On a motion by Commissioner Drew, which was seconded by Commissioner Casler and
carried, the bid 1n the amount of $2,118.00 was referred to the City Manager for

The Manager reported that no bids had been received for repairing the roof
at the Sewage Disposal Plant. On a motion by Commi8s1one~ Drew, Which was
seoonded by Commissioner Casler and carried, the matter was referred to the City
Manager.
Four bids for the pa~ting of the interior of City Hall were opened.
Proposal #1 called for: , A--Palnting basement, woodwork stained and va~nished.

Commissioner Drew. addressing other members or the Commission, stated that
he would like an opinion from the City Attorney as to the advisability or his re-
signing on account of his being a candidate for Mayor, stating that he wanted to
do whatever was to the best interest of the City. The City Attorney read the
Charter requirements for filling a vacancy created by a resignation and noted tha.t
one Commissioner were to be elected for the unexpired ter.m of one yea~, the es-
tablished practice of having three Commissioners retire one year and two the next
would be disturbed. Commissioner Casler moved that the matter be given study untl1
the next regula~ or called meeting or the Commission. The motion was seconded by

The City Attorney read the proposed per.mlt which would authorize Captain
Wi~liam Ueyer use of a part of the dock in front of the Municipal Auditorium for a
periOd of one year. Attorney A. T. Cooper, representing Captain Meyer, objected
to that part of the agreement which would tenninate the agreement at will.. and
stated Captain Meyer would like more assurance of permanency~ The City Attorney
stated that that particular clause appeared in all or the C1 ty' s lea;se agreements.
Cammissioner Drew stated that he had announced at the time the matter first came
before the Commission. his opposition to tying up this dock for any period longe~
than necessary, to care ror docking boats during the time the Yacht Basin is under
construction. Commissioner Casler moved that the proper City ofricials execute
the lease. The motion was seconded by Commissioner Turner and carried. Com-
missioners Ca sler J Sargeant and Turner voted "Aye". Coramissioner Drew voted "'No".
The Manager submitted a request by the North Shore Association, that that
part or Sunset Drive between Fair.mont street and the South line of Sharps Sub-
division be zoned as R-l. together with the Zoning Board's reconmendationthat the request
be granted. Commissioner Cas1e~ moved that,the reoommendation or the Zoning Boa~
be accepted and the mattep be rererred to the City Attorney ror inolusion in the
Ordinance for the Zoning referendum. The motion was seconded by Commissioner
Turner and ca~ri&d.

