The City Commission of the City of Clearwater met in regular session at City
Hall. Monday, March 7. 1955. at 1:30 P.M. with the following members present:

The Mayor called the meeting to order. The invocation was given by
Commissioner Bohannon. Commissioner Strang moved that the minutes o~ the regular
meeting of February 21st be approved in accordance with copies furnished each
member in writing. Motion was seconded by Commissioner Russell and carried
unan imously.
The City Manager reported that six bids had been received to supply summer
uniforms for the Police Department and the Fire Department. The bids were read
as follows:

After tabulation, the City Manager recommended accepting the low bid of $1.650.90
from Donald S. Lavigne Company of Miami. Commissioner Kennedy moved that the
recommendation of the City Manager and the Chief of Police be approved and that
a pur~hase order be executed to Donald Lavigne, Miami, for purchase of Police and
Fire Department uniforms in the amount of $1,650.90. Motion was seconded by
Commissioner Bohannon and carried unanimously.

Regarding the bids opened at the last meeting for 500 steel sign posts. the
City Manager recommended accepting the low bid of $965.00 from the Hunt Company,
Detroit, Michigan. Commissioner Kennedy moved that the City Manager's recomnlenda-
tion be approved and that the contract be awarded to the Hunt Company of Detroit.
Michigan, ~or the purchase o~ 500 ten foot steel channel posts per City specifica-
tions at a cost of $1.93 each or a total purchase order of $965.00. Motion was
seconded by Commissioner Bohannon and carried unanimously.
In regard to the bids for Comprehensive General Liability and Property Damage
Insurance, the City Manager reported that he had discussed the bids received with
the Finance Department and the Purchasing Department and had checked the rating
of the two insurance companies involved. He recommended that the insurance be
re-awarded to the company that is now holding the policy, Travelers Insurance
Company. as he felt that it was the best bid. Mr. Y. F. Wedig, representing the
American Fire and Casualty Company of Orlando, Florida, protested the awarding
of the bid to the other company at a higher rate, stating that his company was an
old established company and would follow the common policy of re-insuring part
of the risk with other insurance companies. Mr. Roger Bouchard, agent ~or
Travelers Insurance Company, reported that his company's bid had been based on the
same experience table and he did not see how it was possible for the other company
to submit such a low bid if they were to provide the same coverage, and he suggested
that a careful comparison be made between the two bids before any final action was
taken. Commissioner Russell moved that the subject be tabled until the Commission
can have further investigation on the build-up of the estimated premium cost.
Motion ~as seconded by Commissioner Bohannon and carried unanimously. The City
Manager said he would have a comparative analysis of the two bids made to present
at the next meeting and requested the aeents of the two companies to furnish him
a detailed report on coverage contained in their bids.
The City Manager stated that the low bid o~ $1.570.20 from the M & H Valve &
Fitting Company, Anniston, Alabama, for 25 six inch gate valves and 6 eight inch
gate valves did not include the accessories. After contacting the low bidder.
he was informed that the M & H Valve & Fitting Company would furnish the accessories
at no additional cost; therefore, he recommended accepting their bid. Commissioner
Bohannon moved that the proper parties be authorized to place this order in
accordance with the recommendation of the City Manager. Motion was seconded by
Commissioner Strang and carried unanimously.
The Mayor announced the continuation of the Public Hearing on the request of
Mr. J. E. Satterfield to permit R-4 usage of the north 150 feet of Tract A,
and also a request to permit Business usage of the west 50 feet o~ the south 100
feet of Tract A, Hillcrest Drive Re-Sub. The City Attorney read the request from
Mr. Satter~ield and the original recommendation from the Zoning Board which was
that the first request be approved and that the second concerp'ing business usage'
be denied. After the matter was referred back to the Zoning doard for explanation

of the reasons lor the recommendAtion on the first request concerning the R-4
usage, the Zoning board recommended that no action be taken until plRns for a
project or development of the area are pr~sented. Mr. Satterfield who was present
withdrew his request for Business usage of the west 50 feet of the south 100
feet of Tract A. He addressed the COffi':lis sion irl hiH own behalf stating th~t the
h~rdship lay in his inability to sell the land as a site for an apartment house
under the present zoning. Mr. John Burnison, adjacent property owner, told the
Commission he approved of grantin')' the refJuest for the R-4 zoning. Mr. R. L.
Kilpatrick, attorney for Mr. and Mrs. James R. IJewis, reported that many of the
property owners in the immediate neiehborhood were opposed to any such change in
zoning desienation as they had relied on the protection of R-l and R-2 zoning
when they built their houses. He presented a petition signed by thirty-nine
property owners objecting to the ~antin~ of the request. Commissioner Kennedy
moved that the City go on record as urholdin~ the Zoning Board in their requirement
and deny this request. Motion was seconded by Commissioner Strang and c~rried
unanimously.
The City Attorney read on its first reading Ordinance 674 which declared
the City's intention to annex part of Druid Acres First Addition. Commissioner
Strang moved that Ordinance 674 be passed on its first reading. Motion was
seconded by Commissioner Russell and carried unanimously.

