" ex J?rr CITY COMMISSION MEETING September 2, 1969 The City Com~iBsion of the City of Clearwater met in regular session at the City Hall, Tuesday, September 2, 1969 at 1:30 P.H., with the following members present: ' ' 11. The invocation was Riven by Reverend McBride, Skycrest Methodist Church. ~Commissionar Williams was late arriving, as, he attended the funeral of Ur. James Fred Campbell. The City Attorney read Resolution #69-102 expressinc condolence to the family of Mr. James Fred Campbell. Commissioner 1113.11 moved that Resolution 669-102 be passed and adopted and the appropriate officials be authorized to execute it. Hotion was seconded by Commissioner Carlson and carried unanimously., Commissioner Carlson moved that the minutes of the regular meeting of August la, 1969 be approved as recorded and as submitted in written summation by the Clerk to eaoh Commissioner. Motion was seconded by Commissioner Hall and carried unanimously. The City Hanager reported receipt of a request from Donald Lauzon to continue his application of JUly 21, for public hearing on annexation and zoning of Horth 1/2 of Southwest l/~ of Northwest 1/4 less North 165 ft. and lass West 100 ft. Section 5-29-16 with MH (mobile home park) zoning and Fire Distriot No.2 classi- fication,thereon, to October 6, 1969. Commissioner Carter moved that ITEM 1 a. annexation and zoning of East side of US 19, about 300 ft. N of SR 588 be continued as requested to October 6, 1969, at 1:30 P.I1. Motion Has seconded by Commissioner Carlson and carried unanimously. The City l1anager announced a public hearing on the request of Riohard L. Kamensky, as Trustee, for annexation and zoning of Northeast 1/4 of Northwest 1/4 less road right of way in Section 1-29-15, with the West 250 ft. as R-4 (multi- family) zoning and the balance as Mil (mobile home park) zoning. Hr. John Bonner, attorney representing Mr. Kamensky, stated that the property to the South is before the County September 9th, for zoning and with this in mind requested that this application be further continued to October 6th. Mr. Lewis Bowman, Montclair Lake Estates stated that while it was an inconvenience to the people who were present at this time.to have the matter continued fUI"ther they offered no serious objection. Commissioner Carter moved that this public hearing ITEM 1 b. for Kamensky property be continued to October 6, 1969, at 1: 30 P .11. Motion was seconded by, Commissioner Carlson and carried unanimously. The next item was a public hearing on the request ot Pat Moore for annexation and zoning of South 1/2 of Southwest 1/4 of Southwest 1/4 Section 36-28-15 with R-IC (sinRle family) zoning and Fire Distriot No.2 classification thereon. The Planning & Zoning Board reoommended approval and dedication of 50 ft. or 1/2 R/W fo~ Keene Rd., 33 ft. or 1/2 R!W fo~ Union St. and 33 ft. or 1/2 R/W for connection to Beechev Rd. from Union St. when platted. Hr. Donald McFarland, attorney representing Hr. Moore agreed to SO ft. for Keene and 33 ft. for Union St. and had no Objections to the Planning & Zoning Board's recommendation. There were no objections. Commissione~ Cal'ter moved that the application of Pat 1100re be approved subject to dedication of R/W requirements as recommended, with R-1C zoning and Fire District No. 2 classification and the City AttoI'ney be instructed to include this in an ordinance to be brounht back to this Commission for approval as soon as possible. Motion wa$ seconded by Commissioner Hall and carried unanimOUSly. The next item was a public hea~ing on the request of Kent Contractors, Inc., for annexation and zoning of Lots 28 and 29, Block A, Zephyr Gardens and Lot D, ' Brentwood Estates Sub. with R-4D (multi-family) zoning. The Planning & Zoning Board recommended approval. Mr. William Knight, officer of the Corporation, was present and explained the proposal and stated the Corporation is trying to purchase Lot 27, Block A. There were no objections. Commissioner Carter moved that the application of Kent Contractors, Ino. for annexation and zoning of property described with R-4D (multi-family) zoning and Fire District Classifioation No. 2 be approved and the City Atto~ney be instructed to inolude this in an ordinance to be brought back to this Commiseion for approval as soon as possible. Gillenwaters T~ustee. fo~ annexation and zoning of South 225 ft. of No~th 834.8 ft. of the West, 330 ft. of the East Q30 ,ft. of Section 19-29-16, with B (business) zoning and Fire DiBt~ict No.1 classification thereon. It is now zoned County Commercial. The Planninp. '& Zoning Boa~d recommended approval. M~. W. O. Gillenwate~s was present' and explained the property would be uaad for a 200 seat ~eBtaurant. He agreed to screening on the West and approved the p~oposed plana for subsurfaoe drainage.: He fur:the~ approvod the recommendation of the Planninp, & Zoning Board to include annexinn part of Tropic Hills Dr. and explained that the restaurant would be toward the front of the property with pa~king to the rear. Mr. Paul Rettig, City Enginee~ing Department, explained the proposed dralnaRo plans. Mr. Frederic Hunt, Japaneao Ga~dens Hobile Homes Est. explained that Tropic Hills Dr. is directly opposite the entrance to Japanese Gardens with a highway crossove~ at this point and objected to tho annexation of Tropic lIills Dr. because of the traffic p~oblem and further presented a petition signed by approximately 80 persons from Japanese Gardens. It was explained that probably the State Road Department would have to approve the 'plans also. tlr. Alexander Portegal, 1223 Eve~glade Rd. stated the Tropic Hills residents we~e not aware of the annexation of Tropic Hills Dr. and recommended deferring this part of the request at least. 