The Mayor called the meetinG to order and twlced. if there \'lere any corrections

Motion was seconded by Co~nlssioner Bohannon and carried unanimously.
It was reported that the Manae;er recommended acceptinG the lO~'l bid of *762.25
for one carload of clay sewer pipe from Columbia Pipe Company. Commissioner Bohannon
moved that the Commission a\"lard the bid to the Columbia Pipe Company in the amount
of $762.25 and that the proper offJ.ci.:1.1s authorize the order. I'lotion \'las seconded
by Comnissioner Strang and carried unanimously.
In regard to the bids for constructing sanitary sewer and lift station in the
vicinity of the Municipal Auditoriwn, the City Engineer recommended accepting the
low bid of $25,425.00 from Dave Curai'my, r.lulberry, Florida. Commissioner Strang
moved on the recollU11endation of the Ci ty Engineer that the contract for the sanitary
sewer and lift station in the vicinity of the Municipal Auditorium be awarded to
Dave C~raway in the amount of $25,425.00 and the proper officials be authorized
to execute a contract. Motion llfas seconded by CommitlsJoner Bohannon and carried
unanimously.
The f-1ayor announced the considera ti on of the renewal of the Ii cense for Howard
the Trader. Mr. Howard ~1ing was presen~ and was represented by Mr. Charles
Campbell of Coachman & Campbell, l\ttorr.cys. r.lr. Ci.:unpbell presented a plat to pave
the drivev/aYs at Howard's which had been approved by the City Engineer. (The City
Manager came in at this time -- 2:05 P.fvI.) Conmlissioner Roberts called attention
to the fact that the buildings on the north side 1;lere unsightly wi th lumber, etc.,
being staclced beside them, on the pal"t of the prolJerty zoned R_L~. The Mayor
suggested it be eheclced as being a fire hazard. Cornmissioner Bohannon reported
that some of the neighbors had complained of the papers blo\'ling off the parldng lot
in back and suggested that I'.1r. Ei'ling agree to put 11 hedge around it or a fence. The
City Attorney stated that a report from the Public Service Department indicated that
trash service had been discontinued on July l2~ 1954, as wooden boxes to contain the
trash were not provided, but added that no complaints had been received since that
time. The City Attorney i'laS of the opinion that proper containers should be provided
to keep trash from blowing around the area even though an outside concern was hired
to dispose of the e;arbage and trash. The Mayor suggested that the Public Service
Department make a periodic check to see that the trash and garbage is being disposed
of properly. Commissioner Bohannon also suggested that the parking lot be paved. The
City Attorney's opinion was that the Commission could not require Mr. Ewing to pave
the entire parking lot unless it was a health rnenace. Commissioner Bohannon reported
that upon making an inspection of Howard's place of business Mr. Ewing assured the
group that he was anxious to cooperate with any suggestions from the Commission. In
response to a direct question from Commissioner Bohannon~ Mr. Ewing agreed that he
would consider paving the entire parking lot and planting a hedge at the rear. The
City Attorney stated that the Chief of Police reported that a survey of the premises

required a duily copy of a transcript of such sales be furnished to the Police
Department if second hand articles were being sold. Co~ni3s10ncr Insco moved that the

The City f>'lano.ger l"eported 1n connection with the bid of Harl"is Pavin(; Company
for the pavinc; of Hobart J\venue \'/h1ch was found by him immediately after the meeting
of Suptelllber 11., 1956, and opened by him in the presence of the City Engineer and
found to lJe the l\.:w bid from amonG the.so received at the September L~th meeting.
He reported th<lt Harl"is Pavlng Company had aGreed to perform the services in the
event that the lJid wau a\'larded to them a.nd that he had a. le tter from ~l. H. Armston
Company, Incorporated, in Which they give their consent tu the bid being a\'larded to
Harris Paving Company, that being the lowe:3t and best bid. On the motion of
Commissioner Bohannon and necond of COllullissioner Insco it \'las moved that the action
or tho Commission at its meetinG 011 September 1.J., 1956, in awarding the bid for the
paving of Hobart Avenue to d. H. Armston, Incorporated, be rescinded and that the
bid in the amount of i!il!., 46l .90 be ai'mrded to Harri G Paving Company, that be1.ng the
lowest and best bj.d and that further the letter of consent from Armston Construction
Company be attached to and made a part of the minutes or this meeting. Motion was
carried unanimously.
Conunissioner Insco left the meeting at this time

