Commissioner Bohannon moved that Comnctssioner Strang be appointed Acting Mayor. Motion was seconded by Commissioner Insco and carried unanimously. The invocation was given by the Reverend Robert Cochran of Peace Memorial Presbyterian Church, Clearwater. The Acting Mayor asked if there were any additions or corrections to the minutes of November 5th and 13th. Commissioner Insco stated that the number of mimeographed copies of the approved restrictions for the Industrial Park should be 100 instead of 500 as referred to in the minutes of November 5th in Paragraph 1, Page 345. Commissioner Bohannon moved that the minutes of the regular meeting of November 5th and the special meeting of November 13th be approved as mnended in accordance with copies furnished each member in writing SUbject to any corrections by Mayor Brown. Motion was seconded by Con~issioner Roberts and carried unanimously. The Manager asked that the Commission consider the financial statements and survey made by Price Waterhouse & Company and introduced two Price Waterhouse representatives, Mr. Q. M. Mercer and Mr. Milton Handelman. Mr. Mercer reported that the financial condition of the City had been reviewed by their firm and that under Phase 2, the report as a result of a survey of systems, recommendations on administra- tive procedure changes were made. Commissioner Bohannon moved that both of these reports be received for study and recommended a meeting of the Commission to go over them after the Commissioners have a chance to analyze them. Motion was seconded by Commissioner Insco and carried unanimously. The City Manager reported that two bids had cruisers with a trade in of two 1955 Ford 4 door Larry Dimmitt, Clearwater Ken. & Strickland, Clearwater been received for sedans. The bids -rrad~- /1'1 $1300.00 - 1100.00 two new police were read as follows: ne/::; $2102.52 2393.36 $3402.52 3493.36 After tabulation, the City Manager recommended accepting the bid of $2,102.52 from Larry Dimmitt, Clearwater. Commissioner Insco recommended that the sarne kind of cars be purchased so there would be standard equipment and it would not be neceasa~ to send the cars out from the City Garage for specialized repair work in different shops. There was a discussion as to whether this could be accomplished under the competitive bidding system. Conmdssioner Roberts moved that the Commission accept the bid of Larry Dimmitt for two police cruisers as the lowest and best bid. Motion was seconded by Commissioner Bohannon. Upon the vote being taken, Co~ssioners Roberts, Bohannon and Strang voted "Aye". Commissioner Insco voted "No". Motion carried. Comm:1.ssioner Insco explained his vote by referring to his previous recommendation regarding standardization. Regarding the bids for one 10 inch and one 20 inch pressure reducing valves, the City Manager stated that based on the recommendation of Briley, Wild and Associates, he recommended awarding the bid to Ross Valve Company, Troy, New York, as the best and lowest bid in the amount of $3,146.50. Commissioner Bohannon moved that the proper City authorities be authorized to place an order with Ross Valve Company, Troy, New York, in the amount of $3,146.50. Motion was seconded by Commissioner Roberts and carried unanimously. The Mayor announced a Public Hearing on the paving of Yelvington Avenue from Gulf to Bay Boulevard to Druid Road and Turner Street from Yelvington Avenue to Keystone Avenue. The Engineer reported that the work was requested by petition from the property owners and the owners present at a preliminary hearing were in favor or the project. He stated that he had presented an estimate of $3.32 per front foot at the preliminary hearing but upon recalculation, the estimate is now $3.90 per front root. The Mayor asked if there were any objections and there were none. After having held this Public Hearing and hearing no valid objections, Commissioner Bohannon moved that the proper City offioials be authorized to proceed with the paving ot Yelvington Avenue from Gulf to Bay Boulevard to Druid Road and TUrner Street from Yelvington Avenue to Keystone Avenue. The City Attorney read the request and the Zoning Board'a reoommendation that a setback of 11 feet 7 inches from Eldorado be granted. ~he Mayor inquired if there were any objections and there were none. After the Public Hearing and considering the recommendation of the Zoning Board, Comndssioner Roberts moved that the request of Maurice M. Condon on behalf of Herman H. Barbour be denied but that the recommendation or the Zoning