The Mayor called the meeting to order. The invocation was given by Reverend
D. P. McGeaChy, Peace Memorial Presbyterian Church, Clearwater. Commissioner
Russell moved that the minutes of the regular meeting of May 3rd and the special meeting
pf May 10th be approved in accordance with the copies furnished each member 1n writing.
Motion was seconded by Commissioner Bates and carried unanimously.
The City Manager reported that five sealed bids had been received for three l5KVA
transformers, two 10KVA transformers and two 3KVA transformers. The bids were read
as follows:

After discussion of the bids, the Mayor requested Commissioner Bates to look over
the bids with the City Manager. By consent, the bids were referred to the City
Manager to investigate and bring back a recommendation to another meeting.
The City Manager reported that three sealed bids had been received for radio
equipment for the Police Department and that one bid from the Radio Corporation of
Americaiwould have to be returned as it was not in an envelope marked sealed bid and
had been opened. The bids were read as follows:

After checking the bids, the City Manager recommended accepting the low bid of $4,683.75
from W. H. Armston Company. Commissioner Bates moved that the City Manager's
recommendation be approved and this bid be given to the W. H. Armston Company at a
price of $4,683.75. Motion was seconded by Co~nissioner Kennedy and carried
unanimously.
The Mayor announced a Public Hearing on the paving and curbing of an alley between
Court and Franklin Streets running 190 feet west from East Avenue. The City Manager
reported that the estimated cost of the project was $676.00 or $1.69 per front foot.
The Mayor inquired if there were any objections from anyone in the audience and there
were none. Having heard 110 valid objection to this Public Hearing, Commissioner
Bates moved that the paving of the alley between Court and Franklin Street be
approved and the benefiting property owners be assessed. Motion was seconded by
Commissioner Kennedy and carried unanimously.
The City Manager reported that five bids had been received for the paVing of 190
feet of the alley between Court and Franklin running west from East Avenue. The bids

After tabulation of the bids, the City Manager recommended accepting the low bid of
$574.00 from W. H. Armston Company. Commissioner Kennedy moved that the City Manager's
and City Engineer'S recommendation of the b~d of W. H. Armston Company of $574.00
for the pavement in the alley between Court and Franklin Street be accepted and the
work authorized. Motion was seconded by Commissioner Russell and carried unanimously.
The Mayor announced the continuation of the adjourned Public Hearing on the
petition of Mr. H. H. Baskin, attorney for Mr. Howard Ewing, for exception to the
Zoning Ordinance under the hardship provisions of the Ordinance. The Mayor
summarized the matter by stating that at the meeting or April 19th the Commission
had denied the request as to rezoning the property as Business, and on being
requested by Mr. Baskin to go on record as recognizing the non-conforming usage of
the property, the Commission had referred the natter back to the Zoning Board for
further investigation and clarification as to the usage o~ the property in the past.
Mr. Baskin contended that the property had been used for business purposes during
the past six months and he requested the Commission to go on record as recognizing the
non-conforming use. Having read the supplemental report from the Zoning Board
relative to the use of the property in the past, the City Attorney stated it was his
opinion that the Commission could not restrict the use of, the building which is partly
within the business zone and partly in the R-4 zone, but he believed that the owner
was legally entitled to use those b~ildings lying entirely within the R-4 area for
no more liberal purpose than the usage they had had within the past six months. Mr.
R. J. McDermott, attorney for the objectors, stated that Mr. Ew~ng ~,aB aware of the
zoning limitations at the time he purchased the property and therefore could not claim
a real hardship existed. The Commission heard statements rrom Mr. J. A. Clapp, Mr.
Wm. O"Dwyer and others in which they opposed the granting of the request. Mr.
Howard Ewing addressed the CommisSion in his own behalf. Following a complete
discussion, Commissioner Bates moved that the petition be granted but that the
property not be used for any more liberal usage than that dur~ng the past s1Jt months.
Motion was seconded by Commissioner Kennedy and carried unanimously.

a fifteen foot setback on Gardenia Street for Lot 12, Block 42, Mandalay Subdivision.
The City Attorney read the request from Mr. Cavanagh and also the recommendation of
the Zoning Board which was that the applioation be granted. The Mayor inquired if
there were any object~ons ~rom anyone in the audience and there were none. Hearing
no valid objections at this Public Hearing, Commiseioner Russell moved that the
request of W. E. Cavanagh ~or a Cifteen foot building setback line from Gardenia
Street for Lot 12, Block 42, Mandalay, be granted. Motion was seoonded by
Commissioner Bate~ and oarried unanimously.

