Commissioner Bates moved that the minutes of the regular meeting ot August 17th and the special meeting of August 24th be approved in accordance with the copies furnished each member in writing. Motion was seconded by Commissioner Strang and carried unanimously. The City Manager reported that four bids had been received for Workmens' Compensation Insurance tor the City for one year. It was reported by the City Manager that eleven bids had been received tor 800 feet ot 21 inch tire hose and 400 feet of li inch tire hose. Commissioner Crown moved that the bids be referred to the City ~~nager forrecom- mendation. Motion was seconded by Commissioner Strang and carried unanimously. The Mayor announced a Public Hearing on the hardship application of Derwood M. Cook to erect a carport and storage room on Lot 17, Block H, Breeze Hill Subdivision, within three feet of the side property line. -The City, Attorney read a letter from Mr. Cook outlining his request. He also read the Zoning Board's recommendation which was that the request be granted. There being no objection, Commissioner Crown moved that the hardship application of Mr. Derwood Cook be approved. Motion was seconded by Commissioner Bates and carried unanimously. The City Manager presented a replat of Pine brook Highlands which corrected the storm drainage easement which appeared in the orig:f.nal plat in Block 3 instead of Block 2. By consent. the matter was deferred for a further report from the City Manager on the condition of the drainage and the streets and the subdivider's compliance with the subdivision requirements that he agreed to comply ~th when he came into the City. The City Attorney presented a proposed contract with Mr. C. P. Collier for the purchase of Lot 6, Pinellas Groves, which comprises five acres, at the price of $350.00 an acre or $1,750.00, and stated that this purchase, together ~th a purchase of ten acres near the Airport from Miss Maude Matthews, will give the City ownership of a large tract of land which can be used for drilling new wells or for light industry. He also stated that a commission was being charged by Mrs. C. E. Ball for assisting with the purchase from Mr. Collier. The Real Estate Committee recommended the purchase. Commissioner Crown moved that the recommenda- tion of the Real Estate Committee be approved for the purchase o~ Lot 6, Pinellas Groves. at the price or $350.00 an acre for the rive acre tract and Eor the payment of a purchase commission of $175.00 to Mrs. Ball who made it possible Eor us to acquire this purchase. Motion was seconded by Commissioner Strang and carried unanimously. In regard to the application of Mr. Howard Ewing for a renewal of bis license to operate an auction house, the City Manager explained that such licenses must be reviewed every six months because of provisions in the City Charter. The Mayor stated that he had had several telephone calls from people who wished to object to the renewal ot the license and wished the matter to be postponed ror two weeks to they could appear to protest. After consideration of the matter, Commissioner Bates asked Mr. Ewing if he would agree, as he did formerly, to the license being cancelled at any time if sufficient reason was established and Mr. Ewing replied that he would agree to that. Commissioner Bates moved that the Commission renew the license for six months, and if any hearing develops anything that is out of order in any way, the Commission would immediately cancel the license. Motion was seconded by Commissioner Russell. Commissioners Bates. Russell, Strang and Crown voted "Aye". Mayor-Commissioner Brown voted "No". Mo~ion carried. The City Manager presented a statement for $250.00 for the tee of Mr. Weldon Starry, attorney in Tallahassee, who assisted in the appeal of the Caldwell and Kerekes suit vs. the City of Clearwater in the Florida State Supreme Court. The Mayor reported that Mr. Phillips, the City Attorney, had already advanced the money to Mr. Starry. Commissioner Crown moved that Mr. Phillips be reimbursed for legal fees in the amount of $250.00 paid to Mr. Starry in Tallahassee. Motion was seconded by Commissioner Russell and carried unanimously_ The Mayor stated that regardless of the outcome of the lawsuit he would like to see the matter submitted to referendum in order to determine if the Commission was acting in accordance with the wishes or the people. Concerning the proposed seawall on Clearwater Beach suggested by Mr. Dopald Beath, the City Manager