City Attorney Chief of Police City Engineer The Mayor announced that the first item on the agenda was the proposed sale to Maas Brothers, Tampa, of City property fronting on the north side of Cleveland Street beginning at a point 185 feet west or Osceola Avenue, with a frontage of 400 feet and a depth of 130 feet, for $120,000.00 cash; in addition Maas Brothers would spend $55,000.00 to construct a band shell and install a publiC parking lot in Coachman Park. He stated that other offers to purchase City property in this area had been received and he thought it might be proper to consider those offers at this time also. The City Attorney read a letter from Mr. James F. Magurno Offering to buy a part of the City property, l50 by 130 feet, with 150 foot frontage on the north B~de of Cleveland Street beginning at a point 185 feet west of Osceola Avenue at the rate of $450.00 per front foot or a total of $67,500.00. Mr. Magurno stated in h~s letter that he had endeavored to bid on this property some years ago and had been informed that it was reserved for park purposes. Commissioner Kennedy stated that the proceeds from Mr. Magurno's offer would not enable the City to carry out its plans for the development of Coachman Park. The Mayor commented that there was a growing tasdency for the business distr~ct to expand to the east and the Commission by encouraging Maas Brothers to erect a large building at this location hoped to balance the business district and help preserve real estate values in the downtown area. Mr. Leland Drew addressed the Commission opposing the sale of City property quoting from the Minutes of the City Commission of August l5, 1949, to show that it had been the intention of the Commission at that time to dedicate the leased Cleveland Street property at such time as the leases should expire. Mr. Drew said it was his opinion that the City should acquire ~#~~,tn~ more property for park purposes rather than disposing of this property. Mr. J b John K. Batstone addressed the CommissionXto the sale of the City property to Maas Brothers stating that the proposed sale of the property should have been advertised for sale to the highest bidder. Mr. M. B. Thayer stated that the land which it is proposed to sell is not adapted ror park purposes; however, he advised the City to retain that part of the property fronting on the water west of Maas Brothers proposed site so the City could get the benefit of any ruture increase in value. He thought that the City property south of Cleveland street was much more adaptable for park development than that covered by the proposed sale. Mr. Alfred Vasconi, Mr. John G. Llewellyn, Mr. Ross B. Norton, Mr. Max Coachman, Mr. Herbert Blanton and Mr. Frank Muscarella spoke in favor of the sale to Maas Brothers. Commissioner Bates explained that the reason why the property was not offered for public sale was that the Commission would not vote approval of the sale or the property to an unknown user. He tho~ht the use of the property by Maas Brothers was in an entirely different category because it lends to the growth and development of the City while sales to other purchasers might not have that effect. He said the Commission was not embarked on a program of the disposition of waterfront property but seeing if it cannot improve the waterfront park situation by taking this opportunity fo~ the use and development of Coachman Park. The City Attorney r.ead a letter from Mrs. Irene Hartsell in which she proposed to sell her property in Block A of John R. Da~ey Subdivision lying adjacent to the Municipal Auditorium, for the sum of $115,000.00 and proposed a payment of $1,500.00 as earnest money deposit; $33,000.00 at the time of closing which wo~ld include the $1,500.00 earnest moneyj payment of $12,000.00 at the end of a year with interest at 4% on the unpaid balancej and the payment of $lO,OOO.OO each year plus interest until the entire balance shall have been paid. The Mayor recommended that if the City consummated the deal with Maas Brothers that they consider this offer at the same time and use some of the money as a down payment on this property. Commissioner Bates, a member of the Committee, joined the Mayor in recommending the acquisition of the Hartsel property for the City. Comm~ssioner Kennedy reporting for the Committee regarding the offer to sell the Clearwater Conservatory of Music property and the Bacon property to the City stated that the latest total offer on both the properties was $57,500.00. He recommended that ~f the City concluded the deal with Maas Brothers that the Comm~ssion give favorable consideration to acquiring the Conservatory of Music property and the Bacon property. He pointed out the purchase would give the City an additional 116 feet of waterfront property, and if the City would also buy the Bartse1 property, the City would be in a better