The City Commission of the City of Clearwater met in rap,ular session at
the City Hall, Monday, lTuly 10, 1972, at 1:30 P.M. with the followin~ members

'l'he !1ayor called the meeting to order. The invocation was Riven by Reverend
Ellis Graves, Trinity Presbyterian Churoh.
ITEM ill - Lot 110wing Resolution #72-82. The City Attorney explained the
resolution. The lots were considered a menace to pUblic health, safety and welfare
by the inspector. There were no objections. Commissioner Wachtler moved that
Resolution #72-82 passed on June 26, 1972, be confit'med and made effective as
to all persons and parcels listed thereon except for those whose lots have been
verified as bein?, cleared and those who have paid the City for the clearing and the
proper City officials and employees a~e hereby direoted to prooeed in aocordanoe
with law and Bee that the lotR ~re cleared. Motion was seoonded by Commissioner
Carwise and carried unanimously.
ITEM #2 - A public hearinfl on Zoning Amendment Continued.
The following descriotion to be changed from MH (mobile home park)
to CG (business):
Beein 415 ft. East and 590 ft. South of the t1orth~lest corner. of
Northeaat 1/4 of Southwest 1/4 Sect. 17-29-16, thence run North-

The City Manager repo~ted that the hearin~ on this pat'ticular item, consistinR
of approximately 7 ac~es, was continued to this date to allow applicant to meet
with residents of the a~ea. Mr. William Gilkey, attorney, representing the applicant
and proposed purchaser, reported that a meeting had been held with the residents,
their attorney H~. Robert TenCh, and IiI'. Vodak. He said that his clients had aEreed
to pay complete moving charRes to move their mobile homes within an approximate 25
mile area and further that if the mobile home could not be set up in one day that
motel accommodations would be provided for 1 or 2 nights as neoessary. He referred
to this particular area as area No. 1 and spoke of area No. 2 which consisted of
prnperty extending Easterlv about 300 ft. more or less from area No.1. He said
in this particular aI"ea there was about 4 0 people and they will be given a 3 year
lease upon obtainin~'requested zoning with their rent firm for th~t time and their
moving will also be paid for. In area No. 3 consisting of property South of areas
1 & 2 the people will be Riven a 1 year option to purchase at the same price as Mr.
Wightman is receivinc for the property, or they may have a 5 year lease if they
desire. He presented a oetition siRned bV about 40 people in area No.1 agreeing
to move. He read a statement of intent rcp,arding the bypass road from U.S. Highway
19 to State Rd. 60 subject to location and various other negotiations. HI'S.
Harrison Dennis, HI'S. James Simmons, 'Hchael 0 I Ueil and Mrs. RORer Higdon spoke in
favor of movinR from the so called area No.1.

M~. Robert TenCh, attorney for the residents of the at'ea, reported that he had
advised the area No. 1 & 2 residents that he felt confident that the Blackburns
would keep their word, but that whatever arranRements were made would be in the form
of a master contract. He fUrther said he could not advise .individual cases. He felt
that perhaps '1r. \~ip'htman and Hr. Blackburn had used divide and conquer tactios.
Reverend Stephens, a resident of Bay Aristocrat Park, spoke of apprehension of the
I'Gsidents of his park, feeling the'! mip,ht be next. !1r. Edward \~hitson, Florida
Sta te LeRislator, reported he had s ponaored legislation on this type of matter but
recommended that the City attem~t to assist the tenants find a place to relocate.
Mr. Jack Murphy, also a member of the LeRialature, repoI'ted receipt of considerable
mail and telephone calls pertaining, to this matter and that the City would be setting
a precedent with their decision. The Mayor stated there had been some criticism of

