The City Commission of the Citv of Clear~ater met in regular session at
the City Hall, Monday, May 15, 1972, at 1:30 P.M., with the following members

The 11ayor called the meetinn to order, The invocation was Riven by Rev.
Fathor Finton MUldoon, St. Cecel ia t s Cathol ic Church, The Hayor oresented service
pins to a number of employees for five, ten and fifteen years of service. The
award of the month was Biven to Nathaniel Golden, puulic Service. Commissioner
Williams moved that the minutes of the special meotinR of April 26th, be approved
as recorded and as submitted in written summation by the Clerk to each Commissioner.

ITEM III - Continued - A Public Hearing on Proposed Agreement, Clearwater
Yacht Club. The City tlanap,er reported that this item had been continued from
April 17th in an attempt to reach a settlement out of court. Mr. Jody Wolfe,
representinp, the Yacht Club passed out sheets outlininp, the offers and proposals
to date. He recommended that the Yacht Club purchase the present pro'Derty under
their lease for $150,000 plus payment of back taxes and interest totaling about
$19,000 and the Yacht Club t%uld then be subject to City taxes. He spoke of .
appraised values involved in a oroposed land exchange. The Club would turn back
to the City the property under lease except for the East 25% of said pro'Derty,
The City would deed to the Club the Youth Maritime Center and assign the option on
FloI'ida Power Corp. property immediately North of the Hari time Center. He showed
the total values exchanRed bv the City at $139,500 and by the Yacht Club at $391,110,
Lengthy discussion ensued particularly relatinp, to the slips, the pram fleet and
the waterfront oroperty along the 83y. Commissioner Hall mentioned a new lease
for 35 years with $50,000 down and $5,000 per year for 15 vears after the first 5
years then $7,000 a year for the remainder of the lease. Further discussion ensued
relating to the finances and values of the properties and the advantages and
disadvantages of lease, sale or exchanRe of land etc. Commissioner Hall mentioned
3 possible solutions: (1) The olan outlined by the City Manager with the land
swap of those portions of land he referred to. (2) An arrangement along the line
of a new lease for 35 years but adjust the down payment to $35,000 allowing them
$1,000 for each year below what their orip,inal proposal was, (3) If neither of
these proposals were acceptable, proceed in court, Commissioner Williams recommended
exchange of the Florida Power property ootion and the Maritime Center for the
Yacht Club property now under lease. The Mayor recommended that this be continued
for one more time and then if the Commission cannot come to an agreement that the
matter proceed in court. Commissioner Carwise and Commissioner Wachtler objected.
Commissioner Carwiae moved that the City Attorney be instructed to pursue this
matter in court. Commissioner Wachtler seconded the motion. Upon the vote being
taken Commissioners Carwise and \'lachtler voted "aye". Commissioners Hilliams,
Hall and Hayor Hougen voted II no " . Motion did not carry.
Commissioners Hall and \o1i11iams were i.n favor of more negotiating and thought
that the matter was close to a solution. The Mayor again recommended continuance
and if an agreement cannot be reached at the next meetinR that the matter would not
be heard again, Commissioner Hall moved to continue this public hearing to May
22nd at 1: 30 P.M. 110tion was seconded by Commissioner Williams. Upon the vote
being taken Commissioners \..,illiams, Hall, Wachtler and Hayor Hougen voted "aye",
Commissioner Carwise voted "no". Motion carried.

ITEM #2 - A public hearing - Continued - Sanitary Sewer Installation, Area
of Keene - Ea st to BURle & Nursery, North to Bugle, The City Hanager re ported
that this was one of the subdivisions in the unincorporated area that petitioned
for sewers, but he recommended denial until such time as the City has facilities
under construction to handle, them. Commissioner Carwise moved that the request
be denied. Motion was seconded by Commissioner Wachtler and carried unanimously.

