CITY COMMISSION MEETING
September 13, 1954
The City Commission of the City of Clearwater met in special session at City
Hall, Monday, September 13, 1954, at 1:30 P.M. with the following members present:

The Mayor called the meeting to order and announced that Mr. Frederick L.
Bell, Consulting En~ineer, from Tallahassee, who specializes in traffic and
transportation studies was here for the purpose of making a pedestrian and vehicular
traffic survey and was present at the meeting. Commissioner Strang requested that
the Engineer start his survey in the ~ea of Gulf-to-Bay Boulevard to determine
what the recorrmended speed limit should be.
The City Attorney reported that Mr. Howard Ewing had asked that his auction
license be renewed on October 1st for one year and requested permission to sell
china and ,~lassware at auction. The City Attorney summarized the report on ~'Ir.
Ewing's business as follows:
1. It was reported that he had not comr1ied with Chapter 17 of the City
Code regarding keepin~ a re~ister, submittin~ copies of it to the
Police Department and retainint"; articles for ten days before sale.
2. That he had not comFlied with the varbage and Trash Ordinance and that
his service had been discor.tinued.
3. There have been comFlaints that operation of the auction house caused
a traffic hazard.
4. There was a written complaint that he had refused to sell certain
articles for the price at which they were advertised. (Later the
complaintant wrote a letter saying that he did not wish to press that
complaint. )
5. That he was maintainin~ a refund booth and that refunds were being
made to customers there.
Mr. R. J. McDermott addressed the Mayor stating that he was representing several
clients and requested that the hearin~ be postponed for one week in order to permit
him to prepare his case. Mr. H. H. Baskin, attorney for Mr. Ewing, spoke to the
Comrrlssion pointing out' that this was not a Public Hearing but was an application
for renewal of an auction license only. Accordin~ to IVIr. Baskin, Mr. Ewing had not
been able to get a statement from the employees of the City as to the City's
exact requirements in the matter of keeping a register of second hand articles
purchased. I~. Ewing stated that approximately ten per cent of his business was
concerned with second haud arti cles and he would be perfectly willing to comply
with any regulations concernin~ them. Regarding the garbage collection, the City
Manager reported that Howard's place of business required more service than what
the City renders under its normal collections so it was necessary for Mr. Ewing
to make other arrangements and he is now having an outside collector pick up the
garbage and trash twice a day. The City Attorney stated that it would be unlawful
for Mr. Ewing to sell china and ~lassware at auction as the same would be in ,
violation of Chapter 16. Code of the City of Clearwater, 1950. Hearing no
objection from the audience in regard to the granting of this license and hearing
no unfavorable reports as to Mr. Ewing's character, Commissioner Russell moved
that a license be granted to Howard the Trader for twelve months with the provision
that it can be cancelled on 24 hour notice on proper grounds; further, that he and
the City Attorney and the City l~nager confer regarding the reports required.
Motion was seconded by Commissioner Bates and carried unanimously.
The ~ayor stated that the Tax Committee had discussed cancellation of certain
delinquent taxes and improvement liens ngainst property owned by various churches
in Clearwater amounting to approximately $4,000.00 and that it had been a greed by
the Committee that these taxes and liens should be abated against the following
church-owned properties:

Commissioner Strang moved that the tax claims and liens against the property
which is now owned by churches and is used by such churches or is included in an'
immediate future expansion pI'ogram be cancelled in accordance wi th the list
prepared by the City Clerk. Motion was seconded by Commissioner Kennedy and
carried unanimously. 'l'he Mayor requested the Clerk to check the list to make
certain that none in this list are speculative properties but are ones which the
churches either contemplate bui1diIlg on forthwith or ha~e an active church program
going on now. Commissioner Russell suggested that the L.lerk write each church
telling them about the action of the Corr~ission and the amount of money that has
been cancelled.

