The meeting was called to order by the Mayor. The invocation was given by
Reverend Robert M. Man of the Episcopal Church of the Ascension. Commissioner
Strang moved that the minutes of the regular meeting of September gth and the
special meetings of September 10th and 16th be approved, subject to any corrections
that Commissioner Crown might have to make, in accordance with the copies furnished
each member in writing. Motion was seconded by Commissioner Russell and carried
unanimously.
The City Manager reported that two bids had been received for the construction
of eight terrazzo courts at the Shuffleboard Club in City Park and said that the
work included 1,896 square feet of terrazzo, 4,3l1 square reet of concrete walk
and 225 lineal feet of retaining wall. The bids were read as follows:

The City Manager recommended accepting the low bid of Burton Walker Company at
$5,793.87. Commissioner Strang moved that the Manager's recommendation be accepted
and that Burton Walker be awarded the contract for the shuffleboard courts, concrete
walks and retaining wall for the sum of $5,793.87. Motion was seconded by .
Commissioner Bates and carried unanimously.
It was reported by the City Manager that three bids had been received for
propane for the City's use for one year. The bids were read as follows:

By consent, the bids were referred to the City Manager and the Purchasing
Department for tabulation and report at the next meeting.
The City Manager submitted a tabulation of bids received and recommended
accepting the low bid of the Harpham Insurance Agency for Workmen's Compensation
Insurance for one year for $S,20l.70. After discussion, Commissioner Russell
moved that the City Manager's recommendation be approved. Motion was seconded
by Commissioner Strang and carried unanimously.
It was recommended by the City Manager that the second lowest bid (Eureka
Fire Hose Division, Atlanta) be accepted due to the type of hose and previous
experience as to the quality of material at a price of $1,l60.00. Commissioner
Bates moved that the City ~anager's recommendation be approved and that the con-
tract be placed with the Eureka Fire Hose Company. Motion was seconded by
Commissioner Strang and carried unanimously.
The Mayor announced a Public Hearing on the hardship application of Mrs.
Irene Richardson requesting a lO foot setback on Sunset Drive ror Lot 10, Block a,
North Shore Park. The City Attorney read the letter from Casler, Douglas and
McManus, attorneys, which explained their client's request by stating that since
this was a corner lot 50 feet wide, a 25 foot setback from the side street would
make the lot too narrow to build a residence on. He also read the Zoning Board's
recommendation which \tas that the request be granted, setback to conform with
existing dwellings on east side of Sunset Drive. Commissioner Strang moved that
having held a Public Hearing with reference to the hardship case of Mrs. Irene
Richardson under the Zoning Ordinance to construct a dwelling on tot 10, Block g,
North Shore Park Subdivision, and having heard no valid objections, that she be
allowed to build on this lot in question with a setback of ten feet on Sunset
Drive and a 25 foot setback on Princess Street. Motion was ~econded by
Commissioner Russell and carried unanimously.
A Public Hearing was announced by the Mayor on the hardship application of
Mr. and Mrs. Emory C. F1uichbough, Mrs. Edith Schults, and George J. Mottor,
owners of Lots 105, 106, 107, 108 and 109, Lloyd-White-Skinner Subdivision. to
change the zoning of these lots from R~l to R-4. The City Attorney read a letter
from Mr. H. H. Baskin, attorney, explaining that the lots nor.th of this property
and the lots east of the property are now zoned R-4 for multiple units. The
City Attorney read the recommendation of the Zoning Board which was that the
request be denied since change of zoning should be done by re~erendum. The City
Attorney read a telegram from Mr. A. N. Notopolous protesting the change. Mr.
H. H. Baskin, Jr., addressed the Commission on behal.f of his clients. Mr. Ben

