Mrs. Doris Alvord requested that the Commission have the minutes of August 10th amended so as to show that if abatements should be due on Unit 9 and the acreage owned by Mrs. Alvord in excess of the $8,000.00 deferred ba~ance, that such abatements could only apply to the $5,350.00 paid on her account by A & W Glads, Inc. Commissioner Crown moved that the minutes of August 10th be amended to provide that the point was brought out and confirmed by attorneys present that this property outside of the City limits could never be asse~sed by the City for the cost of this same Sewage Disposal Plant in view of the fact that it had been contracted to be paid for. Motion was seconded by Commissioner Bates and carried unanimously. Commissioner Bates moved that the minutes of the regular meeting of August 3rd and the special meeting of August 10th be approved as per the amendments to the special meeting of August 10th, without being read in accordance with the copies furnished each member in writing. Motion was seconded by Commissioner Strang and carried unanimously. The City I4anager reported that six bids had been received for 4,800 feet of six inch cast iron pipe. Commissioner Bates moved that the City Manager's recommendation be accepted for this approximately 4,800 feet of six inch cast iron pipe and that it be purchased in accordance with the proposal of the U. S. Pipe & Foundry Company for the price of $$,160.00. Motion was seconded by Commissioner Crown and carried unanimously. The City Manager reported that five bids had been received for two deep well turbine pumps. The bids were read as follows: M. R. Vaughan, Tampa Growers Pump & Supply Co., Tampa Industrial Pump Corporation, Tampa Layne Atlantic Co., Orlando Bolger Servicing Go., Lake Alfred $3 , 593.68 4,266.00 3,180.00 no bid received too late The City Manager recommended that the bids be referred to him for tabulation and brought back for a further report. Commissioner Strang moved that the Manager's recommendation be accepted. Motion was seconded by Commissioner Russell and carried unanimously. The City Manager recommended that the bid of H. K. Wilson of St. Petersburg for $967.70 for Feedwater regulators and one pump governor be accepted. Commissioner Crown moved that the City Manager's recommendation be approved. Motion was seconded by Commissioner Bates and carried unanimously. The Mayor announced the Public Hearing on sanitary sewer for the area bounded on the north by the south line of Granada Street, on the east by the west line of Wilson Boulevard, on the south by the north line of Sedeeva Street and on the west by the east line of Edgewater Drive. The City Manager explained the project, estimatin~ it would cost $2,860.00 for the force main, $1,500.00 for the lift station, '4,250.00 for 1,700 feet of eight inch pipe and $1,200.00 for six man hole covers. He estimated the project as costing $2,89 per front foot. Mr. W. C. Sage inquired as to whether or not sewage from this line would be treated at the old Disposal ?lant, and if so, if the plant would not be overloaded. He was informed that the sewage would be treated at the old plant but that it would not be over- loaded. The City Attorney read a memo from Mrs. A. J. Bacon and Miss L. Maude Bacon objecting to the project. He also read a letter from Mr. C. L. Darling objecting to the project as presented since in his opinion the area covered by the proje~t was too small. Mr. Wm. Dunn of the State Health Department said it was the Department's recommendation that the City proceed with this project in '... ._~_ ...~i.~-.._. _a._.... -2- CITY COMMISSION MEETING August. 17, 1953 the interest of public health. Commissioner Strang moved as follows: "Having heard this Public Hearing on a sewer line, lift station and appurtenances in the area bounded on the north by the south line of Granada Street, bounded on the south by the north line of Sedeeva Street, bounded on the east by the west line of Wilson Boulevard, bounded on the west by the east line of Edgewater Drive, and having peard no valid objection, I move that the project go ahead with as much speed as possible, and that the Manager be authorized to advertise for bids and return them at the earliest possible meeting and that the cost of this sewer line, lift station and appurtenances be assessed against the property there bounded on a front foot basis". Motion was seconded by Commissioner Bates and carried. Commissioner Crown did not vote. The City ~anager presented a sketch from the Westinghouse Company showing the proposed 31 new street li~hts for Manda1ay Avenue and estimated the entire cost of the project as $10.465.86, of which $3,000.00 has already been appropri- ated. It was decided to defer approval of the plan to the noxt meeting in order to see if the Florida Power Corporation would underwrite some of the cost of the new lights. The City Attorney read a letter from Colonel Guy F. Maple resigning his position of Director of Civil Defense in Clearwater because of ill health. Upon the Mayor's suggestion, Conwissioner Crown moved that the Clerk be instructed to write a letter to Colonel Maple expressing the Commission's thanks for the splendid work that he has done, expressing regrets that he is resigning and hoping that his health will improve. Motion was seconded by Commissioner Russell and carried unanimously. Commissioner