Hall, Monday, February 1$, 1952, at 7:30 P.M. with the following members present.

It was moved by Commissioner Russell that the minutes of the regular meeting of
February 4th be approved in accordance with the copies furnished each member in writing
and that their reading be dispensed ",d. tho The motion was seconded by Commissioner
Lynn and carried.
The Mayor announced that the Commission had planned to have a special meeting
for the purpose of appointing a fifth Commissioner. He said it was going to be diffi-
cult to find a man to replace Mr. Blanton and he would su~gest that the Commission
ask Mr. Blanton to reconsider his resignation and serve the balance of his elected
term. He believed Mr. Blanton mi~ht do so if the request was made by the unanimous
action of the Commission. Commissioner Lynn moved that Mr. Blanton be appointed by
this Commission to serve the balance of his elected term, that he be instructed that
this Commission will give him an opfortunity to accept or reject this appointment by
noon tomorrow. The motion was seconded by Commissioner Crown and carried unanimously.
Commis.3ioner Lynn sug.'?-;ested that the iviayor appoint a Committee to call on Mr. Blanton
tomorrow. The Mayor sugq;ested that the entire Commission call.on Mr. Blanton.
The City Manager reported that eight bids had been submitted for construction of
the M3rina Building and the eight bids were opened as follows:

Commissioner Lynn moved that the bids be tabulated and referred to the City Manager,
the City Engineer and the Architect, a report to be made to the Commission at a later
meeting, and the Commission investigate the possibility of a change in plans to effect
a savings. The motion was seconded by Commissione~and unanimously carried.
Crown
The Mayor said the Commission should not lose sight of the plan to include a
pier in the r,larina project; a larp,e numher of the citizens wanted and expected to
have a pier included. Mr. R. Wendell Spragins of R. W. Spragins & Co., Memphis,
Tennessee, financial agents for the City, said his company was committed to the
bondholders on the pier and he requested that a pier be included in the final plans.
The City Clerk read letters from Granville Hamner and from Frank H. Latimer,
setting forth proposals by those gentlemen to erect and lease buildings on the Marina
property. The letters are set forth in the following pages of these minutes and made
a part thereof. By consent, the City Mana~er was instructed to contact these gentlemen
relative to their proposals, and it was agreed that the Commission would meet Thursday
noon, February 21st, to discuss the matter.
The Mayor announced a public hearin~ with reference to improvements on Baymont
Street, Papaya Street and Gulfview Boulevard. The Clerk reported that the public
hearing had been advertised as required, and the City Engineer reported that each
interested property holder had been advised by mail of the hearing. The City Engineer
stated it was intended to assess the paving on a front foot basis and drainage on an
area basis. Mr. Guss Wilder addressed the Commission, stating that the area had been
surveyed at least three times and none of the surveys agreed as to the real location
of Papaya Street, that this is an oversize section and the real location of the right-
of-way is actually twenty feet south of the location where the City proposes to install
a curb. He stated that he had entered into a compromise agreement with the City,
recorded in Deed Book 1189, Page 405, Au~ust 17, 1945, and had moved some buildings
from the area the City contends is a ri~ht-of-way; however, the agreernent stipulates
that if any other litigant should establish the right-of-way as being at the point
he (Mr. Wilder) claims it is, then he would fall heir to the right-of-way the City now
proposes to use. I:~. Wilder was asked by the Mayor as to how long the present right-
of-way had been in use as a thoroughfare. Mr. Wilder replied, "More than seven years,
if that is what you are driving attt. Mr. Wilder said he felt it was necessary to
protest at this time to protect his interests. Mr. Ralph W. Carson informed the
Commission that neither ~~. John S. Taylor, Jr., or Mr. R. D. Witter had any objections
to the proposed project. Mrs. A. D. Tanner inquired as to whether or not it would be
possible to use the existing curb in front of her property and if they would be reim-
bursed for the use of the old curb. The City Engineer stated that the use of the
present curb would not be practical. Mr. Louis Perroni suggested that all the
Australian pines along the street be removed. The City Engineer estimated the total
cost of the project at $11,120.76 or $3.038 per front foot for paving and $.029 par

The City Attorney presented a Resolution which would assess the cost of Marianne
Street drainage against the benef'ited properties. On a motion by Commi.ssioner LYt:ln
which was seconded by Commissioner Russell and unanimously carried, the Resolution
was adopted.