reading by title only by unanimous consent of the Commission. Motion was
seconded by Commissioner ~ohannon and carried unanimously. The City Attorney
read Ordinance 674 by title only. Commissioner Strang moved that Ordinance 614
be passed on its second reading by title only. Motion was seconded by Commissioner
Bohannon and carried unanimously.
Commissioner Strang moved that Ordinance 674 be considered on its third
reading by unanimous consent of the Commissi. on. Motion was seconded by Commissioner
Bohannon and carried unanimously. The City Attorney read the Ordinance in full.
Commissioner Russell moved that Ordinance 674, intention to annex Druid Acres
1st Addition, be passed and adopted on its third and final reading. Motion was
seconded by Commissioner Bohannon and carried unanimously.
The City Attorney reported that there had been no objections to Ordinance 673
declaring the City's intention to annex Betty Lane Heights 2nd Addition; therefore,
he read on its first reading Ordinance 675 which would annex Betty Lane Heights
2nd Addition. Commissioner Strang moved that Ordinance 675 be passed on its first
reading. Motion was seconded by Commissioner Russell and carried unanimously.
Commissioner Strang moved that Ordinance 675 be considered on its second
reading by title only by unanimous consent of the Commission. Motion was seconded
by Commissioner Bohannon and carried unanimously. The City Attorney read
Ordinance 675 by title only. Commissioner Russell moved that Ordinance 675 be
passed on its second reading by title only. Motion was seconded by Commissioner
Strang and carried unanimously.
The City Attorney reported that changes in the O.A.S.I. law made it possible
to include under Social Security those City employees who are ineligible for the
Pension Plan. He said previously a ballot had been sent to the employees and they
had voted almost unanimously that they would like to have Social Security coverage.
Although the Commission has already agreed to execute the standard form of contract
to put this into effect January 1, 1955, he said it would be necessary to pass an
Ordinance in order to make the State's files complete. He read on its first reading
Ordinance 676 relating to Old Age and Survivors Insurance. Commissioner Strang
moved that Ordinance 676 be passed on its first reading. Motion was seconded by
Commissioner Rpssell and carried unanimously.
Commissioner Russell moved that Ordinance 676 be considered on its second
reading by title only by unanimous consent of the Commission. Motion was seconded
by Commissioner Strang and carried u~animously. The City Attorney read
Ordinance 676 by title only. Commissi.oner Strang moved that Ordinance 676 be
passed on its second reading by title only. Motion was seconded by Commissioner

Commissioner Russell moved that Ordinance 676 be considered on its third and

Commissioner Strang and carried unanimously. The City Attorney read the Ordinance
in ful]. Commissioner Strang moved that Ordinance 676 be passed and adopted on
its thi~d reading and the proper officials be authorized to execute it. Motion
was seconded by Commissioner Kennedy and carried unanimously.
Mr. H. K. Baskin, Sr., appeared before the Commission requesting the City
to write a letter to the Army Engineer Corps in Jacksonville showing that the
City will offer no objection to the granting of an application on the part of
H. H. Baskin and Associates to permit dredging and filling on property owned by
the applicants at the south end of Clearwater Beach adjacent to Harnden Drive
according to plans sabmitted. He presented a sketch of the proposed Bayside #5
Subdivision showing a tentative sea~all line as requested by the City. It was the
wish of the Commission that Mr. Baskin submit a proposal deSignating an exact
seawall line in relationship to certain permanent markers within the proposed
subdivision. Mr. Baskin stated that he would have Mr. Leo Butler prepare such a
sketch ~or the Commission's approval. Upon inquiry from the Mayor as to where the

fill was coming from, Mr. Baskin stated it was their inention to secure the entire
fill from the basin north of the fourth finger if possible, and that he and his
associates would be willing to quit claim to the City the submerged tract lying
east of the channel (to ~hich they have title for fill purposes only) provided the
City would agree for them to ~t additional fill from that source if it should
prove to be necessary. Commissioner Strang moved that the appropriate officials
of the City be and they are hereby authorized to write a letter to the U.S.
Engineers assenting to the granting of the application Mr. BaSkin had asked;
secondly, that appropriate officials be authorized to receive a quit claim deed to
the land across the channel from the fourth finger which has been formerly
discussed. and that appropriate officials be authorized to give him a permit it
necessary on trust for an application by him to take fill material from the land
to be quit-claimed and from other adjacent areas approved by the City. Motion was
seconded by Commissioner Russell and carried unanimously.
The City Attorney read on its third reading Ordinance 671 which would declare
the City's intention to annex Salls Subdivision Units 1, 2 and). Commissioner
Strang moved that Ordinance 671 be passed and adopted on third and final reading.
Motion was seconded by Commissioner Kennedy and carried unanimously.
The City Attorney read a Resolution changing the name of Over brook Street
between Betty Lane and Kings Highway to Fairmont Street to avoid Confusion with
Overbrook Avenue which runs north and south. Commissioner Strang moved that the
Resolution be adopted and the proper of~icials be authorized to execute it and that
the information be given the Fire Department, Police Department. Chamber of Commerce
and Post Office. Motion was seconded by Commissioner Russell and carried unanimously.
A Resolution was read by the City Attorney assessing the sanitary sewer
installed in Gulf Vie~ Boulevard 120 reet south of Third Street to the intersection
of Hamden Drive, in Coronado Drive 243.6 feet south of Third Street to the inter-
section of Hamden Drive, and in Harnden Drive from First Street to Gulf View Boulevard.
Commissioner Strang moved that the ~esolution be passed and adopted and the proper
officials be authorized to execute it. Motion was seconded by Commissioner Russell
and carried unanimously.
A Resolution was read dedicating the City property described as the west
eleven feet of the north 621 feet of Lot D and the east 49 feet of Lot ~, New
Country Club Addition, as a public street to be known as Stadium Drive.
Commissioner Russell moved that the Resolution of dedication of Stadium Drive be
adopted and the proper officials ~e authorized to execute it. Motion was seconded
by Commissioner Bohannon and carried unanimously.
The City Manager reported that three fire hydrants on Mandalay Boulevard north
of the Carlouel fence are rusted out and need replacement. He estimated the new
fire hydrants would cost $200.00 each and recommended that a work order be approved
for $600.00. Commissioner Strang moved a work order be approved in the amount of
$600.00 to replace three fire hydrants. Motion was seconded by Commissioner
Kennedy and carried unanimously.
A letter was read ~rom Juvenile Court Judge William G. Gardiner requesting
approval of appointment of Detective Sergeant E. Lester Marston as Special
Assistant Counselor of the Juvenile Court without compensation. The Police Chie~
explained that each Police Department as a cooperative measure has one man designated
to assume such a position with the Juvenile Court in order to comply with the Juvenile
Law. He said this one man can handle any juvenile problem that comes up including
apprehension of juvenile delinquents and investigation of the cases. Commissioner
Russell moved that the City Commission approve the appointment of E. Lester
Marston as Juvenile Counselor. Motion was seconded by Commissioner Kennedy and
carried unanimously.
The City Attorney read a letter addressed to the Commission by the City
Clerk in which attention was called to the ~act that the City of Clearwater tax
certificates from the year 1930 to 1934, inclusive, will become twenty years old
on June 3rd of this year. The letter also suggested that delinquent taxes might
possibly be collected if the City should file application for tax deed on such
property. Commissioner Bohannon moved the suggestion be approved and that the
City Clerk and the City Attorney proceed with this work as outlined. Motion was
seconded by Commissioner Kennedy and carried unanimously.
The City Attorney read an application ~rom Mr. Robert C. Schmid for permission
to erect a 4' by a' rnasonite sign on his property on Coronado Drive) Lot 4.
Columbia Subdivision #4, to advertise the lot ~or sale as a motel site. The City
Attorney read the Zoning Board's recommendation which was that the request be
denied since this would be a Commercial Sign in a residential area. The City
Attorney pointed out that this could be considered a Real Estate sign but the
limitation on the size of real estate signs was six square feet in area.
Commissioner Russell moved that the request from R. C. Schmid for a commercial
sign on Coronado Drive, Lot 4, Columbia Subdivision #4, be denied as per the
Zoning Board's recommendation. Motion was seconded by Commissioner Strang and
carried unanimously.
Commissioner Russell asked to be excused from the meeting at 4:59 P.M.

