Conmdssioner Roberts moved that Commissioner Strang be appointed Acting Mayor. Motion was seconded by CO~lussioner Bohannon and carried unanimously. The Clerk presented a letter as provided in Section 101.57 Florida Statutes ~rom ~'. Alex D. Finch protest1ng the electlon retux'ns as a qualified elector in Precinct 42 stating that he believed the election returns of Precincts 37A, 39, 40, 42A in the City Election held on December IS, 1956, were erroneous and fraudulent and requesting that such returns be investigated, the basis for the protest being that the tally sheets used by the c1erlts and inspectors were inwroperly totalled. The City ATtorney stated it was the obligation of the Commission acting as the Canvassing Board to examine the counters on the voting machines in such precincts to find whether the returns correctly show the vote cast. The Attorney reported at present the machines were in the process of being transported to the official storage place at the Pinel1as County Airport. Commissioner Bohannon moved that the Commission :Collow the recommendation of the City Attorney and meet at the Airport at 4:30 this afternoon, December 19th, to checl\: the numbers on the machines and to reconvene at 1:30 P.M. Thursday, December 20, 1956. Motion was seconded by Commissioner Roberts and carried unanimously. The City Attorney reported that in Precincts 37A and 42A instead of making duplicate copies of the total returns from two machines, one copy had been used for the totals o~ one machj.ne and the other copy was used for the totals of the second machine but all were properly si~ned and it was his opinion that it was not such an objection that would void the election since it was simply a matter of adding the two reports. Motion was seconded by Commissioner Insco and carried unanimously. The Mayor inquired if there was any objection to proceeding to canvass the absentee ballots and there waa none. The Clerk presented twenty-eight ballots received bef"ore the official deadline o~ 5:00 P.M. Monday, December 17th, 1956, and three ballots which were received after the deadline, two on Tuesday, December 18th, and one on Wednesday, December 19th. Commissioner Roberts moved that the three absentee ballots certified by the City Clerk to have been received after the legal deadline for receivlng absentee votes be rejected and held for the prescribed time according to law. Commissioner Insco moved that the report of the election officials be sealed and in the custody of the City Clerk until such a time as we meet at the Airport to check the machines and that the Canvassing Board meet here at the City Hall at 4:00 P.M. with the City Clerk and the City Attorney to go to the Airport to check these machines and that the Commission use.the transportation of the Police Chief's car and an additional car from the Police Department and all go together in one body. Motion was seconded by Commissioner Roberts and carried unanimously. The Manager submitted a recap of the street resurfacing program showing the amount of cash committed to street resurfacing and white way lighting already authorized and the estimated amount of cash available by March 15, 1957. The report included a list of streets which the City En~ineer recommended to be resurfaced first with an estimated total cost of $35,018.65 as follows: N. E. Cleveland Street from Cleveland to Drew Highland Avenue from Cleveland to Palmetto Missouri Avenue from Court to Cleveland Princess Street from Fort Harrison to Sunset Court Duncan Avenue from Gulf to Bay Boulevard to Drew Street Pinebroolc Dri ve from Palmetto Street to Kings Highway Admiral Woodson Lane from Pinebroolc to Kings Highway Hibiscus from Pinebrook to Kings Highway There was also included a separate list of six other streets on which an estimate had not been made but it was thought by the Engineer that they should have priority next. Commissioner Insco asked the Engineer what the history of Park Street was between Myrtle and Greenwood. The Engineer replied that this section had been built of concrete with a muck bottom to it, that the only way to improve it would be to dig the paving up, dig the muck out, replace it with stabilized soil and then put the paving on it. The Engineer was requested to estimate the cost of rebuilding Park Street in this section. The Engineer was also instructed to check Bay, Oak, Turner, Pine, Gulf View Boulevard and some of the streets in the Belmont area to see if they should be included in the resurfacing program. Commissioner Insco moved that the Engineer be authorized to advertise for bids on the list as submitted with the estimated cost of $3~018.65. Motion was seconded by Commissioner Roberts and carried unanimously. The Manager reported receiving a letter from the State Health Board concerning the City supplying water to developers of Sunset Highlands and other subdivisions in the area of Highland and Sunset Point Road outside the City limits, stating that the Health Board is holding up approval of the plats until that is determined. He stated on Briley Wild's overall program it was planned to install a twenty inch main in Sunset Point Road when money is available. It was pointed out that the proposed subdivisions were outside the City limits and could not be annexed as they were not contiguous to the City limits. The Engineer reported when the matter was considered before it was planned to extend the existing main from Highland Avenue. By consent, the matter was taken under