut, Jr. questioned what was olanned for his property and stated that the rumor
is not true that the County had put"chased his property. Considerable di~cussion
'ensued with the City Engineer and City Manager answering questions. Commissioner
Carwise moved to approve the alignment in accordance with TOPICS and autho~ize the
proper applications to the Navigation Contt"ol. Motion was seconded by Commissioner
Wachtler and carried unanimously.
ITEM #3 - A public hearing continued - Sign Ordinance #1404. The City Manager
stated that information had been supplied to the Con~ission t"egarding similal"
ordirances in Honolulu, Alexandria, Va. and Evanston, Ill., wherein one City had
adopted a 7 year amortization abolishing projection signs, etc. He spoke of the
changes discussed at the work session pa~ticula~ly regarding roof signs, mOdifying
the exclusion of projection signs by putting them under an amortization schedule.
A discussion ensued regarding elimination of projection signs entil"ely with
Commissioners Hall and Wachtler a~reeinR some projection should be allowed.
Commissioner Hall moved that the orojection distance be chan~ed from G ft. to 3 ft.
and 1 ft. limitation on flush signs and use the Honolulu ord~nance relating to
roof signs. Motion was seconded by Commissioner Wachtler. IiI'. Herbert Hastings
of Peninsular Sign Co., St. Petersbut"g, Mr. Dominick Minotti of the First National
Bank and Charles Finton discussed the projection limits. Commissioner Hall moved
to table the motion to the next reRular meeting to further evaluate the effect of
the projection sign versus a flush sign. Motion was seconded by Commissioner
Williams. Upon the vote being taken Commissioners Williams, Wachtler and Hall
voted "aye". Commissioner Carwise and Mayor Hougen voted "Noll. Motion carried.
3:~O P.M. At 'this time Hayor Hougen left the meeting and Commissioner Williams
assumed the Chair.

Andy Bylenga, 3M AdvertisinR Co. recommended deleting Sec~ion 19-4 C (1)
(c) on Page 10, and then quoted from Federal and state laws regarding compen-
sation for removal of siRnl, and e~timated that the City would have to compensate
in the neir.hborhood of $600,000. The BuildinR Director stated that most billb~ards
are 15 ft. or more setback f~om right of way.
4 P.M. The Mayor returned at this time and assumed the Chair.
The City Attorney stated that the sign ordinance is pdrt of the zoninR code
therefore not subject to the compensation laws. Commissioner Williams moved that
all billboards or outdoor off-premises siRns become nonconforming upon adoption
of the ordinance. Motion was seconded by Commissioner Wachtler. Upon the vote
beinc takl!n Commissioner h'illi~ms and. Mayor- HouRen voted "aye". Commissionet'B
Wachtler, Cat'wise and Hall voted "No". Motion did not caI"ry.
Georgo Hill, Daniele Signs, expressed the opinion that Section 18-9 G (3)
and (a) on paUe 2S was discriminatory in favor of theatres. The owner of sta 'N
Play Apa~tment Motel asked queAtions about using right of way for signs. John
StevelberR, Diversified Services, building a commercial development at SaD & Highway
19, asked questions about total ~llowable square ft. for sign, which was answered
by the Building Director. Jay Keyes, General Mana~er and Vicc-~esident of the
Hilton Inn, Cleat-water Beach said the ordinance contained a disct'imination, as
most of businesses on beach are trying to reach people coming across causeway,
not the same as on Gulf to Bay Blvd.
Commissioner Wachtler moved to continue this public hearing to the Commission
meeting of November 6th, at 1:30 P.M. to brin~ the ordinance up to date in
accordance with the discussion of today. Motion was seconded by Commissioner Hall
and carr-ied unanimously.
ITEM 04 - A pUblic hearinp, on Unsafe Building, 2895 Thornton Road. The City
Manager explained the owner had not complied with ~itten notice of Building
Official to rehabilitate or demolish the structures thereon and recommended
resolution giving the owner 30 days to comply or have the City do so and file lien
upon the property.