A Public Hearing was announced by the Mayor on the request of Mr. Guy Parker
for a fifteen ~oot setback ~rom Washingto~.Avenue fDr Lots 4 and 5, Block A, Fairmont
Subdivision, for an addition to an existing building. The City Attorney read the
request from Mr. Parker and the Zoning Board's recommendation which was that the
applioation be denied, as the Board felt that granting the request would adversely
affeot the adjoining property owners. Mrs. Parker who was present called the
Commission's attention to a list of signatures of property owners in the vicinity
which showed that they were agreeable to the extension of the present structure
toward Washington Avenue. Commissioner Bates moved that the request be granted and
the justification for deciding this contrary to the Zoning Board's recommendation being
that the neighbors have sinoe commwnicated with us and indicated that they have no
objection. Motion was seconded by Commissioner Russell and carried unanimously.
The City Manager requested that Item 4E, Request of W. A. Walker and Angelo
Carapelli for the approval of Plat for Marantha Subdivision, be deCerred.
The City Attorney reported that Mr. James Andrews had requested that the continu-
ation of the Public Hearing scheduled for this date on his petition to rezone Lot 6,
Block A, Boulevard Pines, be postponed to a meeting in June. Commissioner Kennedy
moved that the Public Hearing on the application of James Andrews be adjourned
to Monday, June 21st. Motion was seconded by Commissioner Russell and carried
unanimously.
The City Attorney read a Resolution assessing the cost of the sanitary sewer
in Lantana Avenue from Iris Street to ~rbena Street against the bene~ited properties.
The Mayor inquired if there were any objections from anyone in the audience and there
were none. Commissioner Bates moved that the Resolution be adopted. Motion was
seconded by Commissioner Russell and carried unanimously.
The City Attorney read on its first reading the proposed Ordinanoe 656 which
would annex part of Druid Acres Subdivision. Commissioner Bates moved that Ordinwnce
656 be passed on its first reading. Motion was seconded by Commissioner Kennedy
and carried unanimously. No one appeared representing the developers of the
subdivision.

A Resolution was read assessing the cost of curbing and widening J~piter
Avenue from Rainbow Drive to Drew street against the benefited properties. The
Mayor inquired if there were any objections from anyone in the a~dience and there were
none. Commissioner BAtes moved that the Resolution be adopted. Motion was seconded
by Commissioner Kennedy and carried unanimously.
In regard to the proposed installation of a storm sewer line in the alley
north of Cleveland Street from Hillcrest Avenue to Evergreen Avenue (south of
Block B, Fairview and Hillcrest Drive Subdivision) the City Manager reported that
the estimated cost of installing 335 feet of 18 inch pipe was $1,250~OO. He
explained that this would take the water off Hillcrest and Evergreen down to
stevenson Creek and that the balance of the drainage project up to San Remo would
be borne by the ~roperty owners but that this particular part would be a collective
pipe and would be hard to assess as it drained the area from Drew Street on the
north and all the way up the crown of the hill east of San Remo. He also pointed
out that the drainage ditch runs down the middle of the alley, thus making the rear
of the buildings facing Cleveland Street inaccessible. He recommended that the
work be done by a City crew. Commissioner Bates moved that the recommendation of
the City Manager be accepted, that the work be authorized and a work order b~
approved for the installation of an 18 inch storm sewer line in the alley north of
Cleveland street from Hillcrest to Evergreen. Motion was seconded by Commissioner
Russell and carried unanimously.
The City Attorney read a letter from the Federal Housing Administration in
which the F.R.A. gave authorization for the City to draw plans and specifications
for paving the streets and alleys in the Greenwood Apartment Project, payment for
the construction work to be assumed upon completion by theF.H.A. The letter stated
that the ultimate aim was the dedication of the streets to the City. The Manager
reported that the streets would be acceptable to the City after this paving.
Commissioner Russell moved that the letter from the Federal Housing Administration
be accepted and that the City Engineer and the City Manager get together and get the
necessary data to estimate the cost fOr the entire project to send to the F.R.A.
for their approval. Motion was seconded by Commissioner BAtes and carried unanimously.
The City Manager rep-orted that the developers of Palm Terrace Subdivision Units 1
and 2 had installed 4,830 feet of two inch water line at a cost of $2,936.10
and gas lines at a cost of $110.45 and had never asked for a refunding contract
from the City. He said the developers were applying for such a contract at this time
and had submitted a cert1~ied statement aa to their expenses which had been checked
by Mr. M. C. Durfy. By consent, the matter was deferred for further study.

