The Mayor called the meetin~ to order and announced that the first item to be
considered would be the request from the Florida Railroad Employees Assoc~ation for
Resolution supportin~ their posit~on in Florida Utility Docket ~753-CCT. The C~ty
Attorney reported that a representative of the railroad brotherhoods had ~ppeared at
the last meeting and asked that the City oppose the ~rantin~ by the Florida Railroad
and Publ~c Utilities Co~ssion of tnis certificate of public convenience and
necessity to Rockana Carriers, Incorporated, and indicate its disapproval of ~rantin~
the permit on the grounds that the large trucks would damage the streets of the City
of Clearwater. The City Attorney read the Resolution 56-32 addressed to the Florida
Railroad and Public Utilities Commdssion asking that the applicat~on of Rockana
Carriers, Incorporated, be denied. Commissioner Roberts moved that Resolution 56-32
be adopted and the proper officials be authorized to execute it. Motion was seconded
by Commissioner Bohannon and carried unanimously.
Commissioner Insco presented a letter from the Special Events Cornmdttee of the
Chamber of Commerce indicating that the Cornmdttee approved the proposed budget of
$9,475.00 ror the Fun IN Sun events. Commissioner Roberts suggested that the
Commdss1on meet with the FUn IN Sun Committee to discuss the various items. ~
consent, the Commission agreed to this.
Commdssioner Strang arrived at 1:50 P.M.
The Mayor announoed the Public Hearing to consider items to be placed in the
Zoning Ordinance to be submitted for referendum in a special election on December 18,
1956. He stated the first item to be considered was the proposal that the zoning
law be amended to provide that no lot or plot having an area of less that 3,500
square feet shall hereafter be used for building in an R-2 area, in place of the
present requirement of 2,500 square feet. He reported that the 2,500 square feet
was not considered enough to use for a duplex residence. There being no objection,
Commiss~oner Strang moved that this item be placed in the ordinance. Motion was
seconded by Commissioner Bohannon and carr~ed unanimously.
The Commission considered the proposal to rezone the following lots in
Hibiscus Gardens from R-2 to Business:
Lots 1, 2, 10, 11 and 12, Block L
Lots 1, 2, 3, 4, 10, Elock J
Lots l2 and l3, Block a
Lots 8, 9, 17 and 18, Block D
The Mayor inquired ~f there were any objections or comments. Mr. Edward C. Heseltine,
owner oC Lots 9 and 10, Block J, Hibiscus Gardens, inquired if both of his lots could
be included in the Business zoniug instead of just Lot 10. The Mayor replied there
had been a straight line drawn across the subdivision to separate the Business zone
from the residentia1 area and he felt that if the proposed zoning was adopted, Mr.
Heselt1ne could present ~t 9 to the Zoning Board and the Co~ssion as a hardship
case for Business use of the property. Mr. Heseltine withdrew his request. Mrs.
Ethel T. Hughes, owner or Lots 15 and 16, Block D, asked if both o~ her lots could
be included in the Business zone. It was the opinion of the Commdssion that the
Ol~er could present the need ror Business zoning to the Zoning Board as a hardsnip
case. Mrs. Hughes withdrew her request. Comm1ss~oner Bohannon moved that the pro-
posed zoning change as set out ~n Item 2 for rezoning from R-2 to Business in
Hibiscus Gardens be approved and placed in the referendum ordinance. Motion was
seconded by Commissioner Roberts and carried unanimously.
The proposal to rezone the following property rrom R-2 to R-4 was considered
by the Commission:

Mr. Edward C. Heseltine, owner of Lots 31 4, 5, Block 0, Hibiscus Gardens, requested
that his lots be rezoned as R-4 from R-2. The Commdssion agreed to granting this
request. Commissioner Bohannon moved that the proposed change o~ zoning from R-2
to R-4 in Hibiscus Garden6 Subdivision as set out ~n Item 2 together with the addi-
tional item of Lots 3, 4 and 5, Block 0, be approved and included in the Zoning
re~erendwm. Motion was seconded by Commissioner Strang and carried unanimously.

