The Oity Commission of the City of Clearwater met in Regular Session at the City
Hall, Monday, June 4, 1951 at 7:30 P. 11. with the following members presentr

The meeting was called to order by the Mayor. ~~e Clerk reported that he had
oorrected para~raph 7 or thA minutes of May 21st to show Commissioner Turner's motion
as follows: Commissioner Turner moved that the City Attorney and the City Manager be
authorized to proceed with this project tmmediately and notify Mr. Kennedy, Mr. Strick-
land and other property ownera ooncerned of the CODll1ission's intention to open Laura'
Street and hard surfaoe Prospect Avenue from its intersection with Laura Street to
its interseotion with Cleveland street. Commissioner Blanton moved that the minutes
of the regular meeting of May 21st be approved as correoted and the minutes of the
Speoial Meeting of May 28th be approved. The motion was seconded by Commissioner Lynn
and it carried.
Llrs. Bruce Taylor for the Junior Service Lea gue s ta ted tha t they had examined the
proposed lease on part of Lots 9, 10 and 11 just south of the water tank on East
Avenue and stated they had approved the rough draft drawn by the City Attorney but
desired the recapture clause be ninety days instead of thirty days. Commissioner Lynn
moved thBt the City Engineer be authorized to prepare a sketch and that the matter
be referred to the Lease Committee for its study and report at the next regular com-
mission meeting. The motion was seconded by Commissioner Turner and it carried.
A petition was read by the Clerk from owners of property along Stevenson Creek
for the Commission to consider and investiga te the possibility of a dlUll across Steven-
son Creek, located in the vicinity of present railroad trestle. The Mayor suggested
a letter be written to the petitioners giving them the City's ideas on this projeot
and alao suggesting the petitioners contact Mr. Schwartz of the SolI Conservation
Service on this project. Commissioner Blanton moved the petition be acknowledged and
the petitioners be advised that the consensus or opinion of the Conmission was that
it be developed among the abutting property owners by forming an association and oon-
tacting Mr. Schwartz of the Soil Conservation Service and tlwt after obtaining the
consent of the abutting property owners that they report to the City Commission at
~~e later date. The motion was seoonded by Commissioner Lynn and it oarried.

.. A petition was presented from property owners in Belleview Court with referenoe
to General Ready Mix Concrete Conpany's conducting a manufacturing business in an
R-2 residential area. Commissioner Blanton moved that this matter be referred to a
committee and report at a later date. The motion was seconded by Commissioner Lynn.
It was suggested the committee investigate the operating of the plant during day ttme
hours only; the General Ready Mix Concrete stay on their own property and keep their
storage of blocks off of McLennan and E Street. The Mayor appointed the Commission
as a whole as a committee to investigate this matter first hand.
The City Manager presented a plat of Skyorest Subdivision Unit No.6 and Unit "DIt
for the approval of the City Commission. Commissioner Turner moved that the plat of
Unit "D" and Unit 6 of Skycrest ~ubdivision be accepted. The motion wa s seconded
by Commissioner Blanton and it carried.
The City Manager presented a plat of Oak Acres Subdivision for the Commission's
approval. The City Manager stated the engineer had checked the plat but the City
Attorney has not had an opportunity to look it over. Commissioner ~nn moved that
the Commission accept the plat of Oak Acres Subdivision subject to the City Attorne1's
approval. The motion was seconded by Commissioner Blanton and it oarried.
The Zoning Board made a report on the sign request from Cantrel~ and Condon,
Albert P. Rogers and B. A. Redmond and stated their recon1ll1endation was the request
for signs be denied. The City Attorney stated that the request or B. A. Redmond was
not a request for a commercial sign but the sign Mr. Redmond wanted to erect was a
point of purchase sign. The City Attorney then stated that the point of purchase
sign, aa defined in the City Code, left the size of point of purchase signa wide
open. It was suggested that the City Attorney delve into the sign ordinanoe regard-
ing point of purchase sign and amend the section if he believes it is desirable.
Commissioner Turner moved that the application of Cantrell and Condon and Albert P.
Rogers for request for sign be referred to the Commission as a whole for inveati-
gationo The motion was seconded by Commissioner Blanton and it oarried. Commissioner
Turner then moved that Mre Redmond's application for point of purchase sign be granted
and he be given permission to ereot sign at the location requested. The motion was
seconded by Commissioner Blanton and it carried.
The Clerk read a letter from the Zoning Board wherein they stated that the re-
quest of Dr. J. K. Davis tor exoeption to the Zoning Ordinanoe to erect a dental
clinio on Lots 20, 21 and 22 of R. H. Padgetts Subdivision be approved. Commissioner
L,.nn moved that Dr. Davis' request be studied by the COIIlIIlission. The motion was
seoonded by Commissioner Blanton and it carried.

