At any rate I believe there was some talk goin~ around about restrictions in the deed which prevented the City from leasing that dock. If there is any such restriction on the record, I have yet to find it. Mr. Wingo, the City Clerk, could find no restriction. This question of restrictions comes up because there mi~ht have been a question as to how this ordinance is to be interpreted. I don't beiieve there is a thing in the world which prevents the City from leasing the dock. If there is, it also prevents any pleasure craft from tyinp, up over ten hours. The City Manager has authority to ~ive permit. ~~en it comes to a matter of policy, if you want to leqse the dock you can. I would like the "Sea Fever" to stay. It has been there over four years. We now hHve the new Marina over there, and it has been said that we should put the boats over at the new Marina. If you put the "Sea Fever" on the s::\me dock, you have a six foot dock leadinlS to a "T" head. You are going to have more people than thAt dock will accommodate. CAptain l~eyer paid $65.00 a month. If you move the "Sea Fever" to the M~rina, he would pay $25.00 a month." City M~nager stated it would be not $25.00 but less than $60.00 if the City puts down additional piling for a slip. Mr. Cooper stated the "Sea Fever" should be le~t at the dock from the standpoint of a tourist angle, that it becomes a question o~ inter- pretation of this Ordinance. f\lr. A. D. Finch, attorney representinp; the eighteen boat owners now docked at the new M'1rina, addressed the Commission. He said "We are not seeking for favors. We are askin~ for a fair deal. We are requesting that the "Sea Fever" be removed from the City Fier. \Ye feel that there has been a discrimina- t ion after the Marina was built." ~:lr. Finch quoted Section 2 of Ordinance 406 which was omitted in Chapter 5 of the City Code. He felt it was unfair to require the other boats to move to the new Marina and allow the "Sea Fever" to remain at the City Dock, as it does not allow fair competition. Mr. Cooper presented petitions to allow the ~Sea Fever" to remain at the City Dock, signed by 304 people. Mr. Lloyd Mosley, attorney, also addressed the COlilmission in behalf of the eighteen boat owners. Mr. Edward Ellwood, I~r. Zachary, r.irs. ',>;eav.:r, r.lrs. Lewis, Mr. James D. Olson and Mr. Weaver in the audience spoke in favor of the Sea Fevel' remaining at the City Dock. MHyor Brown asked the City Attorney to read the Ordinance. The City Attorney read Chapter Five of the City Code. M~yor Brown asked if this was a legally constituted ordinance, and the City Attorney replied that it was. Mayor Brown asked the City Attorney for his legal opinion. The City Attorney repe8ted that he thought it was purely a question of policy for the City. He thou~ht the Commission should settle it as a matter of policy. It is within the power of the COllunission to repeAl the Ordinance if they wish. The purpose of the Ordinance was to in somewise restrict the use of that dock to temporary dockin'y,. I'lay:>r Brown asked if the City Commission who gave the original permit acted within their powers. City Attorney replied, he thought the City violated this ordinance when it did that, the f3ct that the intention was to make it for temporary landin~ facilities. In his opinion, the ordinance was very inadequately drawn, and should be amended and clar'ified. Commissioner Crown asked how mc:my additional slips ~re available in the MQrina. Question was referred to City Dock- master who stated there were available 6 spaces out of 33 in the commercial area and 7 spaces out of 49 in the priv::te area. He also stated there was a place for the "Sea Fever" right now. Commissioner Crown brought up the point that in the coming year while the construction of the new Marina building is going on it will be a pretty crowded place. Co jlmissioner Bl;:mton moved that the City discontinue all use of the dock by commercial boats until the City can formulate a plan for handling pier usage, that Ca~tain Meyer be Given proper notice to vacate M8rch 1, 1952; and in the meantime the City Manager be instructed to look into the matter of proper docking facilities and making such facilities as are necessary for Captain Meyer and that Chapter Five of the City Code, 1950, be repealed by proper legal procedure. Mr. Ben Krentzrnan, appearing on behalf of the Royal Palm Notel and Coffee Shop, presented a request for an exception to the Zoning Act to allow a 10 foot set-back line on Lincoln Avenue rather than the 20 foot set-back as required by the present zoning ordinance on Lot 19 less the east 10$~ feet, Padgett Estates Subdivision. He submitted legal notice aud affidavit of publication showing that a public hearing had been advertised in two consecutive issues of the Clearwater Sun. He also stated that copy of the notice had been sent to thirteen property owners in that area. This matter had been submitted to the Zonin~ Board for its consideration Rnd the recom- mendation was that the request be denied. Mr. Krentzman said that on the west of the motel there is in effect a corner lot. The City zoning runs back on Cleveland Street 110 feet as business zoning. Of the 212.46 feet in depth, the first 110 feet is zoned as business, the rest is zoned as R-2 or multiple dwelling. ~~. Krentzman presented a map of the property showing the location of the proposed building with a set-back of 10 feet on Lincoln Avenue. City Attorney submitted a Resolution which would grant the Zoning exception as requested. Cornmissioner Blanton moved that the Resolution be adopted. Corrmissioner Crown seconded the motion, which was voted upon and unanimously carried. Commissioner Lynn left the meeting at 10:30 P.M. Consideration of approval of plat from L. B. Crayton, located east of South Greenwood Ave,nue and approximately 200 feet north of Lake View Drive - consisting of eighteen lots - was brought before the Commission by the City Manager. He stated that~the City Engineer had already checked this for drainage. This tentative plat was presented to the Commission pending approval of the regular plat when it will be adopted for signature. City Engineer and the City Msnager recommend approval of this tentative plat. Mayor Brown inquired if Mr. Crayton intended to build houses right' away. Mr. Crayton replied that he did as soon as necessary improvements can be put in. He said the houses would be commensurate with that locality meeting FHA standards.
