Consideration was given to request by Mr. A. T. Oooper, Jr., Chairmain, Lions
Olub. Crest Lake Committee_ to close Crest Lake to fishing July 15th in order that
the Leke will be in good cond:1 tion for the Lions Club li'ishing Jamboree. Letter making
this request was read by the City Clerk. Mr. Lynn stated he had inspected the lake
and that it badly needs to be fert:1lized~ Mayor Brown concurred in this opinion.
Commissioner Blanton moved that the request for closing tlw lake be granted. Com-
miss10ner Blanton observed in making the above motion that it is the understanding of
t~ aammission t~t the Lions Club is in no wise responsible for the safety of the
general public in the general use of this lake ~or swimming, etc.. Mr. Turner seconded

The meeting was called to order by the Mayor.
It was sup;p;estecl by Commissioner Blanton that items be taken in the order in
which they appeared on the agenda and t~at adjourrunent take place at 10:30 P. M.
Thi9 was approved by Mayor Drown.
Correction or minutes of June 27th was brought to the attention of the Com-
mission by Mr. Blanton. Mr. Blanton moved the adoption of the minute~ of the regular
meeting of ~me 18th, and special meetings of June 25 and June 27, with amendment of
June 27th minutes by striking out the ~ollowing: \IAn agreement regarding Pierce
Street had been reached as embodied in the contract". This was seconded by Mr. Turner
and oarr1ed.
Public hearing was held on the application of Dr. J. K. Davis for exception to
the zoning act. The Cammisa:1on was In~o~ed that proper notice had been run for
this application for exception in zoning ordinance. Copy of notice as it appeared
in the paper was read by Howard Rives. Objection to the petition was given by W. S.
Shannon, who requested that the original petition be read, together with report of
the zoning board at that time. Letter f'rom nine property owners in the area adjacent
to the property under consideration was presented by Mr. Shannon and read by the City
Clerk. These owners objected to re-zoning of Lots 8 and 9 facing Jefferaon Avenue,
but stated that they would enter no fUrther objection to the re-zoning of Lots 12 and
13 if they were to be used for the erection of a dental clinic building only. Reso-
lution was presented by Mr. Rives eor re-zoning Lots 12 and 13, which was read by
City Clerk. Motion was made to romend Resolutio~ to read that the 15 feet extend to
the right of' way of' :Missouri A. venue ra ther than to li1ssouri Avenue. Mr. Turner moved
that the Resolution be adopted as amended. Mr. Lynn seconded the motion. Vote was
taken and carried.
Consideration was given to Mrs. Rendry's proposal for settlement of taxes. The
City Clerk stated that Mrs. Hendry wished to settle the back taxes in instal:lJnents.
Total back taxes amount to $484.00. It was suggested that she pay $25.00 per month.
Commissioner Blanton moved that the Clerk be authorized to accept the taxes on the
bas~s of installment payments of $25.00 per month. Mr. Turner seconded the motion.
Vote taken and oarried.
Cammittee's report on the sign request of Cantrell and Condon for Albert P.
Rogers, Inc., to erect oommercial sign on the ]WI corner o~ Baker Boulevard and Drew
street was given. Mayor Brown suggested that the matter be referred back to the Com-
mittee on Signs and that the Con.mittee be driven out to look at the sign in question.
Consideration was given to petition signed by nine Grove Street property owners
~or resurfacing of Grove street between Lake A.venue and Keystone Drive. Cost of this
proposed repair would be approximately $683.00. Property owners requested that re-
surfacing be done at the expense of' the City. Mr. Lynn moved that the City Manager
be instructed to proceed with the resurfacing of the block mentioned. Mr. Blanton
seoonded the motion. Vote was taken and carried.
~tter from American Railroad Transportation Corps was read by the City Clerk
soliciting a donation f'rom the City for the purpose of erecting a National Memoria~
IIome in honor of the war dead. Mr. C. L. Darling suggested that source of this letter
be investigated should the City have any intention of making a donation. Cmmnisaione~
Blanton moved that City Clerk be authorized to write letter acknowledging receipt of
this letter and telling them that under ou~ charter we are not allowed to oontribute
funds for Buch purposes. Mr. Turner seconded this motion. Vote was taken and carried.
Request of property owners in Mandalay Unit :/15 at Clearwater Beaoh for change
of zone ~rombusiness to R-2 (Multiple dwelling) was considered. Petition signed by
30 property owners in this area was read by City Clerk requesting this Change. Re-
oommendat~on of the Zoning Board was read by the Oity Clerk approving the requested
change,. Mr. John G. Ll.ewelyn requested that the re-~ning embody parking for use of
the property ownera in the R-2 zone. Oity Attorney stated that this matter was before
the Zoning Board ror reoommendation and that they had not yet reached a decision re-
garding parking in B-2 zoning areas. Oonnniasioner Blanton's feeling was that if an

