The City Commission of the City of Clearwater met in special session at City
Hall, Monday, December 14. 1953, at 1:30 P.M. with the following members present:

The meeting was called to order by the Mayor who reported that the special
meeting had been called to take care of some urgent matters, the first one on the
agenda being the increasing of salaries in the Police Department. He stated that
the entire Commission, acting as a Committee, had met and found after looking into
the salaries of Lakeland, Tampa and St. Petersburg Police Departments, that the
Clearwater Police Department was substantially below the average of those citiesi
therefore, it was the recommendation of the entire Commission that the salaries 1n
the Clearwater Police Department from the position of captain on down through the
various patrolmen, secretaries, court clerk and radio operators be increased up to
an amount that would bring them in line with other cities on the West Coast. The
Mayor read the schedule of the proposed increases:

Commissioner Crown moved that Lhe salaries in the Police Department be re-classified
in accordance with the Committee's report whereby the starting salary for Class C
patrolman would be increased to $225.00 a month and the other Police Divisions
increased as set forth in the report, effective with the next salary payment.
Motion was seconded by Commissioner Russell and carried unanimously. The Chie~ of
Police thanked the Commission saying that every man on the force would appreciate
the raise.
The City Manager reported that since discussing moving the Beach Chamber of
Commerce into the Marina Building, Mr. R. L. Moore who is affiliated with the
Howard Johnson Restauran~ in Tampa had made a counter-proposal to lease the
restaurant space in the Marina Building. Mr. W. B. Dickinson, attorney for Mr.
R. L. Moore, read the letter signed by Mr. Robert L. Moore, Mr. Charles Toro, Mr.
F. C. Harris. Mr. C. W. Dixon and Mr. F. E. Spencer, which stated that if a satis-
factory lease can be worked out, these five men have agreed to form a corporation
for the purpose of entering into the lease and operating the restaurant. The
amended proposal is in part as follows:
"Our understanding is that the proposed lease will be for a period of ten
years with an option to renew the lease for an additional ten years, that the lease
will call for a monthly minimum rental of $300.00 per month for the first two years,
plus 31% of the gross over and above $100,000.00 - for the next eight years a
minimum.of $400.0q per month, plus 3!% over and above a gross of $100,000.00 up
to and 1ncluding $200,000.00 with 2% over $200,000.00 gross, that the option to
renew for the additional ten years shall call for a monthly rental the same as the
last eight years.
It is also our understanding that the property is not now suitable for the
operation of a restaurant, and that certain new construction and alterations will
have to be made in order to make the same suitable. Under the circumstances. the
lease will call for you doing the following things at your expense:

Erect suitable partitions for the purpose of making a dishwashing room
approximately 20 X 20 in the southwest corner of the dining room.
Install proper suction fans in the kitchen for the purpose of exhausting
kitchen odors.
Install sound proor ceilings in the kitchen and dishwashing rooms.
Install tile on the walls within one foot of the ceiling in the dining
room and coffee shop kitchens."
In response to a question by the Mayor, Mr. Moore stated that he would be willing
to deposit with the City a sum of money as earnest money to assure that this was
a bona fide proposition. The Mayor suggested accepting the letter and having
another conference on it later this week. He said there are two problems:
1. ~bether or not the lessee of the present Chamber of Commerce property,
Mr. Smith and Mr. Coon who plan to build a swimming pool on the site.
would be willing to wait a short while. '
2. Also. we need to set out a little more in detail what the City ~uld do
and what the City's counter-proposal would be.

After discussion) it was agreed that an executive session would be set ~or
Wednesday afternoon to meet with Messrs. Smith and Coon to consult with them and
that an executive session would be tentatively scheduled for Thursday with Mr.
Moore.
In regard to the proposed assessment ~or the Skycrest Disposal Plant) the
City Engineer reported that his Department had made a spread on the cost of the
Skycrest Disposal Plant on a square footage basis for the areas inside the City
and the outside areas to be served by the Disposal Plant. Mr. Ben Krentzrnan.
attorney for Mrs. Doris Alvord, presented an objection to the proposed method ot
assessing acreage owned by 14rs. Alvord in the Skycrest area) the objection being
that no allOWAnce was made for streets in the subdivision which she proposes to
plat. Co~nis5ioner Bates sug~e5ted that the Commission recommend that the City
Manager make an allowance of 15% fo~ the streets, making it on the basis that the
normal allowance wouln be on the order or 20%) and it is perhaps possible that
because an area is unplatted that the City and the other people should protect
themselves to the point of being reasonably conservative because they might come
up with a plat that had fewer streets. The Mayor recommended that from now on if
there are more requests for se\~rs for unplatted areas that it be a requirement
to have a plat recorded by the owner before the City enters into any agreement.
Commissioner Bates moved that in making assessments for the Skycrest Disposal
Plant that on all unplatted areas to be served by the Disposal Plant an allowance
of 15% be made for streets. Motion was seconded by Commissioner Strang and
carried unanimously.
The Mayor read a letter from Mr. Cleveland Insco, Jr., General Chairman,
Fun 'n Sun Executive Committee) requesting $1),00.00 to be used by the Fun 'n Sun
Executive Committee for part of the expense of the celebration which has be~n
planned to take place February 27th to March 10th, 1954. The Mayor reported that
the Committee would furnish the City Mana~er with an expense sheet showing how
the money was used. Commi~s1oner Bates moved that the fund request of the Special
Events Committee of the Chamber of" Commerce for $1,500.00 in the Special Events
Fund be made available for the Fun 'n Sun program. Motion was seconded by
Commissioner Russell and carried unanimously.
The City Attorney read a letter signed by representatives of The Woman's
Club of Clearwater, Clearwater Chapter D.A.R.) Christian Science Society, and the
Unitarian Fellowshlp) all of whom use the Woman's Club Building in Seminole Street
Park. The letter requested the City to provide necessary lighting and repair the
driveway and bricks on the grounds of the clubhouse. By consent, the City ~anager
was instructed to investigate and report back to the Commission.
There being no further business to come before the Board, the meeting was
adjourned.

