It was moved by Conunissioner 131ack that the minutes ot the meeting ot
January 15th be approved in accordance with the copY' thereot' furnished each mem-
ber in writing, and that their reading be dispensed witll. The motion was
seconded by Commissioner Turner and carried.
The City Manager reported that he had received a letter trom Mr. Clarence
Bruner stating that he would not be willing to pay 4Pl,400.00 toward the oost ot
a Marianne street sewer installation. Mr. Al Rogers stated that he thought 18
inch pipe might be larp;er than T/ould be absolutely necessary and 8Jl1aller pipe
might be used at less expense. He said he would be willing to contribute his
share. The City Attorney said that according to a Speoial Act ot the State Legis-
lature of 1937, provided 1'01' financing improvements on a Special AssessD1ent basis;,
that it had been impossible to get tinance companies to handle seourities backed
by improvement liensl for several years. He suggested new legislation to provide
tor assessments against any benetited property. He said that Mr. Cook, ot Van
Ingen and Company, bond brokers, would undertake to write an aot and prepare an
issue ot Securities on which they would bid. He said Mr. Cook would be glad to
prepare 8 prospectuB and to appear before the Commission to disouss it. Com-
missione~ Black moved that the Commission have Mr. Cook, ot Van Ingan Company,pre-
sent hi8 prospectus and that the City Attorney be instructed to prepare an amend-
ment to the City Charter providing tor the assessment of Speoial Improvement.

The motion was seconded by Commissioner Turner and carried.
The City Manager submitted a letter from Mr. J. A. Novotney in which
letter Mr. Novotney requested that he be permitted a 10 tt. Bet back on Coronado
Drive instead of the 20 ft. setback now required. The affected property is des-
cribed as Lot 55, the North 40 tt. of Lot 56 and the North 30 tt. of Lot 103,
Lloyd-Vlhite-Skinner Subdivision. The reco~wendation of the Zoning Board was that
the application be denied. Mr. Novotney and Mr. William Goza addressed the Com-
mission rela ti ve to the request. Commissioner Turner moved that a publio hearing
on Mr. Novotney's request be set for two weeks trom this date and that the proper
legal notices be given. The motion was seconded by Commissioner Black and carried.
The City Manager submitted a request by Mr. M. J. Beasley that he be per-
mitted to erect an automotive servioe station on Oulf-to-Bay Boulevard together
with blue prints, specifications and the Zoning Board's recommendation that the
request be granted. Cornrnissioner Black Dloved tha t pennis/don to erect a Service
Station at the proposed location be granted. The motion was seconded by Com-
missioner Lynn and carried.
Captain W. M. Meyer, owner of the boat, Sea Fever, told ~le Commission that
it was his understanding that boat owners operating out or the Municipal Dock,
in front of the Auditorium, had agreed that there would be no soliciting on the
dock. He complained that some of the operators were selling tickets on the dook.
That in some instances people would get on hia boat and present a ticket good
only on some other boat. It was moved by Commissioner Blanton, seoonded by Com-
missioner Turner and carried that Captain. Wright and Newnan be instructed to dia-
oontinue ~le praotice and that any violator lose his rights to use ot the dock.

