06/04/1956 The City Attorney read a letter from Colonel Clarence Hickey, 1550 Grove Street, complaining of low flying planes from the City Airport and recommending that the use of the Airport be discontinued. Mr. John Barsa, 416 Patricia Street, spoke from the floor in agreement with Colonel Hickey. The Mayor then stated that the next order of business would be the approval of the minutes of the regular meeting of May 21st, 1956, and special meeting of May 28th, 1956. Commissioner Bohannon moved that the minutes of the regular meeting of May 21st and the special meeting of May 28th be approved subject to any corrections or amendments by Comrnission~r Strang in accordance with copies furnished each member in writing. Motion was seconded by Commissioner Roberts and carried unanimously. The Mayor announced that a certificate had been presented to Mr. D. J. Raye, Disposal Plant Superintendent, from the State Board of Health indicating that the City of Clearwater had won an award for the best operation of a sewerage plant in cities of over 10,000 population. This was received for the Skycrest Plant during the 24th annual Short School Conference on Water Supply and Sewerage being held last week at the University of Florida. The Mayor commended Mr. Raye on his opera- tion of the plant. The City Manager requested deferment of the tabulation of bids for electrical equipment for the Municipal Auditorium in order to bring in the tabulation of all remodeling bids at the same time. The Comrndssion consented to this deferment. The Mayor announced the next item as a continuation of the Public Hearing on the request of Mr. H. H. Houchard for a fifteen foot setback from the south lot line on Maple street of Lot 145, Glenwood Subdivision. A letter was read from Mr. Houchard requesting cancellation of his request. Commissioner Roberts moved that Mr. Houchard's application be cancelled at his own request. The motion was seconded by Commissioner Bohannon and was carried unanimously. The Mayor announced the Public Hearing on the construction of sanitary sewer, pavement, curb and drainage in LaSalle Street from the east line of Greenwood Avenue easterly for approximately 1,318 feet. The Manager reported that a prelim- inary hearing was held \rlth the property owners to explain the project, and at the same time he explained the need for sanitary sewers to go in before the pavement, and all the property owners present agreed to the improvement. The Mayor explained the advantage of having the sanitary sewer and that in the long run it would cost the property owners less than having septic tanks. The Mayor then explained just when and how the payments could be made. Letters were read from Sarah W. Paige, Dorothy B. Paige, Sam Devine, Jimmy Bullard approving the project. The Mayor inquired if there were any objections and there were none. Comrndssioner Bohannon moved having held this Public Hearing and having heard no objections that the proper City officials be authorized to advertise for bids on the construction of a sanitary sewer, pavements, curb and drainage on LaSalle Street from the east line of Greenwood Avenue easterly for approximately 1,318 feet. Commissioner Roberts seconded the motion and it was carried unanimously. \ ,j I , 1 The Mayor then read a letter to the Commissioners from the Lions' Club of Clearwater requesting a donation of $300.00 toward a float to be entered in the parade during the Lions' International Convention at Miami, June 27th to 30th, 1956. He also read the letter from the Special Events Committee which did not recommend this appropriation becuase of the possibility of establishing a precedent. (Commissioner Strang came in at this time -- 1:55 P.M.). After a short discussion, Commissioner Insco moved that a donation of $300.00 from the Special Events Fund be appropriated toward the expenses of this float. Motion was seconded by Commissioner Roberts and carried unanimously. A letter from Mrs. Christine E. Barry, Mr. John F. Allen, and Mr. F. G. Nelsonl Real Estate Brokers, was read proposing to lease a portion of Lot 7, City Park Subdivision, approximately 50 feet on Causeway Boulevard and 100 feet on Poinsettia Street for a period of fifteen years \~ith renewal option of ten years for a real estate office which will also offer free acco~nodation information service and will act as a clearing house for the Clearwater realtors who do not operate offices on the Beach. Commissioner Roberts stated that he did not believe that property should be leased for commercial purposes. Commissioner Bohannon moved that the request be denied which was seconded by Commissioner Roberts and carried unanimously. The City Attorney