2:45 P.M. t1ax Battle, City EI"Ip,ineer ~eplaced Paul Rettig at this time. Captain Brnest Wichelns replaced Captain,Elwood Lomax at this time. 2:50 P.M. Commissione~ Williams arrived at this time. Mr. C. Phillip Amendt, Jr., 2477 Brentwood Dr., President of Tropic Hills Property Owne~s Association stated the directors met and voted a to 1 in favo~ of no objection to the annexation. Mr. Carl E. Wolf, 1234 Grenada Ave. stated the block captains present at the meeting had not contacted the people for thei~ ~ecommenda- tions. Hr. William Hansfield, 1246 Burma Dr. objected to annexing 1'~opic Hills D~. Commissioner Carter admitted the~e was a traffic oroblem but felt that in the best interest of everyone concerned the property be annexed without including Tropic Hills Dr. Commissioner Carter moved that the application above described be approved with B (business) zoning and ri~e District No. 1 classification and the City Attorney be instructed to include this in an ordinance to be brought back to this Commission for approval as soon as possible. Hotion was seconded by Commissioner Hall and ca~ried unanimously. The Mayor repo~ted receipt of a letter from Attorney Robert Tench, commending the Fi~e Department fo~ thei~ fast action when he had a fire in his home recently. The t1ayor repo~ted receipt of a lette~ from the Governor of Alabama for p~oclamation in regard to hurricane Camille. M~. Elliott Stern, President, Junior Chambe~ of Commerce spoke about a ~eport the Junio~ Chambe~ had compiled t'Communi ty Attitude Surveyll. l1r. Joe \<lolfe, J~., first Vice-President, explained the repo~t and passed out copies. He asked that the City have the su~vey printed fo~ distribution. Upon the request of the Hayor it was agreed to deviate from the agenda to hea~ ITEI1 No.6, ItEstablishing Date for Special Election re Housinglt. The City l-Ianager reported that a letter from l11as Hilda Cook, Supe~visor of Elections, stated that November 25th Has the ea~liest possible date the City could schedule a special refe~endum election. Commissioner Carter moved that Novembe~ 25th~ 1969 be approved fo~ a special referendum election fo~ the Clea~water Housing Authority and the City Clerk and City Attorney and any othe~ appro?riate depa~tment take whateve~ action necessa~y to conduct said election. Hot ion was seconded by Commissione~ Williams and ca~ried unanimously. The City Hanager presented a ~equest for autho~ization to enter into an agreement with Al Rogero for sanita~y sewers in Clea~water Trailer City, 1650 Clearwater Largo Rd., which is South of Belleair Rd., the City limit. He stated that Largo was agreeable for Clearwate~ to provide this se~vice until they are in a position to do 50. Commissioner Carlson moved that the ag~eement be approved subject to plant capacity and the proper officials be autho~ized to execute it. Moticn was seconded by Commissioner Carte~ and car~ied unanimOUSly. The City Manager presented the plat of Parkwood 5th Addn. and recommended approval. Commissioner Williams moved that the plat be approved as ~ecommended and the proper officials be authorized to execute it. !10tion was seconded by Commissioner Carter and ca~~ied unanimOUSly. The City Hanager explained a p~oposed sidewalk ordinance on unimproved property abutting public highway, except in residential a~ea it may be waived by the City Manager and/o~ appeal to Commission. 'Tho City Manager recommended accepting the bid of Connol1dated Pipe &1 Supply,' Birmingham, Alabama, t'or' 20,000 ft. 2" black steel pipe. Commissioner Oarloon movod upon the recommendation of the City Manager that the contract be awarded to Consolidated Pipe & Supply', for the oum of *8,016.40, which io the lowest and beat possible bid and that the appropriate officialu of the City be authorized to execute said contract which shall be 1n accordance with the plnns and specifications and bid. Motion was seconded by Commiouioner Carter and carried unanimously. The City Manager reoommended the bid of Reevea FenceD Inc., which wan the only 'one received, for 6 ft. chain link fence for the City Nuraery. Commissioner Carlson moved upon the recommendation of th~ City Mana~erthat the contract be awarded to ReeveD Fences, Inc'J Tampa, for the sum of ~2,075.00, which is the lowest and best responsible bid and that the appropriate officials be authorized to execute said contract which ahall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Williams and carried unanimously. The City Manage~ reported that the Library Study was completed with recommenda- tions, and that copien of the report would be given to the Library Board and the City Clerk's office. The City Attorney presented Ordinance #1213 amending Section 13-16 of the Code, schedule of license feeB.