The City Attorney announoed consideration of the proposal that City property
including pumped-in area lying south of Stevenson Creek and east o~ North Fort
Harr~son Avenue in the Navajo Park Subdivision be zoned as Public. The Mayor stated
that this property had alrea~ been dedicated as park property by Resolution and this
would merely change the deSignation on the Zoning Map. Commissioner ~hannon moved
that the proposal #3 including the City-uwned land lying south of Stevenson Creelcl
east or North Fort Harrison Avenue and north of Calumet and including Lots 59 to 64,
inclus1vel Bloclc A, Lots 1-9, inclusive I Blooks Band CI Navajo Park, be 20ned as
Publio, Motion was seconded by Commdss1oner Insco and carried unanimously.
The proposal to rezone the following lots in Navajo Park Subdivision from R-M
to R-1 was considered:
Lots 1-9, inc1usivel Blocks D~ EI F and G
Lots 1-10, inclusive, Block H
Lots 1-4, inolusive, Block J
Mr. J. A. Ogden protested the change in zoning. ~. Alfred Marshall stated that he
represented all of the owners concerned in Blocks D, E and F and they were opposing
the proposed change. He explained the subdivision restrictions limit the use to one
family dwellingsl that these lots were zoned R-M in 1952, and on March 181 J.955, a
bill o~ complaint was filed asking that the subdivision restrictions be declared
void because of the changed use or the neighborhood. He said the Circuit Court had
found that the R-M designation should be maintained and that the case was on appeal
in the Supreme Court of Florida to be heard on November 30th. He asked that the
Commdssion not taxe any action rezoning the lots while the matter was still pending
in the courts. Mr. Percy Spengeman, resident of Navajo Parkl spoke in favor of a
change to R-1 or R-2 zoning. The City Attorney recommended in view ~f the pending
Court action that this matter not be placed on the referendum. Commissioner Strang
moved that the proposal that certain lots in Navajo Park Subdivision, ~n Blocks D,
E, F, G, H and J, not be included in the zoning referendum. Motion was seconded
by Conmis8~oner Roberts and carried unanimously.
The Commission considered the proposal to rezone ~rom R-2 to Business Lots 1-61
inclusive, Block 51 and Lots 4-6, Block 21 Pinecrest Subdivision. The Mayor
expla~ned that this property was partly being used ~or Business now under permissive
use. There being no objection, Commissioner Strang moved that the item be placed on
the zoning re~erendum. Motion was seconded by Commdssioner Roberts and carried
unanimously.

The proposal to zone as Business property on the north and south of Turner
Street between ~ssour1 Avenue and Mad~so~ was discussed. After discuss~ng how much
of the property shouJ.d be zoned as Bus1nessl the Zoning Board recommended that a strip
270 reet west from Missouri Avenue extending 147 feet on the north ~rom TUrner and
132 feet south rrom Turner be zoned Business. There being no objection, CommiSSioner
Strang moved that proposal #6 be amended to include an area approximately 270 feet
west ~rom the west l~ne o~ Missouri Avenue extending approximately 147 feet on the
north of Turner Street and approximately l32 feet on the south of Turner Street
be rezoned from R-4 to Business property and that the same be included in the
re~erendum. Motion was seconded by Commissioner Roberts and carried unanimously.
The Commdssion considered the proposal to rezone from Business to R-4 the
following lots in Wallace Addition:
Lots 6 and 9 and the east 62 feet of Lot 10, Block 3
Lots 1, 2 and 3 and the east 50 reet o~ Lots 4 and 5, Block 4
Mr. Thomas Hamilton spoke for himself and his neighbors in ~avor o~ the proposal
stating that these lots were all occupied by houses at present and that he had
presented a petition to the Zoning ~ard and the Commission asking the change. Mr.
