The City Commission or the City of Clearwater met in regular session at City
Hall, Monday, October J, 1955, at 1:30 P.M. with the following members present:

The Mayor called the meeting to order. The invocation was given by the
Reverend J. S. Dauerty of Clearwater Beach. The Mayor inquired if there were any
corrections to the minutes of September 19th and September 26th. The Clerk reported
that Paragraph J, Page 507, should read "setting back the curb nine feet on the
north side". Commissioner Bohannon moved that the minutes of the regular meeting of
September 19th and the special meeting of September 26th be approved as amended
in accordance with copies furnished each member in writing. Motion was seconded
by Commissioner Russell and carried unanimously.
The City Manager reported that ten bids had been received for one carload or
9,000 feet of t~o inch pipe and 7,000 feet of 3/4 inch pipe. The bids were read

Commissioner Strang moved that the bids be referred to the Manager for tabulation
and return to the next meeting. Motion was seconded by Commissioner Kennedy and
carried unanimously.
It was reported by the Manager that seven bids had been received for construc-
tion of paving in Lincoln Avenue from Pierce Street to Court Street. The bids were
opened and read as fo llows:

After tabulation, the City M~ager recommended accepting the low bid of $6,055.50
from Blackburn Paving Contractors. Commissioner Russell moved that Blackburn
Paving Company be given the bid for paving of Lincoln Avenue from Fierce Street
to Court Street in the amount of $6,055.50, the low bid. Motion was seconded by
Commissioner Kennedy and carried unanimously.
In regard to the offer of Mr. Harry Shepard to dedicate right of way for the
west side of Duncan Avenue from Gulf-to-Bay Boulevard to Turner Street at the
location desired by the City and a thirty foot right of way for the north side of
Turner Street from Duncan to Keystone, the City Engineer presented a sketch Showing
the proposed rights of way and pointed out that the City still needed to acquire
a portion of the thirty foot right of way for the south side of Turner Street from
Mr. V. V. Carmichael. The Engineer recommended accepting Mr. Shepard's offer of
right-of-way in return for cancellation of $5,385.00 in prospective assessments
for installing sewer and paving along Duncan Avenue. Commissioner Kennedy moved
that the offer of Mr. Harry W. Shepard to dedicate the Duncan Avenue and Turner
Street rights of way for the amount of' $5,3gS.00 which was to be set off against
the paving assessment be accepted conditioned upon the City's ability to acquire
the additional right or way on Turner Street as shown by the Ci~ Engineer's map
and that the appropriate officials be authorized to negotiate with the owner
(Mr. Carmichael) for the right of way. Motion was seconded by Commissioner Rus sell
and carried unanimously.
The City Manager reported that Mr. L. H. Reid, owner of the sOllth ninety feet
of Lot 30. Bluffview Subdivision, had requested paving of Jeffords Street from
Druid Road to ClesMlater Bay and bas offered to pay the full assessment f"or paving,
stor.m sewer, sanitary se~er and pumping station as the owner on the soutb side dt
Jeffords Street does not wish to participate in any way. It was explained that
Mr.. Reid planned to construct a home and two other houses on the property and