reported that he and the City Engineer had been unable to arrange a meeting with Mr. Beath, Mr. E. W. Barger, Jr., and Mr. Leo Butler and therefore requested that the item be deferred to the next meeting. The City Attorney read a letter from the Florida State Chamber or Commerce describing a clinic scheduled by the State Council for Industry and Commerce to be held on Thursday, August 27th in Orlando and suggesting that Clearwa~er be represented at the meeting. Tbe City Manager suggested tha~ with the Commission's approval be would write to Mr. Earl W. Brown of the State Chamber of Commerce and express regrets that the City of Clearwater did not have any representa~ives at the meeting and request a copy ot the minutes of the meeting. By consent. the Commission agreed to this procedure. In regard to the application of Leroy Outing. negro, to operate two additional taxicabs, the City Manager said that there are now twelve colored cabs and they are all busy and that the Chief o~ Police reported that there have been no viola- tions or accidents involving the colored cabs; therefore. he recommended that since the mileage reports indicate a need ror the extra cabs that the application be gran~ed. He explained that this would give the City a better entrance to Northeast Cleveland and Missouri Avenue from Drew Street. Commissioner Crown moved that the dedication rrom the Gulf Oil Company ot the property at the corner ot Northeaat Cleveland and Drew StreGt be accepted subject to the approval of the Real Es~ate Committee to be appointed by the Mayor aDd the approval of the City Attorney. Motion was seconded by Commissioner Bates and carried unanimOUSly. The Mayor stated that Commissioners Russell and Bates were on the Real E8ta~e Committee. The City Attorney presented a request from the Super-Test Oil Company for permission to erect a filling station on the southeast corner or Gulf-to-Bay Boulevard and Duncan Avenue. He read the Zoning Board's recommendation which was that the request be granted. He also read the City Engineer's report which indicated that prOVision should be made in the plans for maintaining the drainage ditch. The report ~tated that there is no paving on Duncan Avenue; also that ~he plans do not show the type of driveways to be constructed on Gulf-to-Bay Boulevard and that no plumbing plan was included in the plans. Commissioner Crown moved that the Mayor appoint a Committee to confer with the Super-Test 011 Company as to nature of structures and services that are going to be provided and report back to the next meeting. Motion was seconded by Commissioner Bates and carried unanimously. The Mayor appointed Commissioners Strang and Bates to serve on this Committee. Commissioner Bates speaking for the Missouri Avenue Right-of-Way Committee recommended the following for the portion north ot Co~rt Street: 1. That Lot 1. Block 1. and tbe east 11 feet of Lot 2, Block 1, W. F. Hughey Subdivision, including two houses, belonging to the M. Harvey Estate be purchased for .2,750.00. 2. That David Payton. whose property the City has already purchased, be paid $450.00 ~or moving his house from the property. 3. That the south 40 feet of the nortn 65 feet of Lot 1 or Lot 5, and the north 25 feet of Lot 1 of Lot 5, R. H. Padgett Subdivision of Original Lots 2 and 5, owned by Randolph Moore Estate. be purchased ror $600.00 and an allowance of ~50.00 be given for moving the house, the City to connect the sewer to the house after it is moved. (Mr. Kabrich has been advised by Marshall and Rives, attorneys. that the offer is not acceptable.) 4. That the east 30 feet of Lot 1, Block 2, W. F. Hughey Subdivision, be purchased. Commissioner Crown moved that the Committee's recommendation for the acquisition of all the remaining right-of-way between Court Street and Cleveland Street on the Missouri Avenue extension be approved and that the City officials be authorized to proceed for the quick taking of the property owned by the Randolph Moore Estate. Hotion was seconded by Commissioner Strang and carried unanimously. Commissioner Bates gave the recommendations of the Missouri Avenue Right-of-Way Committee tor the portions south of Court Street as follows: That the eas~ 10 feet ot Lots 9, 10, 11, Elock 0, Carolina Terrace Sub- diVision. owned by Oweda Sinclair, be purcbased tor $2,000.00, and recommend leaving the house where it is. That the eas~ 10 feet of Lot 22, Block J, Lakeview Heights, owned by Earl McMullen. be purchased for tlOO.OO. That the east 