Concerning the proposed job clAssification survey and pay plan for City
employees, the City Manager said this work is consid8red a professional service
and is not a biddable proposition but it is possible to get proposals from the
various comp~nies. He presented a proFos~l from Griffenhaean & Associates
which included an itemized schedule of the work to be done in designing a job
clas~ification plan, designing a pay plan to cover the positions, and agreeing
to beein the performance of services immediately, the work to be finished in
three months time. The Manager said the firm had submitted a price of $2,300.00
for the entire work descrihed includin~ one master copy of the plans. He reported
that the cost was lower than estim~tes of $2,700.00 and $3,200.00 from other
companies because this comrany was alreRdy making a similar survey in Tampa.
It was the opinion of the Commissioners thRt the City would need at least ten
coriE:s of t,he plan and that it would be helpful if the work were completed
before budget time. Commissioner StrRng su~gested that Section 2-d, concerning
suggestions as to methods for pl::-Jcino; the pay plan in effect, should be expanded
to cover a period of four or five yeRrs. Commissioner Bohannon moved that the
COlllmission approve Mr. iviiddleton'e emrloying t.his particular firm at an amount of
$2,200.00 which we ur.derstand will provide for one copy of the report and ne~otiate
for nine more copies suhject to his gett-ine; an acceptable price on t.he addi tional
rd. ne copies. Moti on was seconded by CommiRsioner Str:lng and carri ed unanimou sly.
The City Manager reported t.he Finance Dep8rtment had ref)uested approval of
transferring $80,000.00 from the Ci~8rette Tax Fund to the General Fund.
Commissioner Strang moved that $80,000.00 be transferred according to the request
of the Fi nance Departmeht. Moti.on was seconded by Commissioner Bohannon and
carried unanimously.
It was requested by the Finance DepArtment that $50,000.00 be trRnsferred
from the Utility Fund to the General Fund. Commissioner Strang moved that .
$50,000.00 be transferred from the Utility Fund to the General Fund according to
the Finance Departme nt's reque st. Motion was seconded by Commissi.oner Bohannon
and carried unanimously.