position ~or land that oan be utilized for the benefit of the public by owning these three additional parcels and disposing of the one on Cleveland street wh~ch does not lend 1tsel~ to park purposes. He alao recommended that the City pay cash in consummating the transactions. jib ;, , 'j i The Mayor read a letter from Commissioner Russell in which Mr. Russell stated that he regretted that it was necessary for him to be absent from the meeting. He said he realized that he could not vote in absentia but that he wished to express himself as ravoring the consummation of the proposed sale to Maas Brothers if the majority of the Commission voted in favor of it. Commissioner Bates stated that the Commission should take steps to see that the piece of land with l~O root frontage on Cleveland Street and 130 foot depth, lying immediately west of the Maas Brothers site should be omitted from any dedication for the purpose of public parking. Mr. Jerome Waterman representing Maas B~others said it was his understanding that this tract was not to be a part of the parking lot. Commissioner Bates moved that the Commission accept the proposal from Maas Brothers with the amending of that portion of Paragraph Six that we discussed regarding the small piece of property on the north side of Cleveland street, a strip 130 feet deep with 120 foot frontage on Cleveland, immediately west of the proposed Maas Brothers site, and that the proper officials be authorized to sign a contract. Motion was seconded by Commissioner Kennedy and carried unanimously. Mr. Lewis Homer read from a letter which he had addressed to the Commission in which he stated he had a number of clients who were interested in buying some of the property on the north aide of Cleveland street west of the tract which Maas Brothers desire to purchase and also on the south side west of the Baptist Church at the same ratio of price and terms as the Maas Brothers agreement. The Mayor said the Commission would like to know whom they are dealing with and how the intended purchasers planned to use the property. Mr. Homer said he wished a definite repo~t to carry back to his clients and he requested that the City give him a "Yes" or "No" answer at this time. Commissioner Bates told Mr. Homer that so far as his personal opinion was concerned that if the answer was necessary immediately it would be negative. The other Commissioners concurred in this. In view of the request that had been made by Mr. Homer, Commissioner Kennedy moved that the Commission go on record as taking the position that there is no other footage or area of City-owned property 1n that vicinity for sale at this time either on the north side or the south side of Cleveland Street until we see what the Commission is able to work out in acquiring these other parcels. Motion was seconded by Commissioner Strang and carried unanimously. Commissioner Kennedy suggested that possibly conditions could change within a year so as to bring about an entirely difrerent viewpoint. In regard to purchasing the Conservatory of Music property, the Bacon property and the Hartse1 p~operty, Commissioner Bates moved that the Committees have formal contracts prepared and ready for presentation for official action. Motion was seconded by Commissioner Kennedy and carried unanimously_ Regarding the bids opened at the last meeting for post card stock, the City Manager reported that only one of the three companies had submitted an alternate for two and a half tons of the post card stock and that the other two companies had been contacted and had submitted alternate bids also. He recommended accepting the bid of $12.85 per cwt. or $642.50 from the Tampa Paper Company. Commissioner Strang moved that the Manager's recommendation of awarding the bid to the low bidder, Tampa Paper Company, in the amount of $642.50 be approved. Mayor and City Commissioners City Hall Clearwater, Florida Gentlemen: I hereby submit an offer of $450.00 per front foot, in cash, for the one hundred fifty (150) feet of city owned property on the North side of Cleveland street, adjoining the Gulf Station property on the Northwest corner of Cleveland Street and Osceola Avenue. I understand this property is 130 feet deep and 185 feet west of the corner of Osceola Avenue. The site would be used for the erection of a multi-storied store, office and hotel building with a three story garage for parking. The entire project would cost in excess of three-quarters of a million dollars and this offer is submitted with the understanding that construction would start this year. InCidentally, I endeavored to make a bid on this same property about four years ago and was informed that it was reserved for park purposes and not until I read in the Clearwater Sun of the offer of Allied Stores, did I realize that there was a change of thought in the usage of this property.