Wm. Goza, representing Mr. Larry Dimmitt, Jr.1 the owner of Lots 8 and 9 less the
west 54.12 feet, Block 3, Wallace Addition~ stated that he thought this was an
attempt to rezone one lotj that his client had purchased the lot with the Business
zoning and intended to tear down the house on it and erect a building. Ke said
Mr. Dimmdtt made application to the Building Inspector for a permit to erect a
building and the permit was denied by the Building Inspector upon authority from
the Commdss~on. He asked that the proposal to place this on re~erendum be denied and
that the ~nstructions to the Building Inspector be revoked. Commdssioner Roberts
moved that this matter be placed on the referendum in accordance with the recom-
mendation of the Zoning SOard. Motion was seconded by Co~sBioner Bohannon and
carried unanimously.

The proposal to rezone from R-2 to Business the following
Sub of the E~ of NEt of swt of Section 22-29-15 was discussed:
Lots 1, 4, 5, 8, 9, 12 and 13
Mr. Charles Phillips, Jr., attorney, spoke in favor of the proposal stating that the
area was developing as a business area, that there was business property across the
street in the County, and numerous exceptions for Business use had been granted along
Missouri Avenue in this district. It was suggested that sinoe only 40 feet to the
center line of Missouri was dedioated in this subdivision, it would be well to
require a ten foot setback. Commdssioner Roberts moved that the request for the
rezoning of R-2 to Business of lots set out in proposal #8 be approved, that in
addition the Zoning Map be amended to indicate a 10 foot building setback from the
property line facing Missouri Avenue and be included in the zoning referendum.
Motion was seconded by Commdssioner Strang and oarried unanimously.

The request of Mr. Harry O. Chatterson to rezone Lots 5, 6 and 7, Block C,
Carolina Terrace, from R-2 to Business, was considered. The Zoning Board had
recommended that it be referred to referendum. It was pointed out that there were
several business uses of property in this block granted under hardship applications
and it was decided that this request could be handled in a like manner. Commissioner
Strang moved that the matter not be placed on the ballot. Motion was seconded by
Commissioner Insco and carried unanimously.
The Commission considered the request of Mr. Ed Whitson to rezone Lots 1-6,
Block A, Hillcrest Subdivision No.1, from R-l to R-4. The Zoning Board recommended
that the matter not be placed on the referendum but be brought up again aa a hardship
case before the Zoning Board. Mr. Whitson addressed the Commission stating that
most prospective buyers for the property wished to have the zoning changed to R-4
~or multiple units and because of the heavy tra~fic on Drew Street it was almost
,impossible to sell the property for R-l use. He stated that apartment houses were
permitted on the south side of Drew Street west of this property. Mr. Robert w.
Baker, attorney appeared on behalf of afrected property owners in the neighborhood
presenting a petition signed by 88 persons who opposed this proposal and reported
that Mr. Whitson as the original developer of the subdivision had sold all the
other lots with restrictions for single family residences only, and that granting
the request for an apartment house or motel would lower the value of the homes.
Commdssioner Bohannon moved that the Commission adhere to the recommendation of the
Zoning Board and omit proposal #9 from the referendum. "lotion was seconded by
Commissioner Strang and carried unanimously.
Mr. H. H. BaSkin, Sr., appeared on behalf of the Peninsular Telephone Company,
asking that Lot ~ less the north 25 feet, Lots 4 and 5, Blook B, Resub of Lots l6
and 17 and West I o~ Lots 5 and 6, R. H. Padgetts Subdivision, owned 'by the Telephone
Company be rezoned from R-4 to Business in the referendum. He reported that he had
sent a request to the Zoning Board on June 2nd but had not reoeived notice of any
aotion on the request. The City Attorney reported that the matter was discussed at
a joint meeting of the Commission and the Zoning Board on July 19th and the recom-
mendation was that it was not thought advisable to rezone individual lots unless
specific use is shown for the same. The Mayor stated that if a designation of
Business zoning was given the company could use the lots for a poleyard or stockyard
that might be detrimental to the value of the surrounding homes and motels. The
City Attorney suggested that the property oould be designated as Business with an
agreement between the Telephone Company and the City setting out a restrictive
limitation or covenant that could be recorded. He suggested that he and Mr.