TI-2 lot adjoins a business lot it should be used for parking. Mayor Brown suggested
that the matter be deferred until the zoning board reports its findings at which
t~ne the application for re-zonlng in Mandalay will be considered. Mr. Dynn moved
that Mayor Brown's suggestion be adopted - that the matter be deferred until re-
oommendation is given the Oommission by the zoning board, who expect to hold a
speoial meeting in the near future for oonsidera tlon of this question. ~Ir. Blanton
seconded the motion. Vote was taken and carried.
Conmunication rrom Board of Oounty Commission relative to valuation of fore-
olosed property was read by City Clerk. Motion was made that the City Manager be
authorized to represent the City of Clearv/ater at the meeting with the County Com-
mission on ~11y 17th, and ask that the 1950 valuation be the baes bid on the property
to be sold. Mr. Turner nade the above motion, Mr. Dynn seconded. Vote was taken
and ca rried .
Invitation from Board of Oounty Commissioners to attend water conferenoe on
Friday~ JUly 6th, at 2:00 P. M. was read by the City Clerk. Mayor Brown recommended
that this Dleeting be attended by City Manager, City Engineer, City Attorney. and all
oornmissionera V/ho can attend. r.L'his reconunendation was put in the form of a motion
by Commissiuner Turner and seconded by Commissioner Blanton. Vote was taken and
carried.
Bids for crane and half track were opened and read by City :Manager. Bids were
submitted by Florida Georgia Tractor Oompany, Tampa, Florida for a Model S 1/3 cu. yd.
at $10~486.88, and Model E 4/10 cu. yd. at ~13,850.00; and by the Chapman Machine
Company, Tarnpa, for 3/8 yd. Schield Bantam Crane at $10,399.25, 10% discount within
ten days. Mr. Turner moved that the bids be referred to the City Manager for study,
tabulation, and recommendation at the next regular commission meeting. Mr. ~nn
seconded the motion. Vote was taken and carried.
Bids were opened for dry cleaning for police and fire departments. Bids were
submitted by the Sanitary Oleaners, Clearwater and Hart Cleaners, Clearwater. Cam-
m~ssioner Blanton moved thwt the ~tter be referred to the City Manager for tabu-
lation and recommendation at the next regular meeting. Mr. Turner seconded the mo-
tion. Vote taken and carried.
~abu1ation of bid for tires, tubes and retreads for City Fleet were presented.
Recommendation from the Purchasing Department and Publio Service Department was for
the Goodyear Tire and Rubber Company, Clearwater. Mr. Turner moved that the City
1ianager's recommendation be followed and that the contract be awarded to this company
for the ensuing year. Mr. Iifnn seoonded this motion. Vote was taken and carried.
Letter from R. l.1. Thompson Company dated June 20th connnending the work of the
Fire and Police Departments in oonnection with the accident of Theodore Ceraolo was
read by the City Clerk. Mr. Turner moved that the Thompson letter be acknowledged