Crown moved that the Mayor be requested to offer this appoint- ment to Commander E. H. Smith, and if he accepts, his appointment 1s hereby authorized. Motion was seconded by Commissioner Strang and carried unanimously. The City Manager described the proposed plans for the Negro Swimming Pool saying that it was planned for the pool to be 80 feet by 40 feet with a depth o€ 3 feet g inches on each end and a depth of 12 feet in the center. the diving board to be attached at the center of the pool. He estimated the pool would ~ccommodate 236 persons. The C~erk presented a list of seventeen persons recommending that they be appointed as election officials: '. .' The City Attorney read the proposed Ordinance 6~2 which will amend the Zoning Ordinance 627 and will provide for the repeal of the 1952 Zoning Map and the adoption of the 1953 Zoning Map. Commissioner Strang moved that Ordinance 642 be' passed on its first reading. Motion was seconded by Commissioner Russell and carried unanimously. Commissioner Crown moved that Ordinance 642 be considered on its second reading by title on1y~ Motion was seconded by Commissioner Strang and carried unanimously. The City Attorney reported that he had examined the hardship application ot Derwood M. Cook with reference to erecting a carport and storage room on Lot 17, Block H, Breeze Hill Subdivision, and recommended that it would be proper to advertise it for a Public Hearing. By consent, the Commission instructed the City Attorney to advertise the matter for a Public Hearing at the next regular meeting. The City Manager presented a Resolution to have twenty property owners clean their lots or weeds and underbrush. Commissioner Strang moved that the Resolution be adopted. "f ' <. ,', -3- CITY COMMISSION MEETING August 17. 1953 The City Attorney repor~ed that he had word from Major W. R. Gunby that there had been no progress made in securing a ~elevi8ion permit ~rom the F.C.C. The Mayor instructed the City Attorney to contact Major Gunby and call his attention to the ~act that the leased area has not been cleaned in accordance with his agreement. Commissioner Crown reported that some of the property owners on the south end of Clearwater Beach who have no sanitary sewer have requested the City Manager to have an informal hearing on the matter. The Mayor suggested it would be well to have a Public Hearing on paving and drainage in that area. The City Manager stated that the Public Hearing on paving and drainage would be set up sometime after September 1st. but that the Engineer would have to estimate cost of sanitary sewer before the other one could be called. The Mayor announced that ~. Middleton would be on vacation for the next two weeks and suggested that Mr. Gerald Weimer, Assistant Purchasing Agent, be appointed Acting City Manager. Tne City Manager also recommended Mr. Weimer's appointment. Commissioner Crown moved that the City Manager's recommendation be approved and Mr. Gerald Weimer be appointed as Acting City Manager. Motion was seconded by Commissioner Strang and carried unanimously. Mr. James Novotny and a delegation from Clearwater Beach appeared before the Commission relative ~o the ~et back lines in the area adjacent to Coronado Drive and First Street. Mr. Novotny called attention to the fact tnat he had been required to maintain a 20 foot set back in this area two years ago but that in last December's election the zoning had been changed from R-2 to R-M and the set back requirement had been reduced to 10 feet. He said that other owners in the area were forced to maintain a 20 foot set back and that they had not been aware of the set back change created by the re-zoning and he requested that the Commission consider the re-establishment ot the 20 foot set back in this area. Commissioner Crown moved that the Zoning Board immediately call a special meeting to consider the request for the rever~ing to a 20 foot set back on Coronado in conformity with past rulings of the City Commission and to consider such other zoning changes as they might have for further consideration. Motion was seconded by Commissioner Bates and carried unanimously. "Residents in ~he area of Franklin Street from Lincoln Avenue to Avanda Court and Avanda Court have requested that the City take steps to make the streets passable and it was the City Manager's recommendation that a few loads or marl be placed in ~he street. The City Manager was instructed to'keep track of the amount expended so that the matter could be charged against the street maintenance budget. Mr. Leo M. Bu~ler presented on behalf of Mr. Donald Beath a ske~ch showing a seawall Mr. Beatb proposes to build on his property lying south or Water Lot One. City Park Subdivision, stating that he wished to know where ~he seawall should be located. and he also inquired as to the possibility of the City putting a seawall on themjacent City-owned property west of Water Lot One. The cost of the City's portion was estimated at approximately ~7,500.00 for 250 feet of seawall. By consent, the matter was referred to the City Manager for study and further consultation with Mr. Beath. Dear Sir: August 13, 1953 Re: Sewer Line, etc., Sunset Point- Edgewater Drive area This will serve as formal protest on the limits set forth in the notice from City Engineer Lickton which specifies that the sewer line will be