that at least half of the assessment would be required in advance. The Engineer
estimated the cost of constructin~ sixty feet of concrete seawall and thirty feet
of wing ~al1 at the end of Jef~ords Street at .1,440.00. Commissioner Bohannon
moved that the Mayor appoint a Committee to look over the site with the Engineer,
to talk to the o~ner and bring back a recommendation. Motion was seconded by
Commissioner Kennedy and carried unanimously.
The Mayor appointed Commissioners Russell and Kennedy to serve on the
Committee to investi~ate the matter.
The Manager reported that a request had been made by the property o~ners to
ha ve Kendall Street paved from Mandalay Boulevard to the Gulf and a preliminary
hearing had been held at which most of the property owners were favorable to the
project. The Eneineer said that neither of the properties facing the Qul~ at the
west end of Kendall Street have seawalls and the o~ners have indicated that they
do not want one. He estimated the cost of forty feet of concrete seawall and
sixty feet of wing wall at $1,650.00. The Mayor thou ~h t it would be too expensive
for the City to install the seawall at the street end if the adjoining property
owners were not ready to join in the construction. Commissioner Bohannon moved
that the Inatter be referred to the Corrmittee appointed to check on the seawall
for Jeffords Street. Motion was seconded by Commissioner Strang and carried
unanimously.
In regard to completing the paving of Gilbert Street across Brandon Avenue,
the City Attorney explained that he had been negotiatir.g with Nancy Homes, Inc..
developers of New Marymont Firat Addition regarding their responsibility for
finishing the paving of Gilbert across Brandon under their contract and bond to
install improvements in the subdivision. He reported that he had received a check
for $350.00, hal~ the estimated cost of the work, to be held in escrow until the
City Commission approved a connection between Gilbert Street North and the Airport
Road. The Engineer estimated that the cost of installing a culvert and paving to
connect Gilbert Street f.lorth wi th the Airport Road at appro xi mat ely $400.00.
The Mayor suggested that trucks be barred from using this road. Commissioner
Kennedy moved that the City Engineer be instructed to connect up the northern end
or Gilbert Street ~ith pavement and culvert to give access to the Municipal
Airport for passenger vehicles only, work to be done by municipal workers, cost
not to exceed $500.00. Motion was seconded by Commissioner Bohannon and carried
unanimously.
A letter was read ~rom Mrs. Anna M. Whelan, representing Howard Johnson,
Inc., inquirin~ if the property on the north side of Causeway Boulevard opposite
the Marina Building (Lot 7, City Park Subdivision) would be available for lease
or purchase to use as a site for a Howard Johnson restaurant. Mrs. Whelan, who
was present, explained that the company proposed to build a restaurant seating
77 people at an approxinate cost of $75,000.00 and that the company would like a
ten year lease ~ith a fifteen year option or a fifteen year lease ~ith a ten year
option. Mr. Donald Beath, owner of two restaurants in the City, expressed the
opinion that the City should receive the proper amount of money for the strategic
position of the property and not make the lease so low as to be unfair competition
to other restaurants on the Beach. Mr. Beath inquired if other proposals for the
site would be considered as he would like to submit one. The Mayor replied that
the City would be glad to take the best proposition that is offered. After
discussion, the Commission agreed that the proposals should be on the basis o~ a
ten year lease ~ith the fifteen year option; that the lessee should pay the
assessed City, County and State taxes; that the proposal should include a minimum
annua1 or monthly rent with a percenta~e of the gross income; also that the
proposer should submit a floor plan, a perspective of the building, an estimate
of cost, type of construction, and that the building be limited to one story only.
Commissioner Russe11 moved that the City accept the proposal of Howard Johnson,
Inc., and take it under advisement and that sealed.proposals be taken on October 17th
for a restaurant business at that location. Motion was seconded by Commissioner
Strang and carried unanimously.
The City Attorney read a letter from Mr. Harold Hackney of the Sunset Sheet
Metal Shop in ~hich he proposed to purchase City property with a 230 ~eet ~rontage
on Hercules Road running north from Pistol Range Road with a depth of 170 ~eet at
a price of $1,200.00 to use for his sheet metal, heating and air conditioning
business. Commissioner Kennedy said he understood from Commissioners Strang and
Bohannon that negotiations were taking place on some adjacent property. Therefore,
Commissioner Kennedy moved that action be dererred on this proposal until it can
be handled at the same time as the Commission makes a decision on the other
property. Motion was seconded by Commissioner Strang and carried unanimously.
A letter ~as read from Mr. W. L. Smith of the Smith Yacht Basin and Shrimp
Boat Restaurant, Panama City, Florida. which contained a proposal for renting the
second floor of the Marina Building and the first floor coffee shop which is
presently under lease) or if arrangements could not be worked out with the lessee
of the coffee shop, an of~er was made on the second floor deck by itsel~. Mr.
Smith also made a proposal to include the seco~d floor room (presently occupied
by the Beach Chamber of Commerce), the co~fee shop and property in front o~ the
Marina for recreational purposes such as an outdoor bo~ling alley. The Mayor
pointed out that if any proposal was accepted for the second floor space the City
would need to find other space for the Chamber of Commerce activities.
Commissioner Strang moved that the letter be received and acknowledged and that

