explained that Ordinance 632 contr'ollinc; ne1/T subdi vi s.1,ons had not been adopted at
that time. The Engineer estilnated the cost of the sev.Jer line at ;p3.32 per f'ront foot
and the lift station at $2.43 per f'ront foot. The Engineer stated that some of' the
properties l'Jere already connected I-Ji th a te11l1JOrary line to the SeNeI' in Harnden Drive
and those properties l'Jould be cl1arc;od ti-lcir pro rata share of the lift station only.
He said the lift s'co. tion "Tar:; planned to be larGe enough to serve the next finger when

When the purchase was made in 1934 the building was then the finest struct.ure
of its kind in the sout.h. Witn twenty~o years of constant usage, minimum
repair and no modernization, it. is now both unattnactive and ill adapted to
efficient usage.
Costly emergency repairs are badly needed and extensive remodeling is urgen~ly
required to both preserve the building and efficiently adapt it to the rapidly
expanding requirements of the Chamber of Commerce.
The Clearwater Chamber of Commerce Gan and will arrange to finance independen t~3c
and wit,hout, cost. to the City all needed l'epairs and alterations to the building
provided the City w ill make this possible by a transfer -atE title to tihe Chamber
of CODlUerce.

pier at Clearwater Beach. this is a novelty idea such as found at Atlantic City
and Long Beach, California. Elderly tolk find it very inseresting and entertaining.
This was given a write-up in the Clearwa~er Sun and also the Boston Sunday paper.
A reported from the Boston paper ~as here on vacation and thought it quite unusual.
I also have the good will of MW. Coon and Mr. Smith, who have the bathing pavilion
concession. They say it adds to the interests of the Beach.
I don It ""tsell or advertise anything. I place a blanket on the sand
and those who are interested toss a lithle something to show their appreciation.
Thousands of people saapped pictures of this last year to show the folks at home
what they saw at Clearwater Beach, so I believe I have something they like.

