Commissioner Turner seconded the motion. Vote was cast and motion unan~ously carried. Pinel1as Cmlnty Veteran Service Officer's Report for Auv.ust, 1951, was read by the City Clark. Commissioner Turner moved that this report be accepted. Motion was seconded by Commissioner Lynn. Vote was cast and motion unanimously carried. Oity Clerk read letter dated September ? 1951, ~rorn the Society for the Pre- vention o~ Cruelty to Animals o~ Clearwater, Inc., requesting that Ordinance be drawn providing for regulation and licensln~ of dogs in the City to help provide revenue for operation o~ this Society~ which has been runctioning from private do- nations and through volunteer workers on1y~ with the exception of the Veterinarian. Mrs. Robert H. James, of the SPCA, appeared, and asked that licensing be done and outlined some of the problems this ~roup encounter in their work. Dr. G. H. Clanton, Veterinarian, also spoke or the need for this help. He stated that the SPCA haa re- ceived no help from the County PIl.bl1c Health fSroup for the last two or three years, which has nade the problem even more difficult to handle. Commissioner Turner move~ that coromi ttee be appointed to 'Work with the SPCA with re~ard to dog ordinance ~or the City of Clearwater. Commissioner Lynn seconded the motion, which was voted upon and unanimously carried. Mayor Brown appointed Commissioner ~nn as Committee Chair- man, and Commissioner Blanton as Committee member. Mayor Brown also asked the City Attorney to work with this group. and stated that Dr. Robert E. Rothermel, the County Health Officer, should be notified of the meeting and asked to attend. Donald S. Genun~ and Miss Caro] Matran~a as assistant counselors in the law enrorcement phase of the Juvenile Court in order that they may go beyond the l1m:1ts o~ Clearwater in conducting the present work they do, which is that of Assistant Probation Officers. Chief McClamma' e~- plained that it is very necessary in the course of their work to go outside the City limits of Clearwater and that their jurisdiction would extend only to the immediate area surrounding Clearwater. Commissioner Turner moved that approval be given to the appointment of Capt. Donald S. Genung and Miss Carol Matran~a as Assistant Counselors and that letter be written to Judge William r~rdiner, St. Petersburg, notifying him of this fact. Motion was seconded by Commissioner Lynn, vote was taken and motion unan~ously carried. Request from Mr. John Segelken with reference to cleaning up the North bank of Stevenson Creek from Douglas Avenue to Atlantic Coast Line Railroad was brought to the attention of the Commission by the City Manager. He stated that Mr. Segelken wished to have the salt flats next to their property c~eared up and would like to ,know whether the City would stand the expense of clearing up the two street ends.. He recommended that approval be given, as he and the City EnfSineer feel that this work needs to be done. He felt that it could be accomplished at a cost not to exceed $100.00. Commissioner Lynn moved that the City Mana~er be authorized to enter into agreement with Mr. Segelken and ~roperty owners on Stevenson Creek with reference to cleaning up two street ends at a cost not to exceed $100.00 for the two. Commissioner Turner seconded the motion. Vote was taken and motion unan~ouBly carried. City Manager asked how the Commission wanted the removal of buildings on City owned property on Clearwater Beach to be handled - whether they want bids to be taken. Mayor Brown recammended thst City Olerk advertise tnat they be sold to the highest bidder on the City I~ll stepa. The City Attorney stated that this was a 1egal method of handlin~ such a matter. The Mayor stated that he would like to see some of the money obtained from such sale used for beautifying that area. thou~h he realized it would take more money than will be obtained through the Bale to accomplish needed im- provements. He asked whether comf'ort stations should be installed there. The City Manager stated that there was some plumbing equipment which could be salvaged either to se11 or keep to use for such ~rpose and add any other equipment necessary. Mayor Brown ~elt that since plumbing equipment is scarce that whatever could be salvaged should be used in any build:1ng that is put up by the O:1ty. The Oity Manager stated that equipment would be salvaged before the build:1ng was advertised. He stated that a man could be sent from the Building Department to be on hand every afternoon so that the bUilding would be open for inspection after advert:1sement. It was decided that Q min1mum bid be set, the base bid to be what is valued as salvage to tho City. City Manager stated tlmt the price set in the past has not covered cost of maintenance of equipment, and he suggested that price be set high enough to cover cost of such maintenance. Mayor B~wn asked City Attorney if advertisement for hearing had been published in the usual manner. City Attorney replied that all lep,al notices had been published. The Mayor asked to hear objections to this project. Letter was read by City Clerk dated September 23rd from G. W. Wheeler, property owner in this area, who stated that he could not afford to pay the assessment for the work on his property, which he stated would amount to around $2135.00. Mr. John G. Llewellyn stated that this was the sentiment of' many of the property owners - that they could not afford to pay such hi~ assessments. City Engineer stated that Mr. Wheeler's estin18te was based on the old estimate of $7.00 per front foot and that under present assessment set-up the cost would run approximately $1,887.00. At request of Mayor Brown, City Clerk read description of work to be done in this area, as advertised in notice of public hearing. Mayor Brown aslced City Attorney to explain how assessment 1s made under the new law. City Attorney stated that assessment is. r.18.de on an area basis rather than on a front foot basis under the new law, and that the outstanding ad- vantage or this method, particularly in drainage projects, is that it enables the Commission to assess the properties actually receiving benefit from improvements re- gardless of whether they abut on the improvement or not. He stated that the Com- mission is empowered to assess on any improvement but that the area basis assessment is more applicable in relation to curbs, gutters and sewers, and that paving alone is usually assessed on a front basis. Mr. Roy Rigel, property owner, asked question about what kind of a