the Manager be instructed to tell him that the Commission is now considering a
rental of the land area north of the Marina for restaurant purposes and untrl that
question is settled one way or the other, the Commission would not want a competing
restaurant on the second floor of the Marina, and to 5u~geat that he mi~t like
to enter a proposal to lease that area (Lot 7, City ~ark Subdivision). Motion was
seconded by Commissioner Russell and carried unanimously.
The City Attorney read a letter from Mr. Floyd T. Christian, Superintendent
of Public Instruction, which enclosed a bill of sale from the Board of Public
Instruction, giving the City the building known as Pinellaa Vocational Building,
located on the west side of Madison Avenue approximately 200 feet south of Cleve-
land Street for the SUM of 11.00 in return for cancellation of $1,870.77 in
improvement assessments 1'or paving and sanitary sewer on Missouri Avenue. The
Mayor explained that the City had been trying to obtain the building for use as a
Colored Y.W.C.A. and that it would be moved to the area of Madison and Russell
Street on property now under lease to the Y.W.C.A. It was estin~ted that it would
cost $1,500.00 to move the building. Commissioner Russell moved that the City
accept the offer of the Board of Public Instruction by cancelling the $1,870.77
Missouri Avenue assessments in exchan~e for the vocational building on Madison
Avenue; that the building be described sufficiently to make certain the City gets
the right one; that the City Manager be charged with the responsibility of imple-
menting the removal from the premises and getting it on the proper lot. Motion
was seconded by Commissioner Strang and carried unanimously. Commissioner RU8sell
Russell suggested that a letter be written to the Board of Public Instruction
thanking them for their cooperation.
Item 4-F, "Letter from William Trickel, Bomber Booster Club", was deferred
to the next me eting.
In regard to the request from Mr. Blanks Bveritt, radio technician, for a
revision to his contract which would eliminate the assistant he now has and
increase his salary $50.00 to cover the extra work, the City Manager reported that
he agreed with the recommendation of the Chief of Police and the City Attorney as
at the present time it is impossible to get an assistant for Mr. Everitt. However,
he suggested that Mr. Everitt try to find an assistant as soon as possible.
Commissioner Strang moved that the contract be amended on a temporary basis
according to the letter and the proper officials be authorized to execute it.
Motion was seconded by Commissioner Russell and carried unanimously.
The City Attorney read a letter from Mr. Alex D. Finch requesting the
Commission to consider proposed ordinances prepared at the request of the
electricians of Clearwater and recommended by the Electrical Association of Upper
Pinellas County. Commissioner Strang commented that he had read the ordinances
and approved them in general but would suggest some changes. After discussion
of the ordinances with Mr. Finch and some of the electricians in the audience,
the Commission agreed to postpone action until October 17th to allow time for the
Association's Electrical Committee to meet with Commissioner Strang, the City
Attorney, Electrical Inspector Schamehorn and Mr. Aubrey Ort, Superintendent of
the Electrical Department.
The City Manager reported that it was planned on October 17th to hold a
Public Hearing and advertise for bids for constructing a sidewalk on the north
side of Palmetto Street west of the new Pinellas High School. Commissioner
Kennedy suggested that the City Engineer and the City Manager make a resume or
survey of gaps in sidewalks that are now bothering foot traffic and that the
Commission go over them and pick out the most essential ones so money can be set
aside in the next budget to get a sidewalk program started.
The City Attorney read on its first reading Ordinance 685 declaring the
intention of the City to annex a portion of Gunn's Addition and adjacent unplatted
lands west of Gunn's Addition. Commissioner Strang moved that Ordinance 685 be
passed on its first reading. Motion was seconded by Commissioner Russell and
carried unanimously.
Commissioner Strang moved that Ordinance 685 be considered on second reading
by title only by unanimous consent of the Commission. Motion was seconded by
Commissioner Russell and carried unanimously. The City Attorney read the
Ordinance by title only. Commissioner Strang moved that Ordinance 685 be passed
on its second reading by title only. Motion was seconded by Commissioner Bohannon
and carried unanimously.
Commissioner Strang moved that Ordinance 685 be considered on its third
reading with the unanimous consent of the Commis sion. Motion was seconded by
Commissioner Kennedy and carried unanimously. The City Attorney read Ordinance
685 on its third reading. Commissioner Strang moved that Ordinance 685 be passed
on its third and 1'inal reading and adopted by unanimous conRent of the Commission.
Motion was seconded by Commissioner Russell and carried unanimously.
The City Attorney read on its first reading Ordinance 686 which declared the
City's intention to annex Fairburn Addition. Mr. E. Powell McWhirter, owner of
several lots in Fairburn Addition, objected to the subdivision being brought into
the City limits, saying that it would work a hardship on his business and his
plans for the development or the other lots. The Mayor pointed out that the area
is surrounded by the City limits and is being served by City streets, water and

