The City Commission of the City of Clearwater met in Special Session at City j

The meeting was called to order by the b4ayor.
Public hearing was held on Missouri Avenue and S. A• L. Railroad Crossing. A -
! citizon of the Country Club Estates, bor. Leon Whitehurst, presented the reasons why j
? his community wishes this crossing to be opened. Mayor Brawn asked Mr. Whitehurst
the following question, ?+Isn+t it true that safety for yourselves and your children
is your main object in asking for thin crossing? Safety factors?° The reply was,
"Yeas+. Mr. Whitehurat cited the Engineering Department+s cost figure of X3,000.00.
The Railroad attorneys had estimated that it would coat the Railroad from ?p50,000.00
j to 60,000.00. Mayor Brown stated that the Commission would give the matter further
study and give a report as to its recommendations at a later date. He stated that
a final decision would be made prior to the opening of the school year. ? -

Continued public hearing was held on street and storm sewer improvements in ? ??`:
Mandalay and Mandalay Replat Subdivision on Clearwater Beach {held over from special
meeting of June llth, 1951). Mr. Jack Ransom reported that progress was being made
in aontaating interested property owners, that some of the property owners would
prefer to have only street paving installed at this time and would like to have the
project financed by the issuance and sale of certificates of indebtedness assessed
against the benefited properties. Mayor Brown stated that if a petition could be
brought in showing what the majority of the property owners wished to have done and
if fifty per cent of the cast of the improvements could be furnished by them the '
? City would undertake the work and issue certificates of indebtedness for the balance. ? ?' '?

l Consideration was given to petition from Edgewater Drive Assooiation with ,
reference to dredging West of Edgewater Drive North of Stevenson Creek. Petition r; `r+,"
signed by 147 property owners in this section was presented protesting this action. ,, ?°,,,,.?';?;,
? Mr. Darling, president of the Federation of Civic Clubs, stated that this question "'s ?,:?;
1 had been considered by his fourteen member group, reprasonting 1500 of the tax payers
' in this community. Mr. Maurice Thayer was delegated to present the views of this ..
group. He stated that they were unanimously against such dredging now and in the
future and presented a resolution against having it done. Mr. Thayer asked that the ; {'
Ccm?mission go on record against any sale which would enable dredging to be done anti
I that they adopt his resolution as amended. hir. Turner moved that this resolution be ? ??
included in the minutes subject to its beini; properly executed by duly authorized r ,
officials. Mr. Lynn seconded this motion and it wa?a carried. The feeling of the `-k .,
Commission was that any dredging operation spoils the scenic beauty of this Urive ;, r.?,
not only far the property owners residing there but for all of Clearwater and its ,:?; .r,..,y;, ..' ?:
visitors. They felt that if such operations are tolerated one of b? Clearwater+? ?'
greatest economic and aesthetic assets will be destroyed with great consequent loss ?''

WHEREAS, the City bSanager of the City of Clearwater, Florida has submitted an estimate "
of the amount of money necessary to carry on the City Government for the fiscal year
beginning July 1st, 1951 and ending June 30, 1952; and
WIiEREAS, the City Commission has, in meeting duly assembled, examined carefully, con-
sidered, and approved the same; and
WHEREAS, the Tax Assessment Ro11 has been submitted to the City Conm?ission in correct

That the Mayor and City Commission enter a protest to the proposed sales to certain
persons as oovered in paroels pending for action of the Trustees of the Internal
Improvement Fund of the State of Florida on July 3rd and July 17th, 1951, covering
parcels on the west side of Edgewater Drive on the grounds that the parcels fn
question are in the territorial limits of the City of Clearwater and that the parcels
involved and other parcels on the west side of Edgewater Drive between Stevenson Creep
and the Dunedin City limits should be acquired and kept for parks and other purposes3
which would add to the beautification of the city.