read a Resolution from the Civitan International expressing gratitude for kindnesses and services during their District Convention. The Mayor stated that he had attended portions of the convention and commented favor- ably on the type of people that attended and welcomed them back again. Commissioner Insco moved that the Resolution be received with appreciation. Commissioner Bohannon seconded the motion and it was carried unanimously. The City Attorney read Ordinance #708 declaring the intention of the City or. Clearwater to annex acreage in what is to be l{nown as Druid Acres Second Addition into the corporate limits of the City of Clearwater. He reported the receipt of an affidavit from Mr. L. W. Sever that there are less than 10 registered voters in the area. Commissioner Strang moved that Ordinance In08 be passed on its first reading. Motion was seconded by Con~issioner Bohannon and carried unanimously. CommisSioner Strang moved that Ordinance In08 be considered on its second reading by title only with the unanimous consent of the Commission. Motion was seconded by Commissioner Bohannon and carried unanimously. The City Attorney read Ordinance 11708 by title only. Commissioner Strang moved that Ordinance ~08 be passed on its second reading by title only. Motion was seconded by CommisSioner Insco and carried unanimously. Commissioner Strang moved the consideration or Ordina~ce h708 on its third and rinal reading with unanimous consent of the Commtssion. Motion was seconded by Commissioner Insco and carried unanimously. The City Attorney read the Ordinance in full. Commissioner Strang moved that Ordinance 11708 be passed and adopted on its third and final reading and that the proper officials be authorized to execute it. Motion was seconded by Commissioner Insco and carried unanimously. The City Attorney explained the purpose of preparing Ordinance lf70g for controlling the construction and installing or private wells by saying that Florida statutes control private wells serving more than one family but do not control those serving only one family. It is said in Section 2 of the proposed ordinance that no permit shall be issued until said plans and specifications have been approved by the City Engineer and until permit has been obtained from the State Board of Health. At one point, the City Manager recommended deleting the words "Building Inspector" and inserting the word "City" in its place. A short discussion ensued with other recommendations being made. It was decided to read the Ordinance on its first reading and take up the recommendations at a later meeting. The City Attorney read Ordinance 11709 on its first reading. Commissioner Roberts moved that Ordinance #709 be passed on its first reading. Commissioner Bohannon seconded the motion which was carried unanimously. As the Commissioners had not received copies of the May 31st invoice from Briley, Wild and Associates, Commissioner Strang moved that the Resolution regarding payment of the invoice be deferred to a later meeting in order for the Commissioners to receive copies of the invoice. Commissioner Bohannon seconded the motion and it was carried unanimously. The City Attorney stated that he had received a report from Briley, Wild and Associates relative to location of the new Disposal Plant. The CommissIoners decided not to take up this matter at this time but Commissioner Bohannon requested that a State Health Department representative inspect the Marshall Street Plant and report to the Commission. In connection with the proposed dredging in Stevenson Creel{, Commissioner Roberts stated that he wanted it understood that the City is trying to establish a bullili,ead line and not actual seawalls along Stevenson Creek from the A.C.L. railroad bridge to Betty Lane. A Resolution was presented requiring forty-two property owners to clean their lots of weeds and underbrush. Commissioner Strang made a motion to adopt this Resolution. Alvord for Block E, Slcycrest Unit 10. Tne contract on Block E calls for $789.50 and the other $10,923.50. The Manager reported that the contracts have been checked by his office, and the City Attorney's office and he now recommends approval. COrnrrUssioner Roberts moved that the contracts be approved and the proper officials be authorized to execute them. Commissioner Bohannon seconded the motion and it was carried'unanimously. The City Attorney explained that Mr. James Novotny applied for a building permit for alterations and additions to his Glass House Apartments which included extensions outward from a point between the first and second floors, with one being apparently a marquee and the other a passage\'laY to provide