The City Manager submitted a tabulation of bids and ~ecammended the purohaso ot
a coal oonveyor f'rom the Northern Conveyor Company at e price 01' $l,l30~OO. Oom..
missioner Lynn moved that the City Manager's recommendation be followed and the ooal
conveyor be purohased from the Northern Conveyor Company. The motion ~as seconded
by Oommissioner Turner and it oarried.
The City Manager stated they had advertised the sale 01' chairo from the auditorium
and had reoeived two answers to the advertisement, those being from L. G. Harris for
$85.00 and the Knights of Pythias for $100.50 and reoommended the ohairs be sold to
the Knights of' Pythias as the high bidder. Commissioner Turner moved that the proposal
of Knights of Pythias be aooepted. The motion was seconded by Co~iasioner Lynn and
it oarried.
The City Manager presented a tabulation of bids for automobile insursnce and
stated it was the Purchasing Department's and the Finanoe Department's reoommendation
that the bid of Bruoe Taylor for ~1,906.25 be acoepted. The City Manager reoommended
the bids be referred to the next oommission meeting so that he oould investigate as
to why the low bid was not aooeptab1e to the Purohasing Department and the Finanoe
Department. Commissioner Blanton moved that the matter be referred to the next oom-
mission meeting. The motion was seoonded by Commissioner Lynn and it oarried.
The City Manager opened one sealed bid for the shelving at the library. This bid
was from the C1earvroter Construotion Company Mlerein they stated they would oonstruot
92 ft. of Shelving at a oost of $851.00 and added the additional oost of $210.00 for
six desks ~king a total bid of *~1,061.00. Commisoioner Lynn moved ~lat the matter
be referred to the City Manager ror his tabulation, reoODDnendation and Jr'eport. The
motion was oeconded by Commissioner Turner and it oarried.

Commissioner Turner moved that the ~tter be rererred to the City ~funager for his
tabulation and study and recoLLmendation. The motion was seoonded by Commissioner
Dynn and it oarried.
A request was presented from T. R. Palmer for Commission to conaider the dead
end of Car1oue1 Drive at the Bay, private property, and not a publio street, so that
the property owners can improve this street end as they have Hobart Drive and Palmer
Road just northwest of' Car1oue1'Drive. The City Engineer and the City Manaeer re-
oommended the olosing of the street. Commissioner Lynn moved that the matter be
referred to the Beaoh Lease Committee for its consideration and study. The motion
was seconded ~ Commissioner Blanton and it carried.
A request was presented f'rom the Country Club Association requesting that before
the Commission make any recormnenda tions on the Missouri Avenue oross1ng to meet with
the Country Club Association in the very near future and discuss the matter with them
so that they can represent to the Commission their a~a and object in having MisBouri
Avenue open across the railroad tracks. It was suggested the Country Club Asso-
oia tion Bnd the ra,1l1'oad be notified tha t the Commission will hear both sides of the
opening o~ M1ssouri Avenue. Commissioner Blanton moved that the property owners be
instruoted to meet with the Committee for disoussion on the point of opening of
M1ssouri Avenue. The motion was seconded by Commissioner Turner and it carried.
The C1erk read a letter from the Finance Department requesting the loan or
$20.000 from the Utility Departnent Fund to the General Fund. The City Manager
reoonnnended the transfer of the $20,000 to the GeneraJ. Fund from the Utility Depart-
ment instead of a loan BO that the bookkeeping will be out down. Commissioner Turner
moved that the City Manager's recommendation and the City Treasurer's recommendation
be followed and that the $20,000 be transferred from the Utility Department acoount
to the General Fund. The motion was seconded by Con~1ssioner Lynn and it carried.
A report was reoeived from the City Auditor on the fiscal pe~iod of JUly 1, 1950
to January 31, 1951 and stated that the books are in complete balance and suggested
the release of the Surety Bond on the former City Manager, Mr. Boyd Bennett. City
Manager agreed with the commendations of the Finance Department and the City Auditor.
Commissioner Lynn moved that the City Treasurer's recoomendations be aocepted and
the Surety Bond be released on Boyd Bennett. The motion was seoonded by Commissioner
Turner and it oarried.
Captain Bill Meyer appeared on his own behalf and stated he desired the City Com-
mission to look into and try to oorrect the solioiting on the City Pier. Mr. A. T.
Cooper, Jr. stated there has been a lot of skullduggery being oo~aitted down at the
dook and they have affidavits to prove it if the Commission desired them. The City
Manager stated he believed it was up to the sea oaptains to settle the issue among
themselves. Commissioner Blanton stated that in previous minutes it will be shown
that he had made a motion that if any soliciting was go1ng on at the City dock that
the person doing same would have to leave the City Dock. COlnmissloner Turner moved
that the positions of dook masters of Mao B. Newman and Fred Wright at the City Pier
be revoked and the new dook master, o. G. Haggert take over the City Dook and trat
all information booths and all signs at the entrance of the pier be ~vsl~~ imme-