The City Manager presented a letter addressed to the Commission by Marshall
and Rives on behalf of their clients, Francena Tyner and ,Ida M. Betstord, re-
questing that the C01l1mission grant an extension of at least one year to the exist-
ing three year lease, which expires July 15, 1951. Commissioner Turner moved that
the matter be referred to the Beach Lease Committee for its consideration and a
report. The motion was seconded by Commissioner Lynn and carried.
The City Manager 8ubmitted a petition bearing the signature of riVe per-
sons requesting that paving and a sanitary sewer be installed on Bay Esplan~de
and Royal Way to h~ndalay Road' or that the owners be permitted to construot a road
and sewer and finance the program themselves. The City Manager estimated the cost
ot paving at $11.00 a running foot and the cost ot a sanitary sewer at $4.60 per
running toot. Commissioner Black moved that consideration ot the street improve-
ment be deterred until the next meeting and the Commission can have a breakdown
on the $11.00 per front foot cost and that the Attorney be instructed to prepare
the necessary paper8 for a publio hearing relative to the sanitary sewer.
The City Atto~ney reported that Section 13 of Chapter 15 ot the City Code
prohibits the employment ot minors in plaoes of business where alooholic beverages
are aold, whereas the State Law permits the employment ot minors in such plaoes
where alcoholic beverages are not Bold tor oonsumption on the premises under which
oircumstanoes minors in the City of Clearwater are be1ng deprived ot emplo1ment '
1n pract1cally all grocery stores in the C1tYe The City Attorney presented and
recommended 1mznsd1a'te passage ot Ordinance No. 605, same being an 01>dinanoe to

The Oity Attorney reported that the City had by resolution May 3, 1948
dedioated Lincoln Avenue from Oleveland Street South througll Lots 25 and 32,
Padgetts Estates. It was moved by Oommissioner Turner, seconded by Oommissioner
Black and carried that the Attorney's report be accepted and the proper persona
notified.
The Oity Attorney reported that he had oontaoted the members of the Barbers
Association; that the Barbers Association had had a meeting and they were no
longer interested in any portion of the Ordinanoe relating to the operation o~
Barber Shops and Barber Examining Board, and they recommended the repeal of the
Ordinance. The Oity Attorney presented Ordinance No. 604 which would repeal that
portion of the Oity Code relative to the operation of barber shops ~nd the Barbera
Examining Board. Commissioner ~nn moved ~lat the Ordinance be passed on ita
first reading. The motion was seconded by Commissioner ~lrner and carried. Com-
mis8ionel~a Brown, Black, Blanton, Lynn and Turner voted "Aye". There were none
opposed.

The Oommittee on acquiring of property ror the extension of Grand CentraL
street had no report to make at this time.
The report of the Oommittee on Ooachman Heights and Oourt Street ex-
tension was deferred by consent.
Oommissioner Lynn's report for the Committee on aoquiring or propertY' for
the widening of Osceola Avenue stated that they had conrerred with the attorneys
for Mr. W. L. Thomas; that Mr. Thomas' proposition Was not favorable and that the
Oommittee recommends that Oondemnation Proceedings should be instituted. Oom-
missioner Turner moved that the Committee's report be acceptod and that the Oity
Attorney proceed with the acquisition of property under the right o~ Eminent Do-
main. The motion WaS seconded b~ Oommissioner Black and carried.
On a motion by Oommissioner Turner, which waB eeoonded by Oommissioner
Blanton and carried, Ordinance No. 603, the Trailer Ordinance, was passed on the
second readin~ by title only. Commissionera Brown, Black, Blanton, L~nn and
Turner voted Aye". None opposed.
The City Manager presented a statement rendered by Attorney Ben Krentzman
for representing the City before the Circuit Oourt on Appeals from Municipal
Oourt in the oases of Maurice C. Simpson and William Roy Johnson for feea in the
amount of $150.00. It was moved by Commissioner Turner ttwt the payment of the
attorney's fees be approved. The motion was seconded by Commissioner Lynn and
carried.
The Oity Manager submitted a statement from Attornoy Ben Krentzman ~or a
fee of $400.00 for legal services in defending the suit of Daniels Sign Company.
Oommissioner Turner moved that the attorney's fee of $400.00 be paid. The motion
was seoonded by Oommissioner Blanton and carried.
It was moved by Commissioner Black, seoonded by Oommissioner Lynn and
carried, that the request of the St. Oecelia Ohuroh for permission to erect a tem-
porary sign across Cleveland Street at the intersection of Osceola Ave. be grGnted.
Commissioner Black moved that the Ohief of Police investigate the traffic
prOblem at Oleveland Street and Osceola Avenue and take what action he deems
necessary. The motion was seoonded by Oommissioner Blanton and carried.
Commissioner Turner moved that the Street Department proceed to Semin01e
Street ~nd North Garden Avenue and break the curbing so that the streets will be
co-terminus and that they repair the streets at that section. The motion was
seoonded by Commissioner Blanton and carried.
Conmissioner Black moved that the Oity Attorney's suggestion be followed
re1atiye to obtaining a survey of various railroad orossings, and that a Committee
be appointed to assemble facts relative to all crossings so proper act10n may be
taken. The Mayor appointed C01JlIIlissioner Turner and Blanton on a Coramittee to 1n-
yestigate the need for blinker lights or other safety devices for rs11road orossings.
The City Manager submitted the request b,. Andrew P. Niohols that Lot 2"
less the Weet 80 ft., Block 28, Mandala,.; be re-zoned as a hardship cBse, toge~her
wi'th the Zoning Board's recommendation that the request be denied. It was moved
by Commissioner TUrner that this uattar be advertised for public hearing to be
had two weeks from this date. The motion w&s seoonded by Commissioner Lynn and
oarried.