CITY COMMISSION MEETING
November ao, 1950
Attorney Lloyd Phillips appeared before the Commi8sion requesting that
the Co:r.nnisslon re-consider its action in denying Mr. Al~ert Vasconi' 8 request
for a ten foot set baok on Lots 10 and 11 of Padgett's Subdivision on Lincoln
Avenue and Kenwood Court, stating that the only person objeoting at the time of
the hearing had voluntarily withdrawn her objeotions. Commissioner Casler moved
that proper notices be given for a Publio Hearing on December 4th. The motion
was seoonded by Commissioner Turner and oarried.
Items 23, 24, 25 and 26 on the Agenda were considered at the same time.
The items were as follows:-
Tho request of Mr. Herbert Blanton Jr. tha t Lot 9, Block 16', Magnolia
Park be ohanged from R-2 Zoning to '~usiness".
The request ot P. G. and Cora Edwards that ulta 13, 14, 15 and 16 of
Blook 16, Magnolia Park be changed fram R-2 to Business Zoning.
The request of Mr. Herbert Blanton that Lots 7 and 8, Block 17, be changed
from R-2 to "Business" Zoning.
The request of Mr. lle:t'bert Blanton that lots 10, 11 and 12, Block 16,
Magnolia Park, be changed from R-2 to Business Zoning.
In each instance the written request carried the recommendation of the
Zoning Board tl~t the requests be approved for inclusion in the proposed Ordina~ce
for a Zoning re ferendum. Commissioner Drew noted tha t half the lots: in Block 16,
fronting on Chestnut Street would be changed, and would result in spot zoning.
Commissioner Drew moved that the Zoning Board's report be accepted and that Lots
1 to 8 inclusive, Block 16, be included in the re-zoning. The motion was seconded
by Commissioner Casler and carried.
The Clerk read a letter addressed to the Comndsslon by Mr. A. T. Cooper
tendering his; resignation as Municipal Judge; the resignation to be effective
January 1, 1951. Co~iBsloner Turner moved that a letter be written to Mr. Cooper
expressing the Commission's regret at the loss of his services and commending him
for his excellent record a s a Municipal Judge. The motion was seconded by Com-
missioner Casler and carried.
Bringing up the matter of an increase in salary for all City employees
whose salaries are less' than $300.00 a month, Mayor Sargeant said he had been
assured that the funds could be borrowed from the bank.. He suggested an inoreas.-e
of 10% for those whose salaries were less than $250.00 per month and a 5% increase
for those whose salarie& were from $250.00 to $300.00 per monthc He also suggested
that the cost be added to next years budget. Commissioner Drew moved that a Com-
mittee composed of Mayor Sargeant, Commissioner Brown and himself investigate the
matter and submit a report at the next meeting. '11!le motion was seconded by Com-
missioner Casler and carried.
Commissioner Casler moved that consideration of the request made by the
Philadelphia National Baseball Club that the right field wall at the Baseball Park
be moved 30 or 40 feet, be postponed to the next regular meeting. The motion was
seconded by Commissioner Turner and oarried.
The Manager submitted a tabulation of bids as opened at the November 6th
meeting for supplying a Four Door Sedan for the Police DepartIllent. Commissioner
Turner moved that the low bid, the bid of the Thayer Motor Company in the amount
of $723.50 net be accepted. The motion was seconded by Coxnmissioner Drew and
carried.
Commissioner Casler moved that the Committee (Cor.mlissioners Drew a,nd Brown)
negotiate with Mr. H. R. Hamlin for a Right-of-way for extending Grand Central
Street East to Greenwood Avenue. Commissioner Turner seconded the motion and it
carried.
A letter addressed to the Commission by Mr. C. M. Strader, Agent for the
Orange State Oil Company requested pennission to install temporary gaSOline am
oil storage tanks and pumps at the City dock, West of the Auditorium. The same
roquest was made, by letter, from Mr. Guy McMullen, Agent for the Standard Oi~
Company. Commissioner Drew moved that the matter be deferred to the next meeting.
The motion was seconded by Co~nissioner Turner and carried.
The City Attorney reported that he had checked the Cha'rter and state Law
relative to the City's authority to establish Railroad Crossings. He stated it was
his opinion that the City had such authority provided the establishment of a cros&:-,
ing did not deprive the Rai1road of the proper use of its property. COl:lD1issioner
Drew moved that the plan prepared by the Engineering ~epartment be accepted. in
principle. and that the City Manager inform the Seaboard offioials of the Com-
mission's action and they be requested to appear at the next regular meeting
December 4th to discuss the matter. The motion was seconded by Commissioner Turner
and carried.
The City Attorney called attention to the changes that had been made in
the proposed Ordinance regu~ting Building Cont~cting and made comparison& with
the existing Ordinance. Mr. Jacob Cribbs addresoed the Commission. contending
that the Ordinance, even if amended as had been proposed, would be too restrictive
on those person~ wishing to do their own construction work. Mr. H. L. Heckman of
the H. & H. Supply Company told the Commission that if an owner-builder could not
let out parts of the construction to sub-contractors but had to employ day labor
it would result in inrerior workmanship. Commissioner Casler moved that the matter
be dererred to the next meeting and the Attorney be instructed to change the
paragrsph relative to ownerfr to express the feeling of the Commisslon. The motion
was asconded by Commissioner Turner and carried.

The 0ity Attorney reported that he had 1nvestigated the matter and. he
could find no authority for assessing adjaoent property owners for Sea Wall.
at dead end streets on 01earwater l'3eaoh.' Commissioner Drew moved that tl>.e
Sea Wall be constructed at the East end ot Gardenia Street at an e8t1mate~
cost ot 01100.00 in acoordance with the proposal of James R. Billet. The
motion was seoonded by Commissioner Turner and oarried.
The Oi ty Manager requested that he be authorized to invest $1100.000.00
of the $125,000.00 from the sale of Utility Revenue Certiticate~ in Government
bonds, until the money is needed to pay for the water stand pipe installation.
C~1ssioner Drew moved that the matter be referred to the Manager for 1nves-
tigation and report. The motion was seconded by CommisSioner Turner on1 oarr1ed.
The Oity Attorney stated that the new r '.:,/ Code Dooks would be received

The City A~nager recammended the transfer ot $10,000.00 trom the Oigarette
Tax Fund tor widening Myrtle Avenue. It was moved by Commissioner Turner, s8condad
by Commissioner Drew and carried that the transter of $10,000.00 trom the
Oigarette Tax Fund be approved.
Commissioner Drew moved that Item #19, the installation ot 150 ft. o~ e i~ch
water main on Druid Road at an estimated cost of $475.00 and Item (/;20, '750 tt.
ot a inch water main extension on Casler Avenue and R1dgewood Avenue at an
estimated cost o~ $375.00 be approved. The motion was seconded by Commissioner
Turner and carried.