The Mayor announced consideratlon of the renei'ml of the permit for Julius IvT.
Her'ing to operate a bait stand on the Municlpal Docle. Commissioner Roberts moved
that the permi t oi' Julius M. Hering for the bai t stand on the Nuniclpal Dad;: be
renewed from the date of expiration - September 10, 1956, under the terms of the
previous permit. Motion was seconded by COll~lssioner Bohannon and carried unanimously.
Comm:J.ssioner Insco returned at 2:55 P.fi1.
In regard to the plat of Broo]chi11 Unit 2) the City Ivlanager reported that the
developer had complied ~'Ii tl1 all of the resulat:l.ons and had submitted a personal
check for *5,000.00 as bond. The City Attorney recommended that a cashier's cl1eclr
or certified checlc or surety bond be required ac set out :tn tIle Ordinance.
Commissioner Strang moved the approv:ll of Broo~ch:Lll Subdivision Uni t 2 as approved
by all of the different departments subject to either a cash bond or surety bond as
recommended by the Cit~r Attorney. notion Has seconded by Commissioner Bohannon and
carried unanimously.
The City Man2ger prenonted the proposed 3chedule for the dredge which included
complet:l.ng the i'JOr}{ in thl':: cllannel, \'Ior>~ Clt the Scmlnole Street Dock, a per:i.od of'
thirty days in drydocl\. and then deepeninc; the channel in Stevenson Creele from the
railroad br:Ldge to the Betty Lane bridge. Co~n:1.ssioner Roberts asked if it 1I/a.S
intended to malce a launching ramp for' small boats u. t the end of Seminole Street.
The C1 ty I'<1anager was as;:.cd to report on the fe:u.:ibili ty of creating a launchinc;
ramp in this location. By consent, the report on the dredL:;e sC:1edule was approved.
rvlr. Robert Balcer, attorney, appearing on behalf of r.11". :1. H. I.10ses, Resident
r.1anager of the Fleet\'/ood 1\lJartment:3, stated tj1at they T:Jould li1<:e the City to accept
the dedication of the streets and alleys 1n the areu. He presented a plat showing
the streets and alleys. I},'he Engi.leer recommended that the dedication 01' the streets
be approved but that only an easement be required for the alleys and that the City
should not accept the dedication of th8 pa~:inG areas behind the buildings.
COllUnissioner StranG moved that the dedication of the Gtreets and the granting of
the easements for the alleys be approved subject to the proper Resolution being
prepared for approval. Motion was seconded by Cownissioner Bohannon and carried
unanimously.
A letter was read from Mr. Harold Briley of' Briley, Wild & Associates stating
tha t his office had made final inspection of the worl{ performed by Smi th-Sv1eger
Company in connection \'lith Part II of tile storm GeVIer project and reconunended that
the contractor be given llis final payment. A Resolution \'l.2S read authori zing the
payment of $1,235. L~O to the Smi th-Si'/eger Construction Company. Con~issioner Strang
moved that Resolution 56-7 be passed and adopted and the proper officials be

In regard to mov:Lng the fill for Stevenson Creek Parle from the corner of Duncan
and Gulf to B~y Boulevard) the City Manager reported that the City had not yet
obtained the letter from Food F~ir permitting the City to move the fill free of
charge.

The City Attorney read for its first reaclin[; Ordinance 718 which \'lOuld

report prepared by the Federation of Civic Clubs at which time the estimates were

approved and a Comnittee be appointed to set up and talce care of the occasion.
Motion ..'las seconded by Commissioner Strang and carried unanimously.
The City Attorney brought up the question of a date for the next meeting..
September 17th or September 24th. Commissioner Bohannon recommended the 24th.. but
was decided to leave it up to the City Manager as there miGht be bids coming in on
both dates. There being no further business to come before the Board) the meeting
was adjourned at 5:55 P.M.