Circuit Court within thirty day-s after passage of the Ordinance. Commissioner
Strang moved that Ordinance 686 be passed on its first reading. Motion was
seconded by Commissioner Russell and carried unanimously.

reading by title only by unanimous consent or the Commission. Motion was seconded

The City Manager presented a Resolution requiring fifty-five property owners
to clean their lots of weeds and underbrush. Commissioner Strang moved that the

The City Manager recommended that 450 feet of two inch water main be installed
on Spencer Avenue near Turner Street. Commissioner Strang moved that a work order
in the amount of $400.00 be approved for this water main extension. Motion was
seconded by Commissioner Russell and carried unanimously. The Manager was
instructed to deny any applications for connections from the east side of Spencer
Avenue where the right of way has not yet been secured.
It was recommended by the City Manager that 442 feet of two inch gas main
be installed in Railroad Avenue at the estimated cost of $365.00. Commissioner
Russe 11 moved tha t the wo rk order for $365.00 for the gas main be approved.
Motion was seconded by Commissioner Strang and carried unanimously.
The City Attorney requested authorization far Mr. B. J. Driver, Assistant
City Attorney, to attend the National Institute of Municipal Law Officers Conference
in Miami. Commissioner Russell moved that expenses be authorized for Mr. Driver
to attend the conference in Miami. Motion was seconded by Commissioner Bohannon
and carried unanimously.
The City Attorney reported that he had received a letter from Mr. Chester H.
Ferguson, attorney for Maas Brothers, Inc., which stated that he had received the
Resolution setting aside the parking area adjacent to the site of the proposed
Maas Brothers store. Mr. Ferguson enclosed a new easement pertaining to this
property and requested execution. Mr. Ferguson also requested execution of the
same type of agreement previously sent to the City concerning an extension o~ the
lS foot easement immediately north of the property. The City Attorney said that
the first easement if executed as requested would accomplish the purpose of convey-
ing the title to the parking lot to Maas Brothers with the stipulation that it was
to be used for public parking and that the City would control it and could erect
parking meters on the lot. The City Attorney was instructed to inform Mr.
Ferguson that the City would not agree to such provisions.
Mr. Wm. M. Goza addressed the Commission on behalf of Mr. Edward L.
Hohenstein and other owners of Tract A, Hillcrest Drive Re-Sub. He stated that
the plans for the apartment buildings had been revised to show the new setbacks
and the garages had been rearranged but due to the narrowness of the property,
he requested a ten foot setback from Hillcrest for fifty feet where the one
building is to be located. He reported that the adjacent property owners had
been interviewed and had expressed approval of the revised plans by signatures
on the rear of the sketch. The Mayor stated that since the motion granting the
R-4 use of the property had been made at a Public Hearing it would be necessary
to call another Public Hearing to reconsider the Commission's action on restricting
the setbacks on Drew Street and Hillcrest Drive to 25 feet. Commissioner Strang
moved that due to the fact that adjoining property owners have signed approval of
this plan, that this item of Tract A, Hillcrest Drive Re-Sub, be reconsidered at
a Public Hearing on October 17, 1955. for the purpose of considering a setback
line of ten feet from Hillcrest Drive as opposed to twenty-five feet, only for
that one fifty foot area in the middle of the tract. Motion was seconded by
Commissioner Bohannon and carried unanimously.
Regarding improvements to the Franklin Street parking lot, the City Manager
reported that the plans include space for 83 cars and that the estimated cost for
paving. sidewalks and lights was 13.500.00. Commissioner Strang stated that it was
the Conmittee's recommendation that the Manager be authorized to advertise ror bids
and proceed with the work. Commissioner Bohannon moved that the project be