The City Manager recommended the installation of 215 feet of two inch water main
in South Binghampton Park Subdivision outside the City limits at an estimated cost
of $150.00, check for which is on file. Commissioner Kennedy moved that the City
Manager's recommendation for the installation of 215 feet of two inch water main along
Betty Lane in South Binghampton Park Subdivision be approved and the necessary work
order be issued for $150.00. Motion was seconded by Commissioner Bates and carried
unanimously.
The City Manager requested an expression from the Commission on furnishing
water to new subdivisions outside the City limits of Clearwater with our water
situation the way it is. He pointed out that there was a serious problem of low
pressure on the north end of Clearwater Beach and that there had been a 52% increase
in consumption on Clearwater Beach in the last three years. The Commissioners
discussed various ways of remedying this shortage. The City Manager stated that he
had contacted Mr. Briley regarding his future recommendations for Clearwater Beach
and asked him to come to Clearwater in the near future to discuss the matter. The
City Manager said he had received an application for water for a new subdivision
outside the City limits just east of Stevenson Creek off Betty Lane. After Borne
discussion as to whether annexation should be required, the matter was deferred for
discussion at the next meeting.
The City Attorney presented a proposed Resolution requesting that the new high
scho01 located on Gulf-to-Bay Boulevard be designated as either Clearwater High
Scho01 or Clearwater Senior High School. Commissioner Bates moved that the
Resolution be adopted. Motion was seconded by Commissioner Kennedy and carried
unanimously.
The Mayor reported that the County had agreed to pave Grand Avenue from Druid J
Street to Drew Street and had requested a Resolution from the City showing the City'S
willingness to cooperate in the project. The City Attorney said he would check
with the County Commission as to just exactly what they want included in the
Resolution.

Commissioner Russell reported that in regard to the tax settlement for Mr.
Diedr~ch Stemmerman for $1 095.06 against Lot 55, Block A, Bassedena, and Mr.
Benjamin Sutton for $747.94 against Lot 16, Property of A. J. Moore, the propevty
owners were of the opinion that the original assessments for paving Missouri Avenue
were higher than they should have been. The Tax Committee requested the City Engineer
to check the costs of the job and he also agreed that they were high. Therefore, the
Tax Committee was recommending that the assessment against Mr. Stemmerman's property
be reduced to $805.27 and that the one against Mr. Sutton's property be reduced
to $549.99. Commissioner Kennedy moved that the Committee's recommendation be
accepted and approved subject to payment within 30 days. Motion was seconded by
Commissioner Bates and carried unanimously.
00mmissioner Russell reporting for the Tax Settlement Co~nittee stated that
the lien against Mrs. Mary S. Boardman's property dated April 19, 1926, appeared
on the Court House records but did not appear on the records of the City due to
not being transferred when the record sheets were changed. Mr. F. W. Siple's
letter written on behalf of Mrs. Boardman requested either abatement or writing
off of the old lien in the amount of $1,060.56 on which $636.36 had been paid against
the principal and $390.57 had been paid in interest. The Tax Settlement Committee
recommended that this lien be settled for $350.00. Commissioner Kennedy moved
that the Tax Settlement Committee's recommendation for a compromise settlement of
$350.00 be accepted. Motion was seconded by Commissioner Bates and carried
unanimously.
The City Manager presented a Resolution requiring twelve property owners to
clean their lots of weeds and hnderbrush. Commissioner Bates moved the Resolution
be adopted. Motion was seconded by Commissioner Russell and carried unanimously.
The City Attorney reported that the Ball Park validation law suit will be ready
to f11e on Tuesday. The City Manager reported that the final drawings of the Ball Park
had been received and the invitation to bid would go out on Tuesday.
The City Attorney presented a proposed contract between the City and Chester B.
McMullen, Jr. and Ruth McMullen concerning the development of a new cemetery for
colored persons, to be located on the northeast corner of Rosery Road and Highland
Avenue. Commissioner Kennedy reported that he had looked over the site with Mr.
McMu11en and he approved the location; however, he thought the entire twenty acres
should be dedicated instead of just ten acres so there would be room for expansion.
He a1so suggested that a clause be included in the contract providing for proper
maintenance. Commissioner Bates moved that subject to the amendments discussed in this
contract, that the City enter into this agreement with Mr. McMullen and that the
proper officials be authorized to execute the contract. Motion was seconded by
Commissioner Russell and carried unanimously.
The Commission now adjourned as the City Commission and acting as Trustees
of the Pension Fund, on a motion by Commissioner Bates which was seconded by
Commissioner Kennedy and carried unanimously, admitted Eugene D. Sheets, Jr.,
Floyd M. Murrell, Jack A. Marsh, Policemen, and John B. Lovell, Laborer in the
GaB and Water Department, into membership in the Pension Plan.
There being no further business to come before the Commission, the meeting was
adjourned at 6:20 P.M.

