January 19, 1953 r.; The City Commission of the Citq of Clearwater met in regular session at City Hall, Monday, January 19, 1953, at 1:30 P.M. with the following members present: Herbert M. S. Dauerty of the Cbapel by the Sea, Clearwater Beach. Commissioner Russell moved tbat the minutes of the regular meeting of January 5th be approved in accordance with the copies furnished each member in writing and their reading be dispensed with. Motion was seconded by Commissioner Strang and carried unanimously. ' The City Manager reported that six bids had been received for resurfacing Greenwood Avenue from Park Street to Lakeview Drive. The bids were read as follows: Cone Bros. Constr. Co., Tampa eirregular Burton Walker Constr. Co., Plant City X6,723.00 J. N. Conner do bons Tampa 5,943.00 W. H. Armston Co., Dunedin 4,800.00 E. H. Holcomb, Jr., Clearwater 6,779.50 Campbell Paving Co., Clearwater 5,419.00 The City Manager recommended accepting the low bid of 1?. H. Armston Company. Commissioner Crown moved that the City Manager's recommendation be approved. Motion was seconded by Commissioner Russell and carried unanimously. The City Manager reported that six bids had been received for resurfacing Dreg Street from Betty Lane to Glenwood Avenue, and paving 137 feet of Evergreen Avenue south of Drew Street. Commissioner Crown moved that the City Manager's recommendation be approved. Motion was seconded by Commissioner Russell and carried unanimously. r The City Attorney reported that a form letter had been sent to owners of property outside the City limits requesting payment of tax liens assessed against the property ,? previous to 1934 when it was included in the City limits, offering a 50? settlement of face value if aid within 60 da s. The City Attorney read a letter from Mrs. ?. Frances Demond offering a settlement on two lots in Marymont of X1,200.00, to settle taxes and liens amou?pting to ?2 $97.12. He pointed out that the settlement offer was {` ,? in line with the approximate value of the lots. The Mayor appointed Commissioners ?, Bates, Russell and Brown to serve on a Tax Settlement Committee. By consent, Mrs. '' ? Demond's tax settlement offer was referred to this Committee. <; ,?. a>:R:;;?'???? -?,?:: Commissioner Crown suggested that the owners of property within the City on ;??? ? which taxes and improvement liens are delinquent be notified that taxes for 1937 and '? prior may be settled for the face amount of the taxes and that penalty and interest ?r: will be added to taxes for 193$-49, inclusive, and that they be required to pay in ;?i;?.;.?Cj????;?`, full or the City would start foreclosure proceedings. In recommending the purchase of a reproduction machine for the Engineering ??? Department, esti®ated coat ?l,$00.00, the City Manager reported that the item waa ?'h included in the budget under Capital Expenditures and pointed out that durir? the past eighteen months the amount of'?g06.00 had been spent to reproduce maps from the Bngineerfag Department. Commissioner Bates moved that the purchase of the machine be ?' approved. "?Y.'F'?' -2- CITY COI?ISSION MEETING January 19, 1953 The City Attorney read a Resolution addressed to the City Commission by the Clearwater Lodge X1030, Loyal Order of Moose, in which the organisation proposes to fence and equip a playground in the Bela?ant section if the Cityy sill agree to furnish the lead and peraoranel to supervise the playground. The Mayor r®ported that the City Manager, Mr. Eddie Moore Mr. Bob Watkins and he had inspected the proposed site near the ball park in South Clearwater and found it satisfactory. Commissioner Crown moved that the Resolution be referred to the City ldanager and the City Recreation Deppartment for recommendation and report back to the Commission. Motion was seconded by Commissioner Strang and carried unanimously. Mr. William Wigghtman, representing himself and Mr. John Rawe as oxnera of the Clearwater Transit Compan , reported to the Commission that for the peat year the company had an operating loss of ?b,50A.00, and that they did not feel that they could operate an Eaat Clearwater bus also at a toes. However, he requested the approval of the Commission to allow the Clearwater Transit Company to make a working arrangement or a sublease with the Indian Rocks Transit Company for operating a bus service to east Clearwater. He reported that this co?apany would offer a aerrice of nine round tripe a day with a charge of fifteen cents for one Trey. Mr. M. B. Thayer addressed the Commission regarding this natter. Colonel James M. Renck addressed the Commission ae President of the Country Club Estates Civic Club requesting that service for the northeast section of the City also be considered. Commissioner Crown moved that the Clearwater Transit Company be authorised to work out a licensinngg agreeo?ent with the Indian Rocks transit, Incorporated, whereby an east run of approxi- mately nine round tripe per day be instituted at the