o~ Clear~ater and adjoining areas have been working on assidiously for the past
two months. They feel that these ordinances will better protect life and property
and will be in the interest of public sa~ety, as well as making the installation,
maintenance and repair o~ electrical wiring, apparatus or equipment more or less
uniform th.roughout the whole of Pinellas County, and trust that these proposed
ordinances meet with your approval.
The Electrical Association of Upper Pinellas County feels that the proposed
ordinances will be of much benefit to Clearwater and, as such, theT submit tbe~
to you for your kind consideration. Please give us tbe benefit of your experience
as well as any suggested changes. The Association would greatly appreciate having
your reaction to these ordinances at an eaTly date, and if they meet with your
approval, further request that the ordinances, as amended or changed by you, be
orfered for passage by the City COmDission.
As a matter of im-ormation, the same ordinances are now in eff'ect in St.
petersburgl Florida, and have been for some ti.D1e. I might add that the City ot

Location and footage I will attempt to describe, two bunderd thirty feet running
parallel to Hercules Road, north of the pistol range road and approximately one
nundred seventy feet running parallel west with the pistol range road, total
square footage of 39,100.
Re: Offer to purchase city property.
If we can purchase this piece of property for the amount that we can afford to
pay, our plans are to start as soon as possible to build a concrete block building
approxi~tely forty feet facing on Hercules by sixty feet deep. Tpis building to
nouse our of rice, engineering room, display and work area.
We also have plans for the future of building a second building to be used as a
warehouse for storing the stock of such items as insulation, furnaces, air condi-
tioning equipment and duct fittings which are all bulky merchandise.
Our primary business is Residential Heating and Cooling (year round air condition-
ing). We are the franchise dealer for the Chrysler AirTemp, for the Clearwater
trade area, and sell two other makes and service all makes.

I am pleased to convey to you the bill of sale that was executed by the Board of
Public Instruction in its regular meeting on September 21. 1955, giving the City
of Clearwater the old white ~ooden building known as Pinellas Vocational Building,
located on the west side of Madison Avenue approximately 200 feet south of Gulf-to-
Bay Boulevard in Clearwater, Florida, for the sum of $1.00.
The Board passed the motion to execute this bill of sale with the understanding that
the City of Clearwater in turn would cancel the improvement assessments issued against
the Board of Public Instruction in the amount of $1,$70.77 and that the City would be
responsible for moving this building to its location near the intersection of Madison
A~enue and Russell Street, and that it would be used for YWCA purposes for colored

The Mayor called the raeeting to orrier. The invocation was given by the
Reverend J. S. Dauerty of Clearw�ater Beach. The Mapor inquired if there were any
corrections to the minutes of September lgth and September 26th. The Glerk reported
that Paragraph 3, Page 507, shauld read ttsetting back the curb nine fset on ti+e
north sidet�. Commissioner Bohannon moved that the minutes of the regula� meeting of
September 19th and the special meeting of September 26th be approved as amended
in accordance with copies furnished each member in writing. Mation was seconded
by Commissionar Russell and carried unanimausly,
The City Manager reported that ten bids had been received for one carload oi

It was reported by the Nlanager that seven bids had been received for construc-
tion of paving in Llncoln Avenue from Pierce Street to Court Street. The bids were

After tabulation, the City Manager recommended accepting the 1ow bid of �6,055„g0
from Blackburn Pav�ng Contractors. Commissioner Russell moved that Blackburn
Paving Company be given the bid for paving of Lincol?� A�enue from Pierce Street
to Court Street in the amount of $6,055.50, the Iow bid. �lotion was seconded by
Commissioner Kennedy and carried unanimously.
In regard to the offer of Mr. Harry 5hepard to dedicate right of way for the
west side of Duncan Avenue i'rom Gulf-to-Bay Boulevard to Turner Street at the
location desired by the City and a thirty foot right of rvay for �he north side of
Turner Street from Duncan to Keystone, the City Engineer presented a sketch showing
thE proposed rights o£ way and pointed out that the City still needed to acquire
a portion of the thirty foot right of way for the south side of Turner Street from
Mr. V. V. Carmichael. The Engineer recommended accepting Mr. Shepard°s offer oi
right-of-way in returil for cancellation of �5,3�5.00 in prospective assessments
.for installing sewer and paving along Duncan Ayenue. Commissioner Kennedy moved
that the offer of Mr. Harry W. Shepard to dedicate the Duncaxi Avenue and Turner
Street rights of way for the amount af �5,3$5.00 •ahich was to be set off agains�
the paving assessment be accepted conditioned upon the City's aY�ility to acquire
the ariditional right of way on Turner Street as shown by the City Engineerts ma��
and that the appropriate officials be auti.orized to negotiate with the or�ner
(Mr. Carmichael) far the right of way. Mo'��ion was seconded bp Commzssioner Russell
and carried unanimously.
The City Manager rr:ported that Mr. L. H. Reid, owner of the south ninety feet
oi Lot 30, Bluffview Subdivision, had requested �aving of Jeffards Stree't from
Druid Road to Clearwater Bay and has off�red to pay the full assessment for paving,
storm sewer, sanitary sewer and pumping sta�ion as the owner on the south side of
Jeffords Str�et does not wish to participate ia� any way. It was explained that
Mr. Reid planned to construct a home and two oth�r h�uses on the property and