Krentzman, attorney for Miss Ann~-- owner of the lot 1mmediately south of these
lots -- addressed the Commission protesting the granting of this request. After
some discussion, Commissioner Russell suggested that the Mayor appoint a Committee
to investigate this matter. The Mayor said the entire Commission as a Committee
should check the affected properties. Commissioner Strang moved that this Public
Hearing be adjourned to Monday, October 5th, at 1:30 P.M. Motion was seconded
by Commissioner RUBsell and carried unanimously.
The Mayor announced a Public Hearing on the hardship application of Mr.
Joseph A. Clapp which requested a setback of lO feet instead of 25 feet on Duncan
Avenue for Lot 10, Block H, Keystone Manor Subdivision. The City Attorney read
the request from Mr. Clapp requesting a 10 root setback so a house could be
constructed facing on Cleveland Street. The City Attorney read the recommendation
of the Zoning Board which was that the setback conform to the setback of existing
dwellings on Duncan Avenue between Harvard and Drew Streets. Mr. Clarence Chalfont
and Mr. Herbert Lockett, owners of adjoining property, appeared before the
Commission to protest the granting of a ten foot setback since they have observed
a 25 foot setback for thei~ houses which face on Duncan. Commissioner Bates moved
that Mr. Clapp's application for a ten foot setback be denied and that the Zoning
Board's recommendation be upheld that all new buildings shall be kept in line with
the present buildings. Motion was seconded by Commissioner Strang and carried
unanimously.
Commissioner Bates reported that he and the City Manager had interviewed
Captain Barnett Harris regarding creating a "Hall of Fishes" in the Marina Building
similar to the one on Mullet Key which contains plaster cast models of marine
specimens and a collection of shells. A letter from Captain Harris was read offer-
ing to create the material for the museum under a year's contract of $4,000.00,
$1,000.00 for residential purposes and $3,000.00 salary to be divided evenly
between Captain Harris and Mrs. Harris. Commissioner Bates explained that a petty
cash fund of about $lOO.OO should be made available so the Captain could purchase
small materials for his ~ork. The City ~~nager said some remodeling of the walls
and lights, etc., would be necessary also at an estimated amount of $l,500.00
which would include this petty cash fund. Commissioner Russell moved that the City
enter into a contract with Captain and Mrs. Barnett Harris to cooperate with the
City of Clearwater in building a "Hall of Fishes" in the Marina Building on
Clearwater Beach as per Captain Harris' letter, finished product or fishes to
belong to the City; in addition to this there would be $l,500.00 to be expended in
fixing the walls and lighting rixtures in this room, plus a petty cash fund to buy
plaster of paris, paints, glues, etc. Motion was seconded by Commissioner Strang
and carried unanimously.
The City Manager stated that part of the lease with the owner of the Small
Boat ~arina stipulated that the City dredge out the area in front of it. He
reported that the work had been done but it was necessary to have the Commission's
approval of a work order ror $969.00. Commissioner Strang moved that the work
order covering the Marina dredging in the amount of $969.00 be approved. Motion
was seconded by Commissioner Russell and carried unanimously.
The City Attorney read a letter from the Advisory Committee of the Employees'
Pension Fund recommending that Mr. W. P. Ledbetter, of the Public Service Department,
a City employee for twenty-seven years, be retired upon his request at a monthly
pension of $ll2.20 per month effective September 1, 1953. Commissioner Russell
moved that the application for retirement of W. P. Ledbetter be approved as o~
September 1, 1953, and that the City Clerk write him a letter of appreciation for
the work done for the City in twenty-seven and a half years. Motion was seconded
by Commissioner Strang and carried unanimously.
The City Attorney read the application of Kary Darby, colored, to operate a
taxicab in the City. The City Manager reported that he did not believe there was
any need for additional cabs at this time. The City Attorney pointed out that
such permits were not transrerable. Commissioner Russell moved that the permit
be denied as per the City Manager's recommendation. Motion was seconded by
Commissioner Strang and carried unanimously.
A letter ~as read from Mr~ William E. Dunn, County Sanitary Engineer, stating
that he was enclosing a letter from Mr~ John W. Wakefield of the Florida State
Board or Health regarding an inspection trip made by Mr. M. E. Dawkins, Sanitary
Engineer on his stair, through the Clearwater Disposal Plant. The letter from Mr.
Wakefield described Mr. Dawkins' report of his inspection by stating that he found
no evidence of odor nuisance created by the sewage treatment plant, and complimented
the City on the capable supervision and quality of operation at the Disposal Plant.
Commissioner Strang suggested that the letter be accepted with thanks. By consent,
the Co~ission agreed to this.
The City Manager recommended that the lease of William J. Meyer which expired
September 9th for space at the Municipal Dock be renewed on a month to month basis
not to exceed one year. Commissioner Bates moved that the present lease of
William Meyer and J. M. Hering's lease for the bait stand be renewed similar to
the ones that have expired. Motion was seconded by Commissioner Russell and
carried unanimously.
Commissioner Strang reported for the Committee on the Super-Test gas station
application stating that the Committee had a conference with representatives of
the Super-Test Company and as a result, new plans have been submitted which meet
the zoning regulations and engineering regulations of the City. Therefore.
Commissioner Strang moved that the application be granted. MotiQn was seconded
by Commissioner Bates and carried unanimously.

