The City Commission of the City of Clearwater met in speoial session at the
City Hall, Monday, March.22, 1971, at 1:30 P.M. with the following members
present:

The Mayor called the meeting to order. The invooation was given by Chief
Daniels. The Mayor explained that Commissioner Carwise and Austin Watts were in
Atlanta on official City business pertaining to housing and requested approval
of their expenses. Commissioner Carlson rnoved that their expenses be approved.
Motion was seoonded by Commissioner Williams and carried unanimously.
The City Attorney announced that the Anti-Crime Steering Committee waB
sponsoring a Seminar on Circuit Court Prooedure at 7:30 P.M., March 30, 1971,
in Court Room A. 4th floor Pinellas County Court House. with the pUblic being
invited in order to keep them better informed.
The City Attorney recommended rescinding the motion awardi~. the contract
for water supply wells on March 15. 1971 and passing Resolution H7l-25 as the
Department of Housing & Urban Development requires the awarding to be made by
resolution. Commissioner Williams moved to rescind the action of March 15.
awarding the water supply well contract to Virginia Supply and Well Co. Motion
was seconded by Commissioner Carlson and carried unanimously.
Commissioner Carlson moved that Resolution #11-25 be passed and adopted
and the appropriate officials be authorized to execute it. Motion was seconded
by Commissioner Williams and carried unanimously.
ITEM #1 - A pUblic hearing on the request of Walker, et al for Lots 5. 6,
7, 8 Palm Bluff Sub. to be changed from R-IE (single family) to R-4c (multi-
family) zoning. The City Manager read the recommendation of the Planning &
Zoning Board for approval. and explained the request. There were no objecitons.
Commissioner Carlson moved that the request of Norma I. Walker et al to change
R-1E (single family) zoning to R-4c (multi-family) zoning on Lota 5. 6~ 1, 8
Palm Bluff Sub. be approved and the City Attorney be inatructed to include this
in an amendment to the ZOning Ordinance to be brought back to this Commission
for approval as soon as possible. Motion was seconded by COmmissioner Williams
and carried unanimously.
The Mayor read a letter to the Internal Improvement Boardrequesting that
no deeds be issued adjOining uplands on Sand Key in Sections l7~ 18. 19. &
20-29-15 as the City is negotiating for property to be used for park and
recreation purposes. He reported that a reply recommended a resolution out-
lining the City'S objective be submitted to the County Water and Navigation
Authority and the Internal Improvement Board. The City Attorney presented
Resolution #71-26 to accomplish the above purpose. Commissioner Williams moved
that Resolution #71-26 be passed and adopted and the appropriate officials be
authorized to execute it. Motion was seconded by COmmissioner Carlson and
carried unanimously.
ITEM #2 - A public hearing on request from Frederick & Ellen Walbo1t for
Lots 32 and 33. Glenwood Estates Addition to be changed from R-1E (Single family)
to R-3A (multi-family) zoning. The City Manager explained the request and
reported the applicant had revised his request to R-2 (duplex) instead of R-3
(multi-family). The Planning & Zoning Board recommended disapproval of either,
as it is a single family neighborhood and would be spot zoning. The Manager
also reported that 4 objectors had appeared at the public hearing and a letter
from Dr. Cournoyer had been received. Mr. Robert Wilson, attorney representing
the applioant atated that Mr. Walbolt planned to remodel the present building
to duplex and submitted a petition with 6 signatures in favor. Mr. Don Donatel1o.
1536 Drew St. objected and the Clerk read a letter of objection from Dr. Cournoyer.
Mr. Fred Hav~n, 1600 Drew St. spoke 1n favor of duplex. After diScuBB10n on the
matter Comm1Bsioner Williams moved that the request of Mr. and Mrs. Walbolt for
R-3A (multi-family) zoning on Lots 32 and 33. Glenwood Estates Addition be denied.
Be lots do not confor.m to R-2 requirements for duplex. Motion was seoonded by
Commissioner Carlson and carried unanimously.