Mr. R. L. Moore has discussed with us, the undersigned, proposed lease of
the Marina Restaurant property on Clearwater beach, which he has had under
discussion with you and Mr. Middleton.
This is to advise that in the event a satisfactory lease can be worked out
along the lines hereinafter set fo~th, we have agreed to form a corporation for
the purpose of entering into th~ lease and operating the restaurant. In order
that you gentlemen may have some idea as to the extent of the financial backing
this proposed corporation will have, we are indicating opposite our names the
amount of money we intend to put into the company in order to assure its successful,
operation.
Our understanding is that the proposed lease will be for a period of ten years
with an option to renew the lease for an additional ten years, that the lease will
call for a monthly minimum rental of $300.00 per month for the first two years,
plus 3-1/2% of the gross over and above &100.000.00 - for the next eight years a
minimum of $400.00 per month. plus 3-1/2% over and above a gross of $150.000.00*
up to and including $200,000.00 with 2% over $200,000.00 gross, that the option to
renew for the additional ten years shall call for a monthly rental the same as the
last eight years.
It is also our understanding that the property is not now suitable for the
operation of a restaurant, and that certain new construction and alterations will
have to be made in order to make the same suitable. Under the circumstances, the
lease will call for you doing the following things at your expense:

Although the lease will call for your making the above improvements! other
improvements such as installation of a terrazzo floor throughout the ma n dining
room, c~ckta!l lounge, soda fountain, and kitchen, suitable air conditioning equip-
ment installed as well as light fixtures, proper drains and grease traps will have
to be installed, and the interior will have to be finished and artistically
decorated, will have to be made at the expense of the lessee. The cost of the
above, in connection with all of the necessary equipment for the operation of the
coffee shop and restaurant of the type that we know you wish operated, will certain-
ly amount to such a sum that it could not be reasonably anticipated that sufficient
revenues would be derived therefrom to reimburse and compensate the undertaking for
a period of less than the twenty years.
Naturally, we feel that some assurance should be given us in the lease that
proper permits for the operation of the restaurant, coffee shop, cocktail lounge
and package store. We have witnessed the successful operation of similar enter-
prises of Mr. R. L. Moore and have complete confidence in his ability to effici~ntly
and successfully operate the type of restaurant which will be an asset to the West
Coast of Florida.
Naturally, we desire that you treat this letter as confidential. However,
in the event you have any question concerning our participation in the project,
we would be glad, individually or collectively, to talk to any of you in person.

Clearwater to provide necessary lighting, and repair the driveway and bricks on
the grounds of the club house.
Under the present conditions the property is dangerous due to the sunken and
uneven condition of the bricks in the driveway, and the darkness of the park.

that you �entlenien may have some idea as to the �xtent of the financial backing
this proposed corporation wzll have, we are indicating opposite our names the
amount of money we intend ta put into the company in order to assure its successful
opera�ion.
Our understanding is that the proposed lease will be for a period oi ten pears
with an option to rene�r the lease for an additional ten years, that tY±e ].ease wi.1T
call for a monthly minimum rental oi �300.00 psr month for the first two years,
plus 3�1/2� of the gross over and abov� �100,000.00 - for the next eight years a
minimum of ��.OQ.AQ per montiz, plus 3-1/2� over and above a;ross of �150,OdC�.00�
up to and inaluding �200,000.00 with 2� over �200,000.00 gross, that the option to
renew for the adciita.onal ten years shall call for a monthly rental the same as the
last eight years.
It is also our understandin� that the property is not now suitable for ihe
operation of a restaurant, and that certain new cr�nstruction and alterations will
have to be made in order ta make the same suitahl8. Under the circumstances, the
lease will call for you doing the follo�ri.ng things a� your expense:
l. Erect suitable partitions for the purFose of making a dishwashing ronm
approximately 2Q X 20 in the so�thwest corner of the dining room.
2. Install proper suction fans in the kitchen for the purpose of exhausting
kitchen odors.

ment instalZed as well as light fixtures, proper drains and grease traps rdill, have
to be installed, 2nd the interior ivi11 have �n be finished anci artistically
decorated, will have to be made at tlie sxpense of the lessee. The cast of the
abave, 3n eonnecticn with all cf the necessary aquipment for the operation of the
coffee shap and restaurant of the type that we know you wish operated, will certain-
ly amount to such a sum that it could not be reasonably anticipated that suffiaient
revenues would be derived therefrom ta reimburse and compensate the undertaking �or
a period of less than the twentp years.
Naturally, we feel that some assurance should be given us in the lease that
proper permits for the operation of the restaurant, �offee shop, cocktail lounge
and package store. We h�ve witnessed the successful operatior. of similar enter-
prisee, of Mr. R. L. Moore and have comple�e confid�nce in his abiiity to efficiently
and successfully operate the type of restaurant which will be an asset to the �qest
CQast of Florida.