on behalf of Mr. Harry Harrington for a fifteen foot setback from Acacia Street
for Lot 4, Block 26, !'!anda1ay. The City Attorney read the request and the Zoning
Board's recoumendBtion which was that the request be ~ranted. The Mayor inauired
if there were any objections and there were none. Havin~ held this Public Hearing
and having heard no valid objection, Commissioner Strang moved that the Zoning
Board's recommendation be sustained for a fifteen foot building setback line from
Acacia Street for Lot 4, Block 26, Nandalay Subdi vision. Motion was sec onded by
Conmissioner Russell and carried unanimously.
A Public ~earing was announced on the request of l~. Jos. J. Simmons for a
fifteen foot setback from Aurel Street for Lot 7, Block 256 Carlouel. The City
Attorney read the request and the Zoning Board's recommendation which 'Was that the
request be granted. Mr. George Ebert, owner of Lots 8 and 9, was present and
offered no objection. The Mayor asked if there were any objections and there were
none. Having held this Public Hearin~ and having heard no valid objections on
the request of Joseph J. Simmons for a fifteen foot building setback line from
Aurel Street for Lot 7, Block 256, Carlouel Subdivision, Commissioner Strang moved
that the request beq;ranted in acc ordance with the Zoning Board's recorrunerrl ation.
Motion was seconded by Commissioner Russell and carried unanimously.
The Mayor announced a Fublic Hearin~ on the request of Mr. A. R. Meyer ror
a fifteen foot setback from Starboard Way for Lot 8, Block X, Bay Terrace Addition.
The City Attorney read the request and the Zoning Board's recommendation which was
that the request be approved. The Mayor asked if there were any objections from
the audience and there were none. Having held this Public Hearing and having
he~rd no valid objection on the request of Mr. A. R. Meyer for a fifteen foot
building setback line from Starboard Way for Lot 8, Block X, Bay Terrace Subdivi-
sion, Commissioner Strang moved that the request be approved in accordance with
the Zoning Board's recommendation. Motion was seconded by Commissioner Bates
and carried unanimously.

A Public Hearing was called on the request of Mr. Joseph Love for the
re-zoning from R-2 to Business o~ Lot 13, Block C, Carolina Terrace Subdivision,
to permit the operation of a beauty salon. The City Attorney read the request
and the Zoning Board's reco~nendation which was that the request be granted.
Mr. R. J. McDermott addressed the Commission on behalf of his clients, Mr. and Mrs.
Love. The Mayor inquired if there was any objection and there was none. Having
held this Public Hearing on the request from Mr. Joseph Love for the re-zoning
from R-2 to Business of Lot 13, Block C, Carolina Terrace Subdivision, and having
heard no valid objection, Commissioner Strang moved that the request be ~ranted
in accordance with the Zoning Board's recoulmendation. Motion was seconded by
Commissioner Bates and carried unanimously.
The Mayor announced a Public Henring on the request of Mr. Vance Barden to
construct an addition to the Blue Flame Bar, Grille and Liquor Store lac ated on
the southeast corner of Greenwood Avenue and Palm Bluff Street on property now
zoned as R-4. The City Attorney read the request and the Zoning Board's
recommendation which was that the request be granted. The Mayor inquired if there
was any objection and there was none. Having heard this Public Hearing on the
request of Mr. Vance Barden to construct an addition to an existing building to
be used for business purposes on property now zoned as R-4 and described as the
North 122 feet of the West ~75 feet of the swt of SEt of NW~ of Section 10-29-15,
and having heard no valid objection, Commissioner Strang moved that the request
be granted in accordance with the Zoning Boarrt's recommendation. Motion was
seconded by Commissioner Bates and carried unanimously.
The City Attorney read the application of Mr. Emory J. Daniel for permission
to erect a commercial advertising sign, 4' by 54', on the property of Mr. W. L.
Ward at South Garden Avenue and Park Street to advertise free parkin~ on the park-
ing lot for customers of Daniels Fashion Shop. He also read the Zoning Board's
recommendation which \'Jas that the request be approved. The Hayor recommended
that extreme caution should be observed in granting permits for any billboard
signs in the downtown area and suggested that the entire Commission as a Co~mittee
study tpe proposed location before making any decision on the matter. By consent,
this matter was referred to the entire Commission acting as a Committee with a
report to be made at the first meeting in October.
The City Manager presented a Resolution requiring fifty-four property owners
to clean their lots of weeds and underbrush. Commissioner Strang moved the
Resolution be adopted. Notion \'las seconded by Commissioner Russell and carried
unanimously.