Baskin could work out such an agreement before next Monday'S meeting. Co~ssioner
Insco moved that the matter be put on referendum subject to the approval of an
agreement between the City and the Telephone Company next Monday. Motion was
seoonded by Commissioner Roberts and carried unanimously.
Mr. Louis Glazer, owner of the north 356 feet of Lot 2, Lakewood Replat,
requested that all of his property be rezoned to R-2. The Mayor explained that
the east half of Mr. Glazer's property was presently zoned R-4 and the west half
is zoned R-l. After discussion with the Zoning Board it was recommended that the
request be put on the referendum ballot. Commissioner Roberts moved that this item
be included on the re~erendum at the request of Louis Glazer that the north 356 feet
of Lot 2, Lakewood ReplatJ be given R-2 zoning. Motion was seconded by Commdssioner
Insco and carried unanimOUSly.
Mr. Al Rogers requested that the block of Lloyd White Skinner Subdivision
including Lots 58 to 71 and Lots 105 to 120 be changed from R-l to R-4 zoning as
this block faoes the City beach and otherwise is surrounded by R-4 and R-M zoning.
By consent, the Clerk was directed to advertise a Publio Hearing on the request
for next MOnday, November 19th, and notify the affeoted property owners.
Mr. Wm. Meyers, owner of the Sea Fever~ appeared before the Commission to
oomplain that trailers in the Mobile Home Show at the Municipal Auditorium were
parked along the bulkhead by the City Dock and also that Pierce Boulevard had been
closed off completely so that customers for his boat did not have parking space or
acceSB to the Oity Dock. He requested that five or six trailers be removed from the
bulkhead and that Pierce Boulevard be left open. After discussion~ the matter
was referred to the City Manager to work out a satisfactory solution.

Mr. Gonzalo Garcia, of Garcia Realty, presented an application for Mr. J. W.
Thorp to erect a filling station on Lots 1 and 2, Block 84, Mandalay (northeast
corner of Royal Way and Mandalay). The Cit~ Engineer reported that he had approved
the plans with certain corrections. Comndasioner Bohannon moved that the application
be approved subject to the City Engineer's recommendations. Motion was seconded by
Commissioner Roberts and carried unanimously.
Mr. Horace Hamlin, Zoning Board Chairman, recommended that the lots in Fa1rview
Addition facing Evergreen Avenue be changed from R-2 to R-4 as those lots are very
deep and there have been several requests to build multiple units in that area.
Commissioner Roberts moved that Lots 5-14, Block A, and Lots 1-14, Block B, be
scheduled for Public Hearing on November 19th for possible inclusion in the referendum.
Motion was seconded by Commissioner Bohannon and carried unanimously.
Mr. Horace Hamlin suggested that the City incorporate in the new zoning
ordinance requirements for trailer parks similar to the County regulations. By
oonsent, the City Attorney was directed to include such requirements in the ordinance
for consideration on November 19th.
Mr. Hamlin as Chairman of the Zoning Boa.rd made the following suggestions:
l. That the zoning map be changed so it does not have a match line or be
made up in sections in atlas form.
2. That the thirty acres of City owned submerged land south of the
Causeway be zoned as Public or for park purposesj also that Dan's
Island be zoned.
3. That gas stations be required to be located at least 150 feet apart
similar to an ordinance of Ft. Lauderdale's.
4. That a setback from the street line be required for loading platforms
as in some locations semi-trailers were blOCking the street when'
being loaded.
5. That a sidewalk should be required in front o~ business buildings.
6. That different zoning be considered on arterial streets and
possibly residential zoning on Gulf to Bay Boulevard east of
Belcher Road in order to carry traffic better.
The Commission discussed Mr. Hamlin'S proposals but took no action.
Mr. Arthur Kruse, Planning Board Chairman, recommended some control should be
exercised over undeveloped lots in subdivided areas, especially regarding different
setbacks where streets are to be widened. It was the Co~ssion's opinion that there
would not be sufficient time before the zoning referendum to inform the public
regarding establishing specific setbacks along arterial streets.
The Mayor requested that expenses be authorized for Commissioners and City
officials to attend the Florida League of Municipalities meeting in Fort Lauderdale
November l5th-17th. Commissioner Insco moved that such expenses be authorized.