ITEM #3 - A pUblio hearing on the request from H. L. M., Ino. for Lots 1
to 10 inol., Blook D and Lots 1 to 10 inol~ B100k E, Edenville Sub. to be
ohanged from R-1E (single family) to R-40 (multi-family) zoning. The City
Manager explained the request and reported the Planning & Zon1ng Board recom-
mended denial of applioation without prejudice. Mr. Kenneth Zechiel, projeot
manager, requested amending the application to R-3A and not vacating Evelyn
Ave. He agreed to dedioate 50 ft. for Druid Rd. right of way. ~he City
Attorney reoommended amonding the applioation and returning the matter to the
Planning & Zoning Board for reoonsideration. Commissioner Carlson moved to
aooept the request to amend the applioation from R-4D to R-3A (multi-family).
Motion was seoonded by Comrndaaioner Williama and oarried unanimously.
Commissioner Williams moved to continue this hearing to April 19th, 1971,
at 1:30 P.M., and the matter be reconaidered by the Planning & Zoning Board.
Motion wao aeoonded by Commissioner Carleon and carried unanimously.
ITEM I~ - A pUblio hearing on the request from Cribbs & Ownbey-
(A) Property from Northeast Corner of Northeaat 1/4 Seotion 11-29-15,
run South 666 ft. to a P.O.B., South 60 ft., West 524 ft., North
120 ft., East 27 ft., South 60 ft., East 497 ft. to P.O.B. to be
changed from R-1E (single family) and R-2 (duplex) to R-3A (multi-
family).
(B) Property from Northeast oorner ot Northeaat 1/4 Section 11-29-15,
West 497 ft. to a P.O.B., South 606 tt., West 27 ft., South 143 ft.,
West 133 ft., North 23 ft., West 7 ft., North 60 ft., Beat 140 ft.,
North 60 ft., East 15 ft., North 606 ft., East 12 ft. to P.O.B. to be
changed from R-1E (single family) and R-3A (multi-family) to R-2
(duplex).
The City Manager explained the purpose of the request, that original zoning
did not coincide with proposed plat, a strip of above owner's property on the
South was in City at time of annexation and not rezoned to conform with
proposed plat. He read the recommendation of the Planning & Zoning Board for
approval. Diaoussion ensued. There were no objections. Commissioner Carlson
moved that the request of Cribbs & Ownbey for (A) be a~proved to change R-1E
(Single family) and R-2 (duplex) to R-3A (multi-family) and (B) ap~roved to
change R-1E (single family) and R-3A (multi-family) to R-2 (duplex) and the
City Attorney be instructed to include th1s in an amendment to the Zoning
Ordinanoe to be brought back to this Commission for approval as soon aa
possible. Motion was seconded by Commissioner Williams and carried unanimOUSly.
ITEM #5 - A public hearing on the request of the City for the following:
(A)
Lot 1 less West 10 ft., All Lots 2 to 5 inol, Block C, Norwood 1st
Addn. to be changed from R-4A (multi-family) to R-1D (single family)
Lots 6 and 7, Block C, Norwood 1st Addn. to be changed from R-2
(duplex) to R-lD (single family).
West 10 ft. Lot 1, All Lot 8, Block C; Lot 6, Block 0, and vacated
r/w adjoining, Norwood 1st Addn. to be changed from R-IE (single family)
to R-1D (single family).

The City Manager explained the request and read the reoommendation of the Planning
& Zoning Board for approval. There were no objections. Commissioner Carlson
moved that the request of the City ot Clearwater for R-10 zoning on Items 5 a,
b, c be approved and the City Attorney be instruoted to include them in an
amendment to the zoning ordinance to be brought back to this CommiSsion for
approval as soon as possible. Motion was seconded by CommiSSioner Williams and
carried unanimously.
ITEM #6 - A publiC hearing on the request of the City for Lots 1 to 28 incl.,
BlOck E, Avondale Sub. and Lots 1 to 19 incl., and Lots 24, 25, 26, Black C,
Fairmont Sub. to be changed from R-2 (duplex) to R-10 (single family) zoning.
The City Manager explained the request and reported receipt of a petition in
favor for items 6, 7, 9, 10 of about 30 names. '
ITEM #7 - A publiC hearing on request of City for Lots 1 to 10 ino1., BlOCk
D, Fairmont Sub. to be Changed tram R-2 (duplex) to P (public) zoning. The City
Manager explained it and read the recommendation of the Planning & Zoning Board
for approval.
ITEM #9 - A public hearing on the request of the City for the fOllowing:
(A) Lots 7 to 26 inol., Blook A, Greenwood Park to be changed from B
(business) and R-4D (multi-family) to P (public) zOning. The City
Manager explained the request and read the recommendation of the
Planning & Zoning Board for approval.
(B) Lots 6 and 1( Block 0, Fairmont Sub. to be ohanged from R-2 (duplex)
to P (publio) zoning. The City Manager explained the request and
read the reoommendation of the Planning & Zoning Board tor approval.

