he had not been able to clnalyze them prior to the meeting.Comm,issioner Blanton
said this itern had been given ample consideration at a pI'evious meeting,that the
Commission had reached a decision at that till:e and he could see no velid reason
for are-consideration. GOffiIllissioner Blanton moved thut if this item is on the
agenda for this meeting that it be stricken from the agenda.Commissioner Crown
seconded Ccmmissioner Blanton's motion with tthe provision that if it is
stricken from this evenings agenda,that it be placed on the agenda for next

motion had been duly made and seconded and called for the question .The vote
being taken, the motion was carried unanimously.
The City Attorney presented a rc-draft of Ordin~nce No.619,relutive to underground
storage t unks for petroleum products , containing the amendreents as s ugcested at
the last Commission meeting. He stated that the Ordinance as re-drefted did not
limit the number of pumps at filling stations but would limit the total storage
capacity to three tnousand(3000) gallons for gasoline and/or other combustible
petroleum products. The Ordinance \'ionld reg uire inspection by the City Building
Inspector of the underground storage taill~s prioI' to their beinr covcred.Mr Thomas
II.Black addressed the Co.mmiss ion s tatin,c;: that the effect of th is Ordinance Viould
retard the development of the city, the building of nevI service stations,and
the remOdeling of old service stations.Mr _-ld.Gullis adressed the Commission
statine that the Ordinance vwuld. result in giving permanent francIJise to the
major oil companies and be discriminatory against the independent operators.
After further discussion by the GoLIllllission,Comrnissioner Crown moved that Ordinance
No.619 be tabled inuefinitely.rV:otion. was seconded by Commissioner Russell and
carried unanimously.

lvlexico .The City Attorney read Ordinance No .623 in full. Commissioner Blanton moved
that Ordinance No.623 be passed and ado1>ted on its first l'eading.~.lotion was
seconded by Commissioner Crown and carried unanimously.
Cownissioner Russell moved that Ordinance No.623 be considered on its
second reading by title only.Motion was seconded by Goamlissioner Crown and
carried unanimously. The City Attorney read Ordinance No.623 by title only.
Commissioner Crown moved that Ordinance No.623 be passed and adopted on its
second reading bJ title only.Motion was seconded by Commissioner Russell and
carried unanimously.

The City i~ttoI'ney presented a Resolution assessing the cost of the sidewalk
improvements on Seminole Street ~rom Jefferson Ave to Pennsylvania Avenue and on
Greenwood. Avenue:'from. . --'PalmettoStl'eet to:. Drew Street,against the abutting and
benefitted pxoperties. The City Attorney stated that a large portion of the
properties assessed is City-owned property. Comnissioner Blanton stated that
the building of this sidewalk was fulfillment of the pledge of the City to do
something to eliminate some of the traffic hazaxds o~ school children out in the
area where they were haVing to walk in the streets because of there being no
sidewalks. Co~nissioner Lynn moved that the Resolution be adopt~d. Motion was
seconded by Commissioner Blanton and carried unanimously.
By consent, the City Manager was lns1:ruc.ted to investigate the need for
additional sidewalk on Se.nllnole street between Pennsylvalda Avenue and Fort
... ,,' H~rrison Avenue and report back to the Commission.

'rile City Engineer presented plats of BAY TERRACE fI- 2 and BAY TERRACE /)3 located
South of the City limits and East of I3roadway,which plats are replo.ts of certain
lots in BAY TEHRACE SUBDIVIfJION.The Mayor inquired if it would not be necessal'Y
to vacate the prior plat before this plat could be upproved. It was sug~ested
that this mieJ,1t have been taken cure of by stating in the title description that
this is a replat. Aftor further discussioi. by the COIlllllission,Cornmissioner 131anton
moved that this matter be refeI'red to the City Attorney and City Manager to
investigate and report back to the Con~ission at the next meetinB. Motion was

Relative to the openin~ of Pierce street, the ~"yor stated that in
connection with the agreement between the City and the Coachman Estate,of which
Mr.II .Lane Coacluuan is the Executor ,1'01' the 0 penillG of Court Street, the Coachman
Estate had deeded to the city the right-of-way for pierce street bet'tJeen Prospect
Avenue and Greenwood Avenue,the agreement requiring that the City install paving,
curb and gutter 'wi thin fifteen months 1'rom June 21.1951. rrhe City Engineer
stated that the project would involve excavating 2880 cubic yards of muck and
peat,5340 yards of fill dirt,1600 lineal feat of curb ,2700 square yurds of paving,
and estimated the total cost of the project at approximately $14.000;00.
The City EnGineer also stl:ited that the future opening and ill:provement of that block
of Pierce street between 1>rospect 1'..ven_le and Myrtle ...venue would cost approximately
$3663.00 . After further discussion by the Commission, the matter was deferred by
consent until a later date.

