Crest Lake Committee_ to close Crest Lake to fishing July 15th in order that the Leke will be in good cond:1 tion for the Lions Club li'ishing Jamboree. Letter making this request was read by the City Clerk. Mr. Lynn stated he had inspected the lake and that it badly needs to be fert:1lized~ Mayor Brown concurred in this opinion. Commissioner Blanton moved that the request for closing tlw lake be granted. Com- miss10ner Blanton observed in making the above motion that it is the understanding of t~ aammission t~t the Lions Club is in no wise responsible for the safety of the general public in the general use of this lake ~or swimming, etc.. It was sup;p;estecl by Commissioner Blanton that items be taken in the order in which they appeared on the agenda and t~at adjourrunent take place at 10:30 P. M. Thi9 was approved by Mayor Drown. Correction or minutes of June 27th was brought to the attention of the Com- mission by Mr. Blanton. Mr. Blanton moved the adoption of the minute~ of the regular meeting of ~me 18th, and special meetings of June 25 and June 27, with amendment of June 27th minutes by striking out the ~ollowing: \IAn agreement regarding Pierce Street had been reached as embodied in the contract". This was seconded by Mr. Turner and oarr1ed. Public hearing was held on the application of Dr. J. K. Davis for exception to the zoning act. The Cammisa:1on was In~o~ed that proper notice had been run for this application for exception in zoning ordinance. Copy of notice as it appeared in the paper was read by Howard Rives. Objection to the petition was given by W. S. Shannon, who requested that the original petition be read, together with report of the zoning board at that time. Letter f'rom nine property owners in the area adjacent to the property under consideration was presented by Mr. Shannon and read by the City Clerk. These owners objected to re-zoning of Lots 8 and 9 facing Jefferaon Avenue, but stated that they would enter no fUrther objection to the re-zoning of Lots 12 and 13 if they were to be used for the erection of a dental clinic building only. Reso- lution was presented by Mr. Rives eor re-zoning Lots 12 and 13, which was read by City Clerk. Motion was made to romend Resolutio~ to read that the 15 feet extend to the right of' way of' :Missouri A. venue ra ther than to li1ssouri Avenue. Mr. Turner moved that the Resolution be adopted as amended. Mr. Lynn seconded the motion. Vote was taken and carried. Consideration was given to Mrs. Rendry's proposal for settlement of taxes. The City Clerk stated that Mrs. Hendry wished to settle the back taxes in instal:lJnents. Total back taxes amount to $484.00. It was suggested that she pay $25.00 per month. Commissioner Blanton moved that the Clerk be authorized to accept the taxes on the bas~s of installment payments of $25.00 per month. Mr. Turner seconded the motion. Vote taken and oarried. Cammittee's report on the sign request of Cantrell and Condon for Albert P. Rogers, Inc., to erect oommercial sign on the ]WI corner o~ Baker Boulevard and Drew street was given. Mayor Brown suggested that the matter be referred back to the Com- mittee on Signs and that the Con.mittee be driven out to look at the sign in question. Consideration was given to petition signed by nine Grove Street property owners ~or resurfacing of Grove street between Lake A.venue and Keystone Drive. Cost of this proposed repair would be approximately $683.00. Property owners requested that re- surfacing be done at the expense of' the City. Mr. Lynn moved that the City Manager be instructed to proceed with the resurfacing of the block mentioned. Mr. Blanton seoonded the motion. Vote was taken and carried. ~tter from American Railroad Transportation Corps was read by the City Clerk soliciting a donation f'rom the City for the purpose of erecting a National Memoria~ IIome in honor of the war dead. Mr. C. L. Darling suggested that source of this letter be investigated should the City have any intention of making a donation. Cmmnisaione~ Blanton moved that City Clerk be authorized to write letter acknowledging receipt of this letter and telling them that under ou~ charter we are not allowed to oontribute funds for Buch purposes. Mr. Turner seconded this motion. Vote was taken and carried. Request of property owners in Mandalay Unit :/15 at Clearwater Beaoh for change of zone ~rombusiness to R-2 (Multiple dwelling) was considered. Petition signed by 30 property owners in this