Motion was seconded by Commissioner Roberts and carried unanimously. The City
Attorney reported he would be unable to go but Assistant City Attorney Allbritton
would attend.
Commissioner Roberts commented he understood it was imperative that the pro-
posed Fun 'N Sun budget be approved today and suggested reoonsidering the item.
Commissioner Roberts moved that the Commission reconsider the action on the proposed
budget for the Fun 'N Sun Celebration. Motion was seconded by Commissioner
Bohannon and carried unanimously.
Commissioner Roberts moved that the budget of $9,475.00 for the Fun 'N Sun
Committee be approved and that this money be drawn from the Special Events Fund.
Motion was seconded by Commissioner Bohannon and carried unanimously.
There being no further business to come before the Commission, the meeting
was adjourned at 6:05 P.M.

November 13, 1g56
The City Commission of the City of Clearwater met in special session at Ciiy
Ha11, Tuesday, November 13, 1956, at 1:30 P.M. with the following members present:

The May�r called the meeting to order and announced that the first �tem to be
considered would be the request from the Florida Railroad �.lnployees Association for
Resolution supporting their positiion in Florida Utility Docket �F753-CCT. The City
Attorney reported that a representative of the railroad brotherhoods had appeared at
the last meeting and asked, tha.t the City oppose the granting by the Florida Ra.ilroad
and Public Utilities Commission of this certificate of public convenience and
necessity to Rockana Carriers, Incorporated, and indicate its disapproval of granting
the permit on the grounds that the large trucks would dama.ge the streets of the �ity
of Clearwater. The C3ty Attorney read the Resolution 56-32 addressed to the Florida
Railroad and Public Utili�Eies Commission asking that the application of Rockana
Garriers, Incorporated, be denied. G�mmissioner Roberts moved that Reaolution 56-32
be adopted and the proper officials be authorized to execute it, M�tion was seconded
by Commissioner Bohannon and carried unanimously.
Comrnissioner Insco presented a letter from the Special �vents Committee of the
Chamber of Commerce indicating that the Commii:tee approved the proposed budget of
$9,�+75.00 for the Fur. 'N Sun events. Commissioner Roberts sugges�ed that the
Commission meet with the Fun 'N Sun Committee to disouss the various items, By
consent, the Commission agreed to this,
Commiss3.�ner Strang arrived at 1:50 P.M.
The Mayor announced the Public Hearing to consider items to be placed in the
Zoning Ordinanee to be submitted for referendum in a speeial eleetion on December 18,
1956, He state��i the first item to be considered was the proposal that the zoning
law be amended tc� provide that no 1ot or plot haying an area of less that 3,500
square feet uhall hereafter be used for building in an R-2 area, in place of the
present requirement of 2,500 square feet. He reported that the 2,500 square feet
was not considered enough to use for a duplex residence. There being no objection,
Commissioner Strang moved that this item be placed in the ordinance. Motiori Fras
seconded by Commissioner Bohannon and carried unanimously.
The Commission considered the propo�cll to rezone the following 1oL-s in
Hibiscus Gardens from R-2 to Business:
Lots 1, 2, 10, 11 and 12, Block L
Lots 1, 2, 3, �F, 10, Blocic J
Lots 12 and 13, Block H
Lots 8, 9, 17 and 18, Block D
The Mayor inquired if there were any ob�ections or comments. Mr. Edward C. I:eseltine,
owner of Lots 9 and 10, Block 3', H:Lbiscus Gardens, inquired if both of his lots could
be included in tlie Business zoning instead of just I,ot 10. The Mayor �eplied there
had been a strai�ht line drawn across the subdivision to separate the �3usiness zone
from the residential area and h� felt that if tYie proposed zoning was �.dopted, Mr.
Heseltine could present I,ot 9 to �he Zonin� Board and the Comm3.ssion a� a haz�dship
case for Business use of the propericy. Mr. Heseltine withdrew his reque�t. Mrs.