Attached herewith is some additional information from the Zoning Board as
requested in the minutes of the City Commission Meeting dated April 19, 1954.
1. The Board is of the opinion that A & W Glads discontinued operation in
this area on September 1, 1953 (this is from the testimony ~iven to the
Board by R. D. Warner, former Office Manager of the Company).
2. Referring to the Zoning Ordinance paragraph on non-conformdng use, it
is the opinion of the Board that any use of the building in question should
be of the same type of usage, or of a same restriction usage.
3. The Board does not teel that an unlimited usage should be permitted in
an R-4 Zone.

Gentlemen:
I would like to request the City Comm1ssio~ sitting as a board of Adjustment
and Appeal under the authority of the City Zon1~g Ordinanoe for the following change
and for a petition of exception under the hardship provisions of the zoning
ordinance.
1. That William E. Cavanagh, owner of lot ff12 Block 42, Mandalay 6ubdivision
be allowed a 15 foot building setback from Gardenia Street.
From the enclosed chart of this corner it oan be readily seen that the two
existing homes at "A" & "B" are already built with a 15 f'oot set-back. Lot lie"
was granted this same set~back by the Commiesion on January 18th, 1954. This leaves
my lot as the only one on this corner not as yet granted a 15 root set-back.
This lot 1s a 60 foot lot and a set-baok of 25 feet plus 5 feet on the property
line according to the ordinance in torce would ruin this lot as no satisf:actory home
can be built on 30 front feet and if o~e was built to conform to the present ordinanoe
it would detract from all property in the immediate area.
Due to the distanoe and time envolved, ~t is requested that I be given
permission to absent myself from the hearing on this matter, as I have Just returned
from Clearwater. However, if for some reason the Commission wishes me to be
represented at the hearing, I would be glad to cooperate.
It is my intention to start building an soon as this request is granted.

16 feet long by 7 feet wide-we want to make it 5 feet wider.
Having no bed room down stairs tbis has worked a hardship on us, as several
times we have been rorced to use tbis as a bed room during ~llness.
Has been our intentions for years to extend this-each tDme in a position to do
so some thing would prevent suob as-War and no material-my fall from the Yacht
Basin Apartments and having to use as a bed room for a length of time-then my wifes
illness-Now seems things have worked out for us and find the City has extended the
l~ne from 20 to 25 feet-
We measure 90 feet 6" from the curb to outside of room-We have contacted
most of our n0ighbors on the street and all have said would sign that was agreeable
to them.
If you men can see fit to grant tbis to us will certianly deem it a great favor-

benefited by said improvements and the pro-rata cost thereof shall be assessed
against said parcels.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City or Clearwater,
Florida, in session duly and regularly assembled as follows:

Construct a concrete curb on the east and west side of Jupiter Avenue
from the existing roadway on Rainbow Drive to the existing roadway on
Cleveland Street and construct a concrete curb on the east and west
side of Jupiter Avenue from the ex~sting roadway on Cleveland Street to
the existing roadway on Drew Street and modify the existing pavement in
Jupiter Street from Rainbow Drive to Drew Street to provide adequate
drainage.
WHEREAS, under the provisions of Section 123 and other pertinent provisions ot
the City Charter, after said ~provements shall have been completed, the City
Commission shall assess the cost thereof against the properties facing and abutting
said improvements so made, and
WHEREAS, certain parcels of real estate facing and abutting said improvements
have been benefited by said improvements and the pro-rata cost thereof shall be
assessed against said parcels.