bhat at least half of the assessment would be required in advance. The Engineer
estimated the cost of constructing sixty £eet of concrete seawall and thirty feet
of wing wall at the end of Jeffords Street at .�1,�.y.0.00. Commissioner Bohannon
moved that the Mayor appoint a Committee to look over the site with the Engineer,
to talk to the owner and bring back a recammendation. Niotion was seconded by
Commissioner Kennedp and carried unanimously.
The Mayor appointed Comrnissioners Russell and Kennedy to serve on the
Couusnittee to investigate the matter.
The Manager reported that a request had besn made by the property owners to
have Kendall Street gaved fxom I�andalay Boulevard to the Gulf and a preliminary
hearing had beett held at which most of the praperty owners were favorable to the
project. The Engineer said that neither of tha properties facing the Gulf at the
west end of Kendall Street have seawalls and the owners have indicated that they
do not want one. Fte estimated �he cost of forty feet of concrete seawall and
sixty feet of wing wall at �1,650.00. The Mayor thoubht it would be too expensive
for the City to install the seawall at the street end if the adjoining property
owners were not ready to join in the construction. Corr�issioner Bohannon moved
that the matter be referred to the Committee appoint�d to check on the seawall
for Jef�'ords Street. Motion �yas seconded b,y Co�nissioner Strang and carr� ed
unanimously.
In reoard to cr�mpleting the paving of Gilbert Street across Brandon Avenue,
the City Attorney explained that he had been negotiatir_g with Nancy Homes, Inc.,
developers of New Marymont First A�dition regarding their responsibility for
fi nishing the paving of Uilbert acs•oss Brandon under their contract and bond to
install improvements in thP subdivision. H� reported that he ha.d received a check
for �350.00, half the estimated cost af the work, to be held in escrow until t h�
Citp Commission approved a connection between Gilbert Street North and the Airport
Road. T:�e Engi:�eer estimate� that the cost of installing a culvert and pavin; to
connect Gilbert Street North y=ith t,he Airport Road at approxi.mately �400.00.
The Mayor suggested that trucks be barred from usin� this road. Gommiss�oner
Kennedy moved that the City Engineer be instructed to cannect up the xiorthern end
of Gilbert Street with pavement and culvert to d ve access to the Municipal
Airport for passenger vehicles onlp, work to be done by municipal workersy cost
not to exceed �500.00. Motion was seconded by Comrnissioner Bohannon and carried
unanimousZy.
A letter wa5 read from Mrs. Anna M. Whelan, represer_ting Howard Johnson,
Inc., inquiring if the praperty on the north side of Gauseway Boulevard opposite
the �+Iarina Building (Lot 7, City Park 8ubdivisior.�) would be available for lease
or purchase to use as a site for a Howard Johnson restaurant. Mrs. Whe].an, who
was present, explainad that the company proposed to build a restaurant seating
77 people at an approximate cost of �75,000.00 and that the company would like a
ten pear lease with a fifteen year option or a fifteen year lease with a ten year
optiun. iKr. Donald Beat;h, owner of two restaurants in the City, expressed the
opinie:: that the City sYac.uld re ceive the pro per amount oi money for t�a strategic
position of the property and not make the lease so low as to be unfair competition
to other restaurants on the Beach, Mr. Beath inquired if other proposals for tiae
site would be consid ered as he would like to submit one. Tha i�ayor replied that
the City would be glad to take the best proposition that is offered. After
di.scussion, the Commission agreed that the proposals should be an the basis of a
ten year lease with the fiiteen year option; that th� lessee should pay the
assessed City, County and State taxes; that the proposal should include a minimum
annual or monthly rent with a percen�a;a of the gross income; also that the
groposer should submit a floor plzsi, a perspective of the building, ar estimate
nf eost, t�rpe of canstraction, and that the building be limited to one story only.
Commissioner Russell moved that tha City accept the proposal of Howard Johnson,
3nc., and take it under a�visement an� that sealesl,�roposals be taken on October 17th
for a restaurant business at that lacation. Motion was seconded bp Couunissinner
Strang and carried unanimouslyr
The City Attorney read a letter from Mr� Harald Hackney of the Sunset Sheet
Nletal Shop in which he proposed to purch ase City property with a 230 feet frontage
en Hercules Road running north from Pistol Range Road with a depth of 170 feet at
a price of �1,200.00 to use %r hia sheet metal, heating and air conditionin�
business. Commissioner Kennedy said he understood from Commissioners StranG and
Bohannon that negotiations were taking place �n some adjacent property. Therefore,
Commissioner Kennedy moved that action be de£erred on this proposal until it can
be handled at the same time as the Corranissi on mak es a decision on the other
property. Motion was seconded by Commiysioner Stranp and carried unanimously.
A letter was read fPom Mr. W. L. Smith of the Smith Xacht Basin and Shrimp
Boat Resi;aurant, Panama City, Florida, which contained a�raposal for renting tlae
second floor af the Marina Building and the first iloor caffee shog which is
presently under lease, or if arrangements could not be worked out with the lessee
of the coffee shop, an offer was ma.de on the second floor deck by itself. Mr.
Smith also made a proposal to include the second floor room {presently occupied
by the Beach Chamber of Conrinerce), the coFfee shop and property in #'ront oi' the
Mari.na f�r recreational purposes such as an outdoor bowling alley. The Mayor
pointed out that ii any proposal was accepted for the second floor space the City
would need to find othex space for the Chamber oi Commerce activities.