The City Manager reported a letter- from Mr. Stowell requestinR more time to
relocate materials now in storage and having building demolished and removed.
The Buildin~ Oirector considered the buildinR a health hazard. Mr. Lynch,
representing Mr. Stowell, said he maintained the property ~nd Mr. Stowell was
coming down in December and wanted to handle demolition of this particular building.,
Commissioner Carwise moved that Resolution #72-129 be passed and adopted and the
appropriate officiale be authorized to execute ft. Motion was seconded by
Commissioner Williams and carried unanimously.
4:50 P.M. The Mayor left the meetinr. at this time and Commissioner Williams assumed
the Chair.
ITEM #5 - A pUblic hearinR on Requests for Annexation and Determination &
Establishment of Zoning & Fire District Classification:
Contd. - Lot 24, Skvline Groves, RS-50 (single family) & Fire District
No. 2 classification - Nationwide Land Corp.
The City Manap'er outlined the request and read the recommendation of the Planning
& Zoning Board for approval. The applicant was not present. There wet'e no
objections. Discussion ensued rep.arding a higher zoning classification.
Commissioner Carwise moved that the request for annexation by Nationwide Land
Corp. with RS-75 zonin?, and Fire District No. 2 classification be approved and
the City Attorney be instt'ucted to include this in an ordinance to be brought
back to this Commission for approval as soon as possible. Motion was seconded by
Commissioner Hall and carried unanimously.

The City Manager outlined the request and read the recommendation of the Planning
& Zoning Board for anproval. Mr. Irion was present. Commissioner Wachtler moved
that the request for annexation by Harbour Village Inc. with CG zoning and Fire
District No.1 classification ,be approved-and the City Attorney be instructed to
include ' this in an ordinance to be brought back to th~s Commission for approval
as soon as possible. Motion was seconded by Commissioner Hall and carried unanimously.

No. 2 classifioation be approved and the City Attorney be instructed to include
this in an ordinanoe to be brouRht back to this Commission for approval as soon
as possible. Hotion was seoonded by CommissioneI' Carwise and oaI'ried unanimously.

less Hest 223.28 ft. and less East 60 ft. of West 283 ft. of North
133 ft. with RM~24 (multi-family) zoninp, and Fire District No. 2
classification - Schuster.
The City Manager outlined the request and read the reoommendation of the Planning
& Zoning BoaI'd for denial, and in lieu thereof I'ecommended RM-16 with additional
7 ft. dedication for Nursery Rd. which was agreed to by applioant. The City
Attorney said 10 ft. utility easement was also required. Commissioner Hall spoke
of a traffic problem there now and NurseI'Y Rd. will probably have to be ~ laned
some day. Disoussion ensued. Commissioner Wachtler moved that the request for
annexation by Schuster with RM-16 and Fire Distriot No. 2 classifioation be approved
subjeotto traffic flow plan and neoessary right of way and easements. Motion was
seconded by Commissione~ Carwise. Upon the vote being taken Commissione~s Williamo,
\'lachtler, Carwise' and Mavol" Hougen voted "aye II . Commissione~ Hall voted "no".

The City Manager outlined the request and read the I'ecommendation of the Planning
& Zoning Board fo~ approval. There were no objeotions. Commissioner Williams
moved that the request fo~ annexation by Imaz with RS-50 zoning and Fire District
No. 2 classification be approved and the City Attorney be instruoted to include
this in an ordinance to be brought back to this Commission for approval as soon
as possible. Motion Was seconded by Commissioner Wachtler and car~ied unanimously.
g. Lot 9, Blook F, Oak Acres Addn., Unit 1 with RS-50 (single family)
zoning and FiI'e District No. 2 classification - Severino.
The City Manager outlined the request and read the recommendation of the Planning
& Zoning ,Board for denial without prejudioe, since the applicant was not prcsent
at the public hearing. Commissioner CaI'wi5e moved that this item be referred back
to the Planning & ZoninR BoaI'd for recommendation and continued to November 20, 1972.
Motion was seconded by Commissioner WachtleI' and carried unanimously.