The City Manager reported that Mr. C. A. Peterson, County Director of Public
Works, had informed him that the County had secured the right-of-way for Keene
Road from Gulf-to-Bay to Druid Road providin~ the City will pay $850.00 for 43
fruit trees in the right-of-way. He explained that this would be the only
cost to the City, that the County would pave, curb and gutter the proposed streett
the width to be 30 feet and the right-of-way 60 feet. He said the property owners
had agreed to this proposal if the work was fjnished within 120 days. Commissioner
Kennedy moved that the expenditure of $850.00 be authorized for payment for fruit
trees in the right-of-way of Keene Road extended between Druid Road on the south
and Gulf-to-Bay Boulevard on the north in acceptance of ~h€ proposal of the County
to obtain rieht-of-way, pave the street with curb and gutter without any further
cost to the City. and in accordance with the property owners' request that it be
completed within 120 days. Motion was seconded by Commissioner Strang and carried
unanimously.
The Mayor announced that a legislative meeting was scheduled for g:OO P.M.
on Monday, March 7th, where the City Commifision would have the opportunity to
consult with the Pinellas County legislative delegation. He said the City
Attorney had prepared several new acts which must be advertised for 30 days before
presentation at the Legislature, two of which were permissive acts concerning
enlargement of and increasing the benefits under the City Pension Fund and the
Firemen's Pension Fund.
The City Manager recommended the installation of 200 feet of two inch water
main on Union Street east of Dou~las Avenue at an estimated cost of $170.00,
check for which is on deposit. Commissioner Strang moved the utility improvement
in the amount of $170.00 be approved and the proper officials be authorized to
execute the contract. Motion was seconded by Commissioner Bohannon and carried
unanimously.
It was recommended by the City Manager that a two inch water main be installed
on Duncan Avenue in Oak Acres Unit 6 at an estimated cost of $590.00t check for
which is on deposit. Commissioner Strang moved that the utility improvement in
the amount of '590.00 be approved and that the proper offici.als be authorized to
sign the accompanying contract. Motion was seconded by Commissioner Bohannon
and carried unanimously.
The City Manager presented a Resolution requ1r1ng five property owners to
clean their lots of weeds and underbrush. Commissioner Strang moved the Resolution
be adopted. Motion was seconded by Commissioner Bohannon and carried unanimously.
The Commission now adjourned as the City Commission and acting as Trustees
of the Pension Fund admitted Lois A. Barlow, biller in the Gas and Water Department
and Richard John Hardingt officert Police Department, to membership in the Pension
Plan on a motion by Commissioner Strang which was seconded by Commissioner
Bohannon and carried unanimously.
There being no further business to come before the Commission, the meeting
was adjourned at 5:23 P.M.

RESOLUTION
WHEREAS, a confusing situation has arisen as a result of the designation
of a street known as Overbrook Street, which street runs from Betty Lane to Kings
Highway, said confusion resulting from the fact that there is already n street
designated as Overbrook Avenue within the City of Clearwater, and
WHEREAS, after due consideration the City Commission has determined that the
best interests of the City of Clearwater, its citizens and visitors will be
served by changing the name of the street now designated as Overbrook Street to
Fairmont Street.
NOW, THERE:FORE, BE IT RESOLVED by the City Commission of the City of Clearwater,
Florida, in session duly and regularly assembled as follows:
That Overbrook Street in the City of Clearwater, Florida and as shown on the
City maps as running from Betty Lane to Kings Highway be and it is hereby designated
and shall hereafter be known as Fairmont Street, and that that street located in
the City of Clearwater, Florida, known as Overbrook Avenue be and shall hereafter
continue to be Overbrook Avenue, together with any extensions thereof.

RESOLUTION OF DEDICATION OF STADIUM DRIVE
WHEREAS, the City of Clearwater, Florida, is the owner or the lands hereinafter
described, which is suitable and necessary for street purposes for the construction
of a street to be known as Stadium Drive in the City of Clearwater, Pinellas County,
Florida, and
WHEREAS, after due deliberation, the City Commission has determined that it
is for the best interests of the City that such lands should be dedicated for
street purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Clearwater
Florida, in session duly and regularly assembled as follows:
1. The following described land situate, located and being in the City of
Clearwater, Pinellas County, Florida:
The West ELEVEN (11) FEET of the North SIX HUNDRED TWENTY-ONE (621) FEET
of Lot D, and the East FORTY-NINE (49) FEET of Lot E, NEW COUNTRY

Certificates for taxes due the City of Clearwater for the years 1930 to 1934,
inclusive, were sold on June 3rd, 1935, and may possibly be adversely affected
by what is usually referred to as the "twenty year law" an Act of the 1947
Legislature .
In a large nwnber of cases, the amount of taxes due on individual properties is
too small to warrant foreclosure proceedings. In such cases, filing by the City
of an application for tax deed on City-owned Certificates would probably result
in the collection of the major portion of such taxes.
In applying for a tax deed, it will be necessary for the City to advance money
for advertising, the redemption of any individually-owned certif1cates, etc.
However, funds now in our Unclaimed Redemption Fund account could be used for
that purpose.