The City Manage~explained this item was oontinued to allow the applioantto
maet with the affeoted residenta in the immediate a~ea. ' Mr. Charles Barber,
rep~esenting the applioant, reported that a meeting with the Rroup was held,
that they had apparently I'eaohed an aRreemont and he presonted the..layout
that was shown to the eroup. The zoning '~ould be RH-16 to the West of the l~ke
with two story buildings and RS-75 on the East side oomposod of sincle family
units. There were no obiections. Mr. E. J. Robinson Booke in approval of the
plan. He read from notes expressing ap~roval of the RObinwood Community
Assooiation. Mr. ~rber answered quost~ons. Mrs. Donald Lauzon,.mobile home
park owner, spoke of the drainage prob~em which waG then explained by the City
Engineer. Commissioner Carwise moved that the request for annexation by Brown
Homes, Inc. with the zoning as amended to RM-16 for the West portion of the
property with 156' units and RS-75, ainRle family, on the East portion with 20
units making a total of 176 units in the project and rire District No. 2 be
approved subject to ~he, necessary East and West drainage into lake and all
this to be in accordance with th~ plan submitted and m~de a part.of the record,
and the City Attorney be instructed to include this in an ordinance to be
brought back to this Commission for aooroval as soon as possible. Motion was
seconded by Commissioner Williams and'carried unanimOUSly. .

,The owner of said ~roperty has requested that the City
of Clearwater establish P (public) zoninp, and Fire District '
No. 2 classification thereon.
The City t1anager explained those items were continued from Hay 8th to further
neRotiate park lands and solve certain enp,ineerinR problems. The Traffic
Engineer discussod the street layouts and traffic. Jack Dronzek, representinR
the applicant was present. The City Mana~ar said there was total of 3S acres
park land to be dedioated. Commissionor Hall opoko of an offer of a 5 acre
tract of land South of Lakev ie", extended, a short d is tanc e Ea st of S. Hercu leB '
Ave. After discussion, 111". Douglas Roaoh agreed to donate the site, provided
the proposed agreement with U.S. Homes is approved at this meetinr.. CharleD
Trumpler, preBident of Greenbriar Assoc., spoke of the area being a retirement
community and that their homes had been sold to them as such; that, it was free
from noise and heavy traffic and the property is still being advertised in this
manner. He said they do not want a four lane hip,hway and presented an alternate
plan Riving aCCeB!] in and out of the subdivision. 11ro. Claroence Schultz and Mr.
Samuel Stewart, also representing Greenbriar Assoc., spoke in objection. Char.les
Finton stated the park land bein~ donated was only 2 1/2\ of the davalopment and
should be considerably more. The Manager exolained that he was pleased with the
35 acres of parok land but that there would be considerable additional open space
with two golf courses and various recreation areas around the different sections
of the project. A re"rcsentative of the Bridgenort Homeowners Assoc. questioned
the water supply and expressed fear that they might lose their supply as they
had staroted to get salt intrustion in their ",ells now. Mro. William Crown, repre-
senting an ccology group spoke of these larRc developments taxing the water and
sewer suppl ies of the aroea. The ~tayor mentioned sGveroal amendments to the
agreement. Commissioner Caro"dse moved to approve the agroeement as amended and the
propero officials be authorized to execute it. Motion was seconded by Commissioner