Dear Mr. :Middleton:
Reference ~s made to paragraph 3 of your letter of April 29, 1954 ~n which you
requested a letter stating that the Federal Housing Administration would assume the
cost of paving the streets and alleys of the captioned project.
We are enclosing a carbon copy of a letter dated April 13, 1954 from Mr. Lemuel
Showell, Director, Property Management, which clearly indicates the ~ntention of
the Federal Housing Administration to enter into a contract w~th the City of
Clearwater and the manner by which we understand it will be accomplished.
Your attention ~s particularly directed to the last sentence of paragraph 2 of
Mr. Showell's letter which states:
"We wj.ll then draw up an agreement between the Commissioner and the C~ty of
Clearwater providing for pay;ment of the work by the Federal Housing
Admin1.stration upon satisfactory completion and approval by the City."
In view of the fact that the ultimate a~ is ded~cat1on of the streets and alleys
of the Greenwood project to the C~ty of Clearwater, our Washington office and this
office agree, and your Engineer Mr. Ldckton concurs that the most satisfactory'
method of handling the proposed paving will be through City approved cont~actors
under City bidding and supervision, as was the recently completed sewer work.
You are therefore authorized to start the prelj.m1nary work of plans and specifica-
tions with estimate of cost. If your City charter will permit inclusion of the
paving of tne parking areas it will be appreciated if you wj.ll do so, otherwise we
will arrang, for a separate contract on this work.
It will be appreciated if you will have Mr. Lickton submit the drawings, specifications
and cost estimate to this office in triplicate so that we may send two copies to
Washington for approval. Tnereafter the procedure would follow that of the sewer
contract.

WHEREAS, the Pinellas County Board of Public Instruction has caused a new
High School to be constructed on Grand Avenue between Gulf to Bay Boulevard and
~uid Road in Clearwater, Pinellas County, Florida, and
WHEREAS, upon the commencement of use of said high school, the present
Clearwater Junior and Senior High School on Greenwood Avenue in said City will no
longer be used for a high school, but will be used for a Junior High School, and
WHEREAS, the newly constructed H~gh School will be the only Senior High School
within the City of Clearwater, and will predominantly serve the areas embraced by
the City of Clearwater and its suburban environs, and
WHEREAS, the Football Stadium adjacent to the newly constructed High School,
which Stadium forms a part of the facilities of the newly constructed High School,
was promulgated, financed and carried through to completion mainly by the efforts of
residents of the City of Clearwater, and
WHEREAS, it is to the best interest of the public and to the best interest of
appropriate and easy identification that the newly constructed H1~h School be
formally named and designated as "Clearwater High School,lI or as Clearwater Senior
High School. II
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Clearwater,
Florida, in session duly and regularly assembled as follows:
That the Board of Public Instruction of Pinellas County, Florida, be and it is
hereby requested and petitioned to formally name and designate the newly constructed
High School situated in the City of C~earwater, Pinellas County, Florida, on Grand
Avenue and Gulf to BaY Boulevard as "Clearwater High School, II or as "Clearwater
Senior High School."

WHEREAS: it has been determined by the City Commission of the City of Clearwater,

underbrush, and that after ten (10) days notice and failure of the owner thereo~

After discussion of the bids, the Mayor requested Commissioner Ba_tes to look over
the bids with the City Manager. By consent, the bids were refer�ed to the Gity

The City Manager reported that three sealed bids hac� been received for radio
equipment for the Police Department and tnat one bid from the Radio Corporation of

price of $�F,683.75. Motion was seconded by Commissioner Kennedy and carrled
urianimously.
Ths Mayor annourie•ed a Public Hearing on the paving �.nd curbing of an a11ey between
Gourt ar.d Franklin Str�ets running 190 feet west from East AVenue. The City Manager
reported that the estimated cost of the project was $676.00 or $1.6g per Front foot.
The Mayor inquired if there were any objections from anyone in the audience and there
were none. Ha'ving heard rto valid objeetion to this Fublic Hearing, Commissioner
Bates moved that the paving; of` the alley between Cour� and Franklin Street be
approved and the benefiting property owners be assessed. Motion was seconded by
Commissioner Kennedy and carried unanimously.
Tre �ity Manager reported that five bids had been received for the paving of 190
feet of bhe alley between Court and Fr�,nklin running west from East Avenue. The bids