10 teet of Lots 17, le, 19, Block J, Lakeview Heights, owned by Russell HendriCks, be purchased for '250.00. That the east 10 feet or Lots 4 and 5. Block C, Carolina Terrace, owned by Dallas Young, be purchased for $150.00. That the eas~ 10 feet of Lot 6, Block F, Carolina Terrace, owned by Robert Edmondson, be purchased for $100.00. Commissioner Crown moved that the Committee's recommendation with respect to acquir- ing additional right-of-way required on Missouri Avenue extension trom Court Street south to the City limits be approved and that the City o~fieials be authorized ~o execute the documents necessary to effect these purchases. The Mayor announced the consideration of the plat of Skycrest Terrace and Ordinance 643 setting forth the intention to annex said subdivision. The Commdss1on discussed a~ length the drainage problems involved in the Skycrest Terrace Subdivision. The City Engineer stated that since the stree~s we~ shown only on the three tiers of lo~s he was unable to dete~ine jus~ wha~ would be a satisrac~ory solution to the drainage problem. Commissioner Crown suggested tha~ the matter ot getting definite drainage plans be referred back ~o the developers ~or their engineer's suggestions. The City Attorney read proposed Ordinance 644, making it illegal to leave an abandoned icebox or refrigerator in a place where children might have access to it. Commissioner Strang moved that Ordinance 644 be passed on its first reading. Motion was seconded by Commissioner Russell and carried unanimously. Commissioner Crown moved that Ordinance 644 by unanimous consent be considered on second reading by title only. Motion was seconded by Commissioner Bates and carried unanimously. The City Attorney read Ordinance 044 by title only. Commissioner Crown moved that Ordinance 644 be passed on second reading by title only. Motion was seconded by Commissioner Bates and carried unanimously. The City Manager recommended installation of 896 feet of two inch gas main east from Rainbow Drive to easement at an estimated cost of $530.00. Commissioner Crown moved that the Resolution be adopted. Motion was seconded by Commissioner Strang and carried unanimously. The City Manager requested approval of a work order for $381.00 for an electric typewriter for the City Attorney's office. Commissioner Crown moved the City Manager's recommendation be approved. Motion was seconded by Commissioner Russell and carried unanimously. The City Manager requested the Commission's approval of renting a ~pace in the Marina to Mr. Fred N. Andrews who operates a marine hardware store in St. Petersburg and would like to open a branch here. The Manager said it was proposed to partition off part of the room originally planned for a sundry store and rent Mr. Andrew8 one side for $125.00 per month. Commissioner Crown moved that the City Manager's recommendation be approved for the renting of the space mentioned for a marine hardware store. Motion was seconded by Commissioner Russell and carried unanimously. The Mayor requested t~e City Manager to set up a jpint meeting of the Commission ~th the Civil Service Board sometime during the next week. The City Attorney requested instruction as to whether or not he should defend the City in the suit brought by Mr. E. J. Metz for damages sustained in the sinking of his boat at the Clearwater Marina. It was agreed that the City Attorney should defend the suit but that he should also ascertain if the claim was covered by the liability insurance carried by the City. The City Attorney read a letter addressed to the Mayor by Mr. James R. Billet suggesting that the City adopt an ordinance to prohibit the use of cast nets any closer than 150 feet from the seawall line of any developed property within the City of Clearwater. Mr. Billet stated that some ot the cast netters were destructive to property causing damage to the boats and discarding trash fish on the lawns and docks. By consent, the City Attorney was requested to submit a proposed draft of an ordinance to each of the Commissioners for study. ,_.-.-....