nearest practical time and that the Clearwater Transit Company be requested to consider the feasibility of altering its route to service Country Club Bstates and the Pals Terrace area. Motion was seconded by Commissioner Russell and carried unanimously. ]sr. Wightman invited the Commission's attention to the Pact that the Clearwater Transit Company had been operating at a considerable loss even though the ownora had not boen drawing any salaries in the business and requested that a Committee b® appointed to study the possibility of reducing the franchise tax. The Mayor appointed Commissioners Crown and Strang to serve on this Committee. ,,. ?? Mr. Wightaaan also requested an extra space oa Cleveland Street to accommodate the East Clearwater bus. By consent the matter was referred to the City Manager and the Chief of Police. ?k Commissioner Crown presented the request of Mr. Robert J. Hinners, owner of Lakeside Trailer Park, regarding a drainage culvert at the southwest corner of Gulf-to-Bay Boulevard and Belcher Road. He reported that Mr. Hinners would like to have the drainage ditch enlarged with a drag line. Mr. Hinners also addressed tho ' ? Commission explaining the situation. By consent, the matter was referred to the ?, City Manager for a report back to the Commission with his recommendation. t The City Attorney read a letter from Mr. A. D. Finch, attorney for dir. Walter T. Janney, requesting that East Turner Street be widened in Pront of his property on the southeast corner of South Fort Harrison Avenue and Turner Street. Commissioner Grown suggested that the City Manager contact hir. R. M. Mauney, owner of the property on the northeast corner, to see it he would be agreeable to the improvements. Commissioner Crown moved that the matter be referred to the City Manager for recommendation and that he be authorized to proceed to put into effect this isprove- ` went if an official public hearing is not required, and that he obtain per®ission to proceed from the affected property owners in writing. Motion was seconded by _? Commissioner Strang and carried unanimously. `° `?? The City Attorney read the application of Mr. J. H. Blackburn for three more taxi permits and the application of Mr. William L. Ward for two more taxi permits. Mr. A. D. Finch addr®ssed the Commission on behalf of his client, Hr. J. H. Blackburn. Mr. Owen S. Allbritton addressed the Commission for his client, Mr. William L. Ward. Mr. Ben Krentsman spoke for his client, Mr. George Waxe, owner of Ware Taxi Company. After listening to the discussion, Mayor Brown Pelt that no new evidence of need had been presented and recommended that the parmita be denied. Commissioner Bates ?'` stated that he thought the report that the taxi service was unsatisfactory should come from hotel managers or restaurant owners, not from the owners of the taxicabs. He said that he would be willing to reconsider the matter at any time in view of `_ ."} `; public necessity, and if more cabs were needed, to act in whatever manner is ?<<?' :w necessary to put more cabs on the street. The other Commissioners concurred xith 'S' this statement. Commissioner Bates moved that the permits be denied. Motion was `?? seconded by Commissioner Strang and carried unanimously. '? ? Commissioner Russell suggggested that the taxicab ordinance be amended concerning '? ? the taxicab permits so that if a permit fa not used for a taxicab within aS.x months ? ? ,? that the permit can be revoked. By consent, the Citp Attorney was instructed to draM an amendment to the Ordinance to that effect and bring it to the next meeting. ` ? ?;; ??t?` The City Attorney read a letter addressed to the Commission by the Secretary ?k,yY4°}," of the Employeest Committee expressing the appreciation of the City Employeoa for ty 't?=i"'?`? ? ,, the salary raise received December 1 1952. Commissioner Russell moved that the suit of the City of Clearwater versus Pinellas County be dismissed. Motion was seconded by Commissioner Crown and carried unanimously. The City Attorney reported that he had received information that the suit against the City by the Clearwater Beach Hotel will be dismissed because Mr. Pauchey, Jr., reported that the Commission is cooperating to reduce the size of the pumping station. f,=? ?;. _ "'? "?' -3- CITY COM?SISSION MEETING January 19, 195 for filling in of submerged land ad oining their property on the bay front between Fierce and Haven Streets until the ?ity can establish its rights in controlling the development of submerged lands. The Mayor recommended that action be taken on this request of the Clearwater Beach Association and that an immediate request be sent to the Army Engineers asking that no approval be given to the Bay Haven protect until the City has a chance to adopt a definite policy. The City Attorney reported that the Engineering Department is working on the map which will show ownership of eub- merged property in Clearwater Bap and that it will be