MtETING Augu,st 30, 19GB The City Commission of the City of Clea1"water, met in special session at the City Hall, Friday, August 30th, 1968, at 2:00 P.M. ,with the following membe1"s present: " ' " ,H. Stierheim Herbert M, Brown Frank Daniels City l1anager City Attorney Police Chief The Mayor called the meeting to order. The invocation was given by the City Attorney. The HayoI' announced that the meeting was called to consider adopting Ordinance #1166 amending Chapter 4, City of Clearwater Code, 1962. The City Attorney reported that waiver of notice of meeting had been signed by all . Commissioners and Hayor, with the exception of Commissioner Donald Williams who was 'on vacation. The City Attorney read in full on its first t~ading Ordinance #1166 amending Chapter 4, Alcoholic Beverages, City of CleaI'water Code, 1962, by adding Section 4-22 making it unlawful' to allow any person under 21 years, unless accompanied by his parents or legal guardian, to patronize any dance hall or. other place of entertainment where any alcoholic beverage is allowed to be consumed on the premises and which does not hold a valid alcoholic beverage license permitting sale and consumption on said premises. Commissioner Blackstone moved that Ordinance #1166 be passed on its first reading. Motion was seconded by Commissioner Carlson. The City Attorney, Herbert M. Brown, briefed the City Commission on the legal aspects of this ordinance pointing out the lack of specific reference to this type of business activity under the State law and City ordinances. Upon inquiry from Mayor Hougen, the Chief of POlice, Frank DanielS, and City Manager Merrett R. Stierheim recommended that the City Commission adopt this ordinance. . The City Attorney recommended its approval as an emergency measure with three readings today. Upon the vote being taken, the motion carried unanimously. Commissioner Blackstone moved Ordinance #1166 be read and considered on its second reading by title only with the unanimous consent of the Commission. Motion was seconded by Commissioner Carlson and carried unanimously. The Ordinance was read by title only. Commissioner Blackstone moved Ordinance #1166 b~ passed on its second reading by title only. Motion was seconded by Commissioner Carlson and carried unanimously, Commissioner Blackstone moved Ordinance #1166 be read and considered on its third and final reading at this meeting of the Commission by unanimous consent of the Commission. Motion was seconded by Commissioner Carlson and carried unanimOUSly. The Ordinance was read in full. Commissioner Blackstone moved Ordinance #1166 be passed on its third and final reading and adopted and that the appropriate officials of the City be authorized to execute it.