The undersigned represents Mr. Philip J. Frank, who is the present
owner of the captioned lots recently purchased as ~uch ~rom George Peck, et ux
by warranty deed dated August 15, 1956 and recorded on August 16, 1956 in Deed
Book 1613, page 629, public records of Pinellas County, Florida. Attached here-
to and made a part hereof you will find executed "request for approval of sub-
division plat, and agreement to install improvements, etc.", dated thie date
and signea by i~. Frank and his wife, who are the record holders thereof. You
will notice that we have stricken Items J, 4 and 5 from the request for the, reasons
hereinafter set forth.
Attached also please finqproposed replat o~ the a~ove lots, and your
particular attention is call em to the facL ~ha~ no street lines, right of ways,
easements, etc. are affected or relocated by reason of this proposed replat, and
that the only purpose 1hr a replat. of the property is to enlarge the lots.
A review of ~he public records, as well as information previously
submitted by l~. Leo Butler's office will indicate ~hat Howard Street was vacated
by the original subdivider, one, D. A. Salls. ~his took place subsequent to the
date Mr. Frank agreed to purchase Lots 1-9, Block "K" of }t'irst Addition to Salls
~ubdivision, which showed Howard Street as a par~t of the plat. Prior to closing
said purChase by Mr. Frank, I~. Salls dete~ined that he would replat First
Addition to Salls Sub!ivisio~, and our lo~s were thereafter designated as Unit 1,
First Addition to Salls Subdivision, Block 1, Lots 19-27 inclusive.
During the a~orementioned period of time and in Mr. Frank's contract
with the subdivider it was agreed by Mr. Salls that Prescott Street would be
paved and/or resurfaced satisfactory to the City ijf Clearwater, and that all
storm sewers, san&tary sewers and other utilities would be furnished to each lot
as a part of the consideration for the sale of the said 9 lot s by Mr. Salls to
Mr. Frank. I am p-epared to testify that the last. part of the money paid
by Mr. Frank to Mr. Salls was to be used or agreed to be used by l~. Salls ~or the
installation of these utilities. I was likewise assured br the City Manager that
a bond was on file with the City Manager in the amount of ilO,OOO.OO to secure
the installation of said mnilities.
'l'he aforementioned lots in Block 1 of Unit 1, First Addi tion to Salls
Subdivision are now improved by VA and FHA houses and are being occupied by
Mr. Frank's customers who purchased in reliance upon the fact that Prescott Street
would be attended to and the utilities referred to would be installed.
Prescott Street is a disgrac' to the Gity of Clearwater~ There are
holes six and eight inches deep up and down the entire street which are too
numerous to even count. The purchasers of these homes have been extreme.ly patient.
and are en~itled to the immediate consideration of the City in requiring Mr. D. A.
Salls to complete his commitments to the Cit~ to Mr. Frank, and to the ultimate
purchasers of homes in Sills Subdivision.
We n~ Dome to the subject of this request. Mr. Frank is no. the owner
of the captioned lots in First Addition to Salls Subdivision, and in view o~ the
fact that Howard Street has beo.m vacated there exists one-half of th e street area
formerly occupied by Howard Stree~, to-wit: 10 feet, which should be added to the
oorner lot. As stated before, 'there is no change insofar as the frontage of these
lots on Prescott Avenue are concerned, and only the inside boundaries are being
changed ao~o absorb the 30 feet overage resulting from the vacation of Howard Street.
~~. Frank employed Leo M. Butler, registered engineer and surveyor or
6learwater, who has prepared andproposed ~he attached repat of said Lots. In
~eviewing t6 he official .form for submitting plat for approval to the Planning
~oard and the City Commission, I find that is entirely unreasonable for the
City of Cle;:lrwater to require Philip J. Frank as a purchaser of 9 platted lots
in Block "J" of First Addition to Salls Subdivision, to bind himself, his heirs
and legal representatives to pave streets shown on ~he replat according to the
requirements as set forth in the said fonn, and the same goes for curbs, gutters,
parkways, easements, sanitary seRers, storm sewers and draimge utility lines, rights
of ways j and finally the bond whic h is required to accompany the said application
as a condition to approval of the replat, I have therefore, st~ken said items
simultaneous with Mr. Frank's signature. All of the auove matters which are per-
tinent are shown on the attached repiat.
I would like to call the Cityfs particular attention to my file regardin~
Mr. Salls complete failure to keep his solemn agreements with the City of Clearwater
as reflected by copy of a letter received by me from the City Attorney and addressed
to Mr. Salls as far back as May 20, 1955. I can personally testify that I have con-
siatantly eequested ~he City to take legal steps against Mr. Salls mav months even
prior to that time. Again on October 11, 1955 I received a copy of a similar letter,

This was the thinking b$; the City Commission �wenL•y-two years ago when it
purchased �he present building ior the Clearwater Chamber of Commerce.
When the purchase was made in 1934 the building was then the finest structure
of ii;s kind in the souL'h. With twenty.twc+ years of constant usage, mi.nimum
repair and no modern3zation, it is now both unattnactive and ill adapted to
ef�icient usage.
Costly emergency repairs are ba�Zy needed and extensive remodeling is urgently
required to both pxeserve the building and ef£iciently adap� it to the rapidly
exganding requirements of the �hamber oi' Commerce.
The Clearwater Chamber of Commerce aan and will arrange to finance iradependent�jc
and without cost to the Ci�y all needed r�pairs and alterations to tlie building
provided the City will make this possible by a tra$sEer � titl.e to the Chamber
of Commerce.