ready in the near future. The Clerk reported that Q map had been furnished to the State 1?aad Agent ar?d also a list of sections, townships and ranges to identify the location of the submerged land in which the Commission is interested. Commissioner Russell moved that the letters from the North Shore Association, the Edgewater Drive Association the Chamber of Commerce, the Clearwater Beach Association and the Clearwater ?esort Association be acknowledged and that a letter be written on the one specific request (to the Army Engineers regarding the Bay Haven project). Motion was seconded by Commissioner Crown and carried unanimously. The Mayor suggested that the City Manager see that the letter is sent out in the proper form. The City Attorney read a letter from the Board of County Commissioners which expressed regrets that the request for improvement to State Road 590 between Clearwater and Safety Harbor had not been approved by the State Road Department and stating that Mr. Peterson, Director of Public Works, would resubmit the request at the proper tim®. A letter from the State Road Department to the County explaining that the request was refused because of lack of funds was also read. The Mayor suggested that the City Manager be instructed to follow through on this pro,?ect with Mr. Peterson as this road was an extension of Drew Street and the improvement was badly needed. Regarding the proposed addition to F. W. Woolworth Company with reference to the adjacent alley, the City Attorney requested that the matter be postponed until all of the affected property owners could be present. By consent, the matter waa deferred. A letter was read by the City Attorney from Mr. Sinclair Wells, State Land Agent, acknowledging receipt of the Resolution from the City of Clearwater which requested notice of applications dealing with submerged areas inside the City limits, and indicating that his Department will comply with the request. Commissioner Russell moved that the letter from the Florida State Land Agent, Sinclair Wells, be accepted. Motion was seconded by Commissioner Strang and carried unanimously. The City Manager reported that some time ago a traffic count was made by the Police Department which indicated the need of a traffic light be installed at that location. Commissioner Russell moved that the traffic light at the intersection of Palmetto and Betty Dane be installed and that warning signs be placed 500 feet to the north and south of the intersection. Motion was seconded by Commissioner Crown and carried unanimously, The City Manager requested the Commission's approval of a wortc order for ?7?5.00 _ to cover the cost of a body and hoist for the new trash truck for the Public Service Department. Commissioner Russell moved that the work order to cover the trash truck's body and hoist be approved. Motion was seconded by Commissioner Crown and carried unanimously. N1r. Donald Alvord presented a plat of Units 6 and 9 of Skycrest for the Conm?ission's approval. Commissioner Crown moved that the plat on Units ? and 9 of Skycrest be approved subject to the Engineer's recommendation as to curbing. This request was made for the following fire reasons. 1. It will seriously interfere with all fishing xhich ie an asset to all of the tourists. 2. IL will oreate serious traffic congestion on the Causeway, which is now already overloaded. 3. It cannot help but tend toward stagnant water conditions of some nature, which could be generally offensive and unsanitary. Ir. Motion was seconded by Cammissicaner Strang and carried unanimousigra Mr. William Wightman, reprssentin� himself and Mr. John Rowe as own�rs oi the Clearwater Transit Campany, reported to the �ommission that iox� the past year the company had an operating loss of �6,300.00, and that they did not ieel that thep cou2d operat� an Esst Clearws:.er bus also at a loss. However� he requss�ed tbe approval of the Commissidn to allow the Cleaz•water Traneit Company to make a working arrangemant ar a sutrlease vtith the Inai.ar� Rocks Transit Company for apera�ing a bus service to east Clearwater. He reported �ha� this companp wauld oifer a service og nin� s°ound trips a day with a charge o� fifteen cents �vr oa� wap. Mr. M. B. Tteayer addressed the Commission regarding this matter. The City Atto;rney read a letter from the Board oi County Commissioners which expressecl xegrat� �that the request for� improvement �o State Raad 590 betwesn Cl�arwater and Saf�atq Harbor ha3 not been approved by the State Road Department and gtating that Mr. P�aterson, Director of Public Works, would resubmit the request a� the proper time, ,A Iatter from the State Road Department to the Countp explaining that the request w:�s reiused because of lack oi funds was also read. Woolworth Gompany with reference to the adjacent alley, tha City Attorney requestsd that the matter be postponed until all of the affectect property owners could be present. By consent, the matter was deferred.