consideration to be discussed with the Engineer, Manager and the Attorney. The City Attorney requested that Item 5, Resolution approving Street Names, be deferred. Resolution 56-40 was read authorizing payment of $24,668.00 to Briley, Wild and Associates for services in connection with plans for the Marshall Street Sewage Plant Addition and other projects. Commissioner Insco moved that Resolution 56-40 be adopted and the proper officials be authorized to execute it. ' 4 -3- CITY COMMISSION MEETING December 19, 1956 The Manager presented the plat of Druid Manor and stated that it had been approved by the Zoning Eoa~d, the City Engineer and the City Attorney. He reported the developer, Mr. O. W. Allen, had signed an Ordinance 632 contraot, had posted bond to cover improvements, and is requesting that the south 130 reet of the plat be brought into the City. The City Attorney was instructed to prepare an Ordinance to aocomplish this annexation. Commissioner Roberts moved that the plat of Druid Manor Subdivision be approved since all requirements or the City in connection with the subdiviSion plats have been met and the bond posted, and the proper ofricials be authorized to sign the contract and the plat. Motion was seconded by Cornmdssioner Insco and ca~r1ed unanimoUSly. Resolution 56-41 was read authorizing the expenditure of $250.00 rrom the Special Events Fund for an inaugural parade rloat to be sent to Tallahassee represent- ing C~earwater. Cornmdssioner Roberts moved that Resolution 56-41 in the amount or $250.00 be approved for sending the float to the Governor1s Inauguration. Motion was seconded by Commissioner Insco and carried unanimously. A final statement of $7,135.05 from Clearwater Construction Company was presented for the remodeling or the Municipal Auditorium. Commissioner Roberts moved that the final bill on the remodeling of the City Auditorium rrom the Clearwater Construction Company in the amount or $7,135.05 be approved and the proper ofricials be authorized to complete the transaction subject to the rinal certiricate or approval from the Architect. Motion was seconded by Commissioner Insco and carried unanimously. A statement was presented rrom Wakeling & Levison, Architects, for $512.83 for services in connection with the l'emodeling of the Municipal Auditorium. Co~ssioner Roberts moved that the balance of the Architect's ree of $512.83 for the remodeling or the Municipal Auditorium be app~oved and the proper officials be authorized to complete the transaction. Motion was seconded by Cornmdssioner Insco and carried unanimously. The financial statement covering the Women's World Softball Tournament held in Clearwater last September was presented showing a loss of $3,241.10 toward which the City had already contributed $2J244.6~ and authorization of payment of the balance of $996.46 was asked. During the discussion, it was brought out that Mr. R. H. Hall, sponsor of the R. H. Hall team of St. PeterSburg, the host team~ had ofrered to pay a share in the dericit if there was one. By consent, the Manager was instructed to discuss this with Mr. George Shead, the Chairman of the Tournament. In regard to the suit riled on November l5~ 1956, by ~~. Larry Dimmitt against the C~ty because of the Building Inspector's refusal to issue a Duilding permit for 510 Pine Street, the City Attorney reported that he had planned to use as his defense the fact that Mr. Dimmitt had not filed a written application for a permit on this property, but on December 17th, Mr. Di~nitt filed a written application with the Building Inspector for this property which was refused and he has filed a new suit on this date. It was the City Attorney's opinion since the area was zoned as Business property on that date that the City nOi~ has no defense as the applicant was entitled to issuance of a perndt on December 17th but was not prior to that date as he had not made a complete applicatIon. On the basis of the City Attorney's recommendation, Commdssioner Roberts moved that the City Building Inspector be instructed to issue the permit ror the Duilding requested DY Mr. Dimmitt on 510 Pine Street and instruct the City Attorney to make a return to the Circuit Cou~t indicating that the building permit has been issued. Motion was seconded by Commissioner Insco and carried unanimOUSly. Commissioner Insco requested that the report or the Parks Committee meeting with the Ma~ont Association be placed on the next agenda. By consent, Commdssioner Bohannon was excused from the meeting of December 31st. Commissioner Insco moved that the Commission hold a regular meeting on December 31st, 1956, at 1:30 P.M. Motion was seconded by Commissioner Roberts and carried unanimously. By consent, the Manager was instructed to notify the Civil Service Board that the position of Fire Chief will be open for re-examination and ex~ninations should be held in the near future. Commdssioner Insco moved that the meeting be recessed to 4:00 P.M. Motion was seconded by Comrrdssioner Bohannon and carried unanimously. R. Hi~ty and in that instance the precinct return indloates that this cand1date received thirty seven more votes than are shown by the counters on the machine. Commissioner Bohannon moved approval of the election results as corrected by an examination of the voting machlnes and by actual count of the absentee ballots that the canvass of the votee be declar~d official and that the election results be declared official including the passage of the Ordinance 