!t was suggested that the City 1:anager enue~vor to sell the muck excavated fl'om the
Pierce street right-of-way.
The City Clerk read a letter from ~.D.Owens and Associates requesting that the
City convey to them by quit-clainl deed the East. 10 feet of the North 48.08 feet
of lot 54, of BAYSIDE SUBDIVISION,which they had'.dedicated as a portion of Hamilton
Drive.The letter stated that this oarticular ten feet would not be needed for street
purposes since Hamilton Drive is only fiftY(50) feet wide North fjf this section
and sixty(60) feet ~ide South of this section.Following discussion by the Cb~ission
the matter was referred to the City I.iam gel' for fUl'ther study and rec,stomendation
by consent of the COIilmission.
In regard to the Sanitary Sewer project in the Poinsettia street area,the
Ci ty Manager stated that the City is in the position to start worle on this drainage
area. It is the continuation of the ~anitary Sewer on Poinsettia street,North to
Papaya stl'eet, and North on East Shore Drive to Papaya street. Commissioner Lynn
moved that the City Manager and tIle City EnGineer advertise for bids for this
project and proceed with the job,subject to the City Attorney's findings as to
whether or not the Public Hearing already held for this project is valid.Motion
was seconded by Commissioner Blanton and carried unanirnously.

Bids having been tabulated for the ohlorine used at the Disposal Plant
,the City Manager rec~omended the bid of Tesco Chemical Company of Atlanta,Georgia,
be accepted. Commissioner Lynn moved that the City Manager's rec~omendation be
accepted , and that he be authorized to enter into EJ.':contract with Tesco Chemical
Company of Atlanta, Ge.orgia to l' urnish the City wi th the necessary chlorine for the
Disposal Plant in lots of eight(S) cylinders at seven and one-half (7!) cents per
potind ,Motion was seconded by Commissioner Crovm and carl'iea unanimously.

The City Manager presented a contract from the Gulf Oil Company to
furnish enrichment oil for the Gas Plant.Commissioner nussell moved that the
contract with the Gulf Oil Co~pany be accepted and that the proper officials be
authorized to execute said contract. Motion was seconded by Cornmissioner Crown
and carried unanimously.
The Corruuission considered offers from ~r.D.E.Lame and 1~.Robert J.
Clark to purchase 230 feet of city-owned property at th~ corner of Seminole
street and GreenvJOod Avenue. 'llhe City Uanuser stated that iI~r .Lame would need at
least 265 feet on the South side of Seminole street in order to take cal'e of his
proposed building. It \';a s the opinion of the members of the Commission that the
amount offered vms not sufficient but that it was desirable to h~ve these new
industries located in Cleurwater. The City Manager also stated that both firms
plan to locate in Tampa if they were unable to secure a proper location in
Clearwater. ~ollowing the discussion by the Con~ission,the matter was referred to
the City Manager for further negotiations .
The Oi ty Manager announced that two bids had_ been received for tires,
tubes and retreads for the municipal fleet for the period from June ~6th.1952
to June l5th.1953,from the Gulf Oil Corporation of Clearwater and the Goodyear
Service Con~any.The City Manager stated the bids were not dollar and cent bids
but the best bid would be the one that would provided the greatest amount of discount
for the greater length of time.The bias v;ould be calculated by the Purchasing
Department and be returned to the Cownission for their consideration.Commissioner
Lynn moved that the bids be referred to the City l~anager for tabulation and l'eport
back to the Commission at the next meeting.I\Iotion was secortded by pommissioner Crown
and carried unanimously.
The Mayor read a letter from the Lions Club requesting the closing of Crest
Lake from June l6th.1952 Until 8;00 A.M. Saturday morning ,June 28,1952,so that
preparations can be made for the Second Annual Crest Lake Fishing Jamboree,sponsored
by the Lions Club.Commissioner Lynn moved that the request of the Lions aLub be
granted tOl' the pel'iod of time they desil'e, Motion was seconded by Commissioner Crown
and carried unanimously.
The City Manager presented to the Commission a Certificate of Merit issued by
the estate Board of Health to the Clearwater Sewage Disposal Plant in recognition of
the effioient manner in which the plant is operated. On behalf of the Commission '
the CitYeClerk was instructed to prepare a letter of commendation to Mr.D.J$Rape
.Superintendent of the Disposal Plant.

and docking space efthelJ.' to oommercial craft Clt' pleasure craft; provided,
however,that one-third of stiid boat slips and docking space is hereby set aside
and reserved for cOlnmercial craft,and two-thirds of the said boat slips and
dooking space are hereby reserved for pleasure craft; and further provided,that
the City Manager or his represenative shall rent the portion of said boat slips
and docking space set aside for commercial craft only to the type of oommercial
craft known and operated as "open party boats","charter boats" and small boats
" for hire" ;provided,however, that only month -to month tenancy shall be oreated
hereunder.