Board to the effect that he be granted an 11 foot 7 inch building setback line from E1dorado Avenue be granted. Motion was seconded by Conmdssioner Bohannon and oarried unanimously. A Public Hearing was announced on the request of Mr. C. E. Jaokson for a six foot setback from Eldorado Avenue and a six foot setback from Gardenia Street for Lot 1, Blocl<: 7, Mandalay Subdivision. The Oi ty Attorney read the request and the Zoning Board's recommendation that a setbaok of 11 reet 7 inohes from Eldorado Avenue and a 14 root setbacl<: from Gardenia Street be granted. The Mayor inquired if' there were any objections to the setbacks proposed by the Zoning Board and there were none. Motion was seconded by Commissioner Bohannon and carried unanimously. A Public Hearing was called on the request of Mr. Lewis Homer for Mrs. O. E. Wickman for a six foot three inch setback from Sunset Drive and a three foot setback from the north side lot line for Lot 46, E. A. Marshall Subdivision. ~he City Attorney read the request and the Zoning Board's recommendation that a setback of 6 feet 3 inches be granted. Commissioner Insco commented that he thought the recom- mendations of the Zoning Board should also set out the reasons ror the recommendations. Commissioner Bohannon concurred in this suggestion. It was explained that the recommendation of the Zoning Board was in accordance with the drawing attached to the request. The Mayor inquired if there were any objections and there were none. Comndssioner Bohannon moved that the request from Mr. Lewis Horner for Mrs. C, E. Wickman f'or a six foot three inch setback f'rom Sunset Drive and a three foot setback from the north side lot line ror Lot 46, E. A. Marshall Subdivision, be granted and the proper City officials be authorized to grant it. Motion was seconded by Commissioner Roberts and carried unanimously. A Public Hearing was announced on the request of Mr. Henry Mueller for R-4 uae of Lot 9, Block C, Suburb Beautiful Subdivision, the property being presently zoned R-2. The City Attorney read the request which indicated that Mr. Mueller had constructed a motel on Lots 4, 5, 6 and 7, Block C, and would like to construct multiple units on Lot 9 which adjoins the other lots. The Zoning Board's recommenda- tion was that the request be granted as it would be in l<:eeping with the surrounding area but to require a twenty foot setback from the f'ront lot line. Mr. Harr,v Kessel, owner of' Lot 3, Nursery Parl<:, objected to granting the petition. It was pointed out that Mr. Kessel's property was already in the Business zone. Arter having held this Public Hearing and having heard no valid objections, Commissioner Bohannon moved that the Zoning Board's recommendation be upheld and the request be granted with the twenty foot setback. Motion was seconded by Commdssioner Insco and carried unanimously. The Mayor announced the Public Hearing on the request of Mr. James Foree for permission to build a residence on Lot 12 and the north 10 reet of Lot 13, Tennessee Terrace Subdivision, with the square footage or the lot being under the mdnimum requirements. The City Attorney read the request and the Zoning Board'S recommenda- tion that the request to build on slightly less than the required 5,000 square reet be granted. The City Attorney pointed out that this was an R-2 area and the request should have been for permission to build on parts of two lots. The Mayor inquired if there were any objections and there were none. Cornmdssioner Roberts moved that the recommendation of the Zoning Board be granted in that the owner (J~es Foree) of Lot 12 and the north 10 feet of Lot 13, Tennessee Terrace Subdivision, be permitted to construct a residence on that property. Motion was seconded by Commissioner Insco and carried unanimOUSly. A Public Hearing was called on the proposal to rezone the rollowing property from R-1 to R-4 in the zoning rererendwm: Lots 58-71, inclusive, Lots 105-120, inclusive, Lloyd White Skinner Subdivision A letter was presented from Mr. J. Frank Love, owner of Lot 68, stating ~hat he was in favor or the rezoning. A letter from Mr. Fred G. Stiokler indicated he was opposed to the change. Mr. E. B. Casler, Jr., had left a message that Mr. Anast N. Notopoulaa was opposed to the zoning change. Mr. Robert C. Rohn, Mr. Gregory, Mr. Wm. J. Newman, and Mr. E. C. Frank Love stated she approved the proposal as she would lilce to remodel her home into a duplex. Mr. Guy Kennedy, Jr., appeared representing Rogal, Incorporated, owner of Lot 71, and stated that there were many