area was read by City Clerk requesting this Change. Re- oommendat~on of the Zoning Board was read by the Oity Clerk approving the requested change,. Mr. John G. Ll.ewelyn requested that the re-~ning embody parking for use of the property ownera in the R-2 zone. Oity Attorney stated that this matter was before the Zoning Board ror reoommendation and that they had not yet reached a decision re- garding parking in B-2 zoning areas. Mr. Dynn moved that Mayor Brown's suggestion be adopted - that the matter be deferred until re- oommendation is given the Oommission by the zoning board, who expect to hold a speoial meeting in the near future for oonsidera tlon of this question. ~Ir. Blanton seconded the motion. Vote was taken and carried. Conmunication rrom Board of Oounty Commission relative to valuation of fore- olosed property was read by City Clerk. Motion was made that the City Manager be authorized to represent the City of Clearv/ater at the meeting with the County Com- mission on ~11y 17th, and ask that the 1950 valuation be the baes bid on the property to be sold. Mr. Turner nade the above motion, Mr. Dynn seconded. Vote was taken and ca rried . Invitation from Board of Oounty Commissioners to attend water conferenoe on Friday~ JUly 6th, at 2:00 P. M. was read by the City Clerk. Mayor Brown recommended that this Dleeting be attended by City Manager, City Engineer, City Attorney. and all oornmissionera V/ho can attend. r.L'his reconunendation was put in the form of a motion by Commissiuner Turner and seconded by Commissioner Blanton. Vote was taken and carried. Bids for crane and half track were opened and read by City :Manager. Bids were submitted by Florida Georgia Tractor Oompany, Tampa, Florida for a Model S 1/3 cu. yd. at $10~486.88, and Model E 4/10 cu. yd. at ~13,850.00; and by the Chapman Machine Company, Tarnpa, for 3/8 yd. Schield Bantam Crane at $10,399.25, 10% discount within ten days. Mr. Turner moved that the bids be referred to the City Manager for study, tabulation, and recommendation at the next regular commission meeting. Mr. ~nn seconded the motion. Vote was taken and carried. Bids were opened for dry cleaning for police and fire departments. Bids were submitted by the Sanitary Oleaners, Clearwater and Hart Cleaners, Clearwater. Cam- m~ssioner Blanton moved thwt the ~tter be referred to the City Manager for tabu- lation and recommendation at the next regular meeting. Mr. Turner seconded the mo- tion. Vote taken and carried. ~abu1ation of bid for tires, tubes and retreads for City Fleet were presented. Recommendation from the Purchasing Department and Publio Service Department was for the Goodyear Tire and Rubber Company, Clearwater. Mr. Turner moved that the City 1ianager's recommendation be followed and that the contract be awarded to this company for the ensuing year. Mr. Iifnn seoonded this motion. Vote was taken and carried. Letter from R. l.1. Thompson Company dated June 20th connnending the work of the Fire and Police Departments in oonnection with the accident of Theodore Ceraolo was read by the City Clerk. This letter is set forth in the ~ollowing pages of these minute~ and made a part thereof. Petition was read by the City Clerk signed by 15 property owners protesting against opening Chestnut Street between Greenwood Avenue and Nissouri Avenue. Mr. Harold Robinson, one of the property owners affected, personally appeared protesting this action. Motion was made by Mr. Turner that petition be accepted and n~de a part of the record. Mr. Lynn seconded this motion. Vote was taken and carried. County Veterans Service Officer Report for the month of May~ 1951, was read by the City Clerk. Mr. Turner moved tbat the report be accepted. Mr. ~nn seconded ths motion. Vote was taken and oarried. Letter and proposa 1 froIn McMullen and Goza on behalf of T. R. Palmer regard- ing the Easterly end of Carlouel Drive was read by the City Clerk. Mr. ~nn moved the aoceptance of this proposal. Mr. Turner seconded the motion. Vote was taken and carried. Mr. William Goza, who appeared ror Mr. Palmer, was instruoted to prepare Resolution for presentation at a later meeting, the Resolution to be approved by the City Engineer and the Beach Erosion Board. Consideration was given to proposed lease of the Junior Service League (a part o~ Lots 9, 10, and 11 just south of water tank on East Avenue). Mayor Brown re- commended tha h the City Attorney be instruoted to draw up the lease in completed