entrance to the second floor apartments. It was reported that these extensions went beyond the setback line on Coronado and Third Street, and Mr. Daniel Boucher, owner of the south 90 feet of Lots 1 and 2, Replat of Lot 3, Block B, Columbia Subdivision, complained of a violation of the zoning setback laws. The CoI, ty Attorney ordered the permit revoked but did not feel he had the authority to settle the matter and therefore brought it before the Commission. Mr. E. B. Casler, Jr., attorney ror Mr. Novotny, stated the permit was issued on May 18th and was not revoked until the afternoon of June 1st after approximately $15,000.00 had gone into the work and that two inspections had been made by the City Inspectors. Mr. A. T. Cooper, Jr., attorney for Mr. Boucher, said that the encroachment was not apparent until the steel work had gone up and the concrete base poured and that the complaint was made as soon as possible after that time. He believed that Mr. Novotny's architect, builder, and Mr. Novotny himself should have lcnown about the encroachment but the City Building Inspector should have caught ~t at the time of issuing the permit. The City Attorney stated that it was within the powers or the City Commission to either let the permit stand revoked or reinstate j.t. Mr. W. J. Nixon, the builder, read parts of the Zoning Ordinance and showed pictures of the construction as it now stands, claiming that he could see no violation. The City Attorney recommended that in the future when a similar situations arises with an overhanging marquee extending over the setback line that the Building Inspector be instructed to bring the request for a permit to the attention of the Zoning Board to ask if it should be perrrdtted and then that it be brought to the City Commission if necessary. Cornmdssioner Roberts moved with considerable regret that it is necessary in order to avoid a hardship that the permit be reinstated. Motion was seconded by Commissioner Strang. Upon the vote being taken, Commissioners Roberts, Bohannon, Insco and Brown voted "Aye". Conunissioner Strang voted "No". Commissioner Roberts moved that there be free admission at the Colored Swimming Pool for the colored people to swim any time the pool is open but that would not include any services such as towels, suits, etc., and that the City Manager be instructed to work out with the Recreation Department the idea that any fee for swimming in the Colored SWimrndng Pool be eliminated. Motion was seconded by Commissioner Bohannon and carried unanimously. The City Manager reported that the fogging machine for mosquito control work had been delivered, that the truck would be sent to Tampa tomorrow to have it mounted, and by the latter part of' this weelc a schedule of fogging would be started in cooperation with the County Mosquito Control Board. Commissioner Insco recommended that the Mayor proclaim August 16th, 17th, and 18th as Clearwater Bargain Days as requested by the President of the Clearwater Merchants Association. The Mayor requested that the inror.mation be turned over to the City Attorney's office with a request tnat he prepare the proclamation. There being no further business to corne before the Commission, the meeting was adjourned at 4:50 P.M. Licktc�n City Engineer The Mayor opened the meeting and in the absence of the Reverend 0. E. Hanna, he called on the City Attorne� to give the invocation. The Mayor then stateu that the next order of business would be the approval of the minutes of the regular meeting of May 21st, 1956, and special rreeting of May 28th, 1956. Commissioner Bohannon moved that the minutes of �Ehe regular meeting of May 21st and the special meeting of May 28th be approved subject to any corrections or amendments by Commissioner Strang in accordance with copies furnished each member in writing. Motion was aeconded by Comm3 ssioner Roberts and carried unanimously, The Ma.yor announced that a certificate had Y�een presented to Mr, D. J. Raye, Disposal Plant Superintendent, f'rom the State Board of Health indicating that the City of ClearwatEr had won an aUrard for the bes� operation of a sewerage plant in cities of over 10,000 population. This wa�s receivec� for the Skycrest Plant during the 2�th annual Short School Conference on Water Supply and Sewe�age being held last trreel{ at the LTniversity of Florida. The Mayor commended Mr. Raye on his opera- tion of the plant. The City Manager requested deferment of the tabulation of bids for electrical equipment for the Municipal Auditorium ir_ order to bring in the tabulation of all remodeling bids at the same time. The Commission consented to this deferment. The Mayor anno7�.nced the next item