There were no objeotions to Items 6, 7, 9A and 98. Commissioner Carlson moved
that the applications of the City for Item 6 to be changed to H-10, and Items
7, 9A and 9B to P (publio) zoning be approved and the City Attorney be instruoted,
to inolude them in an amendment to the Zoning Ordinanoe to be brought back to
this Commission for approval as Boon aa pooaible. Motion was seoonded by
Co~ssioner Williams and carried unanimously.
ITEM #8 - A public hearing on the request of the City for the following:
(A) Lots 6 to 38 incl., Sunnydale Sub. to be ohanged from R-4o (multi-
family) to R-lO (single family) ~oning. The City Manager explained
the request and read the reoommendation of the Planning & Zoning
Board for approval.
Triangular acreage tract lying between Lots 66 to 70 inol., Blook G,
Sunset Point 2nd Addn. and Railroad r/w and North of Lot 29, Sunset
Point Replat to be ohanged from R-4o (multi-family) to R-2 (duplex)
zoning. The City Manager explained the request and read the
recommendation of the Planning & Zoning Board for approval.

There were no objections. Commissioner Williams moved that the applications of
the Cit~, Item 8(A) to be changed to R-1D (single family) and Item 8(B) to R-2
(duplex) be approved and the City Attorney be instruoted to include them in an
amendment to the Zoning Ordinance to be brought back to this Commission for
approval as soon as possible. Motion was seconded by Commissioner Carlson and
carried unanimOUSly.
ITEM #10 - A public hearing on the request of the City for Lots 1 to 6 incl.,
and 27 to 32 inol., Block A; Lota 1 to 11 incl., and 22 to 32 inol., Block B;
Lots 1 to 11 inol., and 22 to 32 incl., Block C, Greenwood Park Sub. - Lots 1 to
16 incl., Block D, Greenwood Park No.2 - Lots 9 to 12 inol., BlOck OJ Lots 18,
19, 20, Block H; Lots 1, 2, 3{ Block J; Fairmont Sub. to be changed from R-4D
(multi-family) to R-2 (dupleX) zoning. The City Manager explained the request
and read the recommendation of the Planning & Zoning Board for approval. Larry
Meyer, attorney representing the Valentine Estate spoke in opposition at the
Planning & Zoning meeting. Commissioner Carlson moved that the application for
zoning change from R-4 to R-2 be approved and the City Attorney be instructed
to include this in an amendment to the Zoning Ordinance to be brought back to
this Commission for approval as soon as possible. Motion was seoonded by
Commissioner Williams and oarried unanimously.
ITEl>t #11 - A pUblic hearing on Zoning Ordinance amendment. Add R-3 use
distriot to Section 26-11 (6) and add subparagraph (d) to limit height of fences
and walls other than retaining walla when built within the front building setback
of residential zone. The City Manager reported that the Planning & Zoning Board
recommended deferment of this item to next quarterly hearing. The City Attorney
recommended denial. Commissioner Carlson moved to deny Item #11 and resubmit it
for the next quarterly meeting. Motion was seconded by Commissioner Williams
and carried unanimously.
ITEM #12 - A publiC hearing on Zoning Ordinance Amendment. Add subpara-
graph (j) to Section 26-6A (3) to prohibit temporary use of parking or open areas
for tent sales area or display area without speoia1 permit from Building Official.
The City Manager reported that the Planning & Zoning Board reoommended approval.
Commissioner Carlson moved that the addition of subparagraph (j) to Section
26-6A (3) be approved and the City Attorney be instructed to include this in an
amendment to the Zoning Ordinance to be brought baok to this Commission for
approval as soon as possible. Motion waB seconded by Commissioner Williams and
carried unanimously.
Commissioner Williams asked that the ordinance refleot that R-4n is a holding
zone and should not be used.
CommiSsioner Williams moved that the meeting be adjourned at 3:15 P.M.
Motion waB seconded by Commissioner Carlson and carried unanimously.
