Cecelia Catholio Church. In the absence of Mayor HougenJ Commissioner Williams called the meeting to order and announced Mayor, Hougen was attending a National League of Cities Committee meeting. Commissioner Williams presented pins to a number of employees for various years of service. ITEM #1 - Continued - Sanitary Sewers, Terra Alto Estates. The, City Manager atated thi s item was continued from June 21st and explained that the delay was due to a study of the financing for properties outside the City. He stated that this particular subdivision is less than one-half developed but there is some difficulty with septic tanks now. James LazarJ 1469 Carolyn Dr. spoke of desperate need for , sewer. The City Manager recommended that a survey be made to determine all the statistics to present to the property owners with the proposed annexation of the subdivision. A discussion ensued. Commissioner Carwise moved that the item be continued to September 20thJ at 1:30 P.M. Motion was seconded by Commissioner Wachtler and carried unanimously. ITEM #2 - A pUblic hearing on requests for annexation & zoning: a. South 594 ft. df West 390 ft. of East 878 ft. of SEt of swk Section 36-28-15 with R-3C (nmlti-family) zoning and Fire District No. 2 classification thereon. - Currier South 594 ft. of West 460 ft. M.O.L. of SEt of swk Section 36-28-15 with R-3C (multi-family) zoning ,and Fire District No. 2 classification thereon. - Brown The City Manager explained the request l~S continued from June 21, 1971, and read the recommendation of the Planning & Zoning Board for denial. He also read a letter from Chester McMullen & Robert Wilson, attorneys, for applicant and objectors, requesting indefinite postponement. Commissioner earwise moved that this item be continued to September 20thJ 1971, at 1:30 P.M. The City Manager explained this item was continued from July 7, 1971, and was recom- mended fop denial by the Planning & Zoning Board. Mr. James D. Baxt~r, attorney for the applicant, stated that Mr. Spatuzzi had loet with the property owners and believed that a compromise had been reached. He stated they were asking for the same zoning but would accept covenants to limit the development to 10 units per acre along the North and West boundary with the balance at 14 units per acre. He presented a pro- posed oopy of the covenants to Commissioner Williams. Kenneth Jansen, Frank Andrews and Mrs. N. H. BrockmanJ, approved the compromise. Mrs. R. G. Kerwin representing her husband, president of the Montclair Lake Association objected to the density and showed a chart of the area indicating multi-family all around them. A resident of Young1s subdivision stated that Sunset Point Rd. cannot handle much more traffic without widening. Mr. Edward H. WalkerJ architect Objected to approximately 20 units per acre along Sunset Point Rd. After discussion with the Planning Director and within the Commissionj Commissioner Carwise moved that Item No. 2 b. on the agenda be denied without prejudice. Motion was seconded by Commissioner Wachtler and carried unanimously. Comm1ss10ner Carlson recommended further negotiation. 3:15 P.M. Chief Daniels replaced Major MoClamma at this time., c. He atated that this developer had agreed to put in escrow $15,000 for the oonstruo- tion of Drew St., along his property lines; that after the City got the necessary permita for the railroad craBsing, the developer would grade and pave said orossing; that the 9 acres would be deeded to the City for park purposes and the City would deed a small City tract for a park; that a ntreet would be oonstructed along the Northern railroad right of way and that connections would be made to the subdivision to the North. Mr. H. H. Baskinl Jr., attorney representing the dcveloperl introduced Robert Carabello a member of the developing firm and stated that the tract oonsisted of a total of 190 acreo inoluding the traot North of the rai1roadj that single family residences would be built North of the railroad and they will dedicate about 4 aoreD North of the railroad and 9 ncres South of the railroad for park purposos. Mr. Carabe11e gave perccntagoo and nCI'eago figureD for the various usesJ such as 20~ or 40 acres for roado; 32~ or 60 aoreoJ single family detached, etc. He also stated they have agreed to 11 units net per aore or U lnaximum of 1650 units. Considerable disoussion ensued. Commiosioner Carlson