The City Commission of the City of Clearwater met in ~egular Ression at
the City Hall, Monday, April 17, 1972, at 1:30'P.H. with the following members
present:

'rhe ;.layor called the meeting to order. The invocation was given by
Reverend R. E. Rutland, Skycrest United ~1ethodi9t Church. Service pins were
awarded to a number of employees for various years of service. 'The award of
the month was given to Mrs. Sara Brown, Service & Information Dept. Walter
Manning, retiring Fire Chief was Riven a watch as a memento for 25 years of service,
and Sara L. Bver~, retiring Librarian'was given a plaque for 3B years of service.
Commissioner Carwise moved that the minuter. of the regular meeting of [1arch 20th,
1972 be approved as recorded and as submitted in written summation by the Clerk to
each Commissioner. "Iotion t-las seconded by Commissioner Hachtler and carried
unanimously.
ITEt1 Y1 - A public hearinp, on Sign Request - Holiday Inn. The City l1anager
explained that the applicant wished to have a variance from the sign ordinance for
their property at 521 S. Gulfview Blvd. to erect 2 signs. 32 sq. ft. each, which
exceeds the eligibility of the site. Hr. James HUlsey, representing the applicant,
said they could'not agree with the recommendation of the Si~n Committee, which was
16 square feet for each sign and a maximum height of 4 feet, with the messane
"Y>estaurant" and "restaurant and lounp,e" plus an arrow pointing to the parking
area for each. The Buildin~ Director said the total sign areas would be allowed
in a business district classification, but exceeded the maximum in the RI1 classification.
After considerable discussion Commissioner Carwise moved that the request for a
variance to the sign ordinance be approv~d. Hotion t-las seconded by Commissioner
Wachtler. Upon the vote bein?, taken Commissioners \'lachtlero, Car\-dse t Ilall and
Hayor Hougen voted "aye". Commissionet' \~illiams abstained because of possible
conflict of interest. Motion carried.
ITEM #2 - A public ~earing on Ordinance #1375 - Amending Sewer Tap Fees. The
City Manager explained that it has been modified with a tan fee of $100 for single
family one bath home or apartment, 2 baths or more $125 and the fee for a mobile
home apace at $110. Commercial-per toilet or urinal would be $100, ,-lith restaurants t
theaters, car washes, laundries and other commercial enterprises making more than
normal demand on the sewer sYstem, excluded all of which would be negotiated under
the industrial category. Discussion ensued. Commissioner \'lilli~ms moved that
Ordinance #1315 be amended as follows: residential single family and apartments
one bath $100; two or more baths $125; mobile home space $110. commercial-per
toilet or urinal $100; eXCluding restaurants, theaters, car washes, laundries and
other commercial enterprises makinf; more than normal demand on the sewer system to
be negotiated under the industrial category. 110tion Has seconded by Commissioner
Wachtler and carried unanimously.
Commissioner Williams moved that Ordinance #1375 be read and considered on
second and final readinf; by title only at this meeting of the Commission by unanimous
consent of the Commission. Motion was seconded by Commissioner Wachtle~ and carried
unanimously. The Ordinance was read by title only. Commissioner Carwise moved that
Ordinance U1375 as amended be passed on its second and final reading and adopted
and' that the appropriate officials of the City be authorized to execute it.

ITEN 1)3 - A public hearin~ on Possible Agreement - Clearwater Yacht Club.
The City Manacer explained that the Yacht Club did not have a quorum at their last
meeting, therefore Mr. Jody Wolfe. attorney for the Club, asked that this item be
continued. Commissioner Wachtler moved that the public hearing be continued to
tiay 15th, at 1:30 P.M. 110tionwas seconded by Commissioner Hall. Upon the vote
being taken Commissioners Wachtler, Hall and Ifayor Hougen voted "aye".
Commissioner Carwise voted "no". Commissioner Hilliams was absent at this time
and did not vote. Motion carried.
Kent Haxwell, Clearwater Beach, reported he had a petition signed by 200
people for mOl'e space and activities for youth at the Haritime Center. They want
tennis courts, and the use of Yacht, Club swimminr. 9001. The Mayor recommended he
meet with,the City,Manager fo~ a discussion.