SECTION II.No person shall dock a boat o;f any kind or nature at the aforesaid
boat sli~.~ docking spaces for a period longer than four(4)hours without first
obtaining ~p~fmission from the City Manuger or his represeditive ;and without
first having paid the City Man~ger or his represe~tive the rental for the use of
said boat slips or docking spaces.
SECTION III. No motor vehicle shall be allowed on the said docks at any time.
SECTION IV. Any person who shall violate any of the prOVisions of this
Ordinance shall upon conviction thereof,be punished as provided bYl Section 8 of
Chapter I of"'!'he Code of the City of Clearwater ,]1 orida ,1950" .
SECTION V. Chapter V of "The Code of the City of Clearwater,E.orida,1950".,and
all other Ordinances o~ parts of Ordinances in conflict herewith are hereby
repealed.

OF CLEARWATER BAY AND THE GULF OF MEXICO ;PROVIDING FOR THE

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER ,FLORIDA:
SECTION I. No person shall ope~qte a boat or' allow a boat to
be operated in those portions of Clearwater Bay and the G~lf of Mexioo adjaoent
or near publio,oommeroial,yaoht or boating club docks or anohorag~8,or pUblio
property at a speed greater thun the maximum speed designated for the area by
the Harbormaster of the City of Clearwater,Florida.
SECTION II. The Harbormaster for the City of Clearwater,E.orida
shall designate appropriate areas in the waters of Clearwater Bay and the Gulf
of Mexioo in which areas it is reasonable and apprppriate that the speed of
boats~ be controlled.The Harbormaster for the City of Clearwater,Elorida,shall
establish the speed limit for boats operated within such areas,and the said
Harbormaster shall post or cause to be posted in said areas the speed limit .
established for each of said areas.
SECTION III. Any persons who shall violate any of the provisions
of this Ordinance shall upon conviction thereof,be punished as provided in
Section 8 of Chapter I of "The Code of the City of Clearwater,]1orida,l950".
SECTION IV. Each word,phrase,sentence or section of this Ordinance
shall be severable, and the invalidity of any word,phrase ,sentence or Section
shall in no way or gegree impair any other part or parts hereof.
SECTION V. All other Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.

WHEREAS,After Public Hearing on November 19th,A.D.195l,The City Commission
of the City of Clearwater,Florida,determined that certain work and improvements
hereinafter described should be done and made,and
'tlHEHEAS ,pursuant thereto said intprovement s have been made as follows:
Construct a five foot concrete sidewalk,4 inohes thiok
on the South side of Seminole street ,from the Wes~ 6uxb
line of Jefferson Avenue to the East ourb line ot
pennsylvania Avenue.
Construct a five foot concrete sidewalk ,4 inches thick on
the East side of Green~ood Avenue from the South curb line
of Palmetto Street to the NOrth ourb line of Dre~ street.
\1HEREAS, .under the provisions of Section 123 and other pertinent provisions
of the City Charter ,after said improvements shall have been completed,the
City Commission shall assess the cost thereof against the properties especially
benefited t.hereby"and abutting upon or 10ca ted in the immedia te vioinity of the
aforesaid improvements,and
WHEf{EAS,certain parcels of real estate abutting or located in the ~ediate
vicinity of said improvements have been benefited by said improvements and the
pro-rata cost thereof shall be assessed against said paroels.
NOW,THEREFOHE ,BE IT RESOLVED by the City Commission of the City of Clearwater,
Florida ,in session duly and reguflarly assembled as follows:
l.That the above described ~provements on Seminole street ~rom
Jefferson Avenue] ~to Pennsylvania A venue and on Greenwood Avenue from Palmetto
street to Drew Street be and the same are hereby accepted and approved as having
been completed.
2.That the following described properties benefiting from said side-
walk improvements are hexeby deemed to have been benefited by said improvements
in the following proportions of the cost thereof and the same are hereby assessed
in aocordance with the following schedule.

connection with the agreement between the City and the Coachman Estnte,o�' which

In regard to the Sanitary Setver projec� in the Poinsettia Street area,the
Cit3� r�enager stated tlia� the City is in the position to start �vorlc on tllis c�aina�e
area. It is the continuation o�' the Sanitary Se��ver on Poinsettia Street,�iorth to
Papaya S�reet, and North on"�ast Shore Driye to Papaya Street. Commissioner Lynn
�oved that the City hianager and tue City Engineer advertise Yor bids for this
�roject and proceed with the job,subject to the Ci-�y Attorney�s iinclings as to
whether or not the Public Hearing already held for this project is valid.Motion

Bids having been tabulated for the �hlorine used at the Disposal Plant
,the City �Tanager rec�omended the bid oi' Teseo Chemical Company of Atlanta,Georgia,