a client to purchaso Lots 37 to 40 inclusive and Lota 43 to 49 inolusive of
Blocl{ B of Navajo Park Subdivision at $250.00 per lot. It was Dloved by COlll-
missioner Black that the matter be referred to the land A.ppra1sal Committee for
a. report to be raade at their convenience. The motion w~s seoondod by Com-
missioner Lynn and carried.
The City Manager submitted two resolutions which would require certalin
property owners to clean their lots of grass, weeds and underbrush. On B' motion
~rom Con~iss1oner ~lrner, which was seconded by Commissioner Black and carried,
the resolutions were adopted.
In accordance with the City t~anagerrs report it Vias moved by C01ll1nissioner
Blanton, aeconded by Commissioner Black and carried that no objeotions would be
f'iled by the City on the dredging and fillinp; of land on the south end o~ Clea.r-
we tel' Beaoh Island as applied for by Messrs. OWens, Brumby, Baskin and lIancock.
The Oi ty Manager reported tha t he had approved the following gas and
water main e~tensions costinr, less than $300.00:
(a) Jan. 22, 1951 - 180' of lilt gas n18in on Somerset street to serve
four (4) custOli1erS at est1rw.tod cost of ~85.00
(b) Jan. 22, 1951 - 200' of 2ft gaa main on Pierce Street to serve
one customer - estimated cost of $140.00
On s' motion by Commissioner Turner, which was seconded by Commissioner Lynn and
carried, the City Manager's' report was accepted.
Commissioner Black addressed the other members of the Connnission re1f1ltive
to oondi tlons on the beach and the accumulation of dirt and debris and the need
o~ a beautifics tion a'nd clean-up program. lIe suggested the possibility of pur-
cha sing a beach cleaning raft-chine. Commissioner Black l'Jloved that the matter of'
beach beautifioation and clean-up be referred to the City Planning Board for the
Board's Dmmediate study and recon~endations ~nd further explo~tion of the possi-
bility of secur1.nr; an agreement fl"'om private owners of beach property to grant
permission and use of their property by the public in accordance with the plan
submitted to them. The motion was seconded by Commissioner Iwnn a.nd carried.
The Clerk read a letter sddressed to the Commission by :Mr. Arthur W.
Jordan.. Jr., in which Mr. Jordan tendered hio resip;nation as Mun:f.oipa1 Judge to
be ef'fective January 31, 1951, due to his having been recalled for active serv1ce
with the Navy. Commissioner Lynn moved that Mr. Jordan' 8' resip;nation be a-coepted
with regrets and that a letter be written to him commending him for his fine work.