Ethel T. Hu�hes, owner of' Lots 15 and 16, Block D, asked if both of her lots cou13
be includsd in the Business zone. It was the o�inion of' the Commission that the
owner could present the need for Business zonin$ to tYie Zoning Board as a hardshi�
case. Mrs. Hughes withdrew her request. Commissioner Bohannon moved that the g„o-
posed zoning ehange as set out in Item 2 for rezoning from R-2 to Business in
Aibiscus Gardens be approved and placed in the referendum ordinance, Motion was
seconded by Commissioner Roberts and carried unanimausly.

Mr. Edwa.rd C. Heseltine, owner of Lots 3, 4, 5, Block O, Hibiscus Gardens, requeated
that his lots be rezoned as R-�+ from R-2. The Commission a.greed to granting �his
request. Commissioner Bohannon: moved that the proposed change of zoning from R-2
to R-4 in Iiibiscus Gardeiis Subdivision as set out in Item 2 tQgether with the addi-
tional item of Lots 3, �F and 5, Block 0, be approved and �ncluded in the Zoning
referendum. Motion svas seGonded by Commissioner Strang and carr�ed v.nanimeusly.
'ihe City Attorney announced consideration r,f the proposal that City property
� including pumped-in area lying south of Stevenson Creek and east of North Fort
Harrisan Avenue in the Navajo Park Skbdivision be zoned as Public. The Mayor stated
that this property had already been dedicated as park property by Resolution and this
would merely change the designation on the Zoning Map. Commissioner Bohannon moved
that the proposal #3 includin� the City-owned land lying south of Stevenson Creek,
east of North Fort Harrison Avenue and north of Calumet and lncluding Lots 59 �0 64,
3nclusive, Block A, Lots 1-9, inclusive, Blocks B and C, Navajo Park, be zoned as
Public, Motion was seconded by Commissioner Inaco and carried unanimously.
The proposal to rezone the following lots in Navajo Park Subdivision from R--M
to R-1 was considered:
Lots 1-�, inclusive, Blocks D, E, F and G
Lots 1-10, inclusive, Block H
I,ots 1-4, inclusive, Block J
Mr. J. A. Ogden protested the change in zoning, Mr. Alfred Niarshall stated that he
represented all of the oarners ^oncerned 3n Blocks D, E and F and they we�e opposing
the proposed change. He explained the subdivision restrictions lim3.t the use to one
fami?y dwellings, that these lots were zoned R-M in 1952, and on Tiarch 18, 1955, a
bill of complaint was filed askin,� that the subdivision restrictions be declared
void �ecause of the changed use �i tha neighborhood. He said the Circuit Court �ad
found that the R-M designation sh�uld be maintained and that the case was on appeal
in th� Supreme Court of Florida, to be heard on Novetnber 30th. He asked that the
Commission not take any aetion rezoning the lots while the matter was still pending
in the ec�urts. Mr. Percy Spengeman, resident of Nava�o Park, spoke 1,n favor of a
change to R-1 or R-2 zoning. The City Attorney recommended in view of the pe.iding
Court action that this matter not be placed on the reterendum. Commissioner Strang
moved that the proposal thai certain lots in Navajo Park Subdivision, in Bloc1{s D,
E, F, G, H and J, not bE included �n the zoning referendum. Motion was seconded
by Comm-Lssioner Roberts and carried, unariimously.
The Commission considered the proposal to rezone fa•om R-2 to Business Lots 1-6,
inclusive, Block 5, and Lots 4-6, Block 2, Pinecrest Subd.�.vision. The Mayor
explained that thi.s property was partly be�.ng used for Bus3ness now under permissive
use, There be?ng no objection, Commissioner Strang moved that the 3tem be placed on
the zoning referendum. Motlon was seconded by Commissioner Roberts and carried
unanimously.