The City Attorney read a letter from Mr. George R. Landsaw requesting per-
mission to operate a seven passenger Cadillac sedan for a sight-seeing tour within
the City limits. The City Attorney pointed out that if such license was granted
the operator should be instructed to furnish the necessary information to the City
Treasurer, the same as for taxi operator licenses. By consent, the matter waa
referred to the Chief of Police and the Taxicab Committee - Commissioners Strang
and Bates - for a full report at the next meeting.
The City Attorney read in full Ordinance 644 which makes it illegal to leave
an abandoned icebox or refrigerator in a place where children might have access
to it. Commissioner Strang moved that Ordinance 644 be passed and adopted on its
third and final reading. Motion was seconded by Commissioner Bates and carried
unanimously.
The City Attorney reported that the City Commission had met with the Civil
Service Board to discuss the settlement of the suit of Ouida Bilbrey vs. the
Civil Service Board, the City Manager and the City Treasurer. The Commission was
requested by the Civil Service Board to settle the suit at the best possible
figure. The City Attorney said a compromise settlement figure or $1,382.50 had
been reached in return for which Mrs. Bilbrey would give her resignation and
dismissal of the suit. Commissioner Bates moved that the case be settled at the
compromise figure of $1,382.50. Motion was seconded by Commissioner Russell and
carried unanimously.
The City Attorney described the proposed water contracts he had prepared for
the Commission's consideration as follows:
A~reement ~l. This one is exactly the same as the City ofrered the County
many months ago with one exception the City would construct the water
system and sell water to the County.
A~reement #2. Without being involved in any arrangement whereby the County
might build a water system, the City will be a customer of that system
at so many cents a thousand gallons according to a decreasing scale and
the City would not be involved in any of the construction or fiscal
features.

The Mayor suggested that since the Commissioners had not had a chance to go over
the proposed contracts that discussion be postponed to an executive session later
in the week. By consent, the Commission agreed to do this.
The City Attorney submitted a Resolution requested by the Trustees of the
Internal Improvement Fund setting out the facts of the proposed purchase of
additional land in the south part of Clearwater Bay. The City Attorney explained
that the description extends the tract of land that the City purChased so as to
embrace all submerged land directly opposite to the Memorial Causeway south and
to extend out beyond the fourth finger in Clearwater Bay so that no additional
submerged lan~can be filled in south bay which are not connected to the mainland
but would not prevent a bayfront property owner on the mainland from filling the
submerged land adjacent to his property. He further explained that this descrip-
tion did not include the submerged land directly in the pass as it was indicated
that the I. I. Board would refuse to sell it. Commissioner Bates moved that the
description be amended to include all that land at the Pass that we discussed
previously, and if we get a formal refusal of record from the I. I. Board, that
the proper officials be authorized to proceed with the purchase or any and all
of that land that can be secured from the I. I. Board, and that the Resolution be
adopted as amehded. Motion was seconded by Commissioner Strang and carried
unanimously.
The City Attorney read the Resolution asseSSing the cost of curbing, paving
and drainage improvements on Commodore Street from Anchorage Way to Br.oadway and
on Anchorage Way from Marine Street to Commodore Street against the benefited
properties. Commissioner Strang moved that the Resolution be passed and adopted
and that the assessments be spread. Motion was seconded by Commissioner Russell
and carried unanimously.
The City Attorney read the request of Mr. Max Benbow to erect a garage on
Lot 29, Block B, Sunset Point 2nd Addition, next to his house which is located
on Lot 28. He also read the recommendation of the Zoning Board which was ~hat
the request be granted. Commissioner Strang moved that the request of Max Benbow
on Lot 29, ~lock B, 2nd Addition to Sunset Point Subdivision, be advertised for a
Public Hearing October 19th. Motion was seconded by Commissioner Russell and
carried unanimously.
The City Manager reported on the following utility installations:
200 feet of 2" water main on Harbor Drive $165.00
l05 feet of 2" water main on Missouri Avenue 80.00
l05 feet of 2" water main on Laura Street 80.00
164 feet of 2" water main south from Osceola 145.00
320 reet of 2" water main on Keystone Dr. 255.00
l64 feet of 2" water main north from Osceola 145. 00
Commissioner Strang moved that the utility improvements ,be approved. Motion was
seconded by Commissioner Bates and carried unanimously.

