The City Commission of the City of Clearwater met in special sossion at the
City Hall, 110ndaYt April 13, 1970, at 1:30 P..M., ~ith the fo'11owing members

The Mayor called the meeting to order and announced a public hearing to
consider objections to provisions of Ordinance #1257 concerning extending utility
services, sewe~. watet' and gas, into County areas to be financed by revenue
certificates. The invocation was given by the City Attorney.
The City Manage~ explained the public hearinr. was in compliance with
Section lBO.03 (2), Flot'ida Statutes. He described the agreements with Largo,
Dunedin and Safety Hat'bor setting out se~vice areas in the County. He discussed
the effect of septic tanks as a threat to the watet' supply. He explained the
provisions of, a proposed legislative act which would permit the City to install
sewet' lines and facilities outside the City, to assess the cost to the property
ownet's, the work to ori~inate by a petition of 25\ of the prope~ty ownet's in an
area or if the Pinellas County Health Department notifies the City of existing
health hazardS, then a public hearinn will be held. The Mayor explained these
services would be pt'ovided without annexation being required. Aftet' sewer
service is provided the sut'charge will be 50\.
The City Managet' repot'ted letters of objection from Walter Clausen,
President of the Rural Association, O. H. Endsley, James Thompson, Southern
Comfo~t Mobile Village, and petitions of objection signed by approximately
3400 names.
Mrs. Joyce Kim, 1364 Hamlin Dt'., Keene Acres, complained of serious septic tank
pt'oblems in theit' area. Mr. Bob Sevier, Sunset Gardens Home Owners Association,
said they are in favot' of the proposed bill. Mrs. Earle A. Deily, 1909 Nugget
Dr.. complained of odors from drainane from septic tanks in Woodmont Park.
The City Manager stated Mr. Harold Leadbettet' and Mr. Vet'non Fraser, Pinellas
County Health Dept. were present and would t'epo~t later. Mr. James McHoul,
Bellerose Pat'k, whose propet'ty was on Lat'p,o sewer taken ovet' by Clearwate~ asked
about charges. The City 11anap,er explained because of different systems and
financing there would be different rates. The Citv Manager gave the Deputy ,
Clerk a letter of objection ft'om John Rankin, Woodmont Park.
Hr.Wm. Duke, Briley, Wild 6 Associates, explained all utility extensions
and improvements ~n the past 20 years had been financed by utility revenue
cet'tificate-issues. He suggested the surcharge could be considered similar to
t'ent.
Hr. Harold Leadbetter, County Health Dept., spoke of dangerous situations
in several areas where septic tank effluent on ground was going into ditches.
Mr. Vernon Fraser, County Health Dept., stated the following areas were having
difficulties: area no~th of Overb~ook west of Betty Lane, East of DOUBlas Ave.,
Woodmont Park, Douglas Manot', Keene AC1~es, Kapok Forest and othe~s.
Mr. Paul Rettig, representing City Engineet', estimated cost of sewer at
$4.50 to $5.00 per front assessable foot at present time. The City Manager said
the procedure would be similar to that used in the City of advertising for bidS,
letting the contt'act, assessment resolution and that payment could be made in
full at time of assessment or annual payments over ten years at 8%.
Mr. Joseph Clat'k, ~epresenting Tropic Hills ASSOC., said they have sewer but
are an enclave within the City and what would happen if the City decides to take
over the sewer system. The City Manager stated that would only be if the system
did not meet State standards and then it would be on a negotiated basis.
Mr. John Rankin, Woodmont Park, discussed Ordinance 1257 and proposed
legiSlative act. The City Manager explained the County plans provide for the
c~ntral Pinellas ,at'ea to be served by the Cleat'water sanitary se\olel" system. The
C~ty Attorney stated the gas and watet' systems would be extended only if needed.

'Mr. Arnett Borth ,Woodmont Park, spoke in favol', Hr. Walter H., Clausen. .
President, Rural Assooiation, agreed with the City Manager regarding the need for
better oommunications. He thought the rates for Clearwater public utilities were
too high and compared them with Largo and the County. He thouRht in the proposed
public hearinns the percentage of property OHnera in favor should be 50\ plus 1
instead of 25\. The City Manager pointed out Largo does not have secondary
treatment at its sewer plants bu~ they are in the process of oorreoting tha~,
Commissioner Hall left at this time.
Hr. Steve Forgacs, 1400 Regal Rd., spoke of area between Browning,'Lakeview
and Hilton Streets needinr. sewer at an estimated cost of $4.52 per front assessable
foot. Mr. Rottin said if the proposod len!slatlve bill passed it would only
require 25\ of the property owners' approval at the publio hoarinp, for sewer.
Mrs. ,Charlene Stafford, 3053 Hoyt' Ave,. Kapok 'ferrace, spoke of sewer plant
on Gulf to Bay near l1aines Rd. emitting a b-'.d odor. The City Manager said
expansion has just been completed there because plant waG experiencing delMnds
almost beyond its capacity. He said they have taken Gtep~ to correot the odor
and the City does exceed State standards.
At 4:00 P.li. Sgt. JaB. Shaffer replaced Sgt. Daniels.
r-tr. John Forsander, 1448 Temple St., in rural area read a letter he wrote to
Don Stafford, legislative representative from Pinallas County, and stated he thought
sewers can be more reasonably furnished by Pinallas County or Largo. Hrs. Wm. F.
Carlson, 1300 Viewtop Dr., Douglas I~nor asked about sewer installation costs and
spoke of a drain-lge problem at Fairfield and Lakevienl which the City Nanager agreed
to check. Mr. Robert H. Cameron, N. Betty Lane, asked if sewers would be installed
in the road, or at rear of property. The City Hanauer caid it would be whichever
was more economical.
Hr. Robert Carroll, attorney for the Rural Association, asked for more
speoific information such as the revenue certificates or debentures to be issued
are only vaguely described and cost of three types of utilities is lumped rather
than cost estimate fOr each, and proposed utility is not definite as to more gas
and water expansion. The C~ty Attorney stated the next ordinance adopted after
the 40 day period would be more specific and give more detailed plans. The City
Manager suggested a resolution be prepared ans\~erine as many of these questions as
possible and giving a statement of policy. The Mayor suggested the City Manager
hold group meetings with the leaders of the various organizations in the County
for better communication.
Mr. John Forsander asked about surcharges and agreements and costs, in Kapok
Terrace. Mr. Ray Weatherford, 1426 Eastfield Dr., spoke in favor of sewer and
favored spending money on direct advertising to get the correct information to
the affected property owners. Mrs. Earl ArnOld, 1443 Rose St., asked if sewer'
service charge costs would continue to p,o up like the water rates in Highland
Lake area. The reply was that if costs go up rates would also.
Commissioner Hall returned at 4:45 P.M.
Commissioner Williams moved that the Commission, having heard the conver-
sation and points brought up at this meetinr., reaffirm the action taken March 16,
1970, in passing Ordinance #1257 and further instruct the City Nanager to meet
with as many of the representatives of the rural areas as may be practioal to
clarify the City's terms and then prepare a resolution that would state exactly
the City's position and that no further action on the part of the City or
implementation of Section 180 would be undertaken until such resolution is
prepared and adopted by this Commisaion that implementation won't proceed any
further as allowed by the State Legislature. Motion was seconded by
commissio~er,Hall a~d ~arried unanimously., ~