constructed in the area west of Wilson Avenue and that the area east of Wilson is to be excluded. My property, Lots 13 and 14, Block "B" LaJolla - 100 feet - is on the south- west corner of Granada and Wilson. On the south side of Granada from Edgewater Drive to Wilson there are six homes with another now under construction. From Wilson to Broadway there are eight homes, one of which also has a garage apartment. There is quite a decided slope from Broadway to the western boundary of my property and very little from that point to Edgewater Drive. Unless the area east or Wilson Avenue is included in any plan the area west of Wilson will always be threatened with pollution from the septic tanks to the east of Wilson. The property owners to the west of Wilson will not be "especially benefited" by the projsct as proposed and my protest is on the elimination of the area east of Wilson Avenue and has particular reference to Granada Street. Brown City of Clearwater Clearwater, Florida Dear Sir: It has become necessary for me to tender my resignation as Director of Civil Defense of Clearwater, to be effective 15 September 1953. As you know I retired from the Army with a physical disability. I had hoped that my physical condition would improve in this climate, but it has deteriorated to the extent that I have been ordered before a medical board for examination and have been directed to relieve myself of all activities and physical exertion. I have maintained the activities of Civil Defense in Clearwater for practically a year, in Eace of adverse conditions, namely, the disinterest of the qualified citizens of Clearwater to participate in Civil Defense activities. I feel that a Civil Defense organization is still very necessary in Clearwater, as well as in the entire United States. We have a well balanced Civil Defense organization, which was developed by Captain Ashton B. Smith, U. S. Navy, Rettd. In an emergency the organization can be readily put into effect by personnel trained by reason of their professional occupation. I have no recommendation to make as to my successor, as I stated above, that qualified citizens are entirely disincerested in Civil Defense. It is, however, imperative that I be relieved of the duties and responsibilities of Director of Civil Defense of Clearwater, not later than 15 September, 1953. Shortly after that date I expect to be absent from Clearwater for an extended period of time as a patient at Walter Reed General Hospital, Washington, D. Gunby that there had been no progress made in securing a televisi.on permit from the F.C.C. The Mayor instructed the City Attarney to co�tacL Major Gunby and call his attention to the fact that the leased area has not been cleaned in accordance with his agreement. Commissioner Crown reported that some of the property owners on the south end of Clearwater Beach who have no sanitary sewer have reque.sted the City Manager to have an informal hearing on the matter. The Mayor suggested it would be well to have a Public Hearing on paving and drainage in that area. The City Manager stated that the Public Hearing on paving and drainage would be set up sometime after September lst, but that the Engineer would have to e stimate cost oi sanitary sewer before the other one could be called. The Mayox announced that Mr. Middleton would be on vacation for the next two weeks and suggested that Mr. Gerald Weimer, Assistant Purchasing Agent, be appointed Acting City Manager. The City Manager also recommended Mr. Weimer�s appointment. Commissioner Crown moved that the City Manager�s recommendation be approved and i�r. Mr. Novotny called attention to the fact that he had been required to maintain a 20 foot set back in this area two years ago but that in last December's el�ction the zon�ing had been changed from R-2 to R M and the set bacs requirement had been reduced to 10 feet. He sai3 that other owners in ths area were £arced to maintain a 20 foot set bdck and that the•,• had not been aware of th� set back change crea�ed by the re-zoning and he requEsted that tk�a Commission conszder� the re-es�ablishment of the 20 foot set back in tnis area. As you know I retired irom the Army with a physical disability. I had hoped that my physical condition would improve in this climate, bv.�t it has deteriorated to the extent that I have been ordered before a medical board for examination and have been direct�d to relieve myself of all actiai�ies and physical exertion. I have maintained the activities of Civil Defense in Clearwater for practically a year, in face of adverse conditions, namely, the disinterest of the qualified citizens of Clearwater t� particigate in Civil Deiense activities. I feel that a Givil Defense organ�zation is still very necessary in Clearwater, as Well as in the entire United States. We have a we11 balanced Givil �JefQns� organization, �vhich was developed by Cagtain Ashton B. Smith, U. S. Navy, Retid. In an emergency the organization can be readily put zr�to effect by persannel trained by reason oi their professional occupation. I have no recommendation to make as to my successor, as I stated above, that qualified citizens are entirely disinterested in Civil Defeuse. It is, however, imperative that I be relieved of the duties and responsibilities of Director of Civil Defense of ClearwaterJ not later tnan ].j 8e�tember, 1�53.
