Commissioner Ly~n reported for the Co~nittee investigatins the no parking
restriction on the e~st side of South Fort Harrison from Park to Clevel~nd and
the west side of Korth Fort HRrrison from Cleveland to Laura) stating that after
observation on the street vlith the Police Chief it is recommended that the area
be lined out a little better, 3nd th~t the no parking restriction be continued
except between 6:00 P.M. and $:00 A.M. Co~~issioner Crown moved that the

a violation of Ordinance 592. Commissioner Lynn moved that the re~uest be denied

The City MRna~Ar reported that the Zonin~ Board recommended that the request
of Casity Fuel Oil Comp8ny to erect a service station on Lots 18, 19, 20, 21 and 22,
Block B, Hibiscus GHrdens Subdivi~ion, he granted. He stated the City Engineer
found a fe\-, small items whIch should be chaneed 3.nd that the City Attorney had
given it his approval. Commissioner Crown m~ed that the recommendation of the
Zoning 1308rd be approved subject to meetin,::; the re'1uired specifications of the

largely because of the City's rre5ent w~~e scale. He therefore recommended with
thH a/~reement of the City Fin8.r:(~e :Jp.Flrtrn~'mt. t.hat the COlnm:ission consider a 10%
increase for the City employees, sffective December" lst. Co~missioner Lynn moved
the approval of the City ~an~g~r's rRco:~endation of the 10% raise for permanent
employees only. Motion was seconded by Commissioner Russell and carried unQnimously.
Due to the increased amount of work performed by the City Attorney and the
City Prosecutor, the C:i.ty Mana~er recolnmenderl that the City Attorney's salary be
increased to ~',5,500.00 a year and th'.lt the Cit~f Prosecutor's salary be increased
to $1~5. 00 a month. Commis~ion~r Crovrn moved th~t the City l'!anar.;er' s recommendation
with respect to the Legal ~epartment, eff~ctjve December 1st, to increase the annual
sal~ry of the City Attorrey to $5,500.00 ~nd the monthly salary of the City

The City Manager requested the approval of transferring the lease of Al Ro~ers
Real Estate Agency in the Marina Building from Room 6 to Room 8 at an increase in
rental of $65.00 to $120.00. Commissioner Blanton moved that the re~uest be granted

The City Manager reported that he had an application from Mr. William Lemke
to lease the Marina spRce formerly used by the Dockmaster as a temrorary office to
operate a yacht brokerage office and headquarters for electronic repairs covering
instruments on boats and marine navigation. The City Attorney called the Commission~s
attention to the fact that Mr. Oscar Hendrick had asked for an opportunity to sell
small boats in the lease for the Small Boat M3r1na which lease has not yet been
signed by Mr. Hendrick. Commissioner Blanton moved that this matter be deferred
until it is cleared with Mr. Hendrick and ascertain definitely as to whether or not
in; any way this would conflict ~~th the Cityfs contract with Mr. Hendrick. Motion
was seconded by Commissioner Lynn ~nd carried unanimously. The Mayor suggested
that the Attorney and the City L'''anager work out this problem with r.~r. Hendrick and
bring back a report to the G~mmission.

The City ~anager reported the plans he had worked out with the Police
Department and the Traffic Department to imrrove the City parking lot on North
Osceola Avonue which would include addjn~ another driveway at the south end; a
sidewalk down the north and south side and across the west side giving an entrance
to the City park without walking throue;h the parking lotj two sidewalks in the
middle of the lot rl\nnin~ north ~nd south for parkin~ meters, leaving on the south
~i(le of the property 110 foot front~ge on Osceola for future use. He stated tha~
the entire surfRce would be pav8d Rnd wouln accommodate 113 cars. Some changes
were sug~ested by the Con~issioners Rnd were noted by the City Manager. Approxi-

The City Attorney reported thrtt representatives of the Clearwater Federation
of Civic Clubs had objected recently to holdin~ the special election on the amend-
ment to the Zonine Ordinance at the re~u1ar municipal election. He inquired for
instructions from the Conlmi.ssion :'15 t.o whether to pl~ocecd \."ith plans to vote on
the zoning amendment on Decemher 16th. By consent, the matter was deferred to the
meeting of December 8th.
Commi.ssi oner Blanton;) sked for a report from t,he City Attorney concerning
the motion asking hi~ to take proceedin~5 to obtain a refund of' Dr. Black's fee
for thf~ \...ater survey. The City P'.ttorPoey repOl~ted th8t he hAS been preparing the
injunction to stop the County from dril1in5 a well in the Mecca area or the
Coachman Hi~h area; that thf1 m::1tter of whether or not these areas coincide and
whether or not the City is actUAlly h~rmed will be liti~gted in that injunctionj
that it is a necessary precedent to the recovery of the money from Dr. Black that
the question as to whether or not the City is harmed is first decidedj then the
Commission would know whether or Poot the City could recover the money. He stated
he intended to Apply for a temporary injunctjon to stop the County from drilling
the well imm0diately. 9y consent, the City Attorney was instructed to go ahead
with the injunction proc'~edings.

due to it being used for our Underrriv81e~e Child work, with no profit to our club.
The chairman of the committee ~t thqt time, h~lS since been confined more or
less to his home due to illness, and we do not wish to burden him with any other
work on this project.
This week we reei8ved a letter Prom Morrison PeArce Clerk of the Circuit Court
that someone had left the 1950 Citv of Clearweter tax sale certificate (isRued for
unpaid 1949 Cit.y taxes) 'Nith his office foT' an a.rpli c'ltion for Tax Deed on said
lot, and that \'J8 would need to send :t '~heck for ~6.11 before ~!ov. 30th or other
costs would run it up about ~15.CO; in order to save this we immediately paid that
amount, but in doing so we re0uested informRtion on any other taxes we mi~ht owe,

exact datA of the original lease, but I think it was 'entereci into around 1g32.
Gansequentl.y the buildinjs are now some t�aenty ,years old and of Gourse they are
so�ejvhat obsolete and o�z� of date, �articularly when compared ta the many modern ,
, structures �hat have been erected 3t the beach in recer.t years. For this reasan '

demaZi.slied by the City tahen the Fresant lease expires an Januar� 15th� 1.955. In
fact, it is my belief that more than one Gity official has made the st3tement tha't
tha City intended ta demolish these buildings and make othex use of th,e �roper�y
�ust as soor_ as the present le�se expirss. Ar.d this would cer�ainly be a loFical
posit�on for the Cit;F to take hecause of the iact that �Ghese particular buildings
are out of kes�in� urith other nezr structures in the vicinity. ' '

Faraoraph 5 of the Ze�se cont�ins a provision by which the Ci�ty can ca�cel ,
�he lease at ar.y �ime th3t the CityY wants �his property for municipal purposes,
in tYY11CY1 case the City shall reimb�.xrse the lessees for the value of the improvemer.ts '
on �he grogerty. This clause provides that the buildiiigs were worth $�20,000.00 as
' ef the date of the lease, and a depreciatior schedule of three per cent per year '
is set up. On that ba�.is the buildin�s have now depreciated to the am6unt of
�7,$00.00, leaving a re�naining value of �12,200.�0. If the Ci�y re�lly rrants to
_ take this gr�rerty over for soMe other us�, then I suggest that th� CitST pay the '
Bern�r estate the sum o� �12,200.Q0 in accordan;ce with para�r2.ph 5 of �he 1;ease, _
and in th�� event I will have the Rerner estate vac�.te the pra;,e�ty immed9�tely.