Mrs. H. L.. Felton addressed the ~ommission regArdins the condition of the
street in the 1400 block on Park Street between San Remo and Gul~-to-Bay Boulevard..
The City ~ianager explained that there had been several requests ~or sanitary
sewer in that area and the sewers would have to be put in before the street is
paved. He stated that the project was being prepared for a Public Hearing some-
time in the near future.
The City Manager recommended the installation of approximately 500' o~ six
inch water main on Kings Highway and two 2 inch lines running west approximately
750 feet each (on Overbrook and farkwood) amountin~ to an estimated ~2,800..00 on
a refunding contract, check for which is on file. Commissioner Bates moved the
work be authorized. Motion was seconded by Commissioner Kennedy and carried
unanimousl.y..
The City Manager recommended installation o~ 266 feet of six inch water main
and 673 feet of two inch \'iater main in the e asernent on Clark and Long Streets,
outside the City limits and due north of Bonair Hill Subdivision #1. He estimated
the cost at ~1,430.00. Conooissioner Strang moved the work be authorized subject
to a check being received from Mr. Ed. Whitson, and the contract be signed.
Notion was seconded by Connnissioner Bates and carried unanimously.
The City II/Ianager recommended installing 42$ feet of two inch gas main exten-
sion on North Hailroad Avenu~ at an approximate cost of $355.00. Commissioner
Bates moved the work be authorized. Motion was seconded by Commissioner Strang
and carried unanimously.
The Mayor reported that he had received a letter from Mr.. Lloyd Phillips
reques'ting that the City participate in the annual Homecoming Festival and Parade
of the University of Florida at Gainesville by providing a float at a cost of
$150.00. By consent, the request was referred to the Special Events Committee
of the Chamber of Commerce for their recommendation and for a report at the next
meeting.
The Mayor announced that there would be a meeting of the Florida League of
Municipalities at Tampa on November 21-23, 195~. He recommended that the various
departments o~ the City be represented at the meetings as well as having the City
Manager and the Commissioners attend. He also mentioned that the American
Municipal Congress would meet November 28th to December 1st at Philadelphia.
Municipal Judge Leon Whitehurst addressed the Commission describing new
procedures which he was recommendin~ for the Municipal ~ourt, the first of which
was the operation of a Fines Bureau to accept a signed plea of ~uilty and waiver
of hearing in open court from persons charged with designated traffic offenses
and to collect fines as designated by a fine and traffic offense schedule. He
presented a copy o~ the schedule for fines for the Commission's approval. During
the discussion, Cornmissioner Bates sug~ested that the fine for speeding should
be amended to read $1..00 per mile for every mile in excess o~ the designated
speed limit. 'fhe Judge also showed the Co:.unissioners a copy of the proposed
statement to be set up in a rubber stamp for use when a defendant enters a plea
of guilty at the Fines Bureau. Commissioner Strang moved that all three of these
reports as submitted by the MuniciFal Jud~e be approved as amended to go into
effect as of Monday, September 20, 1954, and that a copy be sent to each
Comndssioner. Motion was seconded by Commissioner Kennedy and carried unanimously.
There being no further business to come be~ore the Board, the meeting was
adjourned at 4:43 P.M.

This property is bounded on the South by Acacia Street and on the West by
Bruce Avenue. It has a frontage or 110 feet on Acacia Street and 57 reet on Bruce
Avenue. It is located in an area zoned for single family dwellings and we are
advised that under the existing zoning regulations any improvements on this
property will have to set back 25 feet from each street.
Mr. and Mrs. Harrington request that an exception be made under the hardship
provision of the zoning act to permit construction on this lot with a setback of
only 15 feet on Acacia Street. The requirement of a 25 foot set back along Bruce
Avenue is perfectly agreeable.
Mr. and Mrs. Harrington plan to build a home on this property and have engaged
the services of J. Frank Hancock, Jr., as contractor. However, after allowing
for the 25 foot set back from Acacia, the lot is not sufficiently large for the
home they wish to build, the plans for which have now been completed.
It is therefore respectfully requested that in view of these circumstances an
exception be made under the hardship provision of the zoning act to permit Mr. and
Mrs. Harrington to construct a home as planned on this property, with a set back
of only 15 feet along Acacia Street.