After tabulation of the bids, the City Manager recommended aceepting �he �.ow bid of
$574.00 from W. H. Armston Company. Commissioner Kennedy moved that the City Manager�s
and City Engineer�s rFaommendation of the bid af W. H. Armston Company of $574.00
for the pavement in the alley between Court and Franklin Street be accepte3 and the
work authorized. Motion was seconded by Commissioner Russell and carried unanimously.
The Mayor aruiounced the continuation of the adjourned Public Hearing on the
petition of Mr. H. H. Baskin, attorne,y for Mr. Hnward Ewing, for exception to the
Zoning Ordinanee under the hardship provisions of the Ordinance. The Ma�ror
summarized the rratter by sbating that; at the meeting of April 19th the Commisaion
hau denied the request as to rezonir_g the property as Business, and on being
requested by �Ir. Baskin to go on �ecord as recognizing the non-conforming usage of
the property, the Commission had referred the matter back to the Zoning Board for
further investigation and clarification as to the usage of the property in the past.
IMr. Baskin contended that the praperty had been used for business purposes during
the past s:ix months and he requested the Commission to go on record as recognizing the
non-conforming use. Having read the supplemental report from the Zoning Board
relative �o the use of the property in the past, the Ci�y P.ttorney stated it was his
opinion that the Commission could not restrict the use of the buil�ing which 3s partly
within the business zone and partly in the R-4 zone, but r�e bel3eved that ihe owner
was legal3y entitle� to u�e those buildings lying entirely within. the R-4 area for
no more liberal purpose than the usage they had had within the past six months. Mr.
R. J. McDermott, attorne,y for the objectors, stated tha,t Mr. Ewin� was aware of the
zoning limitations at the time he parchased the property and therefore could not claim
a real hardship existed. The �ommiss3on heard statemente from Mr. J, A. Clapp, Mr.
Wm. 0'�Dwyer and others in which they opposed the granting of the request. Mr.
Howard Ewing addressed the Commis�ion in his own behalf. Follovring a complete
discussion, Commiasioner Bates moved that the petition be granted but that the
property not be used for any more l�beral usage than that during the past six months.

no valid objections at this Publ'�c Hearing, Commissioner Russell moved that the
request of W. E. Cavanagh for a fifteen foot building setbaek line from Gardenia
Street for Lot 12, Block �F2, Mandalay, be granted. Motion was seconded by
Commisaioner Ba�tes and carried unanimously.
A Public Hearin� was announced by the Mayor_ on f;t�e request of Mr, Guy Parker
for a.fifteen foot aetback from Wash3ngton.Avenue for Lots 4 and 5, Bloek A, Fairmont
Sub�ivision, fnr an addition to an existing building, The City Attorney read the
requeEt from Mr. Parker and the Zoning Board�s reeommendation which was that the
application be denied, as the Board felt that granting tt�e requesi; would adversely
af.fect the adjoining property ownera. Mrs, parker who was present called the
Commission�s attention to a liat of signatures of property owners in the vicinity
wh3ch showed that they were agreeable to the extension of the present strueture
toward uJashington A�enue. Commissioner Bates moved that the request be granted and
the justification for deciding bhis contrary to the Zoning Board�s recomrnendation being
�that the neighbors have since communicated with us and indicated that they have no
objection. Motion was seconded by Commiasioner Russell and carried unanimously.
The City Manager requested that Item 4E, Request of W, A. Walker and Angelo
Carapelli for the approval of Plat f'or Marantha Subdiv3sion, be aeferred.
The City Attor•ney reported that Mr. Jamss Andrews had requested tha.t the continu-
ation of the Publie Hearing scheduled for this date on his petition to rezone Lot 6,
B'!ock A, BoulEvard Pines, be postponed ta a meeting in June, Commissiorer Kennedy
moved that the Public iiearing on the application of James Andrevra be adjourned
to Monday, June 21st. Motion was seconded b;� Commissioner Rusaell and carried
unanimously,

and carried unanimously, No one appeared representing the developers of the
subdivision.
A Resolution was read assessing the cost of curbing and widening Jupiter
A�enue from Rainbow Drive ta Drew Streat against the benefited propPrties, The
Mayor inquired if there were any objections from anyone in the aud3ence and there iaere
none. Commissioner Bates moved that the Resolution be adopted. Motion was seconded
by Commissioner Kennedy and carried unanimously.
In regard to the proposed installation of a storm seV�er line in the alley
north of Cleveland Street from Hillcrest AvenuE to Evergreen AVenue (south of
Block B, Fairview and Hillcrest Drive Subdivision) the City Mar_ager reported that
the estimated cost of installing 335 feet of 18 inch pipe was �1,250.-00. He
explained that this �vouZd take the water off Hillcrest and Evergreen down to
Stevenson Creek and that �he balance of the drainage project �.zp to San Remo would
be borne by the property otvners but that this particular part �vould be a collec�ive
pipe and would be hard to assess as it drained the area from Drew Street on the
north and all th� way up the crown of the hill east of San Remo. He als,n pointed
out that the drainage ditch runs down the middlz of the alley, thus mak�no the rear
of the buildin�s facir� Cleveland Street inaccesaible. He recommended that the
w�rk be done by a City crew. Commissioner Bates moved that the recommendation of
the City Manager be accepted, that the work be authori�ed and a work order be
approved for the installation of an 18 inch storm sewer line in the a11ey nor�h of
Cleveland Street from Hillcrest to Evergreen. Motion was seconded by Commissioner
Russell and carried unanimously.
The City Attorney read a letter from the Eederal Housing Administration in
which the F.H.A. gave authorization for the City to draw plans and specifications
for paving the streets and alleys in the Greenwood Apartment Project, payment for
the construction work to be assumed upon completion by theF.H.A. The letter stated
that the ultimate aim was the dec7ication of the streets to the City. The %?anager
reported that the streets would be acceptable to the City after this paving.
Commissioner Russell moved that the letter from the Federal Housin� Admin2stration
be accepted and that the City Engineer and the City Manager get together and get the
necessary data to est3mate the cost f�r the entire project to �end to the F,H.A,
for their approval. Motion was seconded by Commissioner Batea and carried unanimously.
The City Manager reported that the developers of Palm Terrace Subdivision Units 1
and 2 had installed 4,836 feet of two inch water line at a cost of $2,936.10