The City Manager recommended the installation of 400 feet of two inch
water main on Casler Avenue at an estimated cost of $305.00. Commissioner Russell
moved that the City Manager's recommendation be approved. Motion was ~econded by
Commissioner Strang and carried unanimously.
It was recommended by the City Manager that 1,200 feet of two inch gas main
be installed in the easement between Pinebrook Drive and Highland Avenue at an
estimated cost of $905.00. Commissioner Bates moved that the installation be
approved. Motion was seconded by Commissioner ~trang and carried unanimously.
The City Manager recomlnended an extension of l,373 feet of two inch water
main to serve Crystal Heights Subdivision, outside the City, on the usual refunding
contract, at an ~stimated cost of $680.lg. Commissioner Bates moved that the work
order in the amount of $6aO.18 be approved and the proper officials be authorized
to execute the contract. Motion was seconded by Commissioner Strang and carried
unanimously.
It was recommended by the City Manager that 290 feet of two inch water main
be installed on Yelvington Avenue at an estimated cost of $230.00. Commissioner
Bates moved that the City Manager's recommendation be approved. Motion was
seconded by Comnissioner Strang and carried unanimously.
The City Manager reported that emergency repairs were necessary on the
Caterpillar tractor used for the sanitary fill work at an estimated cost of
$1,400.00. Commissioner Bates moved that the necessary authorization be given
to make the repairs. Motion was seconded by Commissioner Russell and carried
unanimously.
Commissioner Russell inquired how often the County Mosquito Control trucks
fog the City and the Beach. The City Manager replied that he did not believe they
operated on a definite schedule. Commissioner Russell moved that the City Manager
inquire of the Mosquito Control Board as to number of times that they have fogged
this area in the last three months and ~lso to report that we would like to have
them come here more often and rog the Beach and mainland. Motion was seconded by
Commissioner ~trang and carried unanimously.
The City Manager reported that an approval of a work order for $l,OOO.OO was
needed to cover the operation of removing the dead fish from Clearwater Beach
deposited by the "Red tide". Commissioner Strang moved that $1,000.00 be
appropriated for emergency use for taking care of the dead fish caused by the
"Red tide". Motion was seconded by Commissioner Russell and carried unanimously.
The City Manager explained that recent heavy rains had caused erosion on the
west side and the south side or the Baptist parsonage on City property near the
Horseshoe Court and it was estimated that it would cost $200.00 to build a con-
crete retaining wall to corr~e~ the situation. Commissioner Bates moved approval
or a work order amounting to $200.00 for a retaining wall for the Horseshoe Court.
Motion was seconded by Commissioner Strang and carried unanimously.
The Mayor reported that some of the neighbors in the vicinity of Lake Belleview
on Lakeview Drive have contacted the State Game and Freshwater Fish Commission at
Tallahassee regarding hyacinth growth on the lake. The letter from the State Game
and Freshwater Fish Commission said that they would furnish the airplane and the
man to do the spraying if the City would pay for the spray, which they estimated
would cost about $250.00. Commissioner Strang moved that the Commission authorize
the Game and Freshwater Fish Commission to spend $250.00 to eradicate the hyacinths
in Lake Be1leview. Motion was seconded by Commissioner Bates and carried unanimously.
The City Manager presented a Resolution to have 5l property owners clean their
lots or weeds and underbrush. Commissioner Strang moved the Resolution be adopted.
Motion was seconded by Commissioner Russell and carried unanimously.
Mr. Ben Krentzman, attorney, addressed the City Commission relative to adoption
of an Ordinance declaring intention to annex Skycrest Unit 9. The City Manager said
that Mr. Krentzman had been furnished with a coPY of the requirements for new sub-
divisions. and that he would like to confer with the owners of the subdivision regard-
ine the ract that the streets are not of proper width and the lack of proper
drainage. By consent, the matter was deferred.
Mr. Charles Kerekes inquired if there could be a prov1s1on in the new Sign
Ordinance which would prohibit motels from having outside signs advertising rates.
The Mayor suggested that the City Attorney be instructed to include all of the
present ordinance in the new ordinance with the addition of a provision which will
eliminate outside signs at motels advertising the rates.
There being no further business to come before the Board, the meeting was
adjourned at 4:55 P.M.

Attached is a request from Kary Darby, colored, for operation of one taxi-cab.
I asked the Police Department ror report on this man and I am advised that he has
had only one arrest and that was for running a "Stop" sign.
We have ror some years had fourteen colored cab licenses and at the present time
have twelve. Under a recent ruling of the Commission two or these would not be
eligible for license in the coming year.

Attached hereto is a letter from Mr. W. P. Ledbetter, employee of the Public
Service Department, requesting that pe be retired under the Employees' Pension
Plan, effective September 1, 1953.
Mr. Ledbetter began his employment with the City February 12, 1926. He will
be seventy-two years of age September 27, 1953. This retirement would be
according to the recent amendment of Section Five of the Pension Fund Act,
which says in part: "Employees w~o have been in the continuous service o~
the City for a period of twenty (20) years or more shall at their request be
retired on an annual pension wpich shall be two per cent (2~) of the average
salary received by said employee for the last five (S) years of his or her ser-
vice multiplied by the number of years of service" and based on the following
calculations:
February 12, 1926 to Sept. 1, 1953 : 27! years
$12,229.79 Total salary received last five years
Average per month for five years - $203.8,
2~ of monthly average *4.08
271 years of service X $4.08 - $112.20, Total pension per month.
We hereby recommend that Mr. Ledbetter be granted a pension of $112.20 per

Attached is a letter, addressed to you, from Mr. John W. Wakefield of the
Florida ~tate Board of Health regarding odor complaints in the vicinity of the
Clearwater sewage treatment plant.
Mr. M, E. Dawkins ~as in Pinellas County during the week of August 17, 1953,
to assist the operator at one or the new sewage treatment plants in this area.
Since this department has continued to receive complaints on odors in the Sunset
Harbor area and the complaintants allege that the Clearwater sewage treatment
plant is the source of the odors, I thought it well for Mr. Dawkins to visit the
plant while he was here.
It has been my opinion all along that the Clearwater sewage treatment plant
was in no way connected with the odors which people living in the Sunset Harbor
area reported.