'fhe Clerk read a communication addressed to the Zoninp,; Board by Mrs. Florence
Barras in which Mrs. Barras requested that she be granted an exception under the
hardshir clause of the Zonin~ Act to perrnit her to convert her residence at 1611
Sunset Drive into two apRrtmunts. The Clerk also read the Zoning Board's recommenda-
t ion that I~lrs. Barras' request be denied. It \\Tas moved by Cornmissi oner Crown that
the Zoning Board's recommendation be arproved and the request be denied. The tnotion
was seconded by Conwlissioner Lynn and carried unanimously.
A communication was read by the Clerk which was addressed to the Zoning Board
by Dr. P. H. Guinand in which Dr. Guinond requested an exception to the Zoning Act
to permit him to erect a clinic and office buildin~ on the north l05 feet of the west
90 feet of the east 120 feet of the northeast quarter of the southeast quarter of the
northeast quarter, Section 15, Township 29 South, Range 15 East. The Clerk also read
the Zoning Board's recommendation that the exception be granted. Commissioner Crown
moved that the action of the Zonin~ Board relative to Dr. Guinand's request be ratified
and the request be granted. The motion was seconded by Commissioner Lynn and carried
unanimously.
The City Clerk read a letter from Florida Acres, Inc., signed by John M. Weis in
which it was stated that the company would appreciate the Commission's consideration
and suggestions for relief of a drainage problem which exists in the Druid Heights
Subdivision. The City Engineer reported that he thou~ht the drainage problem could
be handled nicely by the instal18tion of a curb on Turner Street between Hillcrest
Avenue and Evergreen Avenue. The Mayor raised the point of securing easements from
Evergreen Avenue to the natural drainage basin of Stevenson Creek. Discussion brought
out the fact that the Florida Acres, Inc., own 50% of the property alon~ the street
and that their request could be used as a basis for advertising a public hearing.
COlllmissioner Lynn moved that the City iJlanager and City EnB:ineer be authorized to
advertise for a Public Hearin~ on the drainage in Druid Hei~hts Subdivision and bring
back their report of estim~ted cost of the project all at one time. Motion was
seconded by Commissioner Crown and unanimously carried.
Regarding the bids for sewer pumps for the Clearwater Beach pumping station,
the City Manager stated that he had examined the bids and found that the $5,060.00
bid had covered two pumps, switches and motors, complete, and that the other bid
covered one pump only. It was his recommendation that one pump on the $5,060.00 bid
or $2,530.00 for one pump, motor and accessories be accepted. He requested that a
work order for hh~ project in the amount of t4,702.50 for the complete job, including
installation, be approved. Commissioner Lynn moved that the City Manager's recommenda-
tion be approved and money for a work order in the amount of $4,702.50 be authorized.
Motion was seconded by Commissioner Russell and carried unanimously.
The City Manager reported relative to the water main extension on North Betty
Lane that the subdivision developers will finance the entire line from the City mains
through the subdivision. This will be handled on the City's usual ITiain extension
agreement whereby a refund of $75.00 is made for each new tap. Commissioner Lynn
moved that the water Inain on North Betty Lane be installed at the developers' expense.
Motion was seconded by Commissioner Crown and carried unanimously.
The City Manager requested the authorization to expend $1,500.00 to complete the
sand wall project on Clearwater Beach, this amount to include painting. The wall
would be extended 250 feet from the present north end and 250 feet from the south end.
Commissioner Lynn moved that the City :Manager' s reC],uest be granted to complete the
sand wall on Clearwater Beach. Motion was seconded by COfi@issioner Russell and carried
unanimously.

The City Clerk read a letter addressed to the Commission by rJIr. William J.
Castagna in which he tendered his resignation as Municipal Judge due to his becoming
a candidate for State Representative. Commissioner Lynn moved that the resignation
be accepted with regret. Motion was seconded by Commissioner Crown and carried
unanimously. It was agreed that the new City Judge would be appointed after the
appointment of the fifth member of the Commission.
The City Manager requested the approval of the purchase of twenty-five cocoanut
palms at $5.00 per palm. He stated that the cost of planting would amount to approxi-
mately $3.00 a tree. Commissioner Lynn moved that the City Manager's request be
approved. Motion was seconded by Commissioner Russell and carried unanimously.
Subsequent to the motion, it was determined that the expense should be charged
against the Park Improvement Fund, and it was suggested that the number of palms
purchased be increased to ~ifty.
The City Clerk read a letter addressed to the Chief of Police by Lester W.
MelChert, Sheriff of' Carver County, Minnesota, and one written by Charles E. Houston,
Assistant Attorney General, State of Minnesota, in which they commended Captain Donald
Genung and Patrolman Robert Clark of the Clearwater Police Departlnent for the efficient
manner in which they had handled the arrest and questioning of Robert F. Pett, charged
with murder.