The City Manager reoommended the install�t3,a� of 215 feet of tWo inch w�ter main
in South Binghampton Park Subdivision outside the City limits at an estimated cost
of $150.00, check for which 3s on file. Cammissioner Kennedy moved that the Qity
Man,ager�s recommendat3an for the instalTation of 215 feet of two inch water main alon�
Betty Lane in South Ainghampton Park Subdivision be approved �:.nd the neceasary work
order be issued for $150.00. Motion,was seconded by Comm�ss3oner Bates and carried
unanimously.
The City Manager requested an expression from the Commission on furnishing
water to new subdivisions Qutside the City limits of Clearwater with our water
situat�on the way it is. He pointed out that �here was a serious problem oi low
pressure on the north efid of Clearwater Beach and that there had been a 52� increase
in consumption on Clearwater Beaeh in �he last three years. The Commissioners
discussed various ways �f remedyi.ng this shortage. The City Manager stated that he
had contacted Mr. Briley regarding his future recommerrdations for Clearwater Beach �
and asked him to come to �learwater in the near future to discuss the matter. The
City Manager said he nad received an appli�ation for water fox� a new subdivision
outside the City limits just east of St�venson Creek off Betty Lane. After some
discussion as to whether annexation should be required, the matter was deferred for
�3iseussion at the next meeting.
The (;ity A�torney presented a�,ropased itesolution requesting that the new high
schocl located on Gulf-to Bay Boulevard be designated as either Cl.earwater Hi�h
School or Clearwater Senior High School. Commissioncr Bates moved that the
Resolution be adopted. Motion was seconded by Commissioner Kennedy and carried
unanimously.
The Mayor reported that the County had agreed to pave Grand Avenue from Druid .
Street to Drew Street and had requested a Resolution from the City showing the City�s
willingness to caoperate in the project. The City Attorney said he would check
with the County Commission as to just exactly what they want inGluded in the
Re�olution.
Commissioner Russell reported that in regard to the tax settlement for Mr.
DieBrich Stemmerman for $1,og5.06 against L�t 55, Block A, Bassedena, and Mr.
Benjamin Sutton for $747.94 a�ainst Lot 16, Property of A. J. Moore, the prope�ty
owners were of the opinion that the origin�,l assessments ior paving Missour3 Avenue
were higher than they should have been. The Tax Commi�tee requested the Cit,y Engirieer
to check the costs of the job and he also agreed that they were high. TherefAre, the
Tax Committee was recommending that the assessment again:t Mr. Stemmerman's propertiy
be reduced to $805.27 and that the one against �Ir. Sutton's property be reduced
to $5�+9.99. Commissioner Kennedy moved that the Committee�s recommendation be
accepted and approved subjzet to payment within 30 days. Mation was seconded by
Commission�r Bates and carried unanimously.
Commissioner Russell reporting for the Tax Settlement Committee stated �hat
the lien against Mrs, Mary S. Boar�dman's groperty dated April 19, 19��, appearea
on the Court House records but did nnt appear on the records of the City due to
not being transferred when the record sheets were changed. Mr. F. W. Siple's
letter written :on benalf of Mrs. Boardman requested either abatement or writing
off of the old lien in the amount of �1,060.56 on which �63E>.36 had been paid against
the principal and �390.57 had �een paid in interest. The `�ax Settlement Committee
recommende8 that this lien be settlea ior $350.00. Commic�sioner Kennedy mov�d
that the Ta.�e Se�tlement Commi+tee's recommendation for a compromise settlement of
$350.00 be accepted. Motion was seconded by Commissioner Bates and carried
unanimously.
The City Manager presented a Resolution requiring twelve property owners to
clean th8ir lots of weeda and linderbrush. Commissioner Hates moved the Resolutian
be adopted. Motion was secorzded by Commissioner RusseZl and carrisd una:aimously.
The City Attc;rney reported that the Ball Park validation law suit will be ready
to file on Tues�ay. The C3ty Manager reported that the final drawing� of the Ball Park
had been received and the invitation to b3d would go out on Tuesday.
The City A�torney �resented a proposed contract between the City and Chester E.
McMullen, Jr, and Ruth McMullen concerning the developinent of a new ceme�ery for
colored persons, to be located on the northeast corner of Rosery Road and Highland
Avenue. Commissioner Kenne�y repor�ed 'that h� had looked over the site with Mr.
McN2ullen and he approved the lo�ation; however, he thou�ht t�e entire twenty acres
should be dedicatad instead of just ten acres so there would be room for expansioxz.
He also suggest2d that a clause ba included in tha contract providing for proper
maintenance. Commissioner Bates moved that subject to the amendments discussed in th:Ls
contract, tha� the City enter into this agreement witY� Mr. MeMullen and that the
proper officials be authorized to execute tr.e cantract. Motion was seconded by
Commissian�r Rus3ell and carried unanimously,
The Commission now adjourned as the City Commisaion and aeting as Trustees
o� ��.he Pen�ion Fund, on a motion by Commissioner Bates which was seconded by
Commissioner Kennedy and carried unanimausly, admitted Eugene D. Sheets, Jr.,
Floyd M. Murrell, Jack A. Marsh, Policemen, and John B. Love11, Laborer in the
Gas and Water Department, into membership in the Pension Plan.
There being no further businesa to come beiore the Comm3ssion, the meeting �ras