o~ this meeting. This letter is set forth in the ~ollowing pages of these minute~
and made a part thereof.
Petition was read by the City Clerk signed by 15 property owners protesting
against opening Chestnut Street between Greenwood Avenue and Nissouri Avenue. Mr.
Harold Robinson, one of the property owners affected, personally appeared protesting
this action. Motion was made by Mr. Turner that petition be accepted and n~de a
part of the record. Mr. Lynn seconded this motion. Vote was taken and carried.
County Veterans Service Officer Report for the month of May~ 1951, was read by
the City Clerk. Mr. Turner moved tbat the report be accepted. Mr. ~nn seconded ths
motion. Vote was taken and oarried.
Letter and proposa 1 froIn McMullen and Goza on behalf of T. R. Palmer regard-
ing the Easterly end of Carlouel Drive was read by the City Clerk. Mr. ~nn moved
the aoceptance of this proposal. Mr. Turner seconded the motion. Vote was taken and
carried. Mr. William Goza, who appeared ror Mr. Palmer, was instruoted to prepare
Resolution for presentation at a later meeting, the Resolution to be approved by the
City Engineer and the Beach Erosion Board.
Consideration was given to proposed lease of the Junior Service League (a part
o~ Lots 9, 10, and 11 just south of water tank on East Avenue). Mayor Brown re-
commended tha h the City Attorney be instruoted to draw up the lease in completed fonn
embodying the changes suggested at the time the lease was read at a former meeting
o~ the Oommission. Mr. t1nn moved that Mayor Brown's recor.mendation be followed
and that the lease be presented at the next regular commission meeting for action at
that time. Ur. Turner seconded the motion. Vote taken and carried.
Proposed quit cla~l deed from the City to Donald Cochran, Jr., was presented
by Ben Krentzman, Attorney. This deed is for the purpose of establishing the line
between City owned property and Mr. Cochran's property. Mr. ~nn moved that at 1:50 P.M.
on Saturday afternoon, July 7th, the Commission will go out and look at the area in-
volved in this proposa1.
Consideration was given to the appointment of member to Civil Service Board at
expiration or the term of :Mr., l~ewton Barlow. Motion was made by :Mr. Turner that Mr.
Bar~ow be appointed to sucoeed himself. Mr. ~nn seconded this motion. Vote taken
and carried.
Oonside~tion was given to bid from W. Maurice Blanton to purchase unplatted
Block Y, Hibiscus Garden. Mr. Blanton requested that he disqualify himself fran

made by Mr. Turner that proper City offioials be instructed to advertise Block Y
and that it be advertised the requisite number of times to be sold at public auction
on the steps of the City Hall and that the figure of $750.00 be used as the base
bid. Mr. Lynn seconded the motion. Vote taken and carried.
Consideration was given to bid from Mrs. Anna Hampton Miller to purohase Lota
37 to 40, inolusive, Block D, Navajo Parlt. Motion waa made that offer be declined
and party so notified for the reason that this property is in the area Where develop-
ment is taking place, that similar bids have been refused and theta ftor develop-
ment ia completed all bids of this nature will be considered at tl~t time. Dis-
cussion was held on this matter and conclusion reached that this would be the best
thing to do. Motion was made by Conullissioner Turner, seoonded by .Mr. Lynn. Vote

Mayor Brown suggested that taxi companiep and other transportation agencie&
be 1'urnished with a copy of' proposed taxi 9'rolnanoe. Mayor Brown's request was put
in the form of a motion by Mr. Turner, seconded by Mr. Dynn, voted upon and carried.
Letter from City Employees was I'ead by C1ty' Olerk expressing appreciation fram
their group to the Commission for the $10.00 per month raise voted by the Commisaion
at its last special meeting. Mayor Brown aoknowledged receipt of this letter.
C01'llIllissioner Blanton suggested that consideration be given to re-naming and re-
numbering some of the streets of' Clearwater. Commissioner Blanton made the motion
that a committee be appointed to study this matter on all streets and avenues in
Olearwater where there is confliot and confusion. Mr. ~nn seconded the motion. Vote
was taken and carried. Mayor Brown appointed Commissioner Turner, Commissioner Blanton,
and the City Engineer to this oommittee.
Mr. Turner stated that if Oleveland Street is widened in the first blook beyond
Greenwood Avenue that there were many unsightly telephone poles whicll should be
removed.

There being no fUrther business to oome before the Board the meeting now ad-
journed as a City Commiss10n and sitting as Board of trustees for the pension fund
accepted into the rn~ber&hip of the Pension Plan Luoy Steffey. Motion that Luoy
Steffey be accepted was made by Mr. Turner. Mr. Lynn seconded the motion~ vote was
taken and motion oarried.

of $484.76 on Lot 2, Blk 3, Starr & Savery's Addition.
I know it is not the rule~ but maybe you and the City Clerk can work out a plan
so as I can pay this off in monthly installments. I can pay $25.00 a month. It
might be possible later on to pay more and if so I would like that privilege, but at
the present time I would like to pay $25.00 a month.

