The City Oommission of the City ot 01earwater met 1n Regular Session at
City Hall, Monday, November 6th at ?:30 P.M. with the following members present:

The meeting was called to order by the Mayor. It was moved by Commissioner
Brown that the minutes of the meeting of October 30th be approved in accordanoe
with the copy thereof furnished each member in writing and that their reading
be dispensed with. The motion was seconded by Commissionor Casler and oarried.
The City Manager submitted a letter addressed to him by the Director of
Public Relations of the Philadelphia National League Baseball Olub, suggesting
that the right field wall at the ball park be moved back 30 to 40 feet. Com-
missioner Casler moved that the matter be referred to a Oommittee for a report
at the next meeting of the Connnission. The motion was seconded by Commissioner
Brown and carried. The Mayor appointed Commissioners Brown, Casler and Turner
as a Committee. Mr. W. W. Blackburn invited the Committee to attend a meet-
ing with the Recreation Board Wednesday, November 8th.
The following bids for supplying one Four-Door Sedan for the Police Depart-
ment were opened:

was seconded by Commissioner Turner and carried. Oommissioner Drew moved that
the bids be put in the City l1anager's hands for tabulation. Commissioner Turner
seconded the motion and it carried.

On a motion by Commissioner Drew, which was seconded by Commissioner Turner and
carried, the low bid of Thayer Motor Company in the amount of $4,890.20 waa acoepted.
The Mayor'S report on the Fire Conference at Orlando, was deferred by oon8en~.
Commissioner Drew,for the Committee on a crossing on Missouri or Jefferson,
reported that the Oommittee had met and had turned all information over to the
City Attorney for his consideration and a report as to ~e Oommission's power in
the establishing of railroad orossings.
The 01 ty A ttorne,. now read Ordinance #600, an Ordinanoe oodifying the Oi ty
Oharter and Ordinances. On a motion by Commissioner Turner, which was seoonded
bf Oommissioner Caoler. the Ordinance was passed on ita third and rinal readIng.
Upon roll call, the following Commissioners voted nAye". Brown, Casler, Drew,
Sargeant B.nd Turner. There were none opposed. The Mayor deolared the Ordinanoe
adopted.
Mr. RalPh Richards, Attorney tor the North Shore Oivic Assooiation. appeared
beto~e the Commission, requesting re-consideration of the petition to zone Sunset
Dri ve as B-1, from Fairmont street south to the southern end of the street be-
tween Engman and Palm Bluff streets, and to permit the matter to be placed on the
next ret'erendum. Mr. W. A. stanton, Mr. X.P.A.Taylor and Mr. S. R. Bowen addressed
the Commission favoring the proposed change in Zoning. MIss Luoy Jane~ oppose~
any change in the 1200 block. Oommissioner Casler moved that 8 Committee be
appointed to investigate with Mr. Riclmrds the proposed re-zoning ot Sunset Drive.
The motion was seconded by Oanm1ssioner Turne~ and oarrisd. The Mayor appointed
Commissioner Oas1er as Chairman and Commissionors Brown. Drew and TUrner to tbe
Committee.

The City Manager presented a letter from Mr. A. T. Cooper Jr. requesting
a lease for Capt. Wm. Meyer to that portion of the dock 1n front o~ the Muni-
cipal Auditorium, now occupied by Mr. Meyer on a month to month baBi~. The
City Attorney c1ted Ordinance ~06, prohibiting the use of the dook tor com-
mercial purposes, without a permit 1'rom the City Managel'. He said. however,
that the City did have authority to issue a perm1t for 11 portion o-r tha doc k
1f it wished to do so. It was moved by C~iBs1oner Brown that ~e Commission
approve, in principle, a lease to Capt. Meyer, and that the matter be placed
in the Beach Lease Committee's hands 1'01' determining the amount of rental and
the duration of the lease. The motion was seconded by Commissioner Casler and
carried.

The Clearwater Guides Association called a meeting Thursday night of the
charter boat skippers and dook masters to discuss a proposal for the use ot the
City Dock during the emergenoy created by the City ot Clearwater in constructing
new docks on Clea~Yater Beach.
This proposal is baaed on the policy of protecting the investments of the
dock owners and the charter boat men, and the continuation of their established
businesses. Both the Sportsman Dook and the Imperial Dock have been widely ad-
vertised in th1s territory over a long period or ~earB and s1nce these two docks
handle the greatest percentage of the charter boat business, we feel that the
investment of Capt. Wright of Sportmnan Dock and Mr. Nac Newman of ]nperial Dock,
ahould be equally represented on the City Dock.
The Charter boat captains have 1ikewise been identitied with their separate
docks also for a long period of time and have carried the identity of their docks
in their own advertising and each captain has a big fo1lowing and is ent1t1ed to
continue his business under the title of his respective dock.
We, therefore_ recommend that each dockmaster be assigned an even number
of slips on the City Dock to be designated as his temporB1'1 dock during the ~er-
gency, and that those charter boat oaptains who have been actively engaged at
their reapective docks for a long period of t~eJ six months or more, should be
pe~ltted to work under their own dockmaster. namely the Imperial Dock boats to
be nanaged by Mr. Mac Newman and the Sportsman Dock boats to be managed by Capt.
Fred Wright. and that each dockmaster be pennitted to arrange tor separate tele-
Phones and separate advertising and to continue their respective businesses on
the same basis as they have been doing under their preVious leases with one ex-
ception, which is detailed bel.ow.
Since it has been or will be necessary for tlOe City to replace and install
new piling and repair the City Dock to make it useable for this business, it 1s
proposed that the charter boat men who have been paying six dollars per month
tor their slips at their respective docks_ now pay ~is same amount &s dock
rental to the City and that each dockrnaster be pennitted to charge ten percent
commission as they have been doing in the past, for charter parties on the boats
operating under his dock management.
We feel that the income from the approx1mate~y sixteen Slips for charter
boats at six dollars per month, should go to the City to reimburse them for the
dock ~provements. It is understood that the dock business w1ll continue to be
handled in a dignified and businesslike mwnner without sidewalk or dock s011-
citation.