and for a petition of exception under the hardship provisions of the zoning
ordinance.
l. That Willia.sn E. Cavariagh, owner of lot #12 Block 42, Mandalay subdivision
be allowed a 15 foot buiiding setback from Gardenia Street.
From the enclosed chart of this corner it can be readily seen that the two
existin$ hames at "A" &"B" are already built wi'th a 15 foot set-back. Lot "C"
was granted tnis same setLback by t�e Commission on January 18th, �954. This leaves
my lot as the only one on this corner not as yet granted a 15 foot set-back.
This lot is a 60 foot lot and a set-back of 25 feet plus 5 feet on the property
line accordi�zg to the or@inanc� in force would ruin this lot a.s no satisfactory home
can bz built on 30 front feet and if one was built t� conform to the present ordinance
it would detract from all property �n the immediate area.
Due to the distance and time envolved, it is requested that I be given
permission to absent myself from the hearin� on this matter, as I have just returned
from Clearwater. However, if for some reason the Commission wishes me to be
represented at the hearing, I would be glad to cooperate.
It is my intention to star�t building as soon as this request is granted.

Dear Mr. T�.iddleton:
Reference is ma.de to pas�agraph 3 of your letter of April 2g, 1954 in which you
requested a letter statin� that the Federal Housing Administration would assume the
cost of paving the streets and alleys of the ca�tioned project.
41e are er�closing a carbon copy of �. letter dated April 13, 1954 from Nfr. Lemuel
Showell, Director, Property Management, which clearly indicates the intention of
the Federal Housing Administration to einter into a aontract with the City o�
Clearwater and the manner by tvhich we understand it wiil be accomplished.
Your attenicion is particu'larly directed to the la�t sentence of paragraph 2 of
Mr. 5howe1l's letter which states:
"We will then draw up an agreement betiween the Gonunissioner and the City of
Clearwater providing for payment of the work by the Federal Housing
Administration u�on satisfactory completion and approval by the City."
In view of tlze fact that the ul�i.r►ate aim is dedication of �he streets and alleys
of the (�reenw�od project to the Ci.ty of Clearwater, our Washing�ton office and thls
office agree, and your �gineer Mr. �ickton concurs that the most satisfactory
method of handling the proposed paving will be through City approvzd cont�actors
undsr C�ty bidding and supervision, as was the recently completed sewer work,
You are therefore authorized to start the preliminary work of plans a�d specifica�
tions with estima:ts of cost. If your City charter will permit inclusion oi the
pa�ing of the parking areas 3t will be appreciated if you will do so, other�wise ��re
will arrange for a separate eontract on this work.
It w311 be appreciated if you will have h1r. Lickton submit the drawings, specifications
and cost estimate to this office in triplicate so that we may send two copies to
Washington for apnroval. Thereafter the grocedure would follow that of the sewer
contract.