the Manager be instructed to te11 him that the Coirunission is now considering a
rental of thp land area north of the Marina for restaurant purposes and until that
question is settled one way or the �ther, the Commission would not want a competing
' r�staurant on the second floor of the Marina, and t� su;gest that he mi�t like
ta enter a proposal to lease that area (Lot �, City Pa•rk Subdivision). Motion was
seconded by Commissioner ftussell and carried unanimously.
The Cit y Attorney read a letter from Mr. Floyd T. Christian, Superintendent
of Public Instructian, which enclosed a bill of sale from the Eoard of Public
Instruction, giving the City the building known as Pine].1as Vocational Building,
lo�ated on the west side of Madison Avenue approximately 200 feet south of Cleve-
land Street for the sum of �1.00 in r�turn for cancellation of �1,$70.�� in
improvemPnt assessment� for paving and sanitary sewer on I�issouri Avenue. The
Mayor explained �hat; the City had been trying to obtain the building for use as a
Colored Y.W.C.A, and that it would be moved to the area of Madison and P�usseil
Street on property now under lease to the Y.W.G.A. It was estimated tha�t it would
cost ,�1,500.00 to move the building. Commissioner Russell ttoved that the Gity
accept the offer of the Board of Public Instruction by cancelling the $�l,$70.7^
Missouri Avenue assessment� in exchange i4r the vocatioral buildinb on Madison
Avenue; that the building be describe3 sufficiently to make certain the City gets
the right one; that the City Manager be cha.rged with the re�ponsibility o£ imple-
menting the removal from the premises and getting it Un the proper lot. Mo>ion
was seconded by Commissioner Strang and carried unanimously. Gorranissioner �;��
$ussell suggested that a letter be written to Lh:.� Board of Public Instruction
thanking them for their cooperaticn.