to and made a part hereof you will find executed ttrequest for approval of sub-

A review of the public records, as vaell as information previously

First Addition to Salls Subazvision, Bl�ek 1, Lats 19-27 inclusive.
During the aforementioned p�riod d.f time and in vir. Frank's contract
witn the subdivider it was agreed by NL:, Salls �hat Prescott SLreet wauld be
paved an d/or resurfa�e� satisfactory to the City 6f Cl�arwater, anci that aIl
storm sewers, �n�tar,y sewers and oth�r utilities would be f'urnished io each lot
as a part of the �onsideration for the sale of the said 9 lots by Mr. Sa].ls to
Mr. Frank. I am ��pared ta testify that t he last �,art of the money paid
by Nlro F�^ank to i�r. Sa11s was to be used or agreed to be used by i�'ir, Salls for the
installation of these utilities, I was likewise assured �y the Cit y 2�lanag�r that
a bond was on f ile with the City Manager in the amount of �10,000.00 to secure
the installation of said u�hslitiss.
The aforemeutioned lots in Block 1 oi Uni� 1, First Addition to Salls
Subdivision are now i.mproved by VA and FHA houses and are being occupied by
Mr. Frani�'s custoinex^s who purchased in reliance upon the fact that Pr.escott Street
would be attended to and the utilities referred to would be installed.
Prescott Street is a disgrac� to the Cit y o£ Clearwater.. There are
holes six and eigh.t inches deep up and rlocan the antire street which are too
numerous to even count. The purchasers of these homes h�ve been extreme�tly patient.
and are entiitled to the immediate consideration of t he Cit y in requiring Mr, D. A�
Salls to complete his commitments to the City, to tlr. Frank, and to the ulti�eate
purchasers of homes in S�lls ;ubdivision.
We �zm� nome to the subjeet of �his request. Mr, Frank is no�i the owner
of the captioned lots in First Addition to Salls Subdivision, and in view of the
factthat Howard Street has be�n vacated there exists ane-half of the street area
formerlp occupied by Howard Street„ to-witc �O feet, which should be added �o the
oo�ner lot. As stated before, �here is no criange insofar as the frontage of these
lots on Prescott Avenue are concerned, and onl,y the inside boundaries are being
changed so;�o absorb the 3g .feet overage resulting irora the vacation of Howard Street.
Iv1r, Frank employed Leo M' Butler, registered engzneer and surveyor of
8learwater, wh.o !�� �mepared arxlproposed the attached rei3at of said Lots. In
reviewing Lhe official %rm for submitting plat for approval to the Planning
board and the City Commzssion, I find that is entirely unreasonable for the
Ci;y of Cle.�rwater to require Philip J. Frank as a purchaser of 9 platted lo�s
:i.n Block "Jt► of First Addition to Salls Subdivision, to bind himself, his heirs
and legal representatives to pave streets shown on the rep3at according to the
requirements as set forth in tae said form, and the same goes for curbs, gutters,
parkways, easements, sanitary se�ers, storm sewers and drair�e utility lines, rights
of ways; and finally the bond which is required to accompany the said application
as a condition to approval of the re�latq I have therefore, st�ker. said items
simultaneous with Mr. Frankfs signaLure. All of the aiaole matters which are per-
tinent are shown on tha attached replat.
I would like to call the City(s pari;icular a�tention to my file regardin�
Mr> Salls completa failure to keep his solemn agreements with t�ae City of Clearwater
as reflected by copy of a letter received by me from the City Attorney and addressed
to Mr, Salls as far back as l�ay 20, 1955. I can personally testify that I have con-
sistantly �equested the City to talse legal steps against Mr. Sa11s maiy months even
prior to that time. Again on October 11, 19�5 I received a co�y of a similar lette�,

and I am sure that if NIr, Salls had any intenbions bf com�3eting his commitments
with the City he would have done�'so prio� to this time. However, I shall not
st�rd by and aee my client, Mr. Fx�ank, be forced into completing a cornrn�tment
placed by Mr. Sa11s in vierv of the many, :nany assurances by the Ci�yfbg� the
past two years that this resurfacing, etc. would be for�ed on Mr. Salls, and that
legal ac�ion would be taken in the event he faiZed.
This is represented to you as an extreme.: case of emergency, and the
Co�i�sion should waive the strice Iegal requireraen�s ordinarily required as a
prerequzsite in filino subdivision plats.
I would appreciaLe being notified of the earliest possible date :hat
the City Go�nission can hear this matter in or•dsr that I can be pressnt. I will
slso appreciate being furnished with a copy of the agenda on which th�s m�tter

I have given consideration to your request for my opinion as to whether ar not
the positio;� of Pd��ice Officer or Chief oi Police with the City of Clearwater
is of a charagter ms �sype considered hazardous within the meaning of Section 5
of the Employes� Fension Plan.
In my opinion, either of t hese positions or service in both of th�:se �ositions
is of a charactsr or �ype considered hazardous.
In reachin� Lhis o�ir,ion, I have considered both physical dangers attached to the
position from accident and from dangerous law violators and have given consideration
to the f act that life insur�nce companies generally rate this occupation as being
hazardeus and thus charge more ps�emium from persons so engaged.