violations, rooms being rented, etc., in the block. He asked that the proposal be put on th~ referendum. It was suggested it would be well to continue the twenty foot setback from Coronado in this block also. After consideration of Item 6-A on the agendA, consideration of the two objections advanced and the persona present in favor, Commissioner Roberts moved that the proposal to rezone Lota 58-71, inclusive, and Lots 105-120, inclusive, Lloyd White Skinner Subdivision, be included in the zoning re~erendum to be submitted to the electorate on December 18, 1956, providing that there alao be included a requirement for a twenty foot setbacl{ on Coronado Drive. Motion was seconded by Commissioner Bohannon and carried unanimously. D. Biclcerstarfe, Jr., President of the Clearwater Flying Company, Incorporated, was read again which asked permission to have fill removed from the lake to use part of it around the lake for grading and that the contractor be allowed to talce the balance or the fill for his own private use with no expense to the City. Commissioner Roberts reported that the Committee had looked at the property and felt Mr. Bickerstaffe's plan would be an improvement; however, if the Commission approves this project, the Committee recommends that the cost of com- pleting this work be not considered in the event of the recovery of the property by the City. It was emphasized that the trucks would have to use the old road in carrying fill. Commdssioner Bohannon moved that the Committee's report be received and approved and referred to the City Manager, City Attorney, City Engineer and all concerned to draw up an agreement and bring it back to the Commission. Motion was seconded by Commissioner Roberts and carried unanimOUSly. Mr. George Dalby presented a report on the financing of the American Legion Junior Baseball program and also presented to the Mayor and Commission a citation ~rom the National American Legion Commander for the City's help in backing the program. The Mayor expressed appreciation for the citation. Commissioner Bohannon moved that the report be received and that the American Legion be complimented for the splendid job they have done in hardball and sortball programs in the City of Clearwater. Motion was seconded by CommiSSioner Insco and carried unanimOUSly. The City Manager presented a request from Mr. Myron Koch to permit the Church of the Nazarene to use B10clc B, Druid Groves Subdivision, for church purposes. Commissioner Bohannon moved the request be referred to the City Attorney ror a report. Motion was seconded by Commissioner Roberts and carried unanimously. The Manager presented a request for enlargement to the Belmont Park Civic Center according to a sketch by the City Engineer at an estimated cost or $1,400.00, the worle to be done by Ci ty crews. He reported there was al so a request from the Recreation Department for development of the pa~k area for recreationa~ purposes making a concrete play area and moving the fence at a cost of $4,391.80. Commissioner Bohannon moved on the recommendation or the City ~mnager that the entire project be approved and that the worle be done as funds are available placing the building extension program first. Motion was seconded by Commissioner Roberts and carried unanimously. A report was presented from Mr. Ross B. Norton, Right of Way Agent, concerning the acquisition of certain properties for Myrtle Avenue right of way. The City Manager recommended that the City Attorney be given authority to go ahead with acquisition or right of way in accordance with the report that has been provided and that he be authorized to purchase the right of way where there is no question or condemnation providing it is in line with appraised value of the property. COmrrUssioner Bohannon moved after consideration of the report of Mr. Ross B. Norton as Right o~ Way Agent in connection with Myrtle Avenue project and hearing the recom- mendation of the City Manager to the efrect that the City proceed to obtain the right of way in accordance with said report and that money is available at this time ror that purpose, that the City Manager, the City Attorney and Mr. Norton, Right of Way Agent, are authorized to proceed to acquire right of way in the limits described by the appraisal of the property and in accordance with the limits set out in the report. Mr. Arthur Kruse, Planning Board Chairman, pointed out that the State is only requiring a 66 foot width for ~rtle Avenue and Plan MR-l provides ror an eighty root right of way. He asked that