Dear Mr. Middleton:
The biologist with the U. S. Soil Conservation Se~vice has recoIrmlended to the
Lions Club that Crest Lake be olosed to !'ishing July 15. This measure is advocated
in order that the lake will be in good condition for the Lion's Club Fishing Jam-
boreo which will be held allout two weeks prior to the opening of school th1s Fall.
As you know. the agroement between the Lions Club and the City provideD that
the Club make ~easonable rules pertuining to the use of the lake, subject to the
approval of the City Commission. It is our desire to !'ollow the recommendations
of'th.e biologist and close the lAke from JUly 15th until the date of the Jamboree.
We request that the City approve this contemplatod action. Will you pleaso take

The deplorable condition of the paving was causEdlaat year during the hurricane
season, when water seeped through holes which had been per.mitted to exist in the
paVing, and started s process of breaking up the paving. Due to the quantities ot
rain whioh fe1l th:1s breaking-up process continued and spread until the :paving of
nearly the whole block was oompletely broken up and the street became almost 1mpassab1e.

As you probab~y know, Florida Statutes 194.55, prOVides tl~t suoh lands shall be

then sold to the highest bidder and the proceeds of the sale are divided between
the County and municipality in which the land is J.ocated OIl a pro rata formula based

affected if changes which have been requested by Dr. J. K. Davis are made 1n the
zoning of lots 12 & 13 under a subdivision of lots 20, 21. & 22 of R. H. PADGETT'S
SUBDIVISION as recorded in Plat Book 9, Page 110 of the publio records: of Finella&:
County, Florida.
We are opposed to the granting of the requested change in zoning on the above
mentioned lots for the ~ol~owing reasons:
1. It will set a precedent 1n this area. We know fro~ past experiences in
Clearwater and elsewhere, that a.pparently hannless changes at the time they were
originally made, have later lead to abuses which were never env~saged when the
original change in the zoning was granted. We are thererore~ in principle, opposed
to any change in zoning of isola.ted, or individual~ inatances~
2'. We do not feel that 9. hardship exists in the present case for t'Wo distinct
reasons; first, Dr. Davis was advised by the Broker throu~ whom he purchased the
property that the zoning was R-2~ and second, because~ there were, at the time Dr.
Davis was negotiating for the purchase of the property. and sti~l are, available
locations in areas zoned for business where a Dental Clinic can be built.
3. The attitude of the petitioner appears to us to be that of' attempt1ng to
force a zoning change on the neifihborhood property owners. We have 1n mind a state-
ment made by the nSelling Broker to some of the unders 19ned that 1 t really did not

letter of the City Attorney.
4. We havo all made substantial improvements on our respeotive properties,
feeling saf'e in so doing by virtue or the f'act that the area was zoned R-2. An,:!
change lowering building restrictions can only result in ael'ious deterioration of the
va lues of our property.
We do not w1Uh to oppose the orderly growth and prQ~ress of the City o~ Clear-
water. With that in mind, we did not proteat to the Zoning Board as we were assured
by the "Selling Broker" that Dr. :Da.vis waD willing" and planning" to buil.d a. Dental
Clinio of an architeotura1 deaif~n which would be a one story build ing of semi-
residential style; that set-backs of the R-2 zoning would be observed; that the
grounds around the building Vlould be covered with a nioe lawn and appropriate shrubs,
etc. In fact, it would be a real asset to the oommunity.
We were told during the past week, however, by Mr. Webb Hopkins of' the Zoning
Board, that Dr. Davis has sent a new petition to the Zoning Board requesting not
only that the zoning of the two lots now bef'ore the GOlmllission be changed, but that
of the two lots lyinr, immediately adjacent to, and East of, the lots faoing MisBour~
Avenue, be changed also. These additional l.ots face on Jeff'erson Ave.~ 'Which 1s
zoned R-2 on both sides. We have not received any official notice of this new
petition, nor have we ever received any official notice of the original. petition
when it was oonsidered by the Zoning Board.
:Mr. Hopkins stated that he unde:rstood the reason for the n~w petition of' Dr.
Da vis was that he had been approached by the Penins\.llar Telephone Company with a
proposal to purchase the entire property IF he could get the zoning ohanged f'rom
R-2 to Business.

