'1 r'>";"\':W({:1~fit};< [t ~~:;?; Mayor Brown asked question reearding enforcement of the new law on net fishing, as he felt the Commission should give close study to the enforcement of this law. He felt it was a Oity law written for the City of Clearwater and should be enforced by the City. City Attorney pointed ffiIt that it was also subject to state enforcement. Mayor Brown stated that in the past there has been no effort made to enforce this law on the part of the State and that sinoe there were several men on the Police force familiar with net fishing that it might be feasible to put such individuals on duty for the purpose of checklng on violations 01' this law both night and day. He felt it was up to the Oity to set the policy and that Chief' I>IcOlaDnna and City Mana-ger should bring back recommendations as to how this law will be enforced. City Attorney stated that Ordlnance must be drawn - that the Act is merely a permis'sive Act granting these special powers to the City of' Clearwater and City must pass an ordinance on the matter and it then becomes the duty of the City 1~nager within the framework of the ordinance to promulgate rules and regulations for the putting of this Act into effect. On question of enforcing f'ishing ordinance the only direct means of' enforcement of that is through the provision of our ordinance which malees violation of any state statute or law within the City limits of the City of Clearwater an of'fenae against the City of Clearwater~ ~le Police frequently have occasion to make prosecution~ based upon that provision of mIl' code. Any violations of this law we will have to handle under provision of our code. Mayor Brown wished to l~ve the City Attorney give the matter further legal study and be prepared to 9.dvise the Chief of Police and other enforcement agenc:tes regarding question of warrants, just exactly what kind of case they will have to have to bring violators in, what evidence will be needed, etc. He stated that he would like to have the City Manager and Chief of Police work out same method of patrol. City Manager suggested that City Prosecutor should also be brought into this enforcement. Mayor Brown concurred that the legal department con- sisting of Attorney Ware and Prosecutor should be included. The advisability of' tho City buying or renting Ii boat for the purpose of patrol was discussed. Renting Q' boat appeared to be the more f'easible plan, as the City would not have to maintain and repair such boat. Rental could be paid out of the polioe esorow fund. 00111- missioner Blanton moved that City Mana,ger and Chief of Police get together and work out a s1stem or formula for having a boat available to the Chief of Police for patrol duty whenever necessary in the Bay for the purpose of enforoing this law and work out any other problems in connection with enforcing this la~. Commissioner Lynn seconded the motion, which was voted upon and carried. The Mayor recommended that names and addresses of salt water officials be on file with the Police Chief to call upon if neo6ssar,y. The Oity Attorney stated that before enforcement was actually bogun he would l1ke to investigate the legal question as to whether the State law providing ~t officers and employees of the state Oonservation Commission were vested with t}~ exolusive power and authority to enforoe state general and speoia1 laws of this type. l~ """--..... Mayor Brown steted that the property owners on Marianne St~eet and the vioinit~ were antagonistic beoause they relt that they had received a comrn1tmont fron the 01t.~ Attorney and the City Engineer to produce figures at the public hearing on the !kr1~nne Street project showing the oost of a reduced veraion of this project which they advocatod adopting in place or the ove~ll project that was befo~e tlle Oon~ission in the public hearing. The Mayor therefore ra ised the question as to tlle adviaabil1.w of' reconsidering this entire matter at another meeting of the Commission because it ~ppear~ 'that at the publio hearing on September ll'7th cost figures o~ the reduoed version o~ the project were not made availallle by the City Engineer. The City Attorney answered tao Mayor by stating that durinr, the week preceding the public hearing !dr. A~ Rogera~ one of the property O\'l11e1"S a ffect~d by the MI1 ~ianne street project cel.led the City AttorneY' and requested an opportunity for him and sotte of the other property owners to confer jointly with the City Attorney and City En~ineer. Dmmediately there~fter the City Bn- gineer was oontacted and a conference was arranged, at which oonference there wer~ ~t least a half dozen of the property owners who advocated greatly reducing the J)roject to approximately the pl.an which was origina.lly presented to the Oommission by the City Engineer. The City Attorney f'urther stated that at some point in ~is oonferenoe h~ suggested to the property owners in the presence of the City Enf~ineer that it would be a good idea for the City Engineer to bring the old plan to the public hearing so tbEt if the Commission decided to t'ollow the suggestion of the property owners it 'Wou~d have suffioient inforlrJa tion before 1 t to Xllake an intelligent disposition of the ma tter. The City Attorney further stated that the entire conversation in the coni'erence revo~vecli around a discussion of the two plans and t:b..nt he did not recall that the matter of cost figures were in any wise discussed. He felt it was a City law writtsn for the City of Clearwater and should be enforced by the City, City Attcrnay pointed out Lhat it was also subjact to State enforcement. �uiayor Brown atatad that in the past �there has been no eifort made to enforc� this layv on the part of the State and that since there v�ere several men on the Pol�ce force familiar with net fishing that it migh.t be feasible �o put such individuals on duty for tho purpose of checking on violations of this lav� both night and day. Ha ielt it was up to the City to set the policy and �hat Chief IvicClamma and City hlanager �hould bring back recommendations as to how this iaw will be enforc,ed. City p.ttorneg sta+ted that Ordinance must be drawn - that the Act is merely a permiss�ive Act gs�arnting these special powers to the City of Clearvrater and City �ust pass arn ordinance on the matter and it thon beconies tho duty of the City Dianager within the framework oi the ordinance to promulgate rulos and re�ulations for the pu�ting of this Act inta e£fect. On ques�ion of enforcing �islzing qrdinance the only direct means� of enforcement of that is throu�,li the provision of our erdinsnce which maltes violation of any S'tate statute or law within the City limits of the City of Clear�vater an offense agains� the City of �learaaator. The 1'olice frequantly have occasion to m�ke prosecution� based upon that provision of' our code. Any violations of this law we �aill �ave to handle under provision of our code.