SURVIVORS INSURANCE.
BE IT ORDAINED BY THE CITY COMKISSION OF THE CIT'! OF CLEARWATER, FLORIDA:
Section 1. It is hereby declared to be the policy and purpose of the City
of Clearwater, Florida, to extend effective as of January 1, 1955, to the employees
and o~ficials thereor, not excluded by la~, nor excepted ~erein, the benefits ot
the system of Old Age and Survivors Insurance as authorized bI the Foderal Social
Security Act and amendments thereto, and by Chapter 650, Flor da Statutes, as
amended; and to cover by such plan all services which constitute employment as
defined in Section 650.02, Florida Statutes, performed in the employ of said City
by employees and of~icials thereof.
Section 2. (a) There 1s hereby excluded from this Ordinance any authority
to include in any agreement entered into under Section ) hereo~ any fireman's
or policeman's position now covered by a retirement system, or to include any
individual now a member or no~ eligible to become a member of any existing
retirement system.
(b) On and after the date an employee or official becomes eligible
for membership in an existing retiroment system, his OASI coverage shall cease.
His OASI coverage shall contin~e if, prior to such date o~ eligibility. OAS1
coverage has been extended to include the members of his retirement system.
Section J. The orficials authorized by the Charter of the City of Clearwater,
Florida. are hereby authorized and directed to execute all necessary agreements.
and amendments thereto with the Florida Industrial Commission, as State Agency, .
for the purpose of extending the benefits provided by said system of Old Age and
Survivors Insurance to the employees and officials of 'this City as provided in
Sections 1 and 2 hereof', which agreement saaal provide ror such methods ot
administration of the plan by said City as are found by the State Agency to be
necessary and proper, and shall be efrective with respect to services in employment
covered by such agreement performed on and after the 1st day o~ January, A. D. 1955.
Section 4. Withholdings from salaries, wages, or other compensation o~
employees and officials ~or the purpose provided in Section 1 hereof are hereby
authorized to be made, and shall be made, in the amounts and at such times as may
be required by applicable S~ate or Federal laws or regulations, and shall be paid
over to the State Agency designated by said laws or regulations to receive such
amounts.
Section 5. There shall be appropriated from available funds, derived trom
general revenue, such amounts, at such times, as may be required to pay promptly
the contributions and assessments required of the City as employer by applicable
State or Federal laws or regulations, ~hich shall be paid over to the lawfully
deSignated State Agency at the times and in che manner provided by la~ and
regulation.
Section 6. The City shall keep such records and make such reports as may
be required by applicable State or Federal laws or regulations, and shall adhere
to the reg~ations of the State Agency.
Section 7. The City does hereby adopt ~he terms, conditions, requirements,
reservations, benefits, privileges, and other conditions thereunto appertaining,
o~ Title II of the Social Security Act as amended, ror and on behalf or all
o~ficers and employees o~ its departments and agencies to be covered under the
agreement.
Section 8. The City Treasurer of the City is l13reby designated the
custodian o~ all sums withheld from the compensation of o~ficers and employees
and of the appropriated funds for the contributions of the City, and the City
Treasurer o~ said City is hereby made the wit.hholding and reporting agent and
charged ~ith the duty of maintaining personnel records for the purposes ot this
Ordinance.
Section 9. This ordinance shall take effect upon its approval and publication
as required by law.

RESOLUTION
WHEREAS, after Public Hearing on April 19, A. D. 1954. the City Commission
of tne City of Clearwater, Florida. determined that certain ~ork and improvements
her~1naft8r described should be done and made. and
~EREAS, pursuant thereto said improvements have been made as follows:
Construct an 8 inch sanitary sewer and appurtenances in South Gulf
View Boulevard from a point approximately 120 feet south of the south
line or Third Street, south and southeast to the intersection of Harnden
Drivej and construct an g inch sanitary sewer and appurtenances in
Coronado Drive from a point approximately 243.6 feet south of the
south line of Third Street, south and southeast to the intersection
of Harnden Drivej and construct an g inch sanitary sewer and appurtenances
in Hamden Drive from a point approximately 100 feet south of north line
or Harnden Drive, south to the intersection of South Gulf View Boulevard;
and construct a lift station at the intersection of Hamden Drive and
Devon Drive.
WHEREAS, under the provisions of Section 123 and other pertinent provisions
of the Oity Oharter, after said improvements shall have been completed, the City
Commission shall assess the cost thereof against the properties benefiting from
said improvements, and
WHEREAS, certain parcels of real estate benefiting from said improvement
shall be assessed the pro-rata cost thereof against said parcels.

deemed to have been benefited by said improvements in the following proportions
of the cost thereof and the same are hereby assessed in accordance with the
schedule hereto attached and by reference made a part hereof.
3. That if said assessments herein made are not paid within thirty (30)
days from the date hereof, the City Treasurer is hereby directed to issue and sell
certificates of indebtedness under Section 124 of the City Charter, which
certificates shall bear interest at the rate of 8% per annum a~ainst the foregoing

The City Comm3ssion of the City of Clearwater met in regular session at C�ty
Hall, Monday, March 7, i955, at 1:30 P.M. with the following members present•.

The Mayor called the meeting to order. The invocation was given by
Commissioner Bohannon. Commissioner Strang moved that the minutes of the regular
meeting o.� February 21st be approved in accordance with copies furnished each
member in writing. Motion was seconded by coramissioner Russell and carried
unan imou s ly .
The City Manager reported that six bids had been received to supply sum�er
uniforms for the Police Department and the Fire Department. The i�ids were read