Brookside Subdivision, by Allen K. Henry, Sanitary Engineer of the County 'Health
DepRrtment in which l~r. Henry pointed out that the use of septic tanks in this
8ubdivision would not bo satisfactory. By unanimous consent,' consideration of

the seauriug of tho roquired number or signatures. After considerable discussion,
OOlnmisl:lionar HUBllell moved that the Commi ssion give Mr. Meyer until April lst to
vacate. The lIlotion WlH:J seconded by Commissioner Crown. Commissioner Lynn stated
that it was his understanding that any matter not on the agenda could not be .
presented to tho Comrnission without unanimous consent, that he objected to a discussion
of the matter and he moved that the meeting be adjourned. The Mayor stated that since .
Oommissioner Lynn hfld not ob,iected at the time the matter was introduced and since a
motion had been made and seconded, he felt it was too late to sustain an objection.
The quostion was called for and upon the vote being taken on Commissioner Russell's
rnotion, the motion carried with Commissioners Russell and Crown voting "Aye" and
Commissioner Lynn voting "No". Attorney Finch requested that the Commission take no
aotion on the matter until a full Commission of five members was present. The Mayor
stated that th~ full Commission was present at that time.
There bein~ no further business to come berore the Commission, the meeting
adjourned at 10:27 P.M.

WHEREAS, after Public Hearing on September 17, A.D. 1951, the City Commission of the
City of Clearwater, Florida, determined that certain work and improvements hereinafter
described should be done and made, and
WHBREAS, pursuant thereto said improvements have been made as follows:
Construct a 21ff storm sewer and appurtenances in Il,larianne Street from Clearwater
Bay, westerly to the east line of r~insettia Ave., a distance of approximately
420 reet, and construct an 18" storm sewer and appurtenances from the east line
of Poinsettia Avenue to the east line of ~andalay Avenue, a distance of approxi-
mately 290' and construct a 12" storm sewer and appurtenances from the east line
of Mandalay Avenue Westerly, a distance of approximately 250' and construct curb
on the east and west side of existing pavement of East Shore Drive from the north
line or M8rianne Street, northerly a distance of approximately 250', and construct
a curb on the east and west side of existing pavement of Poinsettia Avenue, from
the north line of Mariapne Street, northerly a distance of approximately 200',
and construct a curb on the east and west side of existing pavement of Poinsettia
Avenue from the south line of M~~rianne Street, southerly a distance of approxi-
mately 195'.
\'lHEREAS, under the provisions of Section 123 and other pertinent prov~s~ons of the
City Charter, a~ter said improvements shall have been completed, the City Commission
shall assess the cost thereof against the property abutting or adjacent to the said
improvements so made.

WHEREAS, certain parcels of real estate abutting or adjacent to said improvements
have been benefited by said improvements and the prorata cost thereof should be
assessed against said parcels.
NOW THEREFORE BE IT RESOLVED by the City Commission of the City of Clearwater, Florida,

hereby accepted and approved as having been completed.

Dear Sirs:
You have a letter I wrote before. I have a hardship case. When I bought this
house at 1611 Sunset Drive, it was with the intention to convert it into two apartments
but the water leaked in so badly I had to spend about one thousand dollsrs to make it
water tight. The leaks had to be stopped first, or the kitchen would have been
installed. Then, also I did not know anythin~ about your zoning rules. I have been
planning this house to help me out in my older days. I must sell the house if I cannot
derive some income out of it to help me nlon~.