fonn embodying the changes suggested at the time the lease was read at a former meeting o~ the Oommission. Mr. t1nn moved that Mayor Brown's recor.mendation be followed and that the lease be presented at the next regular commission meeting for action at that time. Ur. Turner seconded the motion. Vote taken and carried. Proposed quit cla~l deed from the City to Donald Cochran, Jr., was presented by Ben Krentzman, Attorney. This deed is for the purpose of establishing the line between City owned property and Mr. Cochran's property. Mr. ~nn moved that at 1:50 P.M. on Saturday afternoon, July 7th, the Commission will go out and look at the area in- volved in this proposa1. Consideration was given to the appointment of member to Civil Service Board at expiration or the term of :Mr., l~ewton Barlow. Motion was made by :Mr. Turner that Mr. Bar~ow be appointed to sucoeed himself. Mr. ~nn seconded this motion. Vote taken and carried. Oonside~tion was given to bid from W. Motion waa made that offer be declined and party so notified for the reason that this property is in the area Where develop- ment is taking place, that similar bids have been refused and theta ftor develop- ment ia completed all bids of this nature will be considered at tl~t time. Mayor Brown aoknowledged receipt of this letter. C01'llIllissioner Blanton suggested that consideration be given to re-naming and re- numbering some of the streets of' Clearwater. Commissioner Blanton made the motion that a committee be appointed to study this matter on all streets and avenues in Olearwater where there is confliot and confusion. Mr. ~nn seconded the motion. Vote was taken and carried. Mayor Brown appointed Commissioner Turner, Commissioner Blanton, and the City Engineer to this oommittee. Mr. Turner stated that if Oleveland Street is widened in the first blook beyond Greenwood Avenue that there were many unsightly telephone poles whicll should be removed. Soil Conservation Se~vice has recoIrmlended to the Lions Club that Crest Lake be olosed to !'ishing July 15. This measure is advocated in order that the lake will be in good condition for the Lion's Club Fishing Jam- boreo which will be held allout two weeks prior to the opening of school th1s Fall. As you know. the agroement between the Lions Club and the City provideD that the Club make ~easonable rules pertuining to the use of the lake, subject to the approval of the City Commission. It is our desire to !'ollow the recommendations of'th.e biologist and close the lAke from JUly 15th until the date of the Jamboree. We request that the City approve this contemplatod action. Will you pleaso take this up with the ConnnisDion and inform us of' the aotion taken"l The Lions Club has roceived several complaints regarding swimming in the take and the oomplainants seem to understand that we are responsible for the supervision of ohildren Who awbn there. We know fro~ past experiences in Clearwater and elsewhere, that a.pparently hannless changes at the time they were originally made, have later lead to abuses which were never env~saged when the original change in the zoning was granted. We were told during the past week, however, by Mr. Webb Hopkins of' the Zoning Board, that Dr. Davis has sent a new petition to the Zoning Board requesting not only that the zoning of the two lots now bef'ore the GOlmllission be changed, but that of the two lots lyinr, immediately adjacent to, and East of, the lots faoing MisBour~ Avenue, be changed also. These additional l.ots face on Jeff'erson Ave.~ 'Which 1s zoned R-2 on both sides. We knoW" that on one occasion at least, the local manager of the phone company, Mr. Edmunds, ~s stated that if the Dr. Davis property were rezoned and the phone oompany purchased it, they would like to buy the Durant home and remove it to another site and then petition for a change in zoning or the ~lrant ~ot from R~2 to 'Business'. In view of the foregoing facts, we are definitely of the opinion that Dr. Davis does not now have a hardship case, and never has had one. This is; particularly true since j.t is apparent that he is willing to forego the building of a Dental Clinic on the property if he can sell it for a substantial profit and totally ~ithout re- gard of the effect such a sale would have on all property in the area. We further feel, that in view of the new petition now before the Zoning Board, Dr. Davis is not appearing before the Co~ssion 1n good faith or with clean banda.