After tabulatior., the City Manager recommended accepting the low bid o£ �1,650.90
irom Donald S. Lasigne Companp o£ Miami. CQmmissioner Kenne3y moved that �he
recommendation of the Cit3r Managex ana the Chief of Police be approved and that
a purchase order be executed to Donala Lavigne, Miami, for purchase of Police and
Fire Departmen� unif�rms in the amount af �1,650,90. Motion was secon�ied by
�ommissioner �ohannon and carried unanimously.
Regarding the bids opened at the last meeting far 5Up steel sign posts, the
City Manager reco:nmended accepting the 1ow bid of �965.00 from the Hunt Company,
Detroit, Michigan. Commissianer Kennedy moved that the City ManagerTs recommenda-
tion be approved and that the contract be awardsd to the Hur.t Company af Detroit,
Michigan, for the p�archase of 5DQ ten foet steel channel poats per Citp speci£ic3-
tions at a cost of �p1.93 each or a total purchass order of �965.00. Motion was
sec�nded by Commissioner Bohannon and carried unanimously.
In regard to the hids for Comprehensive General Liability and Propzrty Damage
Tnsurance, the City Manager reported that hs had discussed the bids received wzth
the Finance Department and the Purchasing Department and had checked the rating
of the twu insurance �ampanies inval;red. He recommended that the insurance be
re-awarded to the company that is no�v holding the policy, Travelers Insurance
Compan�, as he felt that �.t was the best bid. Mr. Y. F. Wedig, representing the
American Fire and Gasualty Company of Orlando, Florida, prntested the awarding
of the bid to the other company at a higher rate, statino that his company was an
old established company and v;ould follow the common policy of re-insuring part
of the risk with other znsurance comp�.r.ies. Mr, Roger Bouchard, agent f�r
Travelers Insurance Companq, reported that his company's bid had been based on the
same experience table and he did not see how it i,ras possible for t�e other company
to submit such a low bid if they were to provide the same coverage, and he suggested
that a careful comparison be made between the two bicis before any final action was
taken. Commissioner Russell moved that the subject be tabled until the Commission
can have further investioation on th e build-u� of the estimated premium cost.
Motian was seconded by Commissioner Bohannon and carried unanimously. The City
Manager said he would have a comparative analSsis of the two bids made to pz•esent
at the next meeting and requested the agents of the twa companies to furnish him
a de�ailed report on coverage contained in their bids.
The City Manager s�tated that the low bid of �1, 5'70.20 from the M& H Valve &
Fitting �ompany, Anniston, Alabama, for 25 six inch oate valves and 6 eight inch
gate valves did not inr.lude the accessorie�. After contactzng the low bidder,
he was informed that the M& H Valv� & Fitting Corapany would furnish the accessories
at no additional cost; therefore, he recommendea accepting their bid. Commissior.er
Bohannon inoved that the proper parties be authorized to place this order in
accordance wit h the recommendat ion of the City Manager. Motion was seconded by
CAmmissioner Strang and carriPd unanimously.
The Mayor announced the continuation of the Public Hearix�g on the request of
�r. J. E. Satteriield to permit R-1� usage of the north 1$0 fee� of Tract A,
and also a request to permit Business usage of the west 50 ieet of the south 100
feet of Tract A, Hil].cre'st Drive Re-Sub. Tkie Gity Attorney read the request from
Mr. Satterfie].d and the original recommendation from the Zonin� Board which vras
that tne first request be approved and that the second concerning business usage
be denied. After �he matter was r.eferred back to the Zoning �oard for explanation

of the reasons for the recommendation on the first request concerning the R-4
usage, the Zoning hoard recommended that no action be taken until plans for a
project or develo�ment of the area are presented. M.r. Satterfield who was present
withdrew his request �'or Eusiness usage of the West 50 feet of the south 1Q0
feet of Tract A. He addressed the Commission in his own behalf s�ating that the
hardshyp lay in his inability to sell th e land as a site for ar. apartment house
under the present zoning. Mr. John Burnison, adjacent property owner, told tho
Commission he approved of grantin�; the rec�uest f�r t:ze R-4 zoning. Mr. R. L.
Kilpatrick, attorney for Mr. an�i Mrs. James R. Lewis, reported that many csf the
property owner� in the immediate neighborhoad were opposed to any such change in
zoning designation as they had relied on the protecti on of R-1 and R-2 zoning
when they built their houses. He presented a petition signed by thirty-nine
property oY�ners objecting to the grantin� of the reqi�est. Commissioner I�ennedy
moved that the City go on record as urholdin� the Zoning Board in their requiremen�
and dsny this request. Motion was seconded by Commissioner Strang and carried
unanimously.
The Gitg Attorney read on its first reading Ordinan_ce 67�. which declared
the CityQs intention to annex part o£ Druid Acres Fi.rst Addition. Commiss?oner
Strang moved that Ordinance b7y. be passed on its first readin�. Motian was
seconded by Commissioner Russell and carried unanimousl�,

The City Attorney reported that there had been no objections to Ordinance 6'J3
declaring the City�s intention to annex Betty Lane Heights 2nd Additzon; therefare,
he read on its first reading Ordinance 675 which v�ould annex Betty Lane Heiohts
2nd Addit ion. Commissioner Strang moved that Ordinance 675 be passed on its first
reading. Motion was seconded by Commissioner Russell and carried unanimously.
Cormissioner Strang mo•ved that Ordinance 675 be considered on its second
reading by title only by unanimous consent of the Commission. Motion �rtas seconded

The City Attorney reForted that changes in the O.A.S,I, law made it possible
to include ur.der Social Security those City em�loyees who are ineligible for the
Pensian Plan. He 5aid previausly a ballot had been �ent to �he employees and they
had voted almost unanimously that they would like to have Social Security coverage.
Although th e Commission has already agreed to execute the standard form of contract
to put this into effect January 1, 1955, he said it wouJd be necessary to pass an
Ordinance in order to make the State*s f iles complete. He read on its first reading
Ordinance 676 relating to Old Age and Surv_vors Insurance. Commissioner Strang
moved that Ordz nance 676 be passed on it3 first reading. Motion was seconded by
Commissioner Rpssell and carried unanimously.
Commissinner Russell moved th�t Ordinance 676 be considered on iL•s second
readino by title anly by unanimous consent of the Commission. Motion was seconded