726. Commissioner Insco moved that Resolution 56-42 be passed and adopted and the proper officials be authorized to execute it, and that the Clerk be instructed to send copies to the workers. The Manager announced for the information of the Commission that the City Hall would be closed on December 24th. By consent, this was approved. Finch protesting the election returns as a qualified elector in Precinet 42 stating that he believed the election returns of Prec�nets 37A, 39, 40, 42A ln tt�e City Election held on DecEmber 1$, 1g56, were erroneous and frauduler�t and requestin� that such returns be investigated, the basis for the protest being that the tally sheets used by the clerl.s and znspec�ors were improperly totallad. �nE Ci.ty ATtorney stated it was the obligation of the Commission acting as the Car.vassing Board to examine the counters �n the voting machines in such precinets tc f3�nd whether the returns correctl� shov�l the vote cast. The Attorney reported at present the machines were in the process of being txansported to the official storage place at the Pinellas Counz� Airport. Commi�sioner Bohannon moved that the Commission follow the recommendation o£ the City Attorney and meet at the Airport at 4;30 this afternoon, December 19th, to check the numbers on the machines an@ tc reconvene at 1:30 P.M. The report ineluded a list of streets which the City En ineer recommended to oe resurfaced first with an estimated �otal cost Df $35,01�.65 as follows: N. E. Cleveland Street from Cleveland to Drew Highiand Avenue from Cleveland to Palmetto Misaouri Avenue from Court �o Cleveland Princess Street from Fort Harrison tn Sunset Court Uuncan Avenue fram Gulf to Bay Boulevard to Drew Street Pinebrook Drive from Palm�tto Street to Kings Hi�hway Admiral Woodson Lane i'rom Pinebrook to Kings Highway Hibiscus from Pinebrool� to Kings Highway There was also in�luded a separate list o:f six other streets on which an estimate had not been made but it v�as thought by the Engineer that they should have �riority next. Commissioner Insco asked the Engineer what the history oi Park S�reet was between Myrtle and Greenwood. The Engineer replied that this szction hta.d been built of concrete with a muck bottom to it, that the only way to improve it would be to dig the paving up, dig i,he mueic out, replace it with stabilized so`11 and then put the paving on it. The E,hgineer was requested to eat3mate the cost of rebuilding Park Street in this seetion, The Engineer was also instructed to check Bay, Oak, Turner, Pine, Gulf View Bo��.levard and some oi the streets in the Belmont area to see if they 5hould be included in the resurfacing program. �ornmissioner Insco moved that the Engineer be authorized to advertise for bids on the list as submitted with the estimatea cost of ��5,018.65. The M�nager reported receiving a letter from the State Health Board concerning �he City supplyin� water to developers of Sunset Highlands and other subdivisions in the area of Highland and Sunset Point Road outsieie the City limits, stating that the Health Board is holding up approval of the plats until that is determined, He stated on Briley Wild�s overall program �t was planized to install a twenty inch main in Sunset Point Road when money is available. It'was pointed out that the proposed subdivisions were outside the Ci�y limits and could not be annexed as they were not contiguous to ths City limits. The Engineer reported when the matter was cqnsidered before it was planned to exte��d the existing main from Highland Avenue. By consent, the matter was taken tznder cons3.deration to be discussed with the Engineer, Manager and the Attorney. W. Allen, had signed an Ordinance 632 contract, had posted bond to cover improvements, and is requesting that the south 130 feet of the plat be brought into the City. Commissioner Roberts moved that the plat of ISruid Manor Subdivision be approved since all requlrements of the City in connection with the subdivisior plats have been met and tke bond posted, and the proper officialr� be authorized to sign the contract and the plat. During the discussicn: it was brought out that Mr. R. H. Hall, sponsor of the R. H. Ha11 team of St. Petersbur�, the host team, had offered to pay a share in the deFicit if there was one. By consent, the Manager was instructed to discuss this with Mr. George Shead, the Chairman oi' the Tournament. In rega�d to the suit filed on November 15, 1956, by P�.r. Larry Diinmitt again�t the City because of the Bui�ding Inspector's reiusal to issue a building permit for 510 Pine Strest, the Qity A�torney reported that he had planned to use as his defense the fact tha� Mr. Dimmitt h d not filed a written application f'or a permit on this property, but on December 17th, Mr. Dimmitt iiled a written application with tne Building Ir_spector f'or this property which was resused and he has filed a new suii on this date. It was the City Attorney's opinion since the area was zoned as Business property on that date that the City notn* has no defense as the applicant was entitled to issuance of a permit on December 17th but tvas not prior to that date as he had not made a complete application, On the basis of the t;ity Attorney's recommendation, Commissioner Roberts moved that the City Building Insgector be instructed to �ssue the permit for the building requested by Mr, Dimmitt on 510 Pine Street and instruct the City Attorney to make a return to the Circuit Court indicating that the building �,ermit has been issued.