i. A public heat'inB for annexation and zoning pursuant to t'efet'endum

j. Shadowlawn Subdivision.
Tho City Manager said that the PlanninR ~ Zoning Boat'd recommended RS-50 zoning,
and Fire District No.2 classification fot' both subdivisions. Mrs. ~m. J. Campbell
objected to annexation for herself and some neiRhbors. Commissioner Hall moved
that pursuant to the referendum request of Floridena Sub. and Shadowlawn Sub. that
the properties when annexed be zoned RS-50 (single family) and Fire District Ho. 2,
with the item to be included in an ordinance of intent to annex and zone the
property. Motion was seconded by Commissioner Wachtlet' and cart'ied unanimously.
k. Clearwate~ Manor SUb. Ct'eferendum) cancelled by City Commission October
2, 1972.
ITEM #6 - Pet'sonal Appearance - Religious Community Service. Mr. Warren
Henderson representin?, Relip,ious Community Services explained the program as
being fot' emergency housing for burned out families, etc. and requested use of
City pt'operty on a temporary basis particularly mentioning No. 3 Fire Station and
a house on City land on Lakeview Rd. at the location of the new fire station. He
explained that maximum usage for each family would be 30 days until other arrangements
were made for the people. A discussion ensued about movinc the Lakeview Rd. hou~e
and an estimated cost was given at $15,000. The City Manager spoke of the possibility
of putting mobile homes on City owned lots. Commissioner Cat'wise moved that the
City Manager investigate the matter and make a reco~mendation to the Commission.
Commissioner Williams seconded the motion. Commissioner Hall questioned whether
the function was proper for the City to be involved in. Mrs. Gigi Nousianen,
Division of Family Services spoke on the matter and said that other cities are
using this program and they have found it is cheaper to give emet'gency .housing
than to have a social worker spend her time going allover the County tryinr. to
find a place for the people. Upon,the vote being taken the motion carried unanimously.
ITEM #7 - Federal Applications:
The City Manager explained that Item 7 a. Neip,hborhood Facilities and Item 7 c.
Open Space, were requests for Feder~l Funds and authot'1zation for the appropt'1ate
off1c1als to submit the applications whiCh he recommended. Commissioner Wachtler
moved that the appropriate officials be authorized to execute the applications to
apply for funds. Motion was seconded by Commissionet' Carwise and carried unanimously.
b. Neighborhood Development Pro~ram.
The City Manager explained that preliminary estimates were that the Greenwood
area redevelopment program would cost in the neighborhood of one and one-half
million dollaI's with plans to do it over a. period of 3 years. He stated that it
was necessary for the City to put in theit' application as soon as possible and
upon approval it can be detet'mined by the Commission whether they want to consider
it or not. He stated the first year's grant should be about $500,000 and that
applications must be submitted each year but the second and third yeat' might 'require
City contribution. Commissioner Cat'wise moved that Resolution "72-130 be passed
and adopted ~nd the appropriate officials be authot'ized to execute application
not to exceed $500,000. Motion was seconded by Commissioner ~~chtler and cat't'ied
unanimOUsly.
6:55 P.M. Mayor Houflen left the meetin?, and Commissioner Wachtler assumed the Chair.
ITEM #8 - Request fot' Additional Taxi Permits (United). The City Manager reported
that the applicant had requested 3 permits but that Chief Daniola had recommended
only one permit at this time. Chief Daniels explained that Mr. Thomas went out of
business about 15 months aRo because of poor equipment and lack of insurance but'
agreed that the need for extra cabs is there. After discussion Commissioner Carwise
moved that 1 permit be granted and the Chief be authorized to issue 1 more if
needed. Motion was seconded by Commissioner 1211 and carried unanimously.
6:58 P.M. The Mayor returned at this time and assumed the Chair.

The Mayor recommended the appointment of Glenn Beneke to replace Brooks
Carter on the Central Pinellas Transit Authority, subjeot to his acceptance.