Wachtlero. The City Manager said the master ulan showing riRht of way, park dedica-
tion, etc., as amended by nep.otiations, becomes a l)arot of this agreement. Upon
the vote being taken the motion carried unanimously.
After a discussion the Planning Director reviewed the applications and recom-
mended that the 40 ft. strip be changed from RM-l6 to PS (professional service)
zoning and that Tract I be changed froom P (public) to CPD (commercial planned
development) and indicated that the apulicants had approved the changes. Commissioner
Carwise moved that subject to uarok sites, etc., being dedicated as agreed upon that
the requests for annexation by Koch & U.S. Homes and Floroida Power Corp. with the
zoning ,as requested, except that the 40 ft. strip be zoned PS instead of RM-16
and Tract I be zoned CPO (commercial ~lanned development) instead of P (public),
and that all parcels carory Fire Distro~ct No, 2 classification be approved and the
City Attorney be instructed to include this in an orodinance to be brought back to
this Commission for approval as soon as possible. Motion was seconded by Commissioner
Wachtler and carried unanimously,
The Mayoro reporoted that Sandra Swarts was hired as interim Executive Diroectoro
of the Housing Authority but that the position required someone with wider knowledge.
He stated that the Housing Authoroity is Dcrmitted to pay $9,000 per year in
accordance with the number of units under their authority. The 11ayor asked the
Commission to make up any difference between the $9,000 and the roequired amount
to hire a professional executive diroectoro. Commissioner Wachtler moved that
subject to legal approval that the City Manager be authorized to expend sufficient
funds between the $9,000 available from the HousinR Authority to hire an Executive
Director but the total salary was not to exceed $16,000, and also to provide funds
for transportation and interviews. Motion was seconded by Commissioner Carwise.
Upon the vote being taken Commissioners Wachtlcro, Carwise, Hall and Mayor Hougen
voted "aye". Commissioner \>1illiams stated that he abstained from voting as he
had committed himself originally that no City funds would be used in connection
with the Housinp, Authority, Motion carried.
4:45 P.H. The Mayor left the meeting~ this time and Commissioner Williams assumed
the chair. Chief Daniels was replaced by Sgt. Albert Vellucci.
ITEM H3i. - The City ManaRero read a lettero from the applicant requesting
continuance.
South 1/2 of Southeast 1/4 of Southwest 1/4 Section 9-29-16, with
RM-12 zoning (apts.) and Firoe District No.2 classification. - Biggins.
The City Managero explained that the Planning & Zoning Board recommended denial,
but in lieu thereof recommended RS-75. Discussion ensued. Commissioner Hall
moved that the request be denied. Motion was seconded by Commissioner Hachtler,
Upon the vote being taken Commissioner Hall voted "aye". Commissioners \Hlliams,
Wachtler, and Carwise voted "no". Mot ion did not carry.
Commissioner Carwise moved that Item #3i. be continued to June 5th, at 1:30
P.M. as requested by the applicant with an apology offered to those in the audience
present for this public hearing. and that in the futuroe the agenda be published
in approopriate news media. Motion was seconded by Commissionero Wachtler. Upon
the vote being taken Commiosioners Hilliam9, ''l'achtlero and Carwise voted "aye".
,Commissioner Hall voted "no". Mayor Hougen absent. Motion carried. Commissioner
Williams asked that the people be notified to remind them of the date of the
continuanoe of this public hearinR.