In view of the existing Ordinance requiring a 25 foot set back from any
side street in an R-l zone, it is necessary to have approval, as a hardship case,
of a 15 foot set back on Aurel St. (Hardship being that owner can't build house
on his lot unless 15 foot set back is approved.)
The previous Ordinance provided for a 10 foot set back on side streets in
this Subdivision and all existing residences are so located. I therefore submit
the matter for your action and approval on the basis that it will cause no harm
or injury to any surrounding property owners and denial would cause the lot to
be virtually worthless.

Chapter 23 of the Clearwater City Code is hereby made on behalf of Lela Ruth Love
and Joseph Daniel Love.
The applicants desire to have Lot 13 Block C of Carolina Terrace Subdivision,
which they presently own, either rezoned for business purposes or have extended
to them the right to use same for the purpose of establishing a beauty salon in
the building presently existing on said property.
The Froperty is located on the Northwest corner of Missouri Avenue and Howard
Street. Missouri Avenue is the City Limits, and the area immediately to the East
of this property is in the county and unzoned, although, there are plat restrictions
on the property Ll!mediately East of this property.
At the time this property was zoned R-2 Missouri was not a through road as
it now is, and it is felt that there are practical difficulties and unnecessary
hardships in implying the strict letter of the Zoning Act in this situation.

We feel the zoning of this property R4 was unintentional and only resulted

The building was constructed years before the zoning map o~ 1952 was drawn.

The City Commission of the City of Clearwater met in special session at City

The NZayor called the meeting to order and announced th�t Mr. Frederick L.
Bell, Consulting Engineer, from Tallahassee, who specializes in traffic and
transportation studies was here for the purpose of making a pedestrian and uehicular
traffic survey and v�as present at the meeting. Commissioner Strang requested �Y�at
the Engineer start his survey in the aea of Gulf-to-Bay Boulevard to determine
what the recommended speed limit should be.
The City Attorney reported that i�'Ix•. Howard Ewing had asked that his auction
license be renewed on October lst for one year and requested permission to s ell
china and ;lassware at auction. The City �ttornep summarized the report an I�'Ir.
EwingTs Y�usiness as f ollows:
l. Tt wa,s re ported that he ha� not com�lied with Chapt�r 17 of the City
Code ;regarding keepina a re�ister, submitting copies of it to the
Police Department and retaining articles ior ten days before sale.
2. That he had not complied with the ^varba�e and Trash Ordinance and that
his servi�e had been discor.tinued.
3. There have been complaints that operation of the auction house caused
a traffic hazard.
1�. There was a written complaint that he had refused to sell certain
articles for the price at which they were adverbised. (Later the
complaintant wrote a letter saying that he did not wish to press that
complaint.)
5. That he was m�intainin� a refund booLh and that refunds were being
made to customers Lhere.
Mr. R. J. T�IcDermott addressed the Mayor stating �hat he was regresen�in� several
clients and requested that the hearing be postponed for one week in order to �.rmit
him t:o prepare his case. i�1r. H. H. Baskin, attorney for Nir. Ewing, spoke to the
Corrimission pointing out'that this was not a Public Hearing but was an application
for renewal of an auction license only. Accordin� to i�ir. Baskin, i�Ir. Ewing had not
been able to get a statement from the emgloyees of the City as to the CityTs
exact requirements in t:r;2 matter of keeping a register of second hand articles
purchased. Mr. Ewing stated that ag�roximately ten per cent of his business was
concerned with second hand articles and he wou ld be perfectly willing to comply
with any regulations concernin� them. Regarding the garbage collection, the City
Nlanager reported that Howard's place of business required more service than what
the Cit�+ renders under its normal collections so it was necessary for Mr. Ewing
to make other arrangements and he is r.w�w having an outside cellector pick up the
garbage and trash trvice a day. The City �lttorney stated that iit would be unlawful
for Mr. Ewing t� sell china and glassware at auction as the same would be in .
viol�tion of Chapter 16, Code of the Gity of Clearwater, 1950. Hearing no
objection from the audience in re�ard to the granting of this 12cense and hearing
no unfavorable reports as to IJfr. Ewing's character, Commissiones� Russell moved
that a license bE granted tn Howard the Trader for twelve months with the provision
that it cdn be cancelled on 21�. hour notice on proper grounds; further, that he and
the City Attorney and the City i�ager confer regarding the reports required.