The Clerk read a letter addressed to the Connnission by City Manager Boyd
h. Bennett~ tendering his resignation as City Manager to be effective at the
pleasure of the Commission and requesting that an audit be made of the Cityis
accounts from June 00, 1950 to the date his resignation bec~les effective. It
was moved by Commissioner Blanton that 11'!r. Bennett's resigna t10n be accepted as
of February 1.. 1951 and that his salary continue to March 1st and an audit be
made as' sugr,ested by Mr. Bennett. The motion was seconded by Oonnnissi oner BJ.l1ck
and carried.

tendered his resignation i'rO!.'l the position of Associate Municipal Judge. Mr. Black

Judge. The motion was seconded by Commissioner LY1ID and carried.

appointed as Acting City Manager for a n unspecified time. Motion wa's seconded by

should be appointed to act as a Director of Civilian Defense, possibly with the
title of' Coordinator of Civil Defense. Commissioner Black ~oved tbAt Captain

water to cooperate with the City Cmamission and the Director of Civi1~an Defense.

mission~r ~nn th&t February 22nd be declared as Civilian Defense Da1 and that
Mr. A. C. Drew be advised to that effect. The motion was seconded by Connn1asionel"

The Oity :Manager submitted a letter from Mr. Trwnan H. EHrns, Jr., Captain
U. S. A. F. R. requesting per.mission be granted to Voluntee~ Air Reserve T~1ning
~or use of the Municipal Court Room as a ~egular meeting place on Thur~ay nights,
exoept such nights as the City would need the C~~rt Room for its own use. Com-
missioner Turner moved that the request of per.mlssion for using the Court Room be
granted and that Mr. Sima be adviDed to that effect by letter. The motion waa

ing for the past three weeks in the Police Oourt Room with the per.mission of
Police Chief McClamma. Vie need to he ve a Ie tter to the ef.fect that we may
regularly meet here at 8 p:ll on Thursday nights except, or course, if the city
has need of the court room due to unforseen conditions.
By giving thia permission, you will do a great service to the reservists in
this area who are about to return to active duty and who wil1 receive training
at these meetings which will be of use to them in the service.

SECTIon 1. That Section 13 of Chapter 15 of the Code of
the City o~ Clearwater, Florida, 1950, be and the same

shall ornploy any person under 21 years of age. It

The City tvianager reported that he had received a letter fro� Itir. Clarence
Bruner stating t}�at he rvould not be willing to pa� �1,400o0U toward the cost of
a b4arianne Street sawer installation. Lir. A1 Rogers stated that he thought 18
3nch pipe might be lar�er than e�ould be absolutely necessar� and 5�aller pipe
might be used at less expense, He said he vlould be n�illing to contribute his
sh�re. The City Attorr.s� said that according to a Special Act oP the State I,egis�
lature of 1937, grovided for financing improvernents on a Special Assessaient basis,
that it had been impossible to get finance companie$ to handle aecuritiea backe3
by improvement lidns, for �everal �ears. He sug�ested nev� legialstion to nrovide
:for aasessments against any beneiited proparty. He said that 9ir. Cook, o� Van
Ingen and Company, bond brokers, would undertake to write an aet and prepare an
issue of Securities on which they vrould bid. He said Mr. �ook would be glad to
prepare s prospeetus and to appear before tne Cor�nission to discuss it. Com-
missioner B1ack moved that the Connnission have htr. Cook, of Van Ii�gen Coznpany,pre-
aent hia prospectus and that the City Attornsv be instructed to prepare an amend-
ment to the Gity Charter providing for the assessment o,r^ Special Improver.mants