Mr. W. D. OWens appeared and stated there would be about five more days of pump-

Oommissioner Blanton, reporting for ~e Court ~treet Extensi~n Oamm1ttee, stated
that Mr. Kabrich has progressed rapidly in securing the r1.ght-ot'-"ay for Court
Street Extension and he has now reached the point where ~e Cor.m1ss1on w1.l1 have to
authorize the agreements. City Attorney suggested that the City Comm1ss1.on either
make an appropr1ation ot a lump 8um and authorize the use of the mone~ under the
direotion of the Court street Extension Committee t~ purohase the rights-of-way or
wait a oouple of days and have a speoial commission meeting to approve each right-of-
way. It was decided that a speoial commiss1on meeting w11l be oalled.

resignation of Mr. Boyd A. Bennett, City Managers We have reviewed this audit, whioh
1s of course merely a routine audit which establishes the books to be in c~plete
balance.
Since neither the audit nor Mr. Turnburke's oOllmlenta indioate G'ny irregularit'Y in
operation during that period, I would appreciate it if you would ask ~e Commission
to approve the release by ~e City o~ the surety bond held on Mr. Bennett when he
was City Manager.

In oonneotion with our reoent conversation regardinp, the possible availability of
oash for transfer trom the Utility Revenue Fund to the General Operating ~Und, I
would like to suggest, if it meets with the approval of the Commission that a
transfer be approved by the Commission of a $20,000.00 item carried on our books
as a loan to the General ~undJ to be repaid without interest within ten years.
I offer this sur,~estion because of the excellent cash and profit position ot
the Utility Revenue Fund on this date and also that authorization of suoh a
transfer would enable us to remove this aocount from both the General Fund and
the Utility Revenue ~und books before the olose of the present fiscal year.
The above mentioned loan was approved by the City Commission Deoember 26, 1950 tor
the down payment and purchase of Gulf frontage lots from Mr. Ruder.

At the regular meeting of the Zoning Board held Tuesday evening May 29, 1951, a
motion was made and carried that the request of Albert P. Rogers, Inc. to erect
oommercial sign on the N. W. corner of Baker Boulevard and Drew st., Cantrell
and Condon on Baker Boulevard (between Drew and Ridgewood St.) end B. M. Redmond
at 1824 N. Ft. Harrison Ave., be denied.
The Board feels that the erection of these signs would be a violation of Ordinanoe
#592, Section 2, Item "A".

At the regular meeting ot the Zoning Board held Tuesday evening, May 29, 1951, a
reoommendation was made that the request of Dr. J. K. Davis asking an exception to
the Zoning Ordinance to erect a dental clinic on Lots 12 and 13 of a subdivision
ot Lots 20, 21 and 22 of R. H. Padgetts Subdivision be approved.
The Board suggests that the City Commission consider the lessening of the front
set back line due to the fact that Dr. Davis has given 25' (twenty-five feet) of
his property for t he widening of Missouri Ave.
Attached herewith is a oopy of .l.ir. Davis request also a copy of the City Attorney
Ware's opinion on the same.

PETITION
We, the undersigned, owners of property along Stevenson's Creek and adjacent thereto,
respectfully petition the City Commission of the City of Clearwater to consider and
investigate the possibility of a dam on Stevenson's Creek looated in the vicinity
ot the present railroad trestle. At the present time, due to the intlux of salt
~ter on Stevenson's Creek from the Bay, it is creating an undesirable situation
fram the viewpoint of a breeding place fo~ sand flys in Stevenson's Creek, and also,
during low tide, there is created an annoying odor.
It is proposed that the City Commission build a dam at the trestle a tDre said and
craate a fresh water lake by raising and maintaining the level of Stevenson's Creek.

Gentlemen:
We, the undersigned residents of The Belleview Court area in Clearwater, respectfUl11
request that you take the necessary aotion to prohib1t the present use of that por-
tion of the Atlantio aoastlin~ Railroad property now being oooupied by Genersl Ready
Mix Concrete Company.
We all reside in an R-2 residential areas. The General Ready l1ix Conorete Oompany
is oonduoting a manutaoturing business on this property in suoh a way as to oonstitute
a publio nuisanoe.
The Company manufaotures concrete and conorete products at this plant, and uses
large quantities of sand and other materials which are delivered by train. These
trains load and unload throughout the night, and the plant itselt is operated tram

We feel that this is a matter which can and should be oontrolled by the city, and

Albert P. Ro�ers a�d B. A. Re3ucond and stated their recomnendat3on �as the request
for signs be danied. The City Attorney stated that the request of B. Ae Redmond was
not a request for a co�ercial sign but the sign Dir. Redmond wanted to erect was a
point of purchase sign. The C3ty L�ttorney then statied that the point oi purchase
sign, as defined in the Ci�4 Code, left the size of point o£ purchase signs wid�
open, It rvas suggested thet tlze Cit,y rlttorney de7.va into bhe sign ordinance regard-
ing point of purchsse sign and amend the section if he believes it is desirable.

The C3ty Manager presented a tabulation of bida fbr automobile insurance and

the bids be referred ��,o the next commiss3on meeting so that he cou�d �nvestigate as