The proposal to zone as Business property on the north and south of Turner
S�reet between Missouri AVenue and Madison was disc;ussed. After diseussin� how much
of the property should be zoned as Business, the Zoning Board recommended that a strip
270 feet west from. Missouri Avenue extending 7.47 feet on the north from Turner and
132 feet south From Turner be zoned Business. There being no objection, Commissioner
Strang moved that proposal �6 be amended to include an area appro�:imately 270 feet
west from the west 13ne of Miss�ur'i Avenue extending approximately 1�7 feet on the
north o�' Turne� Street a_nd approximately 132 feet on the south of Turner Street
be rezoned from R-4 to Business property and that the sa.me be included in the
referendu�. Motion was seconded by Gommissioner Roberts and carried unanimously,
�.'he Commission considered the proposal to rezone from Business to R-4 the
following lots in Wallace Addition:
Lots 8 and 9 and the east 62 Feet of Lot 10, B1ock 3
Lots 1, 2 and 3 and the east 50 feet oi �ots 4 and 5, �lnck 4
Mr. Thorna.s Hamil�on spoke for himself and his neighbors in favor of the proposal
stating that these lots �rrere all oacupied by houses at present and that he had
presented a petition to the Zoning Board and the Commission asking the change. Mr.
'rJm. Goza, represe�ting Mr. Larry �?immii�t, Jr., tYie owner of Lots 8 and g less the
west 54.I2 Feet, Block 3, Wa.11ac� Addition, stated that he thought this was an
atzem�t to rezone one �ot; that his client had purchased the lot v13.th the Busineas
zonin� and intended to tear down the house on it and erect a building. He said
Ntr. Di.mmit;t ma,de application to the I3uilding Inspector i'or a permi� i:o erect a
building and the permit was denied by the Building Inapecto.r upon authority from
the Commission. He a�ked that the pr.oposal to place this on referendum be denied and
that the instructions �o the Building Inspector be rev�ked. Commissioner Roberts
maved that this matter be placed on the referendum in accordance with the recom-
menda.tion oP the Zoning Bcard, Motion wae seconded by Commisaioner Sohannon and
carried unanimously.

Mr. Charles Phillips, Jr „ attorney, spol�e in favor of"che proposal stating that the
area was developing as a business area, that there was business property across the
street in the County, and numerous exceptions for Business use had been granted along
Missouri Avenue in this district. It was suggested thaL sinoe only 40 feet �o the
center line of NL.ssouri war� dedicated in this subdivision, i� would be we11 to
require a ten foot setback. Commissioner Roberts moved that the request for the
rezoning of R-2 to Business of lots set out in proposal �8 be approved, that in
addition the Zonin� Map be amende3 to indicate a 10 foot building setback irom the
property line facing Miasouri Avenue and be ineTuded in the zoning referendtun.
Motion was seconded by Cormnissioner Strang and carried unanimously.
The reguest of A7r. Harry Q. Chatterson to rezone Lots 5, 6 and 7, Block C,
Carolina Terrace, from R-2 to Business, was consid�red. The Zoning Board had
recommended that it be referreci to rePerendum. It was pointed out that there wsre
sever�al t�usiness uses oz property in this block granted under hardship applications
and it was decided 'chat this request could be handled in a like r�a.nner. Comrnissioner
Strang moved that the matter not be placed on the ballot, Motion was seconded by
Commissioner Insco and carried unanimously.
The Commission corisidered the request of N1r. Ed Whits�n to rezone Lots 1-6,
B1ock A, Hillcrest Subdivision No. 1, from R-1 to R-4. The Zoning Board recommended
that the matter no't be placed on the referenduxn but be brought up again as a hardship
case before the Zoning Board. Mr. irlhitson a�?dressed the Comm3.ssion stating thai
mo3t prospeetive buyers for the property wished to have the zoning changed t� R-4
for multiple units and because of the heavy traffie on Drew Street it was almost
impossib7.e to sell the property for R-1 use. He stated that apartment houses were
permitted on the south side of Drew Street west a£ this property. Nlr. Robert W.
Baker, attorney appeared on taehal£ of affeeted property owners 3n the neighborhood
presenting a petition signed by 88 persons who opposed this proposal and reported
that Mr^. Whitson as the origir.al developer of the subc3ivisian had sold all the
other lots with restrictions for sin�le family residences only, and that granting
the request for an apartment house or motel would lower the value of the homes.