people in the adjoining area had invested their life savings in nice homes costing
up to $30,000 and this project would limit their prospects if they should desit's
to sell their property. Hr. James Stanley, 1948 Soule Rd. objected to the high
density. Mrs. Donald Lauzon, 1965 High\-Iay 19 N. mobile home pat'k owner, spoke of
seweI' and traffic problems and objected to 3 story buildings next to 10 ft. high
mobile homes. .

Commissioner Williams moved upon the request of the attorney for .the applicant

The City Attorney stated that if there are any advertised pUblic hearinRs
scheduled for May 1st that a motion to continue these hearings to Hay 8th should
be made. Commissioner Hilliams moved that any advertised public hearings for May

The City Hanager recommended a special meetinR on Ap~il 26th, at 1:30 P.M.
for report on status of and l'ecommendations on the sewer system which was agreed to
by unanimous consent.
Commissioner Wachtler moved to give prefeI'ence for sewers to those within the
City and annexation applications. Motion was seconded by Commissioner earwise and
carried unanimously.
'ITEM #5 - Resolution - Adopting the Recommended Corridor for the '~ateI'front
Boulevard. Commissioner Williams moved that Resolution #72-~5 be oassed and
adopted and the appropriate officials be authox-ized to execute it. . Motion was
seconded by Commissioner Wachtler and carried unanimously.

The City Manager reported that an item regardinp, removal of parkinc on
Ft. lIarrison Ave. was inadvertently left off the agenda. Mr. C. C. HaInnis,
(tenoral manager of the Ft. Harrison hotel, objected if they cannot load and
~nload at the front door. Discussion ensuedr.egardin~ loadin(t a.nd unloading
at the hotel. Mr. Keith Crawford, Traffic Engineer, said he did not object to
1 car otopping in front of the hotel to load or unload, but normally there are
quite a few car~ there. Mr. Robert Thompson 3aid the sanitation trucks caused
more trouble than the cars of the hotel p,uests. Tho City Hanager recommended
tho dato of May 15th, at 1:30 for a public hearinR on removal of parking from
Ft. lurrison Ave. Commissioner Wachtler moved that the oublic hearing be
approved as recommen(led. 110tion was seco~ded by Commissioner Hilliams and

ITEM 1#6 - Resolution - Authorizing City Expense for the Construction of
a Box Culvert at Stevenson's Creek and Cleveland Street. The Citv Manager
recommended approval on a matchinp, basis with State Dept. of Transportation in
an amount not to exceed ~15,OOO. Commissioner \Vachtler moved that Resolution
H72-~6 be pusaed and adopted and the appropriate officials be authorized to
execute it. Motion Nas seconded by Commissioner flall and carried unanimously.
ITEH iI7 - Youth Center Report. Mr. Paul Stefan, l5~O vlalnut St. submitted
recommendations with discussion ensuinp" rer.arding age groups, director, etc.