as a continuation of the Public Hearing on the request of Mr. H. H. Houchard for a fifteen foot setback frnm the south lot line on Maple Street of Lot 145, Glenwood Subdivision, A letter was read fram Mr. FIouchard requesting cancellation of his request. Cc�mmissioner Roberts moved that Mr. Houchard�s application be cancelled at his own request. The motion was seconded by Commissioner Bohannon and was carried unanimously. The Mayor announced the Public Hearing on the construction of sanitary sewer, pavement, curb and drainage in LaSalle Street from the east line of Greenwood Avenue easterly for approximately 1,318 feet. The Manager reported that a prelim- inary hearing was held with the property owners to explain the project, and at zhe s�me time he expsained the need for sanitary sewers to go in before the pavement, and all the property owners present agreed to the improvcment, The Mayor s�eplair_ed the advantage of having the sanitary sewer and that in the long x°un it would cost the property owners less than having septic tanks, The Mayor then e�lair�ed just when and .'�ow the payments could be mu.de, Letters were read f.rom Sarah W. Paige, Dorothy B, P�.ige, Sam Devine, Jimmy Bullard approving the project. The Mayor inquired if there were any objections and there were none. Commissioner Bohannon moved having he]_d this Public Hearing and having heard no objections that the proper City officials be authori2ed to advertise for bids on the construction of a sanitai^y sewer, pavements, curb and drainage on LaSalle Street from Lhe east line of Greenwood Avenue easterly for approximately 1,31$ feet. Commissioner Roberts seconded the motion and it was carried unanimously. The n4ayor then read a letter to the ComrrLissioners frum the Lions� Club of Clearwai:er requesting a donation of �300.00 toward a float �o be entered in the parade during the Lions+ International Convention at vLiami, June 27th to 30th, 1956. He also read the letter f'rom the Special Events Committee which did not recommend this appropriation becuasc of the possibility of establishing a precedent. (Commissioner Strang came in at this time -- 1:55 P.M.). After a short discussion, Commissioner Insco move� that a donation of $300.00 from the Special Events Fund be appropriated toward the expenses of tihis float. Ccmmissioner Bohannon aeconded this motion and it was carried unanimously. The City Attorney read a letter from Colon�l Clarence Hickey, 1550 Grove Street, complaining of low flying planes from the City Airport and recommending that the usE of the Airport be discontinued. Mr. John Barsa, 416 Patricia Stre�t, spoke from �the floor in a�reement with Colonel Hickey. Nelson, Real Estate Brokers, was read proposing to lease a portion of Lot 7, Ci�y Park Subdivision, approximately 50 feet on Causeway Boulevasd and 100 feet on Poinsettia Street for a period of fifteen years with renewal �ption of ten years for a real estate office �vhich Will also offer free accomr�iodation informat3on service and w�.11 act a� a clearing house for �he Clearwater realtors who do not operate off�.ces �n the Beach. Commissioner Roberts stated that he did not believe tha� property should be leased for commercial �urposes. Commissioner Bohannon moved that the request be denied tivhich was secanded by Comm3.ssioner Roberts and carr3ed unanimously. The City Attorney read a Resolution from the Civitan Tnternational expressing grati-�ude for kindnesaes and services during their Distr�et Convention. The Mayor stated that lze had attended portions of the con�rention and commented favor- ably on the type of people that attended and welcomed them back again. ComrrLi,ssioner Insco moved that the Resolution be received with appreciation. Commissioner Bohannon seconded the motion and it was carried unan3mously. The City Attorney iead Ordinance �708 declaring the intention of the City of Clearwater to annex acreage in what is to be known as Druid Acres Second Addition into the corporate limits of the City of Clearwater, He reported the receipt of an affidavit from Mr. I,. W, Sever that there are less than 10 registered voters in the area. Commissioner Strang moved that Ordinance �708 be pa�secl on its first reading. Motion was seconued by Commissioner Bohannon and carried unanimously. Commissioner Strang moved that Ordznance �'70f3 be passed and adopted on its third and final reading and that the proper officials be autharized to execute i�. Motion was sec�nded by Commissioner Insco and carried unaniriously. The City Attorney explained the purpose of preparing Ordinance �j09 for controlling the construction and installing of private wells by saying that Florlda statutes control