Comm.issioner Bohannon moved that the Commission acihere to the .recommendation of the
Zoning Board and omit proposal #9 from the referend3zm, Mof;ion was seconded by
Commissioner Strang and carried urxanimously.
Mr, H. H. Baskin, Sr., appeared on behalf o� the Peninsular Telephone Company,
asking that LoL �3 less the north 25 fee�, Lots �+ and 5, Bloek B, Ii.esub of Lots 16
�nd 17 and West 2 of Lots 5 and 6, R. H. Padgetts Subu�ivision, owned'by the Teiephone
Company be rezoned from R-4 to Business �n the referendum. He reported tl�iat he had
sent a request to the Zoning Baard on June 2nd but had not received notice of any
action on the request. The City Attorney reported that the matter was discussed at
a joint meet3ng of the Commission and the Zoning Board on July 19th and the recom-
mendation was that it was not thought adv�sanle �o rezone individual lots unless
specific use is sho*rm for the same. The Mayor stated that if a designation of
Busines� zoning was given the compan� could use the lots foa� a poleyard or stockyard
that might be detrime�tal to the value of the surroundi.r,g humes and motels, TY:e
City At�orney suggested that the property could be designated as Business �,�th an
agreement between the Telephone Gompany and the City setting out a restrictive
limitation or covenant that could be recorded. He suggested that he and Mr.
Baskin could worlt out such an agresment before next Ntonday�s meeting. Comm3.ssianer
Insco moved that the matter be put on refer�ndum subject to the approval of an
agreement between �he City and the Tel��,hone Company next b%nday. Motion was
s�conded by Commissioner Roberts and car-riea unanimously.
Mr. Louis Glazer, or�ti*ner of the north 356 feet of Lof. 2y Lakewood Replat,
requested that all of hls property be �ezoned to R-2. The Mayor explairied that
the east half o� Mr. GlazerTs property ivas presently zoned R-4 and the west half
3s zoned R-1. After c�iscussion with the Zoning Board it was recommended that the
request be put on the referendum ballot. Commissioner Robes�t� moved that this item
be included on �he referendum at the request of I;ouis Glazer that the north �56 feet
of Lot 2, Lakewood Replat, be given R-2 zoning, Motion IJ8.8 seconded by Commissioner
Insco and carried unanimously.
Mr. A1 Rogers requested that the block of Lloyd White Skinner Subdivision
in.cluding Lots 58 to 71 and Lots 105 to 120 be chan�ed from R-1 to R-4 zoning as
this block faces the City beach and otherwise is surrounded by R-4 and R-M zonirig.
By consent, the Glerk was direeted to advertise a Publie Hearing on the request
for next Monday, November 19th, and notify the affected property owners.
Mr. Wm. Meyers, owner oi' the Sea Fever, appeared before the Commission tc�
complain �hat trailers in the Mobile iiome Show at the Municipal A�.�ditorium were
parked along the 'bullrhead by the City l�ock and alsc that Pierce Boulevard had been
elosed off completely so that custome'rs for his boat did not havP parking space or
access to the City Dock. He requested that five or six trailers be reraoyed from the
bulkhead and tha�t Pierce Bouleva.rd be left open, After discussion, the matter
�vas referred to th� City Manager to worK out a satisfactory solution.

Mr. Horace Hamlin, Zoning Board Chairman, recommended that the lots in Fairview
Addition fac3ng E�r�esgreen Av�:nue be change@ from R-2 to R-4 as those lots are very
deep ancl there have been several requests to build multiple unita in that a�ea.
Commissloner Roberts moved that Lots 5-14, Block A, and Lota 1-1�+, Bloek B, be
scheduled for Public Hearing on November 19th for possible inclusian ii1 the referendum.

Mr. Ho�ace Hamlin suggested that the Gity incorporate in the new zoning
ordixzance requiremerts for trailer parks similar to the Coun�y regulations. By
consent, th� City Atterney was direc�ed to include such requirements in the ordinance
for consideration on November lgth. .