Dear Mr. Middleton:
At the request or Mr. William E. Dunn, Sanitary Engineer, Pinellas County Health
Department, Mr. M. E. Dawkins, Sanitary Engin(~er of our Contral Staff, visited
your sewage treatment plant on August 20, 1953.
This visit was in connection with complaints, which apparently continue, regardw
ing odors allegedly due to the sewage treatment plant operation.
On the night of August 20, our representative in compAny with Mr. D. J. Raye, the
Plant Superintendent, surveyed the residential area in tho vicinity of the plant.
We wish to note that city personnel were unaware of the tim1n~ of this visit and
therefore could nave taken no special precautions to eliminate odors. We also
point out that ~eather conditions were ideal for carrying odors from the plant site
to the nearby residences along Stevenson Creek, had such odor sources been present.
The inspection continued through the night hours dur1n~ which tho alleged odors
persist.
During the visit Mr. R. A. Berkhiser, whom we believe to be an officer in the
Sunset Harbor Civic Club, and another citizen of the Clearwater area, visited
the plant. We believe that Mr. Berkh1ser haa been a spokesman for the odor com-
plaintants. The two citizens reportedly 1ef't the plant convinced that the plant
was being operated properly and that another source for the odors would have to
be found.
We again wish to state that we are quite pleased with the capable supervision and
quality of operation maintained at your sewage tr'eatment plant. Operation reports
of your plant are regularly reviewed by this office. Members or our central
stafr, as l'lell as of the Finellas Count.y IlEJalth Department, have visited the plant
many times over the past ~ew months, includine several night visits, and to date
there has been found no evidence of odor nuisance created by the sewage treatment
plant. As we have pointed out before, we consider your plant to be one o~ the
best operated primary treatment plants in Florida.
We cannot positively state the source of the alleged odora. We would suggest
again the mudflats in Stevenson Creek and the noarby septic tanks which overrlow
to the stream, as the source. We would heartily endorse a sewering plan ~or the
areas on both sides of Stevenson Creek as an essential step in clearing up the
odor problems.

RESOLUTION
WHEREAS, after Public Hearing on March 16, A. D. 1953, the City Commission
of the City of Clearwater, Florida, determined that certain work and improvements
hereinafter described should be done and made, and
WHEREAS, pursuant thereto said improvements have been made as tollows:
Construction of curbs and a 30 foot pavement on Anchorage Way trom the
south line of Marine Street to the North line ot Commodore Street and
the construction of curbs and a 30 toot pavement on Commodore Street from
the Eas& line of Anchorage Way to the weat line ot Wilson Boulevard and
the construction of a pavement between the existing curbs from the Ea8~
line of Wilson Boulevard to the west line ot Broadway and construction
of such necessary curbs as required on Commodore S~reet between the
east line of Wilson Boulevard and the west line of Broadway and the.
paving of the intersection of Conwodore Street and Wilson Boulevard.
The construction of a 12 inch storm sewer and appurtenances to provide
necessary drainage for Commodore Street and Anchorage Way from Anchorage
Way and Commodore Street westorly to Clearwater Bay.
WHEREAS, under the provisions of Section 123 and other pertinent provisions
of the City Charter, arter said improvements shall have been completed, the Ci~y
Commission shall assess the cost thereof against the properties facing and abutting
said improvements so made, and
WHEREAS, cer&ain parcels of real estate facing and abutting said improvements
have been benefited by said improvements and the pro-rata cost thereof shall be
assessed against said parcels.

limits, the points I wish to cover are West to Clearwater Beach, East to Davis
Causeway, South to the end of the City limits, North to the end of the City limits.
I will be using a seven passenger Cadillac Sedan for the tour and the designated
spot for picking up passengers will be left to the Commission. The tour will
include about forty-five minutes to an hours time.

The meeting was called to order by the Mayor. The invocation was given by
RevPrend Robert M. Man o£ the Episcopal Church af �he Ascension. Commissioner
Strang maved tihat the minutes of the regular meeting of September $th and the
special meetings oi September lOth and 16th be approved, subject to any corrections
that Ccymmissioner Crown might have to make, in accordance with the copies furnished
each member in writing. Motion was seconded by Commissioner Russel3. and carried
unanimously.
The Gity Manager reporLed that Cwo bids had been received f�r the construc'tion
of eight terrazzo courts at the Shufi'leboard Club in City Park and said that the
work included 1,$96 square feet of terrazzo, 1�,311 square feet of concrete walk
and 225 lineal.feet of retaining wall. The bids were read as follows;