ITEH #8 - Continued '- Request for Dock Permit (Bie). The City Hanager
explained the aoplication was for a 312 ft. private dock immediately South of
Smith's fin~er''' with a recommendation from the Harine Advisory Board that it be
denied. Mr. Norman Bie, attorney representing East Cove, Inc., stated the County
required City approval first. He said the applicant employed a Harine contractor
to consult with City Engineer as to what should be done and submitted a drawing
and letter of application. Mr. Hie asked for entire City file be incorporated in
the record with a copy of every document be furnished to the applicant. The City
Manager said he had a report from the City EnRineer dated September 1st, 1971,
which indicates the man came in to see him and left this plan; when brought up
at work session 10-15-71, the Commission requested that the Harine Advisory
Committee make a recommendation; referred to Harbormaster Oct. 15; letter from
Advisory Committee came back on March 8, 1972; item was scheduled in MarCh,
continued at Mr. Bie's request to the present date. Hr. Bie said the September
date was not the inception of the effort to obtain approval as had previous
consultations with matter to be studied. Nr. Bie said he did not need a permit
to construct a dock and continued to discuss his property. He further reviewed
the history of the property. The City En~eer concurred in the City Manager's
statement that there had been no discussion of trading land withl1r. Bie. Mr.
Bie said that in 1965 he offered right of way to the City at no cost for the
proposed loop subject to no assessment for paving the street. He replied to
Commissioner Car'.-1ise that his request was to put a private dock on his ONn private
property to tie up his boat. He further stated that the marine contractor had been
following the matter to meet the requirements, but the City Engineer' said there
had been no official request except for a set of drawings. Hr. Bie felt the company
had done what had been indicated for them to do to try to get the permit. The
minimum depth of water he estimated at 3 1/2 ft. if measured about 31U ft. from
shore. Commissioner Carwise moved after having heard this request for dock permit
that the request be denied as there is no sho\"!ing of a necessity; no showine that
the zoning is proper for the purpose intended; no showing of disposal of effluent;
no sho'.-ling that the sanitary aspects were sufficient; and that the r,llans \-rere
insufficient for the purpose of moorinp, a boat to be lived on at that location and
that the depth of water Nas inSUfficient. Hotion was seconded by Commissioner
\~acht1er. Nr. Bie said his application did not say he was going to live on the'
boat and in answer to a question said his boat was ~O ft. long. The City Engineer
reported that the marine contractor made the application verbally and it was he
who stated that Mr. Bie was r,oinp, to dock his hoat and live on it at the end of
the requested dock. Upon the vote being taken for the question Commissioners
Carwise, Hacht1er and Hayor Hougen voted "aye II. Commissioners \llilliams and Hall
voted IIno". Motion carried. In reply to a question, the City Engineer stated
that the City has the same criteria as the County nn~ if they meet this criteria,
the Building Dept. would issue a permit subject to County, State of Florida, and
Corps of Engineers approval. The Planning Director stated that the dock would not
be permitted under the present zoning according to an opinion of the Legal Dept.
6:~0 P.M. Commissioner Williams left the meeting at this time.
ITEM #9 - Variance - Beverage License Restrictions. The City Manager explained
that an amendment to the beverage ordinance was needed to permit Rranting a 10\
variance in the distance requirad for a beverage establishment to be located from
a school or church. Commissioner Carwise moved that Ordinance H1377 be read and
considered by title only on the first reading by the unanimous consent of the
Commission. Motion was seconded by Commissioner Wachtler and carried unanimOUSly.

negotiated providinp, for a niRht watchman and increasing the contract in the amount

Attorney reported that some of the persons that were to be at this meeting were

ITEM #22 - Authorization to exercise Option to Purchase - Lake Chatauqua Park
Property. The City Attorney explained that this option expired May 1, 1972.
(8 1/2 of S 1/2 of NE 1/4, Sect. 32-28-16) Since we have received unofficial
notification from the State Department of Natural Resources of approval for the
Lake Chatauqua park pttoperty owned by Glazer, Bookbinder, et al, upon which the City
holds an option to purchase and since this option must be exercised before May 1,
1972, Commissioner Carwiss moved that this option to purchase be exercised before
that date and that the proper officials be authorized. to execute same. Motion was
seconded by Commissioner Wachtler and carried unanimously.

the area therefore asked that the apnointment be resoinded and recommended Donald

Couzens and approve the appointment of Donald Carlson. Motion was seconded by
Commissioner Carwise and carried unanimously.
Commissioner- Hall requested the Cit., Planner develop some method to define
part ~f de~elopment property not used but considered part of calculation. The
P1ann~ng Dlrector answerered questions.
The' City Mana~er reported that Commissioner Williams before leaving the meeting
asked that the Planning Dil:'ector be requested to consider requiring a masteI' plan
for any acreage development irrespetive of ~~hether or not it gets a specific zoning.