Meeting the proposed dredge schedule is as follows:
(a) It, is expected chat the dredge will complet.e ~he channel work by
September 24, 1956.
(b) We anticipat.e f'our weeks work at t. re Seminole Street Dock which
will keep this equipment busy until about Oc~ober 22n~.
(c) An Overhaul period of approxilr.ately thirty days is recomnended to
separat.e, clean and paint. t.he pontoons and \.0 repair machinery.
(d) 1'he dredge will be t.ranspor~ed overla nd ~ 0 St,evenson Creek about
November 19) 1956 to begin a channel f our feat dee p a nd two hundeed
feet wide from the railroad brid~e to the Bet.ty Lane Bridge.
We believe t.hat the Stevenson Creek project will run into 195e and we
recommend that. schedulin~ o~ fur~her work ~or this unit be deferred indefinitely.

in the World M.en's Soft Ball Tournament soon to be held in Sacramento, Cedif-
ornia, and
WHEREAS, the members of said Soft Ball Team, in addit.ion to beirg
excellent athlet.es, are ~orthy representatives ~6 the Florida citizenry and are
good will ambassadors ~or the Stat e o~ Florida, and

mined as follows:
(A) 'J.'hat the Cit.y of Cle arW::1t-c.l' now ovll1 s t operates a nd maintains
a comblned and consolida~ed sys~em of utility proper~ies supplyingwa~er and
sanitary and st.orm sewerage services in and to said City and its inhabitants
and oth~ users, and tohat; it. is .lllecessary and assent-ial that said utilit.y
propert.ies be i~uproved and ext.ended, as hereinafter provided, ~or ~ he protecti on
of t.he heal~h, safety and welf"are of the Ctty and it s inhabitanr.5.
(H) That che City derives revenues from rates, fees and charges
made and collected fer the services and faci1icies of the aforesaid utility
propert.ies a nd ~'1d revenues are nOli pled~ed or encumbered in noy mann er and that
no obli'.;at.i ons of any kind are chargea bl.e agains t the revenues of Slid utility
properties, or any part. t hereof except as f'ollOll s:
(1) The Ci~y has heret.ofore issued and has now outst.anding its
Utility Revenue Cer~ificates, Series of 1955, da~ed ~~usc 1, ~955, in the
principal anount o~ ~1,500.000 maturing in numerical order on August. 1 of each
year in Ule yet1rs ],956 t.o ~985, inclusive, ",hicn by ~heir terms m-e payable from
and secur~d by a lien upon and pledge of" t.h e revenues derived f"rom t.he operation
o~ ~he aforesaid utility properties, in the manner provided in the Original