private wells serving more than one family but do not control thoae serving only one family. It is said in Seetion 2 of the proposed ordinance that no permit shall be issued until said plans and specifications have been approved by the City Engineer and until permit has Ueen obtained from the State Board of Health. At one point, the City Manager recommended deleting the words "Building Inspector" and inserting the word "City" in its place. Commissioner Roberts moved that Ordinance �{(09 be passed on its first reading. Commissioner Bohannon seconded the motion which was carried unanimously. As the Commissioners had not received copies oi the May 31st invoice from Briiey, Wild and Pssociates, Commissioner Strang moved that the Resolution regarding payment of the invoice be deferred to a later meeting in order for the Commissioners to receive copies of the invoice. Commissioner Bohannon seconded �he motion and it was carried unanimously. The City Attorney stated that he had received a report from Briley, Wild and Associates relative to location of the new Disg�sal Plant. The Coznmissioners decided not to �Eake up this matter at this time but Commissioner Bohanr�on requested that a State Health Department representative inspect the Marshall Street Plant and repc�rt to the Commission, In connection with the proposed dredging in Stevenson Creek, Commissioner Roberts stated that he wanted it understood that the City is trying to establish a bulkhead line and not actual seawalls along Stevenson 'Creek from the A,C.L, railroad bridge to Betty Zane. The Manager reparted that the contracts hasre been checked by his �ffice, and �he C�.ty Attorney�g of£ice and he now recommends approval. Commiesioner Roberts moved that the contracts be approved and the proper of£icials be authorized to �xecu�e them. Commissioner Bohannon seconded the motion and it was carried•unanimously. The City Attorney explained that Mr. James Novotny applied for a buildin� permit for alterations and additions to his Glass House Apartments which included extensions outward from a point between the first and sec�nd floors, with one being app�.rently a marquee and the other a passaget�ray to provide entrance to the second floor apartments. It was reported that these extensions went beyond the setback line on Coronado and Third St'reet, and Mr. vaniel Boucher, ovmer of the south g0 feet of Lots 1 ar.d 2, Replat oT Lot 3, }31ock B, Columbia Subdivision, complained of a violation of the zoning setback lawse The City Attorney ordered tb.e permit revoked but did not feel he had the authority to sett?e tne matter and therefore brought it before the Commission. Mx. E. B. Casler, Jr., attorney f'or Mr. Novotny, stated the permit was issued an May 1$th and was not revoked until the afternoon of June lst after approximately �15,000.00 had gone into the work and that two inspeccions had been made by the City Inspectors. Mr. A. T. Coopery Jr., attorney for Mr. Boucher, said �hat the encroachment was not apparent until the steel wark had gone up and the concrete base poured and that the complaint was made as soon as possible after tha� time. He believed that Mr. Nuvotny�s architect, builder, and Mr. Novotny himself should have known about tY:e encroachmen� but the City Building Inspector should have caught it at the tiime oz issuing the cermit. The City Attorney stated that it was within the powers of the City Commission to either let the permit stand revoked or seinstate it. Mr. W. J. Nixon, the builcler, read parts of the Zoning Ordinance and showec� pictures of the canstruction as it naw stands, claiming that he could see no violation. Commissioner Roberts moved that there be free admission at the Colored Swimming Pool for the colored people to swim any time the pool is open but that would no� include any services such as towels, suibs, stc., and that the City Manager be instrucied to work ou.t with the Recreation Department the idea that any iee for swimming in the Colored Swimming Pool be eliminated. Motion was seconded by Commissioner Bohannon dnd carried unanimously. The City Manager reported that the fogging machine for mosquito control work had been delivered, that the truck would be sent to Tampa tomorrow to have it mounted, and by the latter part of this week a schedule of fogg�ng would be started in cooperation with the County Mosquito Control Board. Commissioner Insco recommended that the Mayor proclaim August 16th, 17th, and 18th as �learwater Bargain Days as req�iPsted by the President of the Clearwater Merchants Association, The Mayor requested that the information be turned over to the City Attorney�s office with a request that he prepare the pro�lamation.