At the regular meeting of the Zonin~ Board held Tuesday evening, February 12, ,
1952, a motion was made and carried that the request of Mrs. Florence Barras to con-
vert her residence 10cRted at 1611 Sunset Drive, (Lot 8, of Gulfview Subdivision)
into two apartments, be denied.
In denying this request, the Board feels that it cannot be granted under the
hardship ruling, due to the fact this area is zoned R-l. That no work was started
prior to enactment of referendum.
Attached herewith is a copy of Mrs. Barras request and a copy of her purchase
contract. Also opinion of City Attorney l/:are.
NOTE: According to records in the Buildin~ Department, no work was started

Gentlemen:
Please consider this letter as my formal request to your Honorable Board and to
the City Commission of the City of Clear\'Tater for permission to forthwith erect on my
real property here in Clearwater, 8S hereinafter briefly described, a building for.
use by myself as my office in the furtherance of my profession as a practicing
physician of this locality. The writer formerly owned approximately ten acres adjoin-
ing the hereinafter described property but reserved this particular lot with the hope
of erecting offices for his use in his profession at a later moment. Subject property
is presently zoned by the city zoning ordinance as "R-2" and it is my understanding
that I should secure perrnission for the proposed building from your Honorable Boerd
and the City Commission prior to the issuance of a building permit.
I hand you herewith a petition which has been signed by persons living and owning
property in the immediate vicinity of this property and proposed construction and I
earnestly request that this board will ~rant my request and submit a favorable
recommendation to the Honorable Members 'of the City Commission.
The real property owned by the undersigned and on which this request is made lies
in the City of Clear\oJater and is briefly described as "That certain tract of land
fronting 105 feet on Hillcrest Drive and bein~ 90 feet in depth, situate in the N. E.
corner of the N. E. k of the S. E. e of the N. E. ~, Section 15, Township 29 South,
Range 15 East.

Gentlemen:
It has been a distinct honor for me to have served the City of Clearwater as
Municipal Judge, however, in view of the nature of Judicial office, and in order to
preserve the hi;.~h degree of dirr,nity attendant the administration of justice in our
Courts, the Code of Ethics to which we of the legal profession have subscribed con-
tains the following provision re~~rding judges, by which my action is governed:
"While holding a Judicial position he should not become an active candidate
either at a party primary or at a ~eneral election for any office other than a judi-
cialoffice."
As you are already aW3re, I have announced my candidacy for the office of State
Representative from Group III, subject to the Democratic primary election. In preparing
to embark upon an active political calnpaign, I do now tender to you herewith my
resignation from th~ off~ce of Munjcipal Judge, effective immediately upon the appoint-

Gentlemen:
During my several visits to the City of Clearwater as a member of the "Fighting
Phillies" baseball team, I have noticed the progress you have made along the water
front, especially the Clearwater M8rina facilities that you have, and wish to compliment
you.
I understand that you are goin~ to open bids for the construction of the main
building in the very near future, and in considering this fact, it seems to me that
there is also a crying need for additional facilities over there that will not be
offered in the new Marina Building. Specifically I have reference to a buildin~ that
will serve the needs of the sports fisherman, regarding both live and fresh bait, and
the care of the sportsmen's fish after they have been taken. I believe that the area
facilities should also include a quick-freeze plant so that the fisherman's fish can
be cleaned and frozen, stored, and/or shipped, as his needs may require. Many of our
sports fishermen would like to have their choice catches mounted. My present plans
would include connections with some of the best taxidermy houses in Florida.
I also feel that the sportsman should have at his disposal, out-board motors, and
row-boats for rent.
To house these facilities, I propose to the City of Clearwater to construct a
building on the Marina property between the west bridge and the Shell Oil property,
witp dimensions to be mutually agreed upon between myself and the City of Clearwater.
Length of said building to ,be approximately 100 ft. and depth to be determined
according to what the best usage of the property would permit.
1 also feel that a salesroom for one of the major boat companies should be
poused herein. In connection with the outside facilities, it is my understanding
that the City of Clearwater intends to build a small boat launching ramp near this
area. Adequate space would be left for this facility, and if at any titne the City
or myself feel that a hoist should also be added, this could be done as the need
would require.
r feel that this idea fits in with the overall picture of the Marina, as it
would take the smelly operation of cleaning and processing the fish out of the main
building, which is a desirabl~ solution to what could be one of your major problems.
I would like to meet with the City COlnmission or their representatives at a very
early date to work out lease provisions and rental rates. I feel sure that we can
work out these terms in a manner suitable to both the City and myself. I think you
will agree with me that it will take a 10 or 15 year lease, with perhaps a renewal.
clause in it for me to safely amortize my investment.
I have noted with keen interest the results of the City's Architect, Walter
Mallorie and Associates, and feel that anyone building a building on city property
adjacent to the Marina, should use the same architect as has been employed by the
City, and I will state at this time that I would gladly consent to do so.
I would like to have this matter brought to a head as quickly as possible due
to the fact that building restrictions are subject to change from time to ti.me, and
costs appear to be rising rather than decreasing. As you mayor may not know, I