~~..." -. ----.. -5- CITY COMMISSION MEETING September a, 1953 The Commission now adjourned as the City Commission and acting as Trustees ot the Pension Fund on a motion by Commissioner Strang which was seconded by Commissioner Crown and carried unanimously, admitted Botty Lou Smith, Secretary in the Police Department, and Johnny Hattaway, Laborer in the Public Service Department, into membership in the Pension Plan. Dear Sir; I am writing in request of permission from the Zoning Board and the City Commission to build a carport and storage room onto my residence at 1424 E. Druid Rd., Block H, Lot 17, Breeze Hill Subdivision. This property has been in my possession for five years and was purchased with the understanding that a carport or garage could be built within three feet of the lot line. However, upon applying for a building permit recently I was informed that the zoning laws had been changed as of December, 1952. If I must abide by the new laws I will not be able to proceed with my plans. As you can see by the enclosed sketch, there is approximately 14 feet between the existing porch and the lot line. In order to leave five feet leeway we would only be allowed nine feet outside dimensions, including two cement block columns. This would leave less than 7', 4" inside clearance which would make a carport impractic- able and detract rather than add to the value of our property. Accordingly, all hands are needed in the task of searching out industrial opportunities, in the preparation of essential ground- work, and of conditioning the minds of investors. The job is big enough to challenge the most forceful among our citizenry. What is done now, or not done now, will show up on tomorrow's Florida economic countenance. For example, the $300 million v~hich began flowing into Florida t s industrial veins about three years ago are now, much of it, paying off. In another 12 months all Florida will begin feeling the pleasant effects of this money's presence in our state. Many of these cast-netters are fine people but unfortunately some of them are prone to use boistrous and foul language within earshot or our homes. Some are Dalicious and destructive in slamming their nets against our boats, the leads making marks on the hull. They throw rough fish and craba on our la~s and docks. All in all these men are destroying the value of one of Clearwaters greatest assets, Our waterfront homesites and on request we can furnish you with the names o~ several people who are ready to leave the waterfront and/or the Clearwater area on this one account. It is not our wish or intention to put a stop to the extra income these boys derive from selling their fish, but to try to find a happy solution where-by all can live and let live. We feel that it is within reason to ask you to immediatly consider a simple ordnance which would prohibit the use of cast nets any closer than one hundred and rifty feet 150' from the seawall line of any developed property ~thin the City of Clearwater. In no way should this be construed to cover sport fishermen who use hook and line or bait casters. In the past ten days the Law enforcement bodies of Clearwater have been called upon numerous times where wilfull destruction or trespass was inv01ved by cast-netters. At present with no ordnance such visits by the police are almost a waste of tax- payers money and the policemen's time. It is our humble opinion that an ordnance as mentioned above ~11 be most welcomed by our law en~orcement officers and it will create a better understanding by all persons involved. After consideration of the matter, Commissioner Bates asked Mr. Ewi.ng if he would agree, as he did iormerly, to the license being cancelled at any t3me if sufficient reason was established and i�lr. Ewing replied that he would agree to that. Some are malicious and destructive in slamming their nets against our boats, the leads making marks on the hull. They throw rough fish and crabs on our lawns and docks. All in all these men are destroying the value of one of Glearwaters greatest assets, Our �vaterfrQnt homesites and on request we can furnish you with the names of several people who are xeadp to leave the waterfr°ont and/or the Clearwater area on this one accounb. It is not our wish or intention to put a stop to the extra income these boys derive from selling their fish, but to try to find a happy solution where-by alY can live and let live. We feel that it is within reason to ask qou to immediatly consider a simple ordnance which would prohibit the use of cast nets any closer than one hundred and fif'ty feet 150t from the seawall lin� of any developed property within the City of Clearwater. In na way should this be cons�rued to cover sport fishermen who use hook and line or bait casters. In the pas� ten days the Law eniorcement bodies of Clearwater have been called upon numerous times where wilfull destruction or trespass was involved by cast-netters.