proviSion be made for setback restrictions to provide for eventual widening. He recommended that the report be referred to the Merchants Association Committee for study and a report bacl{. Commissioner Insco moved the Commission receive the report of Mr. Sullivan and Mr. Abernathy in regard to the downtown parking lot and refer it to the Merchants Association Committee, and that Commissioners Insco and Roberts be appointed as a Committee to work with the Merchants Association on this matter. Motion was seconded by Commissioner Bohannon and carried unanimously. The proposed plat for the Clearwater Industrial Park prepared by the Engineering Department was presented for approval. It was reported that the restrictions to cover this property had been previously approved. COfMUssioner Roberts moved that the plat for the Clearwater Industrial Park be approved as drawn and the proper officials be authorized to execute and take the necessary steps to have it filed among the records of the Cleric of the Circuit Court of Pinellas County. Motion was seconded by Commissioner Bohannon and carried unanimously. A letter from the Industrial Committee recommended that the Commission approve the application of Peninsular Telephone Company to purchase Lot 10, in the Clearwater Industrial Park plat at the corner of Calumet and Sunshine Drive. A minimum price of $3,150.00 per acre was previously set on this property. Commissioner Roberts moved that the recommendation of the Industrial Committee for the sale of Lot 10 of the proposed Clearwater Industrial Parl{ plat to Peninsular Telephone Company be approved and that the proper City officials be authorized to enter into a contract for the same at the price previously set per acre subject to the restrictions for Clearwater Industrial Park previously approved by the Comrndssion. Motion was seconded by Commissioner Bohannon. Upon the vote being taken, Comrndssioners Roberts, Bohannon and Insco voted "Ayel1. Commissioner Strang did not vote. Motion was carried. .:"".. ". Hart, office manager of Clearwater Construction Company, with an invoice attached for $32.67 for repairs to the tennis courts at the Municipal Auditorium. The letter stated that Mr. Robert M. Snyder, President of Clearwater Construction Company, wished to donate this amount to the City and to consider the invoice paid. The Manager recommended that the contribution be accepted of services to the tennis courts in the amount of $32.67. Commissioner Bohannon moved that the contribution be accepted of $32.67 and that the Manager be instructed to write a letter of thanks. Motion was seconded by Commissioner Roberts and carried unanimously. The Manager presented a request from the Firat Church of Christ, Scientist, to use the Municipal Auditorium on the afternoon of February lOth for a lecture. The City Attorney reported that the Manager had made up a list of rules for the use of the Aud:l.torium and one of the rules was that a request for use for any religious or political organization should be passed on by the Commission. Commissioner Bohannon moved that the City Manager be requested to delegate someone to get more information as to the use, time needed, etc. Motion was seconded by Commissioner Roberts and carried unanimously. Commissioner Roberts reported that in connection with the Mobile Homes Show there were a hundred or more trailers parked over on the last finger of Clearwater Beach as a caravan with people living in them for several days. Commissioner Roberts said he had received complaints that although electricity and water were provided the sanitary conditions were not handled well. The Mayor asked that the Manager look into the situation and give a report as to why requirements were not met so that it won't happen again. The Manager said that he would take full responsibility as 110 trailers in the caravan were coming in connection with the Mobile Homes Show, that no provision had been made for them so these emergency arrangements were made to park on the last finger. Commissioner Bohannon commented that he had long advocated that the City hire a businessman as agent to manage the City property such as the new bandshell, the Auditorium and the Ball Park and lceep them occupied in a profitable manner to the City. The Manager reported that there had been considerable diffiCUlty with the basement of the Library flooding making it practically unusable and that the sewage also backed up when it flooded. He said the Engineer had recommended that since a lift station and sewer lines were being