Mr. H. H. Baskin, Sr., appeared before the Commissxon requesting the Gity
to write a l�t�er to the Ax�my Engi.neer Corps in Jacksonville showing that the
City will offer no objection to the granting of an applicatian on the part �f
H. H. Baskin and Associates to permit drsdging and filling on property owned Uy
the applican.ts at the south end of Clea.rwate.r Beach adjacent to Hamden Drive
according to plans submitted. He prasented a sketch of the proposed Bayside #3
Subdivision showing a tentative seawall line as requested by the Gitye It was
wish of the Commission that Mr. $askin submit a proposal designating an exact
seawall line in relationship to certain permanent mark�rs witl�in the proposed
subaivision. Mr. Baski� stated that he would have Pdr, Leo Butler prepare sueh
sketch for the Commission's approval. Upon inquiry from the Mayor as to where

secundly, that appropriate o£f�_aials be authorized to receive a quit claim deed to
bhe land across the channsl fr��m t�he fourth finger which has besn formerly
discussed, and that appr�priat,e offic3als be authorized to give him a permit if
necessary on trust for an app'lication by him to take fill �eaterial from the land
to be quit-claimed and fa°om other adjacent areas a�proved by thE C�.ty. Motion was
seconded by Commissioner Rus��ell and carried unanimously.
The City Attorney read on its third reading Ordinance 671 which would declare
the City�s i�tenti on to annex Salls Subdivision Units l, 2 and 3, Commissianer
Strang moved that Ordinance 671 be passed and adopted on third and final reading.
Motion was seconded by �omm,issioner Kennedy an d carried unanimously.
'i'he City Attorney reac't a Resolution changing the name of Overbrook Street
betzveen Betty I,ane and Kings Highwap to Fairmont Stree� to avoid confusion with
Qverbraok Avenue which runs north and south. Commissioner Strang moved that �he
Resolution be adopted and �he proper o£ficials be authorized to execute it and that
the inf ormation be given the Fire Department, Poii�e Department, Chamber of Commerce
and Post Office, MBtion was seconded by Co��.ssioner Russell and carried unanimouslq.
A Resolution was read by the City Attorney assessing the sanitary sec�er
installed in Gulf View Boulevard 120 feet south of Third Street to tY�e intersection
of Hamden Driye, in Coronado Drive 21�3,6 feet south of Third Street L•o the in�er-
section of Hamden Drive, and in Hamden Drive from First Street to Gulf View E;�u7.evsrd.
Commissianer Strang movsd that the kesolution be passed and adopted and the proper
officials b e authorized to execute it. Motion was seconded by Commis�ianer Russe3l
and carried unanimously.
A Resolut ion was read dedicating the City praperty described as the wes�
eleven feet of the north 621 feet of Lot D and the east l�g feet of Lot E, Nero�
Country Club Addition, as a public street to be knov�n as Stadium Drive.
Commzssioner Russell moved that the Resolution of dedication of Stadium Drive be
adopted a�nd th� proper o�ficiaZs b� authorized to execute it. Motion was seaonded
by Commissioner Bohannon and carried unanimously.
The City Manager reported that three fire hydrants on Mandalay Boulevard north
oi the Carlouel fence are rusted out and nee� replaceraent� Ii� estimated the new
fire hydrants would cost �200.00 eac� and recommended that a work order be approved
for �b00.00. Commissioner Strang moved a work order be approved in the am�unt of
�600.00 to replace three fire hydrants. Motion was seconded by Commissioner
Kennedy and carried unanimously.
A letter was read from Juvenile Court Judge William G, Gardiner requestin�
approval of appointment of Detective Sergeant E. Lester Marston as Special
Assistant Counse].or of the Juvenile Court without comgensation. The Police Chief
explained that each Police Department as a cooperative measure has one man designated
to assume such a position with the Juvenile Caurt in order to comply with thr; Juvenile
Law. He said this one man can handle any juvenile prablem that comes up including
apprehension of juvenile deZinquents and investigatian of the cases. Commissioner
Russell maved that the City Go�issinn approve the appointment o£ E. Lester
MarsLon as Juvenile Counselor. Motion was seconded by Gommissioner Kennedy and
carried unanimouslp.
The City Attoxney read a letter addressed to the Gommission by the Ci�q
Clerk in which att�nt ion was called to the fact that the Gity oi Glearwater tax
certificates from the year 1930 to 193t�, inc? usive, „aill b�come twenty years old
on June 3rd of this year. The letter also suggested that delinquent taxes might
possibly be collected if the Czty should file application ior tax deed on such.
propertq. Commissi.oner Bohannon moved the suggestion be approved and tk�a� the
City Clerk and the City AtGorney proceed with this work as outlined. Motion was
seconded by Commissioner Kennedp and carried ur,animdusly.
The City Attorney read an application from i�ir. Robert C. Schmid for germission
to erect a tE! by $f masonite sign on his px�operty on Coronado Drive, Lot �.,
Columbia Subdivision #1�, to advertise the lo� £or sale as a mot�l �ite, The City
Attorney read the Zoning Board+s recommendation which was thab the rsquest be
denied since this would be a Commercial Sign in a residential area. The City
Attorney pointed out that this could be considered a Real Estate sign but the
limitation on the size oi real estate si�ns was six square feet in area.
Commissioner Russell moved that the requsst from R, C, Schmid for a commerci�l
sign on Coronado Drive, Lot 1�, Cfl1umbia Subclivision #4, be d�nied as per the
Zoning Board's recommendation. Motirn was seaonded by Commissioner S�rang and
aarried unanimously.

Concerning the progosed job classification survey and pay plan for City
employees, the Ci,ty Manager said this work is considered a pro£essional service
and is not a biddable pr�position but it is possib].e to get proposals from the
various companies, fIe presented a proposal from Griffenhagan 8c Associates
which xncluded an itemized sche�Cttle of the work �o be done in designing a job
classification plan, designing a pay plan to cover the positions, and agreeing
to ta:egin the performance of services immediately, the work ta be finished in
three months time. The I�Ianager said the firm i�ad submitted a price o.f �2,300.00
far the entire work described includin� one mastar copy of the plans. He reported
that the cnst wa.s lower than estimates of �2,700.OQ and �3,200.00 from other
aompanies becaL�sE this company was already making a similar survey in Tampa.
It was the opinion of the Gommissioners th�t the City would need at least ten
copies of the pl�n and th�t it would be helgful if the k�ork were camplete�
before budget time. Commissioner 5trang suggesi;ed that Section 2-d, concerning
suggesci4ns as to methods for placinP the pay plan in eiiect, sh.ould be expanded
�o cover a period of four or five years. Commissioner Eohannon moved thab the
Coirun�ssion appr�ve i4Ir. Middletonts emgloying this part�cular sirm at an amount af
�2,200.00 which we understand v,�ill provide for one copy of the report and nev;otiate
f�r nine rnore copies subject to his getting an acceptable price on the additiona7.