In regard ta the reo,uest frc,m Mr. Blanks Everitt, radio technician, fcr a
re�ision to his contract which would eliminate the assistant he now has �nd
increase his salary �50.-00 to cover th2 �xtra work, the City Manager reported that
he agreed with the recommendation of the Chiaf of Police and the Gity Attorney as
at the present time it is i7npossible to get an assistant for Mr. Everitt. Howeverr
he suggested that Mr. Everitt try to find an assistant as soon as possible.
Commissioner Strang moved that the contract be amended on a temparary baais
according to the letter and the proper officials be authorized to execute it.

The City Attorney read a letter £rom Mr. Alex D. Finch requesting the
Commission to consider proposed ordinances prepared at the request of the
electricians of Clearwater and recommended by the Electrical Association of Upper
Pinellas County. Cor�miissioner Strang commented that he had read the ordinances
and approved them in gener�l but would suogest some c hanges. P.fter discussion
of the ordinances with Mr. Finch and some of the electricians in the audience,
the Commission agreed to postpone action until �ctober 1'7th to al low time for the
Asscciation's Electrical Committee to meet with Comnissioner Strang, the Citp
Attorney, Eleci;rical Inspector Schamehorn and Mr. Aubrey Ort, Superintendent �f
the Electrical Degartmeat.
The City Manager reported tha t it was planned on October 17th to hoid a
Public Hearing and advertise for bids for constructing a sidewalk an the north
side of Palmetto Street west of the new Pinellas High School. CammissionFr
Kennedy suggested that the City Engin�er and the Citp hianager make a sesu:,�e or
survey of gaps in sidewalks that are now �,othering Foot traffic and that the
Commission go over them and pick out the most essential ones so money can be set
aside in the next budget to get a sidewalk program started.
The City Attorney read on its first readi�g OrdinancE 6$5 declaring the
intention of the Cit y to annex a portion of Gunn's Addition and adjacent unplatted
lands west of Gunn's Addztion. Corrunissioner �trang moved that Ordinance 6$5 bs

The City Attorney requested authorization for Mr. B. J. Driver, Assistant

The City Attorney raported that he had receive@ a letter grom Ydr< Chester H.
Ferguson, attorney for Maas Bro�hers, Inc., which stated that he had received the
Resolution setting aside the parking area adjacent to the site of the proposed
Maas Brothers store. Mr. Ferguson enclosed a new easement pertaining �o this
property and requested execution. Mr. Ferguson also requested execution of the
same type of agreement previously sent to the City concerning an extension of the
1$ foot �asement immediately north of the propertp, The City Attr�rney said th at
the first easement if executed as requested would accomplish the purpose of convep-
ing the title to the pax•king lot to Maas Brothers with the stipulation that it was
to be used for public parkin; and that the City would control it and could erec�
park3no meters on the lot. The City Attorney was instructed to infox�m Mr.
Ferguson that the Citp would not agree to such provisions.
Mr. Wm. M. Goza addressed the Gommission on behalf of Mr. Edward L.
Hohenstein and other owners of Tract A, Hillcrest Drive Re-Sub. He stated that
�he plans for the apartment buildings had been revised to show the new setihacks
and the garages had been rearranged but due tp the narrowness of the property,
he requested a ten foot setback from Hillcr�st �or fifty feet wh�re the one
building is to be located. He reported that the adjaaent property owners had
been interviewed �nd had expressed approval of the revised plans by signatures
on the rear of the sketch. The Mayor st;ated th at since the motion granting the
R-!� use of the property had been made at a Public Hearing it woul�i be necessary.
to call another Public Hearing tn reconsider the Commission's action on restricting
the setbacks on Dr.ew Street and Hillcrest Drive to 25 feet. Cominissioner Strang
moved that due to the fact that adjoining property owners have signed approval of
this plan, that this item o£ Tract A, Hillcrest Drive Re-Sub, be reconsidered a�
a Public i�earing on October 17, 1955, for the purpose of cor,sidering a setback
line of ten fee� from Hillcreat Drive as opposed to �wenty-five feet, onlq for
that one fif�ty foot area in the middle of the tract. Motion was seconded by
Co�issioner Bohannon and carried unanimously.
Regarding improvements to the Franklin Street parlcing lot, thE City PRanager
�eported that the plans include s ace for 83 cars and that the estimated co st for
paving, sidewalks and lights was �3,500.00. Commissioner Strang stated that it was
the Committee�s recommendation tha� the Manager be aubharized to a dvertise for bids