Tho City HanaRer explained the Application nnd read the recommendation of tho
PlanninR & Zoning Board for approval, with the recommendation that applicant be

a letter of objection. DonAld MoFarland, attorney, was present representinp, the
applicant and stated that they requested RM-10 zoning with about 4 triplexes in
approximatoly 7 acres with the balance being duplexes. He also stated that the
duplexes would sell in the neip.hborhood of $40,000 to $50,000 and agreed to
cooperate in extension of sewer lines along Sunset Point Rd. Mr. John Rankin,
president of Woodmont Park Assoc., spoke in approval. Commissioner Wachtler moved
that the request for annexation by Florill Corp. et al, with RI1-10 zoning and Fire
District No. 2 clasAifioation be aonroved and the City Attorney be instructed to
include this in an ordinance to be brour,ht back to this Commission for approval

The City Manager explained the request and read the recommendation of the Planning
& Zonin?, Board for approval. There were no objections. Hr. Frank Colvin, owner
of property, was present. Commissioner Hall moved that the request for annexation
by Frank Colvin with CG zoning and Fire District No.1 classification be approved
and the City Attorney be instructed to include this in an ordinance to be brought
back to this Commission for approval as soon as possible. Motion was seconded by
Commissioner Wachtler and carried unanimously.
f. Lots 15 and 16, Missouri Heights, with CG (general business) zoning
and Fire District No. 1 classification. - Stone
The City Manager explained this request Has one \<There the applicant did not appear
before the Planning & Zoning Board, and the Board recommended denial without
prejudice. He said he received a letter from Mr. Stone saying he did not receive
the notice and indicated he had a ReWer oroblem. It was recommended that it be
referred back to the Planning & Zoning BOard which would not necessitate a new
application. Discussion ensued. Commissioner Wachtler moved that this item be
continued to June 19th, at 1:30 P.M. !1otion was seconded by Commissioner Carwise
and carried unanimously.
g. Replat of Ardmore Place, less those lots already within the City
limits of the City of Clearwater with RS-50 (single family) zoning
and Fire District No. 2 classification.
The City Manager explained the request \<Tas by petition of over 50% of the property
owners. He read the recommendation of the Planning & Zoning Board for approval
as modified with RS-SO zoning for portion North of Browning St. and RM-12 for
portion South of Browning. Mr. Steve Forgacs asked questions. Commissioner lall
moved that the request for annexation by 50% or more of the owner~ of area designated
in Replat of Ardmore Place be approved with the recommendation of t.~ Planning &
Zoning Board for zoning and Fire District No. 2 classification be aDLroved and the
City Attorneyoo instructed to include this in an ordinance to be brought back to
this Commission for approval as soon as nossible. Motion was seconded by
Commissioner Wachtler and carried unanimously.
h. Lots 20 and 21, Highland Lake Sub., with CG (general business) zoning
and Fire District No.1 olassification - Tourot, et al.
The City Hanager explained the a1,)plication and read the recommendation of the
Planning & Zonin?, Board for denial, and in lieu thereof, PS zoning, with covenant
for no multi-family units, a parkinR and aocess review by the Traffic Engineer,
a screening of the PS properties from adjoining and abutting properties, a sign
limitation to be in accordanoe with the new proposed sign ordinance and rip,ht
of way dedication of 17 ft. for Lakeview Ave. and 7 ft. for Highland Ave. "Mr.
George Routh, attorney, ~epresenting the applicant, was present and stated that
they would accept the recommended PS zoning. Mr. Ford Beeoher, manager of the
property, stated that it was impossible to keep a tenant in the residence due to
,business on the other 3 oorners of the interseotion. Mr. Otto Sarver spoke in
objection and there was also a petition in objection containing 42 name~.

classification be approved and the CitvAttorney be instructed to inolude this
in an ordinance to be brought back to this Commission for approval as soon as
possible. Motion was seconded by Commissioner Wachtler and carried unanimously.

I'rEM #4 - Removal of, Pat'king - Fort lIarroison Avenue. Recommendations weroe
made to remove parking on FOt"t Harrison Ave. between Drew and pinellas St.,
restriping to make 4 lanes, ~emove certain lane signs and install others, redesign
the signal at Court St. and Haven St., prohibit left turn at certain interosections
and designate left turns at others and permit truck loading only between 7 A.M. '
and 11 A.M. Commissioner Hall moved that Resolution *72-56 be passed and adopted
and the appropriate officials be authoroized to execute it. Motion was seconded by
Commissioner Carwise and carried unanimously.
ITEM #5 " Continued - Personal Aoncarance - Clearwater Women's Club Members.
Mrs. Anderson, President, of the club'had to leave early. Mrs. Keith Weston,
representin~ the Club, stated they did not know their lease was in jeopardy and
it was imposoible to change the rulesm the one week given to do so. She also felt
that as the problem was not their fault they should be recompensed for the financial'
loss if 'required to vacate. She asked for 90 days time to vacate and requested a
letter in writing on the matter. Commissioner Carwise moved to remove from the
table the motion of May 8th directing the City Attorney to invalidate the lease.
Motion was seconded by Commissioner Wachtler and carried unanimously. Upon the
vote beinR taken on the original motion of May 8th directing the City Attorney
to break the present lease, the motion carried unanimously.
ITEM HG " Motion re Special Meeting - May 30, 1972. The City Manager recom-
mended a special meeting of the Commission for May 30th, to consider annexation
and zoning of property in the NW 1/4 of NW 1/4, Section 16-29-16, for the housing
project. Commissioner Carwise moved that there be a special meeting and work
session on May 30th. Motion was seconded by Commissioner Wachtler and carried
unanimously.
ITEM #7 - Tampa BaV Regional Planning Council Study - Clearwater East Pollution
Control Facility. The City Manager explained that the Commission had received
copies of a letter from Tampa Bay Regional Planning Council relating to a study
involving an analysis of water quality and extending sewer outfalls in Tampa Bay.
He recommended approval of the letter of agreement and appropriation of funds.
Commissioner Wachtler moved to approve a letter of agreement and the necessary
funds be approved as recommended by the City ManaRer. Motion was seconded by
Commissioner earwise and carried unanimously.
ITEM N8 - Acceptance of Plats:

The City Manager presented the plats and recommended approval. Commissioner
Wachtler moved to approve the plats subject to payment of lot mowing lien by
developers of Clearwater Point Townhouse. Motion was seconded by Commissioner

outlined the request of Rodeway Inn for on-premises consumption, and said the
usual investigation had been made and there was no reason to deny the license.

this in an amendment to the beverage ordinance. Motion was seconded by
Commissioner Wachtler and oarried unanimously.

of $59,965~49, which is the lowcst and best responsible bid and that the appropriate
offioials be autho~ized to execute said contract which shall be in accordance with
the plans and specifications and bid. Motion was seconded by Commissioner Wachtler
and ca~ried unanimOUSly.
ITEI'( 614 - Bids, to/ater Service Buildinr; - 1969 Hater & Sewer Program. The
City ManaRer recommended accepting the bid of Taylor General Construction Co.,
Largo, Fla., which he outlined. Mr. William Duke. Briley, Wild & Associates
explained the building would be oement block construction and designed for future
second story to accommodate offices. Commissioner Williams asked questions about
Briley, Wild & Assoc. qualifications to design bldg. instead of an architect. The
City Engineer explained if they a~e qualified they can do it. Discussion ensued.
Commissioner Waohtler moved that the bid be awarded to Taylor General Construction
Co" for the sum of $71,656, which is the lowest and best responsible bid and that
the appropriate officials be authorized to execute it. Motion was seconded by
Commissioner Carwise. Upon the vote being taken Commissioners Wachtler and Carwise
voted "ayell, Commissioners Hall and ,.}illiams voted IIno". Hotion did not carry.
ITE~f #15 - Bids, Microfilm Equioment & Installation for Police Dept. The
City Manager explained the bids from Eastman Kodak Co. and Lanier Business
PrOducts. Commissioner Hall moved upon the recommendation of the City Manager
that the contracts be awarded for Items 1, 3, 5 to Eastman Kodak Co. in the amount
of $7,379.50, and Items 2 and ~ to Lanier Business Products in the amount of
$1,430, which are the lowest and best responsible bids and that the appropriate
officials be authorized to execute said contracts which shall be in accordance
with the olans and specifications and bid. Notion was seoonded by Commissioner
Carwise and carried unanimously.
The City Engineer spoke of the Clearwater Pass Bridge repairs which are being
paid for by the company that damaged it but there is another prOblem with the
fender system which has eroded away and needs repaired with Misener Marine Constr.
Inc. doing the work for $3,388 with building maintenance help. Commissioner Hall
moved that this emergency expenditure be approved for Misener Marine Const. Inc.,
to repair the fenders at Clearwater Pass Bridge. Motion was seconded by Commissioner
Carwise and carried unanimOUSly.
The Planning Director recommended' that two zoninr, ordinanoe ohanges and a
change of zoninp, be placed on the Commission agenda of June 5th, as they were
considered of emerp,sncy nature. Commissioner Hall moved to approve the recommen-
dation that these items ap~ear on the agenda of June 5th. Motion was seconded by
Commissioner Wachtler andcarried unanimously.
Hr. Robert Haokworth representing the Human Relations Council expressed
appreciation for the City's efforts regarding housing.
ITEM H18 - Ordinance Ul363 - Setting License Fee for Charter and Party Boats
- Effective - October 1, 1972 - 2nd reading. Commissioner Wachtler moved that
Ordinanoe H1363 be~ad and considered on second and final reading by title only