The Tel.ephone Company is in the market for a plot of ground in the generalL area,
under discussion, upon which to build a two or three stor,y building to be used as
the main exchange for Clearwater; said building to contain all present and future
automatic equipnlent for Clearwater proper" and in addition, to provide the company
with its principal. warehouse facilities for this section of Pinellas County. There
are sites in areas zoned 'Business' where such a buildins can be constructed.

The owners of' the home loca ted on the Southwest c orner of J'ei'i.'erson Ave. and
Grove St':I llir & Mrs Ross Durarlt, have been approached by a representative of the
phone company to inquire if they would sel.l their home to the phone cOl11p8.ny. We
knoW" that on one occasion at least, the local manager of the phone company, Mr.
Edmunds, ~s stated that if the Dr. Davis property were rezoned and the phone
oompany purchased it, they would like to buy the Durant home and remove it to another
site and then petition for a change in zoning or the ~lrant ~ot from R~2 to 'Business'.
In view of the foregoing facts, we are definitely of the opinion that Dr. Davis
does not now have a hardship case, and never has had one. This is; particularly true
since j.t is apparent that he is willing to forego the building of a Dental Clinic
on the property if he can sell it for a substantial profit and totally ~ithout re-
gard of the effect such a sale would have on all property in the area.
We further feel, that in view of the new petition now before the Zoning Board,
Dr. Davis is not appearing before the Co~ssion 1n good faith or with clean banda.
We request, and urge, ymtr honorable body to reject the petition for change'
in zoning which is now under oonsideration.

upon our discussionS':
(1) I will secure the construction of a concrete aeav~ll from the south-
easterly extremity of Car10uel Drive, as platted, in B.i northerly direction across'
the easter~y end of said street, following northerly along an unnamed entranceway
to the site of the old dock which wa s s i tUB. ted on this property, thence in a north-
westerly direction to the easterly limits of Lot 11, Block 274, Carlouel Sub.~
which lot is owned by me.
(2) In consideration of my agreement to construct the seawall as above set
forth, it is understood that you will vacate any rights to use as a public street
which may be held by the City of Clearwater to the above described unnamed entrance-
way, which lies north of the northerly line of Carlouel Drive, as extended in an
easterly direction to the Bay, and will socure the pa.ssa.ge of' such ordinances and
the execution of such documents as will be necessary or desirable for me to secure
ownership of this tract, as against the City of Clearv~ter.
(3) It is understood that nothing contained in this off'er shall be construed
to deprive tho City of Clearwater or the general public from the use of' Car10ual
Drive to the easterly end thereof, as re-constituted, all the way to the waters of

The meeting was called to order by the Mayor.
It was sug�ested by Cammiss3oner Blanton that i�ems be taken in the orde� in
which the� appeared on tho agenda and that adjournment take place at 10:30 P. �.

Correction of minutes of June 27th was brought to the a�tention of the Com�-
miasion bp Mr. Blanton. Mr. Blanton moved the adoption oP the minutes� of th.e regular
meetin� oi' June 18�h, and apecia7. meetings oi' June 25 and June 27, vrith amendment of
Jti.ine 27th minutes by strikin� out 'c-,he followin�; "An a�reement regarding Pierce
S�reet had been reached as embodieci. in the contract�P, Thi�-was seconded by Mr. Turner
and carried.
Public hearing was held on the appl,ication of Dr. J. Kv Davis for exception to
tha zoning act. The Comznission was informed that proper notice had been run i'or
thia appl3cation for exception in zoning ordinance. Copy of notice es it appeared
irz the paper was read by Howard Rives. Objection to the petition was �;iven by W. S�
She,nnon, who raguested that the original pet3.tion be read, together with report af
i:he zoning board at that time. Letter from nine property o�vners; in the area adjacent
to the property under corssideration was presented by T4r. Shannon and read by the Citg
Clork. These owners objected to re-zoning of Lots 8 and 9 facing Jefferson Avanue,
but stated that they would anter no �zrther objection to the reoz:oning of Lots 12,and
Z3 if the,y were to be used for the erection of a de`ntal clinic building only. Resoo
lution was presented by D�Ir. Rives for re-zoning Lots I2 and I3, which was read by
City Clerk. Aiotion was made to amend Resolution to read that the 15 feet extend to
the right of waq of A4issouri Avenue rather than to 8iissouri Avenue. Idr. Turner moved
that the Resolution be adopted as aniended. Ivir. Lynn seconded the motion. Vote was
taken and oarried.
Con9ideration was g3.ven to bfrs. Ylendry+s proposal for settlement of taxes. The
Cii;y Clerk stated that NTrs. siendry wished to settle the back taxes in install.�.nents.
TotaT back taxes amount to �484.A0. It was suggested that she pay �25,00 per month.
Cozmnissioner Blanten moved that the Clerk bs authorized to accept the taxes on tho
ba�is of inatallment payments of �p25.00 par month. ��ir. Turner seconded the motinn.