The City Manager• reported the Finance Degartment had requested approval of
transferring �$Q,OOO.00 from the Gi;ar.ette Tax Fund to the General Fund.

of the Finance Depar°tmen'�. Motian was seconded by Commiss3oner Bohannon and
carried unanimausly.
It v�as requested by the Finance Department that �50,000.00 be transfe.red
from the Uti].ity Fund to the Gene�al Fund, Comrnissioner Strang moved that �
�50,0OO.00� be transferred from the Utility Fund to the General Fund according to
the Finance DepartmentTs request. Motion was seconded bs= Gommissianer Bohannon
and carried unanimously.
The City Manager re,ported that Mr. G. A, Peterson, Cour.ty Director of Public
Udorks, had informed him that the County had secured the right-o#'�way ior Keene
Road from Gulf-to-Bay ta Druid Ro�d providin� the City wi 11 pay �$50.00 ior 43
fruit trees in the right-of-way. He explained tha.t this would be the only
cost bo the City, that the County would pave, curb and gutter the proposed street,
the width to be 30 feet and the right-of-way 60 feet. He said the grQperty owners
had agreed to this proposal if the work was finished wi�hin 12G days, Commissioner
Kenn�edy moved that the expenditure of �$50.00 be authorized for paymen� for iruit
L•rees in the right-of-way of Keene Road extended between Druid Raac' on the south
and Gul.f-to-Bay Boulevard on th� north in acceptance of the prapos�al of the County
to obtain right-of-way, pave the street with curb and gutter wi.thout any further
cost to the City, and in acc�rdance with the property o�ners' request that it be
completed within 120 days. Motion was seconded by Commissioner Strang and carried
unar�imous ly .
The Mayor announced that a le�islative meet:.ng was schedu�ed for $;00 P.I�,
on Monday, March 7th, where the Gity Commission would have the oppartunity to
consult with the Pinellas County leGislative delegation. He said the Ci±y
pttorney had prepared several new acts which must be advertis�d for 30 days before
pre.�entation at the Legislature, two of which were permissivE acts concerning
enlargement of and increasin� the benefits under the City Pension Fund and the
Firements per_sion Fund.
The City Manager recommended the installation of 200 f eet of two i�ch water
ntain on Unzon Street east of Dou�;las Avenue at an e�timatsd cost of �170.00,
check f or �vhich is on deposit. Commissioner Strang moved the utility imPr�vem�nt
in the arnount of �].70.00 be approved and the proFer officials be authorized to
execute the contracL. Motion was seconded by Commissioner Bohannon and carried
unanimously.
It was recommended by the City Manager that a two inch water main be installed
on Duncan Avenue in Oak Acres Unit 6 at an estimated cost of �590.00, check for
which is on de osit. Commisszener Strang moved that the utility improvernent in
the amount oi �590.Q0 be agproved and that the proper ofiicials be autY±orized to
sign the accompanying corttract. Motion vaas seconded by Commissioner Bohannon
and carried unanimously.
The City Manager presented a 1�esolution requirir_g iive property owners to
c].ean their lots of weeds and underbrush. Commissianer Strang moved the Resoluti.an
be adopted. Mo*ion was seconded hy Co.mmissianer Bohannon and carried unanimously.
The Commi.ssa.on now adjourned as the City Commission and acting as Trustees
of the Pension Fund admitted Lois A. Barlow, biller in the Gas and Water Department
and Richaz�d John Harding, officer, Police Deparbment, to membership in the Pension
Plan on a motion by Commissioner Strang which was secc;�ded by Commissioner
Bohannon and carried unanimously.

WHEREAS, a confusing situation has arisen as a result of the designation
of a street known as Overbrook Street, which street runs from Betty Lane to Kings
Highway, said confusion resulting from the fact that there is already a street
designated as Overbrook Avenue within the City of Clearwater, and
WHEREAS, after due consideratian the City Commis�ion has determined that the
best interests of the City of Clearwater, its citizens and visitors will be
served by changing the name of the street now designated as �verbrook Street to
Fairmon� Street.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Cleaxwater,

Certiiicates for taxes due the Cit}� oi Clearwater for the years 1930 to i934,
inclusive, were sold on June 3rd, 193j, and may possib3y be adversely affected
by what is usually referred to as the T�twenty year law" an Ac� of the 1947
Legislature.
In a large number of cases, the amount of taxes due on individual proparties is
too small to warrant foreclosure proceedings. In such cases, filing by the City
of an application for tax deed on City-owned Certificates wou�d probably r�sult
in the collection of the major portion of such taxes.
In applying for a tax deed, it will be neces�ary for the City to advance money
for advertising, the redemption oF any individually-owned certii5.cates, etc,
However, funds now in our Unclaimed Redemgtion Fund account could be used for
that purpose.

Construct an $ inch sanitary sewer and appurtenances in South Gulf
View Boulevard from a point approximately 120 feet south of the south
line of Third Street, south and southeast �c the intersection of Hamden