moved that,thc requcst for annexation by Estell Reagan & Eather neagan, and contract purchaser La-Monte Shimberg Corp. for R-3C zoning and Fire Diotriot #2 olassification be approved eubject to the covenants as road by the City Manager including 11 unite per ncro density, and the City Attorney be instructed to include this in an ordinance to be brought back to this Commisoion for approval as soon as possible. Edward J. Geoghcganl attorney representing the Rural Association spoke in objeotion. Disoussion ensued. Commissioner Carlaon moved that the request for annexation by Al Rogero Builder, Inc. for R-1C (Single family) zoning and Fire District No. 2 classifioation be approved ' and the City Attorney be instructed to include this in an ordinance to be brought baok to this Commission for approval as soon as pOSSible subjeot to the necessary Nursery Rd. and Morrow Drive right of ways. Motion was seconded by Commissioner Car\nse and oarried unanimously. ITEM #3 - Request ~or re-evaluation License Fee (Palmist). The City Manager reported that Robert J. Carroll attorney representing Madam Chaktal palm reader, wished to discuss the lioense fee for a palmist further. Mr. Carroll, ,was present. The City Attorney presented ordinance #1336 deleting certain license categories including fortune tellersJ palmists, etc. and enacting a new Section prohibiting such businesses in the CitYI and stated that many other cities have such ordinanoes prohibiting these activities. Mr. Robert J. Carroll asked questions. Commissioner Carlson moved that Ordinance #1336 be read and considered by title only on the first reading by the unanimous consent of the Commission. Motion was seoonded by Commissioner Wachtler. Upon the vote being taken Commissioners Waohtler, Carlson and Williams voted HAyeH. Commissioner Carwise voted IINoH. Motion did not oarrYJ therefore the City Attorney read the ordinance in full. Commissioner Carlson moved that Ordinance #1336 be passed on its first reading. Motion was seconded by Commissioner Wachtler. Upon the vote being taken Commissioners Carlson, Wachtler and \'iilliarns voted II Aye II . Commissioner Carwise voted HNoH. Motion carried. The Acting Mayor recommended the seoond reading be delayed until the next meeting. ITEM #4 - Request ~or Variance of Sign Ordinanoe - Taylor Building. The City Manager explained the request from George H. Hill, Jr. of Daniels Signs for the Taylor Buildine at 121 N. Osoeola Ave., and reported app~oval was recommended by the Sign Committee. Commissioner Carlson moved to grant the variance to the Sign Ordinance for the Taylor Building at 121 N. Osceola Ave. as outlined by the City Manager. Motion was seconded by Commissioner Carwise and carried unanimously. ' ITEM #5 - Authorization to enter into a contract with F. Alfano - Transfer Station. The City Manager recommended al~thorization to enter into a contract with F. Alfano of the firm of Frank R. MudanoJ A. I. A. Architect Inc'J for architectural services to assist the City in speoificationsJ design, etc., of the transfer station at a maximum outlay of $1,000.00. Commissioner Carwiae moved that the authorization be approved as outlined. Motion was seconded by,Commlssioner Wachtler and carried unanimously. ITEM #6 - Set date for Minimum Housing Code Violation Hearing - 803 Jurgens Street. The City Manager reoommended setting the date of August 2nd, 1971 at 1:30 for the public hearing. Commissioner Wachtler moved that the public hearing be held August 2nd. Motion was seconded by Commissioner Carlson and carried unanimously. ,ITEM #7 - Vacation of Easement - Oakhill Sub. (E.B. Casler) The City Manager had u letter from E. B. CaslerJ attorney I representing James H. CoomesJ Memphis I Tenn. for vaoation of eaDement in loto 11 21 31 41 6 & 8 Block BJ Oak Hills Sub. and recom- mended approval. Resolution #71-78 was presented authorizing the vacation of the above easement. Commissioner Carwise moved that Resolution #71-78 be passed and adopted and the appropriate officials be authorized to exeoute it. The Oity Manager presented recommendation for slight modifioation to the agreement with st. Petersburg far the joint UBe of the sanitary land fill aite. He atated that for the first 2 years the rate was set for $2.00 per ton, with the rate schedule to be renegotiated at that time. Comttdasioner Wachtler moved that the amendment be approved aa