curb is to be used. City Manager replied that it was an improved flat curb which can be driven over. It both drains and allows parking. Mr. Philip J. Tomei asked why curb was proposed for just one side of Mandalay, and that he would 1ilee to see curbing put in on the other side of the street as well. Mayor Brovm re- plied that it is hoped that this can be clone in the future but that at present only the area included in the project as advertised can be done at this time. The City En- gineer ata ted thL. t wa ter from one side of Manda1ay does not drain to the other because of the elevation of the crown of the street so that it was not felt necessary to in- clude the other side of Mandalay at this tiIlle. They are trying to take care of drain- age to Royal Way without ha vinp, to run storm seVier with :r:tanholes all the distance on Mandalay. Mr. F. L. fficinner asked whether paving of unnamed street goin~ down to the Bay one block froril Clearwa ter was p-;oinp; to be done, as tha t would make pa vinp, assess- ment heavy on his one lot. Mayor Brown replied that it was planned to pave all of the street ends which include, Water Street, Royal Way, and Somerset. ~Ir. Skinner asked whether the City would be able to pay for this paving. :Mayor Brown replied that this subject had been discussed at a previous meeting, and COI!1m.issioner Turner stated that at that discussipn it had been learned that the cost would lwve to be borne by the property owners. Cmamissioner Turner stated that in another part of this area which was not paved the property owners had allowed grass to grow on the street ends and ha ve alrnost come to feel that they own the property on these street ends. Mr. John Bates asked if it is legal for the City to assume such cost. City Attorney replied that it was not. Mayor Brown asked Mr. Skinner if the plan meets his approval other- wise. Mr. Skinner replied that he had no connnent other than his letter previously written. :MaY'or Drown asked for show of hands of those in favor of the project in its entirety as outlined. Some twelve or fifteen property owners raised their hands. The Mayor stated that the problem of the property owners who have made heavy investmenta in homes or apartment houses and who have no streets or drainage is a serious one~ and that in order to facilitate the installation of these improvements so that the streets will not be tied up too long that the City will go ahead and do the ~lprovement5 with- out having the usual 50% of money for the project on hand in the City Treasury in view of the record of property owners in this area for prompt payment of previous assessment on sanitary sewers. 1iayor Brown called on Commiss:ioners for expression of opinion. Cammisaioner Lynn felt the work should all be done at once, that it is badly needed~ and he asked Mr. Maxwell, property owner, for his opinion on the subject. Mr. Maxwell said that he and all the property owners are anxious to have it done in order that the money they have invested in this land will begin to show a return. Commissioner Turner stated that it appeared that a nmjority of the people would like to have the work started.1: He suggested that the Attorney read the Resolution approving this work. City Attorney read Resolution and inserted amendments Showing that objections had been made to the work, said object1.ons recorded in the minutes, and that they were held to be in- sufficient to prevent the work. Commissioner Lynn moved adoption of the Resolution with amendments sug~ested bY' the City Attorney. Commissioner Turner seconded the motion. The Oity Attorney explained that this Resolution sets into Dlotion the machinery of the City of Clearwater by which these iI:1provements will be accomplished. He sta ted that in ordeJr to save time and expedite construction of this project that it was proper to open bids the same evening in which such Resolution is passed. Mr. Jack Ransom asked who would pay additional assessment if the contractor to whom bid is awarded should n\n into a barrier of some sort and there is an emergency coat not contemplated in a considerabl& ~ount. Mayor Brown replied that the contracts are let to do the job and that the pro- perty owners pay to p,et the job done and the contractor nlUst keep trying until the job is done. He stated that the Commission takes tho lowest bid only if the contractor is reliable and reputable. He stated tha~ that truck can be reconditioned and turned over to the City Garage. The other truck 15 for the Engineerin~ Department to take care of their added work of superViSion, in- spection, carrying transit equipment, etc. He said that this was a bud~et item the first of the year, and will be taken out of Maintenance Fund. He recommended that the low bid of Larry Dimmitt, Ino., Clearwater, Florida, for two Chevrolet pick up trucks at $2,498.00 total be approved. The Clearwater Chapter of the Society for the Prevention of Cruelty to Animals of Clearwater, Inc. which is a branch of the National Society, WaS incorporated in Clear- water in 1949. Since its inception the organization has handled an ever-increasing number of cases involving cruelty# abandonment, neglect, lost and found, injured and sick aninlal 1018 cases in 1950 and 1112 during the first seven months ot: 1951. The an1mals in- cluded cats, dogs, monkeys, birds, horses, mules and oattle. The Society has a temporary Shelter on Drew St. and also maintains a special an1mal ambulance with a f'ul1-tuae driver who can answer calls in the Upper Pinellas are~ at any time. All of the costs of operation have been defrayed by voluntaZ1 contri- butions and most of the work has been done by a few unpaid workers. :tn"view of the inoreasing demands upon the organization~ the Society has requested Mr. Charles E. Dear Mayor Brown: Effeotive Ootober 1 is a new Juvenile Court Act and I am writing you at this time and sending copies of. this letter to City Manager ~~mcis Middleton and Ohief of Police George T. McOlamma. In order to co-ordinate the work of the law enforcement phase of the JUvenile Court I respectfUlly request your permission to appoint Oaptain Donald S. Genung and Miss Carol Matranga as assistant counselors, who were fonmerly known as assist- ant probation officers. These two members of the Clearwater Police Department have specialized in the hand- ling of juvenile problems for the City of Clearwater and with your permission I would like to designate them as asistant counselors of the Juvenile Oourt who will serve without additional payor compensation.