time of their election and stated that Hr. Blackburn's contributions were no
more than some other people had made. After a discussion Co~~isaioner Carwiae
moved that agenda Item No. 2 be approved for a ohange of zoning from HH to CG
on the described property and the City Attorney be instructed to inolude this
in an amendment to the zoning ordinanco to be brought back to this Commission
for approval aD 800n as possible subjeot to right of way through properties
owned by the Blaokburn Brothers from US 19 to State Road 60 at total cost to
the Blackburns and froe of coot to the City. Motion waG seconded by Commissioner.
Williams and oarried unanimously.
The City Attorney reported that the Commission could expect to soe executed
oopies of agreemonts between parties in Area No. 1 wi th'i"n the next 2. weeks prio:r
to the reading of the rezoning ordinance.
Commissioner Williams moved that the preVious motion be dependent upon
satisfaotory 4Rreement with the affected property owners with the owners-
developers paying entire expenses for relooatinp, the residents of Area No. land
that they pay within 3 years the total expense for relocating those in the No. 2
area. Motion was seconded by Commis9ioner Carw!se and oarried unanimously.
ITEM #3 - A Pub1io Hearing on Requests for Annexation and Determination G
Establishment of Zoning & Fire District Classification:
a. Begin 1250.51 ft. South and 50 ft. West of Northeast corner of
Northwest 1/4 Section 16-29-16, run West 619 ft., North 95'ft.,
West ~OO ft., No~th 165 ft.. West 219 ft.. North 165 ft., East
619 ft., North 165 ft.. East 619 ft., South 590 ft.. to P.O.B.
with RPD (residentai1 planned development) zoninR and Fire District
No. 2 classification - Poinsette.
The City Manap,er outlined the request and read the recommendation
& Zoning Board for denial but in lieu thereof recommended RS-SO.
Watts, representing Mr. Poinsette, showed a plan, with 118 units,
approximately. and described the area.
Sgt. Chester Cichowicz replaced Capt. Hm. McClamma at this time.
The Planning & ZoninR Board recommended 87 units net on about 10 acres. Commissioner
Wachtler sugge9ted that the density be set and work out a residential planned
development with sinR1e family or duplex on the perimeter and 6 to 8 units in the
interior with a net density of 8.7 units oer acre; that consideration be given to
6 units to a bui1din~ with a two story help,ht limitation and with a total project
density approaching that under RS 50. Mrs. DeBlake~ stated that the property has
a 7.3 net density in the County and requested that it be denied but offer the same
density as available now in the County. Mr. R. A. Ruppert, from Crystal Heights
Sub. objected and requested single family zoning. Mr. David Hogue, representing
~l home owners in Kapok Park Sub. spoke in opposition. The Planning Direotor
stated that under County zoning l~5 units could be placed thereon. The City Clerk
reported one letter of objection. Commissioner Wachtler moved that the request for
annexation by Lyle poinsette be app~oved with RPD (residential planned development)
zoning and Fire Distriot No. 2 classification and the City Attorney be instructed
to include this in an o~dinance to be b~ought back to this Commission for approval
as soon as possible, and subject to a plan being submitted to the residents in the
immediate area; for review by the City Planner; not to exceed 96 units on total
tract; preserving as many t~ees as possible, single family usage on the perimeter
and a two-sto~y height restriction. Motion was seconded by Commissioner Carwise.
Upon the vote being taken Commissioners Carwise, Wachtler and Mayor Hougen voted
"aye". Commissioner Williams voted "no". Motion carried.

The City Manager outlined the request and read the recommendation of the Planning
& ZoninR Board for denial, but in lieu thereof recommended RS-75, (single family).
The City Clerk had one letter in favor of annexation. The applicant was not
present nor was his representative. The re~esentative at the Planning G Zoning
Board meeting had agreed to the change. Commissioner Williams moved to suspend
the policy regarding applicant being present for this item. Motion was seconded
by Commissioner earwise and carried unanimOUSly.
Commissioner Williams moved that the request for annexation by Mr. Garrett as
amended with RS-7S zoning and Fire District No. 2 be approved and the City Attorney
be instructed to include this in an ordinance to be brought back to this Commission
for approval as soon as possible. Motion was seconded by Commissioner Wachtler and
carried unanimously.

ITEM '14 - Housing Authority. The Hayor spoke of a list of housing problems
he had presented to the Housing Authority p~eviou91y. He mentioned that the
Commission had appropriated up to $7,000 to supplement the executive direotor's
salary and indicated that they would probably consider appropriating expenses for
travel for intorview8 for an executive director. Mr. Lee Barbee, Chairman of tho
Housing Authority! agroed everything possible should be done regarding Housing,
. but there was a f nancinR problem and HUD prohibits certain financing until the
construction of p~ojectft reach a certain point. He requested that there be two
directors at present and asked for $9,000 for an extra director, $2,~00 for a
secretary, $3,900 for office help and BO forth, for an annual expenditure of
$25,200, plus $3,400 for a one time expense. Commissioner Williams moved that the
Housing Authority be allocated l/~ of a mill for operating expenses to bo approved
by a referendUm election as Roan 8S possible with this money to be allocated as 4
supplement to financing. Commissioner Carwise seconded the motion. Atter con-
siderable discussion Commissioner Carwise moved that the motion be tabled. Motion
was seconded by Commissioner Wachtler. Upon the vote being taken Commissioners
Wachtler and Carwise voted "ayell. Commissioner Ittilliams and MayoI' Hougen voted
"no". Motion did not carry.
Upon the vote being taken on the original motion Commissioners Williams,
Wachtler and Carwiae voted "aye". Mayor Hougen voted IIno". Motion o&t'ried.
Commissioner '~achtler moved to appropriate funds up to $28,600 until a
referendum can be held so that the Housing Authority can have sufficient funds to
operate. Commissioner Williams seconded the motion which carried unanimously. A
discussion ensued relating to problems of drainage easement and power for the East
Clearwater project and also about ~he occupants of the trailers on Holt Ave.,
keeping the area clean.
ITEM f5 - Change Order "1 - Project IV, Part 1, 1969 Water & Sewer Program.
Mr. Wild, of Briley, Wild & Associates, Consulting Engineers outlined 2 change
orders. He said the first Change Order was to increase the size~ the force main
from 18 to 24 inches adding $24,111.80 to the contract with Dawson Co. Inc.,
Jupiter, Fla., and the second involved change order adding $225,695 to the contract
with Boyce Co. for 20 inch water line. The City Engineer and Utilities Director
concurred with the City Manager for the approval. Commissioner Wachtler moved upon
the recommendation of the Consulting Engineer, City Engineer, Utility Director and
City Manager that both Change Orders as described be approved and the appropriate
officials be authorized to execute them. t10tion was seconded by Commissioner
Williams and carried unanimously.
ITEM #6 - Resolution - Authorizing Amended 701 Application to HUD. Commissioner
Williams moved that Resolution #72-814 be passed and adopted and the.appropriate
officials be authorized to execute it. Motion was seconded by Commissioner Carwise
and carried unanimously.
ITEM ~7 ~ Acceptance of Plat - Bayedge Terrace. The City Manager presented
the plat and recommended approval. Commissioner Carwise moved that the plat be
accepted and the appropriate officials be authorized to execute it. Motion was
seconded by Commissioner Wachtler and carried unanimously.
ITEM #8 - Beautification - Median Strip - Missouri Avenue. The City Manager
outlined the project saying RiChard Leandri, Sunshine Mall agreed to pay cost of 10
fiberglass portable plante~, 3 ft. & 6 ft. diamete~, 1 trees, with the City to
provide the b~ick work and ground coverinp, and labo~ necessary. He recommended
a contract be autho~ized to p~oceed with the work. Commissioner earwise moved
that the project be approved as outlined. Motion was seconded by Commissioner
Wachtler and carried unanimously.
ITEM #9 - Request for Waiver of Basic Rental for Auditorium (Hadassah). The
City Manager presented the request from the Safety Harbor Chapter fo~ their bazaar
with aRreement from them to pay basic janitorial fee and electrical cost for ai~-
conditioning. Commissioner earwise moved that the request be approved. Motion
was seconded by Commissioner Wachtler and ca~ried unanimously.
ITEM H10 - Request to operate Consignment Bueiness - Creative Touch Products,
Inc. The City Manager explained this was a request for a consignment shop business
on Nursery Rd. They plan to sell handcrafted items such as paintings, sculpture,
pottery, metal sculpture and other art forms. It is already licensed as a gift
shop. Commissioner Wachtler moved that the request be approved. Motion was
seconded by Commissioner Carwise and carried unanimously.