Coimnittee+s report on the s3gn request of Cantreil and Condon for Albert F.
Rogers, Inc., to eract commercial sign on the NVt corner of Saker Boulevard and Drew
Street was given. Mayor Brown suggestad that the matter be referred back to the Coan-
mittee on Signs and that the Coumiiti:ee be driven out to Took a� the sign in question.
Cons3deration was given to petition signed by nine Grove Street property or�ners
ior resurfacing of Grove Street between Iake Avenue and Keystone Drive. Cost of this
proposed repair would be approximately �683,00. Property ov,ners requested that re-
surfacing be done at the expense of the Cit;�, r;ir. Lynn moved that the City 2�ianager
be instructed to proceed w3th the resurfacirig of the block mentioned. Mr. Blanton
seconded the motion. Vote was taken and carried.
Consideration was given to request by hZr. {�. T. Cooper, Jr. J Chairsnains Licns
C1ub, Crest Iake Co�mnittee,, to c7.ose Crest Lake to fishing July 15th in order that.
the Imke wlll be in good condition for the Lions Club Fishing Jamboree. Letter �aking
this request w�S read by the City Clerk. Mrv Lynn �tated he had inspected the lake
and that it badly needs to be fertilized. B2ayor Brown concurred 3n this opinion.
Corimiissioner Blanton moved that the request i'or closing the 'lake be grantsd. Com-
missioner Blanton observed in making the above motion that it is the understanding oi
the C'ozmnission that the Li�ns Club is in no w3se responsible for the safe�y of the
general pizblic in the �;eneral use of this lake for swimming, etc.4 Dir. Turner seconded
the motion regarding closing the lake. Vote was taken and carried.

soliciting a donat3on from the City far the purpose of erecting a National D2emorial

Blanton moved that City Clerk be authorized to write letter acknowledging rece3pt of

corrmier�dation of the Zoning Soard was read by the City Clerk approving the requsated
change. Mr. John G, Llewely,n requested that the re-�oning embody parl�ing for use of

when it was considered bp the Zoning Board,

The owners of the home located on the S'outhwest corner of Jefferson Ave. and
Grove St., I�4r &�irs Ross Durant, Y�ave been approached by a representative of tha
phone compe.ny to inquire if they woutd sell their hor.ne to the phone company. S"Te
know, that cn one occasion at least, the local manager of the phone cormpan�, �Ir.
�dmunds, hag stated that if the Dr. Davis property raere rezoned and the phone
eomparYy purchased it, they v�ould like to buy the Durant horie and remove i•t to another
site and then petition for a change in zoning of the Durant lot from i?-2 to �Busines-s�.
Tn vievr of -�he foregoing facts, wa are definitelg of the opinion that L�r. Davis
does not now have a hardship case, and never has.had oneo This is particularly true
since it is apparent that he :Ls wi113ng to forego the building of a Dent�l Clinic
on the property ii` he can sall it for a sub5tantiel profit and totally without re-
gard of the effect such a sale vrould hftve on all property in the area.
We furthar feel, that in view of the nav� petition now before the Zoning Board,
Dr, Davie is not appearing before the Commission in good fai.th or with clean hands.
�Ne requast, and ur�e, your honorable body to reject the petition for change
in zoning which is nov�r under consideration.
If, however, Dr. Davis ��ill a�ree 3n writing to conetruct a Denta�l Clinic, �ub-
ject to the original promises previously set forth, and in �ccordance srith the
ryaammendation of the Zoning Board, r�nd to start actual construetion �arithin ninety
days from the decision of the Couunission, we will not entsr further objection,