The Manager submitted two Resolutions which would require certain property
owners to clean their lots of grass, weeds, and underbrush. On a motion by Cam-
missioner Turner, seconded by Commissioner Drew and unan~ou81y carried, ths
Resolutions were adopted.
On a motion by Commissioner Casler, seconded by Co~1ss10ner Turner and
carried, the Commission approved the issuing of a per.mit tor a tent show, for
November 16-11-18 and 19th, on ~operty owned by Tack and Warren.

Commission acting as Trustees for the Pension Plan.
Soveral weeks ago on behalf of my client, Alfred P. Vasconl, formal appli-
cation was made under the hardship section of our ordinance to alter the pro-
visions or the zoning act or this City. The request was made in proper form and
had gone through proper channels, the zoning board having given its approval to
the proposed change. Upon this first application to you gentlemen, sitting as
members of the City Commission, the proposed change was evidently favorB'bly con-
sidered by you, as instructions were given to the City Attorney who, follOWing
these instructions, published a notice which in part stated tha.t all persons
interested in this matter were requested to be present at the date and time indi-
cated for the purpose o~ being heard. The notice was properly published and
the date given in said notice was October 16, 1950.
At the Commission meeting held on the above-mentioned date it developed
that a letter wes received from Mrs. Alice V. Farnam, who resides at 1241 Grove
Street. This letter was taken by the Commission as an objection and was evi-
dently the basis for their re~s1ng to grant the requested chango in the zoning
Ordinance. No other objections were heard, but the Commission refused to pass
the resolution.
,It now develops that Mrs. ~rnam was contacted by another neighbor Mr. John
Sterr, who asked her reasons for objecting. It developed that she was ~f the
opinion that the status quo was better than any change and that she did not mow,
actually_ what the proposed changes meant. Thereafter, my client, Mr. Vasconi,

I am writing you in behAlf of the North Shore Association. Some t~e ago
this Association filed a petition to have rezoned as R-l both sides of Sunset
Drive from Falrmont street south to the dead end of Sunset Dr1ve. The Zoning
Board disapproved this request, and it was later also dl~pproved by the City
Oommission.
The Association has now con~erred with a committee of the City Commission
on this matter. The Committee has indicated that, subject to the approval of
the Zoning Board, it would be willing to zone a8 R-l, both sides of Sunset Drive
f:rom Fair.mont Street south to the south line of Sharp's Subdivision. I attach
a map on which the arfected area is colored red. Both sides of Sunset Drive are
already zoned as R-l north of FSir.mont.
In behalf of the AssocIation I respectfully request the Zoning Boa~ to
approve rezoning as R-l both sides of Sunset Drive from Fainnont to the south

to that part of the agreament which would terminata the agreement at will, and

before the Commission, hi� oppos3tion to tying up this dock for any period longe]r

The Manager submitted a request by the North Shore Association, that that
part of Sunset Drive between Fairmont Street and the South line o� Sharps Sub_
division be zoned as R-1, together with the Zoning Board�s recozmnendatiqr� t}aat the request
be granted. Commissione� Casler moved that the reco�mnendation of the Zoning Boarel
be accepted and the matts� be re£erred to the Cfty Attorney for inelusion in the

visions of tha zoning act of this City. The request wAa made in proper form and
:nad gone through proper channels, the zoning bos�d having given its approval to
th� proposed change. IIpon this firs$ application to ynu gentlemen, sitting as
menbere of ths City Commission, the proposed change wa:s evidently i'avorably con-
s3dered by you, as instructions were given ta the City A�tnrney who, following
those instru�tions, published a notiae which in part stated ths�t all persons
intere3ted in this metter were requested to be present at the date and time indi-
cated for the purpose of being he�rd. The notice v�as properly publlshed and
the date given in said notice was October 1&, 1950.
At the Commiasion meeting he3.d on the above mentioned date it developed
that a letter was received from hIrs. Alica V� Farnam, who resides at 1241 Grove
Street. This letter was taken by the Cu�¢nission as an objection and was evi-
dentlg the ba�sis for their rei'using to �rant the requested change in the z.oning
ordinance. No other objections were heard, but the Commission re±izsed to pass
th.e resnlution.

residenti�l to Business Rnd to include st�me on the Decomber zaning referendum,
i£ necessary, be granted.

The Zoning Board decision on this application is based on the fact tl�at th3s
property ie immediately acros� the streAt from and faces an area occupied ex-
clueively by negroeg anc� therefare is not desirable for whi'te res3dencea an�
i� deed reatr3cted against negro occupancy. Therefore, it i,s practica,lly worth-
less as residential property.
Also, consider�tion was given to the fac� that the extension of Court Street
into Chestnut Stxee� to Greenv�ood Avenue, which we understand is contemplsted
immediately will naturallq change the status of thia ixrniediate neighborhood,