outlined by the Oity Manager and the proper offioials be authorized to exocute said agreement. The Oi ty Manager recommended accepting the bid of Rockwell Manufacturing Co., Pittsburgh for automatic parking meteI'D. Commissioner Carlson moved upon the 'recommendation of the Oity Manager that the contract be awarded to Rockwell Mfg. Co. for the Dum ,of $7,960, which is the lowest and best responnible bid and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Wachtler and carried unanImously. ITEM #11 - Bids, PaVing, Curbs & Drainage - San Juan Court, Itlllcrest to Gulf to Bay. The City 11anager compared the separate bids for San Juan Court~ Hillcrest to San Remo, and San Juan Court, San Remo to Gulf to Bay~ and the com- bined bid for San Juan Court, Hillcrest to Qulf to Bay, and the combined bid for San Juan Court, Hillcrest to Gulf to Bay which was a better price. After Borne discussion Commissioner Wachtler moved that this item be continued until August 2, 1971 for further information. Motion was seconded by Commissioner Carwise and carried unanimously. ITEM #12 - Bide, Refuse Transfer Station Equipment. The City Manager ex- plained and concurred in the recommendation of the utilities Director for not accepting the low bid because it did not meet epecH'ications, and recommended the middle bid of Sanco Corp., Lakeland, Fla. Discussion ensued and Mr. Stopher, utilities Director, gave a report on the item. Commissioner Carlson moved that the bid of Transtat EqUipment Co. be rejected as irregular and not meeting speci- fications and upon recommendation of the City Manager and utilities Director that the contract be awarded to Sanco Corp.! for the sum of $152,500, which 1s the lowest and best responsible bid and that the appropriate officials of the City be authorized to execute Boid contract which shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Wachtler and carried unanimOUSly. ITEM #13 - Bids. Sanitary Sewer - Cardinal Drive. The City Manager reported this sanitary sewer was to serve certain lots annexed in Pinellas Terrace, 1st Addn. and that informal bids were taken and he recommended the one submitted by Kelley Construction Co. in the amount of $4,135.50. After conferring with the Assietant City Engineer, the City Manager recommended the item be deferred for further information. By consent it was agreed to defer this item to August 2, 1971. , -, ITEM #16 - Ordinance #133~ - Annexing & Zoning Portion of Govt. Lot 2 1n Sect. 16-29-16 - (McMUllen) & a Portion of Sect. 19-29-16 - (Lee). Commissioner' Carlson moved that Ordinance #1334 be read and considered by title only on the first reading by the unanimous consent of the Commission. Motion was seconded by Commiosionel' Wachtler and carried unanimOUSly. The City Attorney presented the request of Attorney John Bonner representing JapancGc Gardells fur a continuance of the public hearing for change of zoning in JapanolJc Gardena from the meeting date of July 26th to August 16th. Commissioner Wachtler lnoved to approve the request and continue the pUblic hearing to August 16th, 1971. Motion wuo seconded by Commiosioner Carwis~ and carried unanimously., Upon a question the City Attorney said it would not be necessary to notify in- dividuals in Japanese Gardena as it would be a monumental tas)<. It was requested that the newspapers give the continuance publicity. MI:'. Louis ScimonD complained that no action had been taken relating to the rates chal'ged at the Marina. Upon a question from Commissioner Carlaon the City Manager reported that the Corps of Engineers was still developing data on the dredging on Dunedin Pass and the City Engineer was optimistic about the matter. Commissioner Carlson suggested that a marked nautical mile be set up somewhere in the harbor. Commissioner Williams suggested if a subdivision 1s 75% developed it requires a request of 50% of property o~mers ror sewers, if less than 75% developed it requires a 90% request. , Commissioner Carlson left the mee\;ing at this time. The City Commission then met as Trustees of the ,Pension Fund with the Acting Mayor calling the meeting to order. A letter was read from the Advisory Conunittee of the Employees Pension Fund recommending that Pauline M. Caputi be retired at a disability pension of $150.10 per month, effective August 13, 1971, after being approved by a City phYSician in addition to her own doctors.