It �as recommended by the City Manager that the s econd lowest bid (Eureka
Fire Hose Division, Atlanta) be accepted due to the type of hose and previous
experience as to the quality of material at a price of �1,1L�0.00. Commissioner

tract be placed with the Eureka Fire Hose Co�npany. Motion was seconded by

The Mayor announced a Publa.c Hearing on the hardship application of Mrs.
Irene Hichardson reques�ing a 10 foot setiback on Sunset Drive for Lo� 10, Block $,
North Shore Park. The City Attorney read the letter irou; Casler, Douglas and
McManus, attorneys, which explained their clientts request hy stating that since
this was a ca.rner lot �0 fee�t wide, a 25 foot setback from tbe side street would
make the lot too narrow to build a residence on. He also read the Zoning Board*s
recommendation which ti�as that the request be granted, setback ta conform with
existing dwellings on east side of Sunset Drive. Commisszoner Strang moved that
having held a Public Hearzng with reference to the hardship case o£ Mrs, Irene
Rzchardson under the Zonittg Ordinance to construct a dwelling on Lat 10, Block $,
North Shore Park 8ubdivision, znd having heard no valid objections, that she be
allowed ta build on this lot in question with a sebback of ten feet on Sunset
Drive and a 25 foot setback on Princess Street. Nlot�.on was seconded by
Commissioner Russell and carried unanimously,
A Public Hearrng was announced by the Mayor on the hardship application of
Mr. and Mrs. Emory C. Fluichbough, Mrs. Edith Schults, and George J. i�ottor,
owners of -Lots 145, 1a6, 10i, 10$ and 109, Llopd-White�Skinner Subdivision, to
change the zoning of �hese lots from R-1 to R-�.. Ths City Attorney read a letter
from �Jlr. H. H. Baskin, attorney, expla�ning tha.t the lots n��th of this property
and the lots east of the property are now zoned R-l� for mu�.tiple units. The
City Attorne.y read the recommendation of the Zoning Soard. which was that �he
reques� be deniad sinae change of zoning should be done by referendum. The City
Attorney read a telegram from Mr� A. N. Notopolous protesting the chan�e. Mr.

The NFayor announced a Public xe�ring on the hardship app�ication of Mr.
Joseph A. C1app �hich requested a setback of 10 feet instead of 25 feet on Duncan
Avenue for Lot 10, Block H, Keystone Manar Subdivision. The City Attorney r ead
the request from Mr. Clapp requesting a 1Q faot setback so a house could be
constru�ted facing on Cleveland Street. The City Attorney read the recommendatian
o£ the Zoni.ng Board which was that the se�back conform to the s etback of existiag
dwell.ings on Duncan Avenus between Ha-^vard ar�d Drew Streets. Mr. Clarence Chalfont
and i�ir. Herbert Lockett, owners of adjoining property, appeared before the
Commission to protest the granting of a ten foot setback since they have observed
a 25 foot setback for theix houses which face on Uuncan. Cor,�missioner Eatss moved
that Mr. Clapp�s appiication for a ten foot se�back he denied and �hat the Zoning
Bcard's recommendation be upheld that all new buildings shall be kept in line with
the pre5ent buildings. Motion was ssconded by Commissionpr Strang and c arried

Commissioner Bates reportzd �hat he and the Ca.ty Manager had ir�terviez�red
Captain Barnett Harris regardzng creating a"iiall of Fish�s" in the Marina Building
similar to the one on Mullet Key which cor_tains plaster cast models of marine
speci�ens and a collection o£ shells. A letter from Captain Harris was read of�'�,r-
ing to create the ma�erial fbr the museum under a year's contract oi �4,000.00,
,�1,OOQ.00 for residen�ial purposes and �3,000.00 salary to be divided evenly
bettKeen Captain Harris and Mrs. Harris. Commissioner Bates explained that a petty
cash fund Qf about �1QO.QQ should be made available so the Gaptain ca�zld purchase
small materials f'or his work. The City ySanager said some remodeling of the walls
and ligY��ts, ete. , wcsuld be nece:;::ary also at an estimated amannt oi �1, 500.00

enter into a contract with Capta3n and Mrs. Barnett Harris to cooperate with the

belong to the City; in addition to tha.s there would be �1,500.00 to be expended in
fixing the wal.ls and lighting fzxtures in this room, plus a pstty cash fund to buy

and carried unanimously.
The Ci�y Manager stated that par� of the lease �+rith the owner of the Small
Boat i°larina stipulated that �he C�ty dredge out the area in front of it. He
reported that the v�ork had been done but it was necessary ta have the Commission's
approval o.� a work order for �969.00. Comcnissioner Strang moved that the work
ordsr covering the Marina dredg3ng in the amount of �969.00 be approved. Motion
was seconded by Commissioner Russell and carried unanimously.
Tha Ci�y At�ornep read a letter from the Advisory Committee of the Employees�
Pension Fund reco�ending tha� Mr. V7, P. Ledbetter, of the Pub1:c Service Aepartment,
a City emp].oyee for twenty>seven years� be retired upon his request at a mon�hly
pension oi �112.20 per month effective September 1, 1953. Commissioner Russell
moved that the application far re,'.:.�rement of W. P. Ledbetter be approved as of
September 1, 1953s and that the Ci�Gy Glerk write him a lettez af appreciation for
th� work done for the City in twenty-seven and a half years. Motion was seconded

