The City Commission of the City of Clearwater met in special session at City
Hall, Monday, October 26, 1953, at 1:30 P.M. with the following members present:

The lneeting was called to order by the City Attorney in the absence of the
I'/'!ayor. Commissioner Strang moved that Commissioner Crown be appointed Mayor
pro-tem Liue to Mayor Brown's absence. Motion was seconded by Commissioner Russell
and carried unanimously.
In a discussion of the proposals received from Smith and Coon and Mr. G. T.
McKernan at the last rneetincs for constructing a swimming pool and other facilities
on Clean...ater Beach, the Acting 1,layor asked i;1r. G. T. A'AcKernan if he and his
partner would be willing to start i~nediate construction of a swimming pool in the
event the City advises him that it wishes him to do so. Mr. McKernan reported
that he would be willing to start such construction. The Mayor called attention
to the fact that in the proposal that Mr. McKernan made there was no definite size
given for the proposed swimming pool ~nd sussested that he submit a sketch of his
revised proposal showing the dimensions of the swimming pool, the buildings, etc.
Relative to the proper procedure, the City Attorney said the Commission had two
choices -- first, to have the two bidders amend their proposals; second, to reject
the bids and re-advertise the project. It was suggested that the amended proposals
should include a statement saying when the pool will be built. It was agreed that
if a new bidder wished to submit a proposal, such a proposal would be considered
at the same time as the revised bids. Commissioner Bates moved that the Commission
notify the two parties concerned that they will have an opportunity to modify their
proFosals and they should be in the City Manager's hands on or before the next
regular meeting which is Monday, November 2nd. Motion was seconded by Commissioner
Strang and carried unanimously.
Commissioner Bates suggested that the Commission have a meeting with the
Executive Board of the Chamber of Cownerce to discuss details of moving the Beach
Chamber of Commerce activities to the ~arina Building. By consent, the Commission
agreed to do this.
The City Manager presented a petition signed by Mr. George W. Smith, filed
on behalf of the owners of the First Addition to High ~oint Subdivision, requesting
the City to open an4 pave Spencer Avenue from Druid Road to Turner Street and
Turner Street from Keystone Drive to Spencer Avenue. The petition stated that a
30 foot right-of-way was dedicated in the plat but it was not believed that any
similar dedication was made by the owners of property to the north and east of this
subdivision. The Commission took no official action since discussion brought out
the fact that Mr. V. V. Carmichael, Sr., owner of the acreage to the east, was not
willing to donate the land for right-of-way purposes.

main on Woodlawn Street at an estimated cost of $650.00.
moved that the City Manager's recommendation be approved.

Commissioner Bates moved that the City Manager's report be accepted and the
installations approved. Motion was seconded by Commissioner Strang and carried
unanimoUSly.
It was recommended by the City iwlanager that 150 feet of two inch gas main be
installed on Palmetto Street at an estimated cost of $140.00. Commissioner Strang
moved that the City Ivlanager r s recommendation be approved. Motion was seconded by
Commissioner Russell and carried unanimously.
The City Manager reported that installation and materials for two new traffic
lights and including a "walk light" at the corners of Cleveland Street and Garden~
and Cleveland Street and Osceola Avenue would cost approximately $705.00.
Commissioner Russell moved that the work order be approved. Motion was seconded
by Commissioner Bates and carried unanimously.
The City Manager presented a Resolution to have twenty-three property owners
clean their lots of weeds and underbrush. Commissioner Russell moved that the
Resolution be adopted. Motion was seconded by Commissioner Strang and carried
unanimously.

The City Manager presented a statement for $500.00 for legal services by
the City Attorney. Commissioner Russell moved that the work order for $500.00
for legal fees for the City Attorney be approved. Motion was seconded by
Commissioner Bates and carried unanimously.
~he City Attorney reported that it was necessary to bring the Nelson lease
up to date and submitted the following amendments for the Commission's approval:
1.
The completion date would be changed to one year from the end of the
present litigation instead of one year from the end of the demolition.
100% perforlnance bond would be required instead of $50,000.00 deposited
for performance.
To include the fact that the abstract has been examined and the title
found to be merchantable.
That Paragraph 14 regardin~ the rights of subrogation be deleted.

The City Manager stated that the fiscal agent for the Ball Park Fund had
reported that it would take approximately 90 days to have the bonds or certificates
ready for delivery. The Manager sug~ested that during this period the Commission
could approve the plans for the Ball Park and after the plans are approved, they
could instruct the City Engineer and the Manager to advertise for bids So that
they might be opened and awarded about the time these certificates are delivered
to the City. He further stated that the fiscal agent would need an approved set
of plans sometime during this 90 day period. He also suggested that the Ball
Park Committee or the entire Commission check the proposed plans to see if they
are acceptable. Commissioner Strang thought it would be well to get a definite
proposal as to fees from ~Iarr and Holman, ~ashville architects specializing in the
design of recreational facilities, who prepared the preliminary plans. He also
suggested that the supervision of the actual construction be done by a local
architectural firm. Commissioner Russell said that first, the plans should be
approved and second, the Commission should negotiate with Mr. Carpenter, owner of
the Phillies, for an extension of their contract for ten years. By consent, the
Ball Park Committee was specifically authorized to proceed with negotiations on
the ball park plans right up to the act of signing a contract; also to proceed
right up to the point of signing a contract with the Phillies for a ten year
extension.
There being no further business to come before the Board, the meeting was
adjourned at 2:33 P.M.

WHEREAS: it has been determined by the City Commdssion of the City of
Clearwater, Florida, that the property described below should be cleaned ot weeds,
grass and/or underbrush, and that after ten (10) days notice and failure of the
owner thereof t;o do so, the C'ity should clean such property and charge tho costs
thereof against the respective property.
NOW THEREFORE BE IT RESOLVED by the City Commission ot the City of Clearwater,
Florida, that the following described property, situate in said City, shall be
cleaned of weeds, grass and/or underbrush within ten (10) days after notice in
writing to the owners thereof to do so and that upon failure to comply with said

The Petition of Raymond V. Simmerman and wife HELEN SIMMERMAN and
JOHN R. WINNETT and wife EFFIE H. WINNETT, through their undersigned attorney,
represents the following facts:
1. Petitioners WINNETT are the record fee simple owners of the following
described real estate situate in Pinellas County, Florida, to-wit:
LOT FOUR (4) of FIRST ADDITION TO HIGH POINT SUBDIVISION, according