(D) rha~ ~he average annual Ne~ Revenues of the aforesaid u~ility
proper~ies (as such term is de~ined in the Original Ordinance) during ~he
preced1n~ two (2) years were ~370,553.93.
(E) That ~he Ci~y is authorized to issue the Certificates
authorized herein as pari passu additional cer~ificates wl~hin the authorization
contained in Sec~1on 3.04 (K) of t.he Original Ordinance.
(F) That the aforesaid utility properties shall be improved and
extended subs~ant.ially in accordance with the plans and specifications prepared
by Briley, Wild and AS60cia~es, Engineers, and horetofore filed in ~he office
of the Ci~y Audi~or and Clerk at an estimated cost of not exceeding $2,000,000.
Such cost. shall be deemed 1#0 include t.he coat. of t.he construet.~on or acquisition
of extensions, improvements and betterments t.o said utility properties, including
the acquisition of any lands or interest. theroin and of any fixtures or equipment
or properties deemed necessary or convenient thereror, interest. upon ~he certifi-
cates is~ued pur~uant t.o this ordinance prior to, and during and for six mont.hs
after the comple t.ion 011 sucb extensions, improvement s and bet.~el"ments, engineering
and legal expenses, expenses for estimat.es of costs ani of revl~nues, expenses
for plans, speci~ications and surveys, adminst.rative expensos ar.d such other
expenses as may be necessary or incident to ~he financing authorized by ~his
ordinance, and \-he consliruct.1on Dr acquisit.ion of ~he extensions, improvements
and betterments authorized by .t.his ordinance and ~he placing o~ same in operation.
(G) 'j,'hat t, he e6t,iJna~ed revenues to be derived from t he operation
of said utility propert.ies will be more chan sufficient to pay all operat.ing and
maintenance costs of said utili~y properties and t.o pay the princiFal of and
interest on \-he Certificates herein au~horized and the principal of and interest
on t.he outstanding Uti1it.y Hevenue Cert.ificat.es, Series of 1955, dat.ed August 1,
1955, and all s1nkingfund, reserve and other payments provi.ded'~.for in this
ordinance, and in the Original Ordinance, and that it will never ba necessary
or aut.horized t.o 13vy taxes on any roal propert.y in said City to pay the principal
of or interest on any of the Certificat.es ~o be issued pursuant ~o ~h1s ordinance,
or t.o make any of the reserve, sinking fund or other payQ)ents provided for in
this ordinance, and that ~he Cert.ificates issued pursuant. to this ordinance
shall mot const.it,~e a lien upon any of the said ut.ility proJ.-6rtiies or upon any
other property whaLsoev~r mf ~he City.
1.03. QltDINAGCE '.LO COl\~)TI'futE CON'l'H./.C'i'. In cor.sideration of the
acceptance of the Certificates authorized t.o be iS5ued hereunder by tihose who
shall hold ~he same from time l.O t.ime, t.his ordintlnce and \-he Original Ordinance
shall be deemed to be and shall constitute a contract between che City and
such cJr~i~ica~eholders, and t.he C0venBnts arn agreements herein and in said
Original Ordinance set. forth to be perrormed by said City shall be for the
equal benefit, protiection and security of t.he legal holders of any and all of
t.he U~ility Revenue Cert.ificates, ~eries of 1955, and the Cer~ificaces issued
hereunder, and t.he coupons attached thereto, all of Which shall be of equal
rank and wit.hou~ preference, priorit.y or dist.inct.ion of any of 1:, he Certificat.es
or coupons over any other t.hereof, except as expressly providedtberein and herei~.
1.04. DEFINItIONS. That. all of t.he definit.ions and ~erms contained
in the Original Ordinance shall have the same meanings ascribed thereto in the
Original OrdinaIlc e and shall apply fully to this ordinance and t.o t he Certi~icates
issued h~eunda'.

Cit.y of Clearwa~er, l'lcrida, 'to be known as "Utilit.y Revenue Cert.i~icd.tes,
Series of 1956", are hereby au thorized to be issued.in ~he aggregate prinCipal
amount. of not exceeding, '1'1AIO 1~i1lion Dollars ($ 2,000,000)0 for t.he
purpose of financing the cost or the improveae nt 5 to t he System as provided
inSect.ion 1.02 (F) hereof.
2.02. DESCRIF'.i:'ION OF GER'l' IFIC liTES. 'l'he Certificates shall be dated
A~ust. 1, 1956; shall be in \-he denomination of ~l,OOO eachp shall be numbered
from 1 t.o 2000 , inclusive; shall bear interest. at. a rate or rates, not exceeding
t.he legal ra~e, tio be de~ermined upon the sale thereof, payable semi-annually
on February 1 and Auguut 1 of each year, and ahall mature serially in numerical

payable with respect to bo~h principal and interest at the principal
office of the Chase Manhat~an Bunk, New York City, New York in lawful
money of the United States of America, and ahall bear interest from
their date, payable in accordance with and upon surrender of the ap-

have signed or sealed any of the Certificates shall bease to be such officer

delivered as herein provided and ~y be issued as if ~e person who signed
or sealed such Certificat.es had not ceased t.o hold such office. Any Certi-