, tna� he Vras encloaing a letter froffi Mr: John W. Wakefield of the Florida State
Board of Health regarding an inspection trip made by Mr. M. E. Dawkins, Sanitary
Enginesr on his staff`, through the C1�arwa�er Disposal Plant. The letter from Mr.
Wakefield described Mr. Bawkins+ report of his inspection by staiing that he found
no evidence of odor nuisance areated by the sewage treatment plant, and cnmplimented
the Gity on the capable supervision and quality af operation at the Disposal Plant.
Commission�r Strang suggested that the letter be accepted with thanks. By consent,
the Coq�imission agreed to this.
The City i�an�ger recommended that the lease of William J. Meyer which expired
September 9th for space at the Municipal Dock be renewed on a month tQ month basis
not to exceed one year, Commissioner Bates moved that the pr�esent lea�e of
Wili,iam Meyer and J. M. Hering's lease for the baiC stand be renewed similar tio
the ones that have expired. Moti.on was seconded by Commissianer Russell and

Commissioner S�rang reported for the Committee on the Super-Test gas station
application stating that the Committee had a conference wibh representatives nf
the Super-Test Gompany and as a result, new plans have been submitted which meet

to it. Commissioner Strang moved that Ordin.ana� pi�4 be passed and adopted on its

The City Attorne;� reported that the City Gommission had met with the c:ivil
SeY•vice Buard �o discuss the settlement oi the suit oi Ouida Bil,brey vs, the
Civi�. 8�rvice Baard, the City Manager and the Citp Treasurer. The Commission was
requestei? by the Civil Service Board to settle the suit at the best possible
figure. The City Attorney said a compromise set�iemer_t fzgure of �1,3$2.g0 had
been reached in return for which Mrs. Bilbrey would give her resignation and
d�sraissal of the suit. Commissioner Bates moved that the case be settled at the
compromise figure of �1,3�'2.50. Motion was seconded by Commissioner Russell and
carried unanimously.
The City Attorney described the proposed water contracts he had prepared for
tha Commission's consideration as follaws:
A�reemant �1. This ane is exactly the same as the City offered the County
many months ago with one exception -- the city would canstruct the water
system and sell wa�er to the Coun�y.
A�reement �2. Witl^.out being invoI.ved in any arrangement whereby the Gounty
might build a water system, the City wi31 be a customer p� �hat system
at so many cents a thousand gallons according to a decreasing scale and
the Gity would nat be involved in anp of the construction or fiscal
features.
The Mayor suggested that since the Commissioners had not had a chance to go over
the proposed contracts that discussi�x� be postponed to an executive session Iater
in the week. By consent, Lhe Con�zission agreed to do this.
The City Attorney submitted a Resolution requested by the Trustees of the
Internal Improvement Fund setting out the facts oi the proposed purchase of
additional land in the south part of Clearwater Bay. �he City Attorney explained
that the description extends the tract of land that the City purcl•iased so as to
embrace all submerged land directly opposite to the Memorial Causeway south and
to extend out beyond the fourth fin�er in Glea.rwatea- Bay so that no additional
submerged landscan be filled in south ba�r which are not connscted to the mainland
but would not prevent a bayfront property owr�er on the mainland from filling the
submerged land adjacent to his property. He further explained that ihis desc'rip-
�ion did not include the submerged land directly in the pass as it Wras indicated
that the I. I, Board would re�use to sell it. Commissioner Bates moved that the
description be amen�ed to include all that land at the Pass that we discussed
previously, and if we ;et a formal refusal of record fro�n the I. I. Board, that
the proper officials be authorized to proceed with the purchase af any ancl all
of that land that can be sacured irom the I. I. Board, and �hat the Resolu�ion be
adopted as amended. Motian was seconded by Commissioner Strang and carried
unanimously.
The City Attarnsy read the Resolution assessing the cost of curbing, paving
and drainage improvements on Cammodore Street fro:n Anchorage Way to Br.oadway and
on Anclzorage Way from Marine Street to Commodore Strset against the benefited
properties, Commissioner Strang moved that the Resolution be passed and a d�pted
and that the assessments be spread. Motion was seconded by Commissionar Russell
and carried unanimously.
The City Attarney read the request of Mr. i�ax Benbow to erect a garage on
Lot 29, Block B, Sunset Point 2nd Addition, next to his house which is located
on Lot 2$, He also read the recommendation of the Zoning Board which was that
the request be granted. Cnmmissioner Strang moved that the request o�' Ma�c B�nbovr

It was xecommended by the City Manager that 1,200 feet of two inch gas main
be installed in the easemsnt between Pinebrook Drive and Highland Avenue at an

At�ached is a letter, addressed to you, from Mr. John W. Wakefield oi' the
Florida State Board of Health regarding odor complaints in the vicinity of the
Clearwater sewage treatment plant,
Mr. M. E. Dawkins was in Pinellas County during the wesk of August 17, 1953,
to assist the operator at one of the new sewage treatment plants in this area.
Since this department has continued to receive complaints on odors in the Sunset
H�rbor area and the complaintants allege that the Clearvrater sewage treatment
plant is the source of the odors, � thought it well for Mr. Davakins to visit t,he
plant while he was here.
It has been my opinion all along that the Clearwater s�wage treatment plant
was in no way connected with the odors which people living in the Sunset Harbor
area reported.