The undersigned own or occupy homes on or adjacent to the Clearwater-Dunedin
waterfront north of Stephenson?a Creel:.
We selected this location far our homes because it is close to Clearwater Bay,
ane'a because of the beautiful and unobstructed view of the water e;vailable in this
locality.
We are now advised that certain real estate speculators are planning to dredge
fills or 'fingers" out into Clearwater l3ay in this area, and erect buildings; thereon.
Any auah development would destroy the beauty of the bay shore area, would remove
the chief attraction that caused us to establish our homes here, and would greatly
depreciate our property values.
W® therefore respectfully and urgently petition the City of Clearwater, the
?'?:,:;?, City of Dunedin, the Trustees of the Internal Improvement Fund of the State of Florida.,
"??=? the United States V?ar Department, and everyone else having any jurisdiction or con-
trol of this nmtter, not to permit any such dredging or filling in this area under

RES'OLUTT ON
WiiERF?#S the scenic drive extending along the waterfront of Clearwater Ray from the
business district of the City of Dunedin, Florida, to Stev®nson+s Creek in the Gity
of Clearwater, Florida, is one of the moat beautiful waterfront drives in the State
of Florida.;
AND ti ? S said waterfront in said area forms the basic thecae of City planning and
beautifioation for both the City of Dunedin and the City of Clearwater, Florida,
and is of great value and a municipal and public asset of both said cities;
AND i'?iEREAS the alteration of said waterfront by the dredging, filling and develop-
ment for building sites in any part of the area lying between said waterfront drive
and the waters of Clearwater Bay would result in inestimable damage to the scenic
beauty and residential desirability of both the City of Dunedin and the City of
Clearwater, thereby detrimentally affecting alI property values and the rights of
all of the citizens of both said cities;
AND WiiERFAS the water of Clearwater Bay in the area irunediately adjacent to said
waterfront drive and navigable to boats and other craft that ply the waters of said
bay and the Gulf of Mexico, a large number of which said boats and craft are owneQi,
by citizens, residents, and tourists of the cities of Dunedin and Clearwater, which
said navigable waters and shore line of Clearwater Bay afford landing, mooring and
docking facilities for said boats and crafts and further afford access for ingres&
and egress to the channels of Glearwater Ray and to the Gulf of btexico for all oP
the citizens of said cities; that any substantial alterations of said shoreline or
the waters of Clearwater Bay in the area aforesaid would seriously and detrimentally
affect and permanently damage said navigation facilities and righta? of ingress and
egress to the waters aforesaid;
NOW TiiEREFORE be it resolved by the City Commission of the City of Clearwater, Florida,,
in special meeting assembled this 25th day of June, A.D., 1951, that this Commission
is unalterably opposed to any filling or dredging operations which would in any wise
affect the present shoreline of Clearwater Bay in the area lying between the business
section of the City of Dunedin and Stevenson?s Creek in the City of Clearwater and
this Commission in behalf of the citizens of the City of Clearwater would view with
alarm and distress any plans, acts or omissions of any public body or agency or a+ny
private persons or corporations which would in any wise contribute to the s?lteration
of said shoreline.

The meeting was called to order by the Ma�ror.
Public hearing wae held on NIissouri Avenue and S. A. L. Ra,ilroad Grossing. A
citizen of the Country Club Estates, B4r. Leon Whitehurst, presented the reasons why
his community wishes this crossing to be openad, r4ayor Brown �sked hlr. Whitehurst
the foll'owing quea�ion, ��'IsnTt it true th�t sa£aty for yourselves and your children
is your main object in aaking for this crossing? S'afety factors?° The .replg was,