constructed below the hill for the bandshell he recommended disconnecting the sanitary sewer line at the Library and extending the line to the new sewer line serving the bandshell. He reported the Engineer estimated the cost at $1,800.00. The City Engineer stated the contractor (Mr. Dave Caraway) was still working on the project and this work could be added to his contract. Commissioner Bohannon moved that the City Manager be authorized to take whatever steps are necessary up to the estimated cost made by the Engineer of $1,800.00 to correct the drainage and sewage problem at the Public Library. Motion was seconded by Commissioner Roberts and carried unanimously. The City Attorney reported that he and the Engineer had met with Mr. Wm. Wightman, attorney, and Mr. Frank Levinson of Clearwater Bay Marineways and tentatively approved an agreement for the exchange of property with the City. He presented a sketch sQpwing the area to be included in the deed to the City and the property the City is deeding to Marineways, reserving the storm sewer easement. Commissioner Roberts moved that the agreement with Clearwater Bay Marinewaya, Incorporated, be approved in con- nection with its usage of property extending west of its present location and authoriz- ing the exchange of deeds between the City and Clearwater Bay Marineways, Incorporated, in connection with adjusting the property lines of the City and Clearwater Bay Marineways, Incorporated, lying west of Sue Barco Subdivision in the City of Clearwater and the proper officials be authorized to execute the deeds and the agreement. Motion was seconded by Commissioner Insco and carried unanimously. E\.!ing requesting permissJ.on to sponsor a free elephant show for children on December 20th on his property. Another letter also f'rom Mr. Ewing requested permission to produce a water ski show on Crest Lake during the Christmas season. Comnlissioner Insco moved that the two requests that were submitted be denied and reconunend that Mr. EWing try to find a more suitable location. Motion was seconded by Commissioner Roberts and carried unanimously. The City Manager read the following excerpt from the preliminary feasibility report on the proposed second causeway between Clearwater and Clearwater Beach: "In anticipation of improved revenues essential for this project we recommend a delay in preparation of final feasibility report until such time as: 1. Island Estates Development is under construction. 2. Dunedin Causeway is either under construction or eliminated. 3. Clearwater Beach - Belleair Beach C~useway plans are finalized. 4. Traffic volumes are greater. 5. Highway plans in the area are mc.re certain and improvements to Sunset Point Road realized. Commissioner Roberts moved that the Commission receive the preliminary feasibility report from the engineering firm of DeLeow, Cather & Brill for further consideration. He said the proposed agree- ment reads that so long as any portion of the property bounded by Grove Street on the north, Cleveland Street on the south, by Lincoln on the west and on the east by Betty Lane is zoned anything other than Business, they will agree that they will not use their property f'or any of the following purposes: 1. For open storage of goods, ware6~ merchandise and equipment. 2. As a location of warehouse. 3. As a location for repair shop for motor vehicles or bther equipment but not precluding parking of vehicles. The City Attorney stated that he would get the agreement executed by the Peninsular Telephone Company and see that it is properly recorded. The City Attorney read on its f'irst reading Ordinance r(26 amending Ordinance 627, the City Zoning Ordinan.ce, and the Zoning Map of 1953. The City Attprney read Resolution 56-3L~ which requested the Pinellas County Board o~ Conunissioners to consider and adopt Plan MR-l or some similar plan if MR-I is not acceptable to provide for future development or roads in the upper part of Pinellas County. The City Attorney stated that Mr. Kruse, Planning Board Chairman, had informed him that a copy of the schedule or proposed street widths should be attached as part of Plan MR-l. Commissioner Roberts moved that Resolution 56-34 with the addition of the street widths attached to the copy of MR-l be approved and the proper City officials be authorized to sign it. Resolution 56-36 was read authorizing the payment of $1,123.67 to Briley, Wild and Associates for services in connection with the Water Improvement Project'dthe storm Sewer Project and the Sewage Sludge Digester. The