The i�layor st�ted that the Tax Committee had discussed cancellation of certain
delinquent taxes and improvement liens against property awned by various churches
in Clearwater amounting to approximately $�4,000.00 and that it had been a greed by
the Committee that these taxes and liens should be abated against the following

Commissioner Strang moved that the tax claims and liens against the property
which is now owned by ahurches and is used by such churches or is included in an
immediate future expansion program be cancelled in accordance with the list
prepared by the City Clerk. Mot ion was seconded by Com�nissioner Kennedy and
car.ried unanimously. '1'he P�Yayor requested the Clerk to check the list to make
certain that none in this list are speculative properties but are ones which �he
churches eii:her contemplate buildinp on forthwi�h or have an active churcli program
going on now. Commissioner Russell suggested that the �lerk write each church
telling i;hem about the action oi the Commission and ths amount of money that has
been cancelled.
The ,�iayor announced a Public Hearing c+n the request of �Ir. J. T�aeed McMullen
on behalf of Mr. Harry Harrin�ton for a fif teen foot setback from Acacia Street
for Lot 1�, Block 26, l�jandalay. The City Attorney read the request and the 'Loning
Board's recommendation which was that the request be �ranted. The i�ayor inquired
if there were any objections and there were none. Having held this Public Hearing
and havin; heard no valid objection, Comr,iissioner Strang moved that the Zoning
Board's recommendation be sustained for a fifteen fo�c building setback line from
Acacia Street for I�ot i�, Block 26, 1'landalay 5ubdivision. Motion was seconded by
Conunissioner Russell and carried unanimously.
A Public Hearing was announced on the request of T�ir. Jos. J. Simmons for a
fifteen foot setback from xurel Street for Lot 7, Block 256 Carlouel. The City
�ttorney read the request and the Zor.ing Board�s recommendal;ion which was that the
request be granted. i�Sr. George Ebert, owner of Lots $ and 9, was present and
offered no objection. The I�i�yor asked if there were any objections and there were
none. Having held this Public Hearing and having heard no valiu objections on
the request of Joseph J. Simmons for a fifteen foot building setback line from
Aurel Street for Lat 7, Block 256, Garlouel Subdivision, Commissioner Strang moved
th at the request be aranted in accordance with the Zonin� Board�s recommerrlation.

that extreme ca.ution should be observed in gran�ing pe.rmits for any billboard
signs in the downtown area and su��es�ed that the entire Commission as a Committee
study the proposed location before makzng any decision on the matter. By consent,
this matter was r��ferred to �he entire Commission acting as a Committee with a
report to be made at the first meeting in October.
The City ivlanager presented a Resolution requirin� fifty-four property owners
to clean their lots of weeds and underbrush. Commissioner Strang moved the
Resolution be adopted. Nlotion was seconded by Cotnmissioner Russell and carried

of the Chamber of Gommerce for their recommendation and for a report at the next
meeting.
The i�layor annourced that there would be a meeting of the �'lorida League of
Nunicipalities at Ta�npa on No�,rember 21-23, 1954. He recommended Lhat the variou�
departm4nts of the City be represer,ted at the meetings as well as having the City
Manager and the Commissioners ai:tend. He also mentioned that the American
Municipal Congress would meet November 2$th to December lst at Philadelphia.
Municipal Judge Leon VVhitehurst addrQssed the Commission describin� new
procedures which he was recommendin; % r the T�iunicipal �ourt, the first of which
was the operation of a Fines Bureau to accept a si�ned plea of puilty and waiver
of hearing in open court from persons charged with deszgz�ated traffic offenses
and to collect fines as designated by a f ine and traffic offense schedule. He
presented a copy of the schedule for fines for the Commission's approval. During
the discussion, Commissioner Bates sug�ested that the fine for speeding should
be amended t o read �pl. GO per mile for every mile in e;ccess of the designated
speed limit. `Phe Judge also showed the C�:.imissioners a eopy of the proposed
statement to be set up in a rubber stamp for use when a defendant enters a�lea
of ;uilty at the Fines Bureau. Commissioner Strang moved that a11 three of these
reports as submitted by the Munici�al Jud.�e be approved as amended to go into
effect as of �Ionday, September 20, 1�51�, and that a copy be sent to each
Commissioner. i`�otion was sec�nded by Commissioner Kennedy and carried unanimously.

property will have to set back 2� feet from each street.

provision of ths zoning act to permit construction on this lot with a setback of