The R�ilroQd attorneys had estimated that it would cast the Railroad from �p50,000,00
to �60,000.00. t�ayor Bxown statod that the Coirunission would give the matter further
study and give a report as to its recommendations at a iate� date. He stated that
a final deciaion would be made prior io the opening oz thg school year.
Continued public hearing was hald on street and storm se�ver 3.mprovemeni� in
Mandalay and Mandalay Replat Subdivision on C1ear:vater Beach (held ovor from specia�.
meeting of June llth, 1951). Mr� Jack Ransom repor�ed that progress was bein� made
in contacting interested property owners, that some of the proparty owners would
prefer to have only atreet paving inst211ed at this time and tivould Tike to have the
project financed by the issuanee and sale of certif3cates. of indebtedness assesQad:.
agains�t the benefited progertieso Mayor Brown atated that if a petition could be
brought 3n showing what the majority of the property owners wished to have done and
3f fift�• per ceni: of the cost of the improvements could be i'urnished by them the
City would undertake the work and issue certificates of indebtedness for the balance.
Consideration v�as given to petiti_on fro� Edgetivater Drive As�ociation wi�}z
reference to dredging Wast of Edgewater i�rive North of Stevenson Creek. Petition
signed by 147 property owners in this section was presentad protesting this actiori.
Mr. Darling, President of the Federation of Civic Clubg., sta��ed that thie question
had been con�idered by his fourteen member group, representing 1500 of tlze tax payer�
in this com,`nunity. Mr. IaIaurice Tl�ayer was delegated to present the views of this.
group. He statod tliat they vrere unanimously against such dred�in� now and in the
future and presentad a resolution aga3net having it dona. �4r. Thag er asked that the
Commiasion go on record againat any aale which would enable dredging to be done and
that the,y adopt his res�olution ae amended. I�ir. Turne� moved that �his resolution be
includec: in the minutes subject to its being properlg executed by dulS authorized
officials, Mr, Lynn eeconded this motion and it wa�srcarried. The feelin� of the
Commissioin was that ariy dredging o�eration spoils the scenic beauty of. this Drive
not only for the property oUrners residing there but for all of Clearwater and it�
uiaitorso They fel� that if sueh oper•ations are tolerated one of �.a Clearwate���
greatest economic and aesthetic assets will be destroyed with great consequent loas
to the community. Com�nissioner Blanton moved tl�at the resolution be passec� as
amended. Mr. I,ynn seconded the motione It was carried. n�Iotion was made by R4re Lynn
�o instruct the Citg Attorney to proceed with a briefing to see what the rights of
the City are in regard to preventing the sale of propert� involved in the proposed
dredging, This motion was seconded by i,.r. Turner and carried.
Mr. VJil7.is Owens and Mr. Leo Butler, Civil Engineer, appeared before the
Corrimisaion to explain proposed ckianneT dredgin� from eight feet at I�tarinas to e3.ght
feet at Little Pass and the closing of the abandoned channel l�ay3.ng iuunediately to
the North of the new channeT. They asked that a lettar ba written to the Distric�
Engineer, U. S. Army En�3neer, Jacksonville, Florida, asking permission to dredgs
the channeS and showing the approval of the City Comm:ission of the project. A letter
was drafted to be s3�ned by the City Mana,gor and a mo�ion was made by Mr, Blanton
that proper City officials be authoriz,ed to execute the letter and hold it in
aboyance until such time as Mesars. Orvens, B�akin at al ilzrnish an aerial map or
photograph to be approved by the City Managere h�Ir. Turner seconded the motion and
it was carried.
Mr. Turner moved that the City Iuianager�s recommendation for purchase of a
police cruiser from the Thayer Pdotor Company in the amount of $�640,AO net be approved.
�Ir. Lynn seconded the motion and it was carrier3. �
Mr. Turner moved that a Plymouth station wa�on in the amount of �p1,790,00 be
purchasod f'rom the Thager Motor Compang for the Recreation Dspartment as recrnrmiended
by the C3ty Managere Mr� Lynn seconded the mot3on and 3t was carried.
Nir. Turner moved tk�at the recommendation of the City Manager tha� the first
floor of the C3ty Hall be painted by H. H. Fre3dt, whose bid r�Rs in the amount nf
�605.5D. Mr. Blanton seconded the motion. Motion carried,
Tentative bud�et for i'iscal year beginnin�, July l, 1951, and ending June 30,

of tha amount of money neceasary to carry on the City Government for the fiacal year
beginning July lst, 1951 and ending June 30, 1952; and

AND WHEREAS sa3d v�aterrront in said area forms the baaic therne of City planning and
boautification fo� both the C3.t�r of Iluneain and the City of Clearwater, Florida,
and is of �.reat value and � municipal and public asaet of both said cities;
AIJD WHEREAS �the alterat3on of s�,id waterfront by the dredging, filling and davelop-
me�t for building eites�. in any part of the area lying between said waterfront drive
and the v�aters oP Clearwater �ay would result in inestimable damage to the seenic
beauty and residential desirability of both the City of Dunodin and the City oP