will shortly be under contract with the "Phillies", and will be extremely busy in
spring training, and later playin~ rather a close schedule of b~ll during our summer
circuit.
Clearwater has always seemed like a second home to loe, and I intend to retire
here some day, and feel that this would be a good investment for such a purpose.

In regard to the present plans far the new Clearwater Marina, on Clearwater
Beach, I respectfully submit the following proposals for the prompt and I trust the
favorable consideration by your honorable board.
I. To immediately construct a separate building on the Clearwater Marina property
directly to the east of the Shell Oil Company's present ~asoline station. This
property would front on Causeway Blvd. and on the \'Jater, and including the small boat
basin. This lot is the same property 3S the property now bein~ planned for use by
the city as a launchin.~ ramp for the small boat facilities of the Marina.
2. The cost of the building, which will be approximately 30' x 100', and ~Ghe
equipment, would be approximately ,~35, 000. 00. The desi~n and architectural scheme
would conform with all present existing buildings and planned buildings. Actual
plans to be prepared by the present City Architects, "Walter Mallorie & Assoc.", and
final plans to be submitted to the City Commission for their recommendation and
approval.
3. Building will serve all boat, fish, and bait needs of the fishing public in
connection with the new marina. Plans call for providin~ within this one building a
fish market and brokage of fish to northern points, bait facilities, cleaning of fish,
deep freeze facilities for storage, freezin~ and smoking of fish, repair of all types
of outboa.rd motors, fishinr:; tackle and reels etc., v-r.Lth inside storage provided for
small boats and motors.
4-. In connection with the small boats to be rented would be constructed at my
expense a large hoist to lower and raise these boats from the water. These facilities
would be used to put the small bo~ts bein~ rented into the water and these same
facilities would also be made available at my expense, free to any and all persons
driving to the ~Iarina with their own boats, for the purpose of boating or fishing.
This hoist \'{ould be constructed ;.tt my ex['ense snd v;ould eliminate the construction
of the planned ramp by the City and would provide better service than such a ramp.
It has been the experien~c of the boating and fishing public that any ramp takes up
valuable space and can only accomodate a few cars and boats. Most ramps are also so
constructed that not all cars and boats can use them satisfactorily. Therefore,
additional and better service would be provided with this planned hoist, with 'a com-
petent operator avail~ble to take care of this free service.
5. For the privilege of constructin~ the above, I would like a ten year lease
with a renewal option, at a fair monthly rental, the amount to be established by the
City and myself. Also an additional protection of Iny investment in the event this
area would be needed at a later date by the City for "muncipal purposes" or in the
event that my lease should be terminated.
6. My previous experience has been as a tool and die manufacturer, restaurant
operator, manager of a wholesale fish market in Detroit, and at present I own and
operate the Koli-Bree Apartments on Clearwater Beach. I have lived in Clearwater
since 1949 and this will continue t.o be my home and where I will continue to invest
my money because of the wonderful co~nunity which we have and the even greater
community which Clearwater will become.
7. I invite your investigation as to my character, business and financial
background, and would appreciate the opportunity of appearing before your honorable
board personally to discuss the above proposal and answer any questions which you
may have.
8. In conclusion I would like to re-emphasize the desirability of having this
increased investment on your Marina property and the even ~reater desirability of
having the noise of outboard motor repairing and the mess and odor of' freshly caught
and cleaned fish away and separated from the main Marina Building, so that the public
is better served.
Since time is most important I would appreciate your kind and prompt attention
to this matter.

relative to their proposals, and it was agreed that the Commission would meet Thursday
noon, February 2lst, to discuss the matter.