At the requsst �f Mr. Wil�iam E. Dunn, 5anitary Engineer, Pinellas County Health
Department, Mr. M. E. Dawk?n5, Sanitary Engineer of our Central Staff, visited
your sewage treatment plant on August 2Q, 1953.
This visit was in connection with complaints, which apparently continue, regard-
ing odors allegedly due to the sewage trea�ment plant operationz
On the night of August 20, our representatzve in company with Mr. D. J. Raye, the
Plant Superintendent, surveyed the residential area in the vicinity of the plant.
We wish to note that city personnel were unaware of the timing of this visit and
therefore could have taken no special precautions ,*,o eliminate odors, i�'e a3so
�oint out that weather conditions were ideal for carrying odors from tr�e plant site
to the nearby residences along Stevenson Creek, had such odor sources been presen�.
The inspection continued through the night hours during which the alleged odors
persist.
During the visit Mr. R. A. Berkhiser, whom we believe to be an offieer in the
Sunset Harbor Civic Club, and another citizen of the Clearwater area, visited
the plant, We believe that Mr. Berkhiser has beerz a spokesman for the odor com-
plaintants. T:�e two citizens repoxtedly left tl.e plant convir_:.e�i that the plant
was being operated properly and that another source for the odors would have to
be found.
We again wish to state that v�e are quite pleasad with the capable supervision and
quali�y of operation maintained at your sewage treatment plant. Gperation reports
of your plant ar� regularly reviewed by this office. Members of our central
staff, as well as of the Pinellas County Health Department, have visited the plant
many tim�s over the past few months, including several night visits, and to date
�hea•e has been found no evidence of odor nuisance created by the sewage treatment
plant. As we have pointed out before, we consider your p].ant to b e one of the
best operatzd primary treatment plants in Florida.
We cannot positively state the source nf the alleged odors. We would suggast
again the mudflats in Stevenson Creek and the nearby smptic tanks which overilow
to the stream, as the source, We would heartily endorse a sewering plan for the
areas on both sides o£ Stevenson Creek as an essential step in clearing up the
odor problems.

RESOLUTION
WHEREAS, after Public Hearing on March 16, A. D. 1953, the City Gommiss3�n
o£ the City of Clearwater, Florida, determined that certain work ar�d improvements
hereinafter described shouZd be done and made, and
WHEREAS, pursuant thereto said improvements have been made as follows:
Construction of curbs and a 30 foot pavemeat on Anchorage Way #'rom the
south line of Marine Street to the North line of Commodore Street and
the construction o.� curbs and a 30 foot pavement on Commodore Street from
the East line of AnGhorage Way to the west line of Wilson Boulevard and
the construction of a pavement between the existing curbs from the East
line of Wilson Boulevard to the west line of Broadway and construction
of such necessary curbs as required on Commodore Stree� betweEn the
east line of Wilson Boulevard and the west line of Broadway and the
paving of the intersection of Commodare Street and Wilson Boulevard.
The construction of a 12 inch storm sewer and appurtenance5 to provide
necessary �irainage for Commodore Street and Anchorage Way from Anchorage
Way and Commodore Street westerly to Clearwater Bay.
WHEREAS, under the provisions of Section 123 and other pertinent provisions
of the City Charter, after said improvements shall have been completed, the City
Coiramissian shall assess the cost thereof against the properties facing and abutting
said improvements so made, and
WEIEREAS, certain parcels of real estate facing and abutting said im�rovements
have been benefited by said imprevements and the pro-rata cost thereof sha11 be
assessed against said parcels.
NOW, THEREFdRE, BE IT RESOLVED by the City Commission of the City of
Clearwat�r, Florida, in session duly and reguiar�ly assembled as follows:
1. That the above described improvements on Commodore Stree� from Anchorage
Way to Broadway and on Anc�orage Way f°rnm Max�ine Street tr� Commodore Street be
and the same are hereby accepted and approved as having been completed.
2. That the following described properties facing and abutting sai.d curbing,
paving and drainage improvements are here�y deemed to liave been banefited by said
impro�ements in the fallowing proportions o.f the cost thereof and the same are
hereb3� assessed in accor•dance with the �ollowing schedule,