Manaser recommended acceptin~ the bids of three separate firms for the materials.
Commissioner Wachtler moved upon the recommendation of the City Manager that the
contract for electrical materials be awarded as followss Itemo 1 & 7to Raybro
Electric Supply, Clearwater for $211.65; Items 2,3,4~5t G & 10 to Graybar Electric,
St. Petersburg, Fla. for $ 2 t 782. G 5; and Items 8 & 9 to J.M. Tull ltetals Co., Tampa,
Fla. for $60.50 which are the lowest and best responsible bids and that the
appro?riate offIcials of the City be authoriz.ed to exec.ute said contrAct which shall
be in accordance with the plans, specifications and bid. Motion WAS seconded by

ITEM #16 - Bids, X-Tru Coat Pipe & X-Trube Tubing. The City Manager recommended
accepting the bids of two separate firms for the pipe and tUbing. Commissioner
Carwise moved upon the recommendation of the City Manager that the contracts be
awarded as follows: Items 1-2-3 submitted by B~H Sales, Orlando in the amount of
$9,066.45, and Items 4 & 5, by Tampa Valve & Fittings, Tampa in the amount of
$6,936, which are the lowest and best responsible bids and that the appropriate
officials of the City be authorized to exeoute said contract which shall be in
accordance with the plans and specifications and bids. Motion was seconded by
Commissioner Williams and carried unanimously.
ITEM N17 - BidS, Garland, for Traffic Engineering. The City Manager recommended
accepting the bid of Bruno's Discount Decorations, Riverview, Fla. Commissioner
Williams moved upon the recommendation of the City Manager that the contract be
awarded to Bruno's Discount Decorations, Riverview, Fla. in the amount of $3,176.62,
which is the lowest and best responsible bid and that the appropriate officials of
the City be authorized to execute said contract which shall be in accordance with
the plans, specifications and bid. Commissioner Carwise seconded the motion which
carried unanimously.
The City Manag~~ recommended leasing from Paul Randolph the former Social
Security office building, 111 North Ft. Harrison Ave. (Lot 25 and North 25 ft. Lot
26, Block 1, Gould & EwinRs Sub.> to provide space to relocate the Parks & Recreation
Dept. and the Traffic Engineer. This would allow the Planning Dept. to move into
the present Parks & Recreation Dept. quarters and the Building Dept. to expand into
the Planning office. He reoorted that an 18 month lease at $1.49 per square ft.
had been agreed upon. Commissioner Wachtler moved that the lease be approved and ~he

The Hayor commended the firms submitting nroposals for studying another
causeway. He recommended Georp,e Kunde and Associates, Miami for the causeway study
and McFarland-Johnson-Gibbons Enginee~s, Inc., Clearwater for a drainage study.
Commissioner Williams moved ~hat the recommendations of the Mayor be approved and
the City ManaRer be authorized to neRotiate a contract and bring it back to the