for one carload of clay setiver pipe from Columbia Fipe Company. Commissioner Bohannon
moved that the Commission award the bid to the Columbia Pipe Company in the amount
of �p762.25 and thai the proper officials author�ze the order. Motion was seconded
by Comm:i_ssioner Strang and carried unanimotzsly.
In regard to the bids #'or constructing sanitary sewer and lift statior� in the
vicinity oP the Nunicipal Auditorium, the City Engineer recommended accepting the
lov�r bid of $25,425.00 from Dave Caraway, Mulberry, Florida. Commissioner Strang
moved on the recornmendation of the City Engineer thati �he contract for the sanitary
setiaer and lift station in the vicinity of the Municipal Auditorium be awarded to
Dave C�araway in the amount of �25,425.00 and the proper officials be authorized
to execute a contract. bTotion Gvas secondec:� by Commissioner Boharuion anct carried
unanimously.
The Mayor announced Lhe consideration of the renetval of i;he license for Howard
the Trader, Mr. FIoward Etling was present and �aas represented by D1r, Charles
Campbell of Coachman �w^ Campbell, Attorneys. Mr. Campbell presentzd a pla� �c pave
the drivesvays �.t Howard�s which had been approved by the City �gineer, (The City
Mana.ger came in ai, 1;his time -- 2:05 P.M.) Commissioner Roberts called attention
to the fact that the buildings on the north side tivere unsightly with lumber, etc.,
Y�eing siacked beside them, on the part of the property zoned R-4. The A7ayar
suggested it be checked as being a fire hazard. Conanissi�ner Bohannon reported
that some of the neighbors had complained of the papers blowing off the parkin� 1ot
in back and sug�ested that f�1r. Ewin� agree ta put a hedge around it or a fence. The
City Attoi�ney stated that a repa.t fr�^m the Public Service Department ir_dicated that
trash service had been discontinu�d on July 12, 1g54, as wooden boxes to contain the
trash were not providecl, but added that no compl�.ints had been received since that
time, The City Attorney tvas of the opinion that proper containers should be provided
to keep trash from blowing aroLmd the area even though an outside concern taas hired
to dispose of tr�e garbage and trash. The Mayor suggesterl that the Public Service
Department make a periodic check to see that the trash and garbage is being disposed
of properly. Comniissioner Bo:�annon also aug�ested that the parking lot be paved. The
City Attor.ney�s apinion was that the �ommission �ould not require Mr, Evring to pave
the entire parking lot unless it cvas a health menace. Commissioner Bohannon reported
that upon makin� a.n inspec�ipn of Howard�s place of business Mr, Ewing assured the
group that he was anxious to coo�erate with any sug�estions frbm the Commission. In
response to a direct question from Commissioiler Bohannon, MY�, Ewin� a�reed thai� he
tivould consider paving the entire park3.ng lat and planting a hedge at the rea,r, The
C:tty Attorney stated that the Chief of Police reported that a survey of the premises

fbund to be the low bid from among those rece3ved at �he Septembes 4th meeting.
He reported that Harris Pavin� Company had agreed to perform the services in the
event that the bid tvas ativarded to them aizd that he had a leL-ter from W. H.Armstoil
Company, Tncorporated, in tivl�ich they give their consent to the bid bein� awarded to
fiarris Paving Company, Lhat being the lowest and best bid. On the motion of
Commissioner Bohannon and second of Corrunissioner Insco it �vas moved that the actiori
o�' tihe Commission at its meeting on September �F, 1�5C�, in awardin� the bid for the
paving of Hobart Avenue to t�l. H. ArmstotZ, Incorporated, be rescinded and tha.t tlze

in the water system, sanitary setaers and storm sewers. Reference tivas made to a
report prepared by the Federation of Civic Clubs at ti+�hich time the estimates w�re

(b) We anticipaLe four weeks work at the Seminole 5treet Dock which

(c) An Overhaul period of approxiu:ately thirty days is recommended to
separate, clean and Fai� the pontoons and to re�air machinery.
(d) The dredge will be transpor�ced overland t o Stevenson �reek about
Novemher 19, 1956 to begin a.hannel f our fe�t deep and two hundEed
feet wide from Lhe railroad Lrid�e to ihe Betty Lane Bridge,