The City Manager reported relative to the water m�in extension on North Betti}r
Lane that the subdivision develapers will finance the entire line from the City mains
through the subdivision. This will be handled on the City's usual main extension
agreement whereby a refund of �a75,00 is made for each new tap. Commissioner Lynn
moved that the water main on North Betty Lane be installcd at the developers� expense. '
NZution was seconded by Commissioner Crown and carried unanimously.
The City Manager requested the authorization to expend �1,500.00 to complete the
_ sand w�.11 project on Glearwater 3each, this amount to include painting, The wall
wo�ld be extended 250 feet from the �resent north end and 250 feet from the south end.
Commissioner Lynn moved that the Ci�y I+'tanagerTs requesi, be granted to complete the
' sand wall on Clearwater Beach. Motion was seconded by Commissioner Russell and earried
unanimously.
The Ci�y Glerk read a letter addressecl to trie Commission by Mr. William J.
aactagna in which he �endered his' resi�nation as Niunicipal Judge due to his becoming
andidate for'State Representative. Commissioner Lynn meved that'the resignation
be accepted with regret. Motion was seconded by Commissioner Crowri and carried
unanimously. It was agreed that the new City Judge weuld be appointed after the
appointment of bhe fifth member of the Commission.
The City Manager requested the approval of the purchase of twenty-five cocoanut
palms at .�5,00 per palm. He stated that the cost of planting would amount to approxi-
mately �3.00 a tree. Commissioner Lynn moved fi,hat the Gity M�na�er's reqnest be
approved. Motion was seconded by Commissioner Russell and carried unanimously.

1, To immediately construat a separate buildii,o on the Clear��rater Marina property
directly to the east of �he Shell Oil Company's present �asoline station. Tliis °
propert.y would fron�G on Causeway Blvd. and on the water, and including the sma11 boat
basin. This lot is the same property as the groperty now bei�g plannacl for use by
�he city as a launching ramp for the small boat facilities of 'the Maxxna. ,
2, The cost of the building, which �-vill be approximately 30' x�00', and the '
equipm�nt, would be agproximately �35,,'000.00. The design and architectural scheme
would con�orm with a11 present existing buildings and plarned buildings. Actual

: 3. Building will serve a11 boat, fish, and bait �eeds of the �'ishing public in
connection with the new marina, Plans call ior providing within this one buildir_g a ,
fish market and brokage of sish to northern points, bait faciLties, cleaning of fish, '
deEp freez� facilities for storage, freezing and sm�king of fish, repair of all types
of autboard motors, iishinp tackle and reels etc., with inside storage provided for
sm�ll boats and motors.
1�. In connection with tne small boats to be rented would be constructea at my
expense a large hoist to lower anfl raise these boats irom the water. These facilities
would be used to put the sm311 boats �eing rented into the water and these :same
facilities vrouid also be made available at my expense, free to any and all persons
driving to the ?larina with their owr, boats, for the pur�ase of boating or fishing:.
This hoist tauuld be constructed �t my expense and w�uld eliminate the construc�io.n
of the plar�ned ramp by the City and v�ould provide better service than such a rarnp.
It has been the experiencs of the boating �.nd fishing public that any ramp takes up
valuable space and can only accomodate a few cars and boats. Most ramPs are also so
- constructed that not all cars and boats can use tY:em satisFac,torily. Therefore,
additional and bette� service would be provided with this planned hoist, �vith a com-
getent operator available to take care of t17is free service.
5. For ths privilege of constructing the ab�ve, I would like a ten year lease
with a renewdl option, at a fair monthly rental, the aniount to be established bg the <
City and myself, Also an additional protection of my investment in the event this '
_ area u�ould be needed at a later date by the CitV for �'muncipal �urposes�t or in the
event that my lease should be terminate�.
6. �y previous experience has been as a tool and clie manufacturer restaurant '
operator, manager of'a wholesale fish marke� in Detroit, and at present�2 own and _
operate the Koli-Bree �5.partments on Clearwater Beach. I have liued in Clearwater '
slnce 19�9 and this will continue to be my nom� and where I will continue to invest
my money because of the wonderful cornmunity which we have and the even greater
community which Clearwater will become. '

board personally to discuss the above proposal and answer any questions which you

increased investment on your Marina property and the even �reater desirability of.
having the noise of outboard motor repairing and the mess and odor of•freshly raught
and cleaned fish ai,�ay and separated from the main Mari�a Building, so that the public '
is better served.