City Attorney reported that Mrs. Doris T. Alvord has requested a release from the City upon final payment of $2,231.21 for her contract covering a propor- tionate share of space in the Skycrest Disposal Plant for property which is now Skycrest Unit 10. He said the Treasurer had confirmed that he had received a check for $2,231.21 Which was the final payment on the contract. Commissioner Bohannon moved that the release be authorized and be executed by the proper City officials. Motion was seconded by Co~ssioner Insco and carried unanimously. The City Attorney requested that Item 8-H, Reconsideration of agreement with Miss Elsie Duncan, be deferred to the next meeting. The City Manager reported that the City's rormer Traffic Engineer, Mr. Fred Bell, Dad recommended that automatic traffic signals be installed at Druid anq ~issouri and Druid and Court Street as the traffic count was within range for traffic signals. It was suggested that the two traffic lights should be synchronized. The Manager also recommended that a traffic light be installed at the intersection of Sunset Point Road and Edgewater Drive to be actuated by the traffic approaching on Sunset Point Road. The invocation *�ras given by the Reverend Robert Cochran of Peace Memoria7. Presby�terian Church, Clearwater. The Acting Mayor asked if there were any additions or corrections to the minutes of November 5th and 13th. Commissioner Inaco stabed that the number of mimeographed copies of the approved restriction3 f�r the Industrial Park should be 100 instead of 500 as ref'erred to in the minutes of November 5th in Paragraph 1, Page 345. Commissioner Bohannon moved that the minutes o£ the regular meeting of November� 5th and the special mEeting of November 13th be approved as am�nded in accordance with copies furnished each member in writing subject to any corrections by Mayor Brown. Motion was seconded by Commissioner Roberts and carried unanimously. Th� Manager asked that the Commission ecnsider the financial statements and survey made by Price Waterhouse & Coznpany and introduced two Price Waterhau�e representatives, Mr. Q. M. Mercer and Mr. h93.lton Handelman. Mr. Mercer reported that the financial conc3ition of the City had been reviewed by their firm and that under Phase 2, the report as a result of a surv��y of systems, recommendations on administra- tive procedure changes were made. Commissioner Bchannon moved that bcth of these reports be received for study and recommended a r,:eeting of thP Gommiasion to go over them after the Commissioners have a chance to analyze them. Motion was seconded by Commissioner Insco and carried unanimously. The City Manager reported that two bids hac: been received for two new police cruisers wi�h a ts�ade 3n of two 1g55 Ford 4 doo2 sedans. Commissianer Insco recommended that the same kind �f cars be purchased so there would be standard equipment and 3.t vrould not be necessary to send the cars out from the City Garage for specialized repair work in different shops. There was a discussion as to whether this could be accomplished under the competitive bidding System. Commissioner Robertcs moved that the Commission accept the bid of Larry Dimmitt for two police cruisers as the lowest and best bid. Motion was seconded by Commissioner Bohannon. Upon the vots being taken, Commissioners Roberts, Bohannon and Strang voted "Aye" Commissioner Insco voted "No". Motion carried. Commissioner Insco explained h�.s vote by referring to his previous reconunendation regarding standardization. Regarding the bids for one 10 inch and one 20 inch pressure reducing valves, the City Ma,nager �tated that b�.sed on tY�e recommendation of Briley, Wi1d and Associates, he recommended awarding the bid to Ross Valve Gompany, Troy, New York, as the best and lowest bid in the amount of �3,1�F6.50. Commissioner Bohannon moved that the proper City authorities be authorized ta place an order with Ross Valve Company, Troy, New Yerk, in the amount of $3,7.46.50. Motion wa�: seconded by Commissioner Roberts and carried unanimously. The Mayor announced a Public Hearing on the paving of Yelvington Avenue from Gulf to Bay Boulevard to Druid Road and Turner Street from Yelvington Avenue to Keystone Avenue. The En�ineer reported that the work was requested by petition fr�m the property owners and the owners present at a, preliminary hearing were in favor of the project. He stated that he had preaented an esiima,te of $3.32 per front foot at the preliminary hearing but upon recalculation, the estimate is now $3.90 per front foot.