The City 1�ianager submitted a letter fro�n &ir. J. A. Novotne,y in v�llich
letter �ir. Yovotney requesteci that he be permitted a 10 �t. set back on Coronado
Drive instead of tha 20 ft. setback now required. The a£fected property is des-
cribed sa T,ot 55, tYie North 40 ft. oP Lot 56 and the North 30 ft. of Lot 103,
L1oyd-YlY:ite-Skinner Subdivision� The recozumendation oi' the Zoning �oard was that
the application be d�nied, l�ir. Novotney snd Ivir. '+Jilliam Goza addressed the Com-
mission relative to the request. Cormnissioner Turner moved that a public hearing
on bir. Novotnay�s request be set for tjvo weeks from this date and that the proper
legal notices be given. The motion �vas seaonded bv Cov�nissioner Black and carried.
The City i�iana�er aub�itted a reqt;est by hIr. bi, J. Beasley that he be per-
mitted to erect an automoLive service station on C�ulf-to-Bag Boulevard together
wtth blue prints, speciPications and the Zoning Board�s recoaffaendation tl�at the
request be granted. Coumiissioner Black �oved that permission to erect a Service
Station at the proposed loca�ion be granted. The xaotion was seconded hy Com-
missioner Lynn and carriad.
CaptQin W. bS. ideyer, owner oz the baat, Sea Fever, told the Commission thgt
it Nas his undarstanding that boat ownexs operating out oP the hiunicipal Dock,
in Pront of the Auditorium, hed agreed that there would be no soliciting on the
dock. He complained that some of ,he operators were selling tickets on the dock.
That in so�e instances people would get on his bost and preaent a ticket good
only on some other boat. It v�ras moved by Gorrmiissioner Blanton, seconded by �om-
missioner Turner and carried that Captaina 1Nright and Newcian be instructed to dise
continue the practiGe and that any violator Tose his rights to use of the dock.
The C3ty Llanager presented a letter addressed to the Couunissi�n by hiarshali
and Rivea on behalf of their alients, France�e Tyner and Ida �4. Betsford, re-
questing that the Corrmiission grant an axtrension of at least one year to the exist-
ing three year lease, whieh expires July 15, 1951< Comm.issioner Turner moved that
the matter be referred to the Beach Lease Connuitt�ee for its considerfi t3on and a
report. The motion was seconded b� Couunissioner Lynn and carried.
The City Manager sub�it�ed a petition bearing the signature of five per-
sons requesting tYiat paving and a sanitary sev�er be installed on Bay Esplanade
and Royal Way to biandalay Road or that the owners be permitted to construct a road
and sewer and finsncs the program thamselves. The Citg Dlanager eatimated tha cost
of pavin� at �p11.00 a running foot and the cost o£ a sanitary sewer at �p4.60 per
running foo�. Commissioner Black moved that conaideration of the street improve-
ment be deferresl until the next meeting and the Couimission can have a breakdown
on the �11.00 per front foot cbst and that the Attorney be inetrueted to prepara
the necessary papers for a publiQ kiearing relative to the sanitary sewer.
T2ie City Attorney reported that 5ection 13 of Ghapter 15 of the City Cods
prohibits the smployment of minors in places of bueineas where alcohol3c boveragea
are �o1d, whereas the State I,aw pernits tha employment of minors in such plaaes
wher� alcoholic beverages are not sold for con:sumption an the premises under whiah
circumst�ncea minora irr the City of Clearwater are bein� daprived of employment
in practically a11 grocery stores in the Citv. The City Attorney presanted and
recommended irmnediate passage of �7rdinance No. 605, same being an Ordinence to
Amend Section 13 Chapter 15 of the City Code. Coimni�sionar Black moved that by
unanimous consont Ordxnance No. 605 be passed on all three readings at the Com-

The Cit� Attorney reported that he had contaated the members of' the Barbers
Association; that the Barbers Assoc3ation had had a meet3ng and the,y wera no
longer interested in any portion of the Ordinance relating to tho opera�ion of
Barber Shops and F3arber �xamining Board, and they recox;mended the rapesl of the
Ordinance. The Citg At�orney presen�ed Ordinance No. 604 whi�oh would repes�l that
portion of tha City Code relative to the operation of barber �hops and the Barbers

for representing the City bei'ore the Circuit Court on Appeals frori?Vtunicipal