The exception mentioned above 1s this: We understand that the dockmastera
covered by this plan, w11l not be charged for the renta1 or their present locations
during the construction period and therefore~ having no investment in property on
the City ~ok, the slip rentals should go to the City as outl1ned above.
We have not included the three open party bosts in the fifteen or sixteen
charter boat slips. These are the Miss Elsie, the Jeannette and the Katrina. We
feel there will be ample room for these boats on th8 west end of the City Dock
but they would be managed by their present dockmasters and their dook rental
should also revert to the c1t~.

We feel that this plan will cause less confusion and give better servioe to
the general public and the charter boat fleet. There will probably arise a tew,
minor details to be ironed ou"t but we feel that wi.th mu'tual co..openltlon between
the City and the dock masters and charter boat men. it will be no great obstacle
and w11l. help to preserve intaot the identities of the ind1vidual dooks, tho
doek masters and their charter boa t fleets so tha t when the new dooks are OOlD..
plated, normal business may again be resumed.

The City Attorney submitted a deed to Traot A of Skycrest Unit #4, to be
used by the City r~r Park purposes. Commissioner Brown moved the acceptanoe of
Traot A of Slqcrest Unit #4 as a public park, to be named Skycrest Park, under
the provisions of the deed and that the plat of Skycrest Unit ~ be approved.
The motion was seconded by Commissioner Turner and carried. Commissioner Brawn
moved that the plat of Sky-crest Unit B, be approved. The motion was seconded
by O~mmissioner Turner and oarried.

The City Manager submitted the contraot with Vi. H. Armston COl:1pany based
on its bid nade for the construction of Part I and Part II o~ the Causeway
Yacht Basin, in the amount of $105,803.34, together with a performance bond with
the National Surety Company of New York, New York in like amount. It was moved
by Conulllssionar Turner that the bond and contraot be approved. '):'he motion was
second0d by Conmissloner Drew and carried.
The City Manager presented a report by the Florida State Board of Health
on the Pollution Survey of the waters or Clearwater Bay and St. Josephs Sound.
Commissioner Brown moved that the report be accepted and the City Mansiger be in-
structed to come back with recommended action. The motion was seconded by Com-
miss10ner Casler and carried.

Dear Mr. Bennett:
I am writing this letter on behalf of Mr. William Meyer who is the owner
and the operator of the boat .Sea Fever", now operating from the manIoipal dock,
As you know, Mr. Meyer has for some ttme used the faoi1ities of the dock on a
month-to-month basls, and for this privilege, has paid the oity a rental ot
$45.00 a month. This figure inoluded the sum of ~25.00 rental on the boat slip,
used by the "Sea Fever" and $20.00 for rental on the bait stand and concession
whioh was opersted under Mr. Meyer.
Mr. Meyer desires to obtain from the City a lease on the fao1litles he 1&
now uDing. From the soale of rentals being charged for docking space in the
City, it is Mr. Moyer's opinion that the present rental is oertainly most tair
rrom the CIty's standpoint, and he is w11ling to continue to pay this rental;
however, he desires some certainty and would like to enter into a lease for not
less than a yesr on this basis. If such a lease is entered into, Mr. Meyer agrees
to erect a bait stand on the dock whioh will be substantial and attractive. It
is believed that a bait stand will be very convenient to the people who fish tram
the drawbridge and the city dock. As you know, the bait stand whioh previously
was situated upon the dook was destroyed by the last hurricane.
Will you please put this matter up to the City Commission at the earliest
pOSSible moment for oonsideration?

OF THE ORDINANCES OF THE CITY O}l' CIEARWATER, FLORIDA,
PROVIDING FOR THE REPEAL OF CERTAIll ORDINANCES NOT
INCLUDED THEREm, AND FOR OTHER PURPOSES HEREINAFTER
SET FORTH.
WHERElS, the City Commission of the Cit~ or Clearwater baa caused its
ordinances of a general a nd permanent na ture to b e compiled and re vised a nd the
same are embodied in a oompilation and revision thereof known as RThe Code ot
the City of Cloarwater, Florida, 19500, now therefore,
BE IT ORDAINED BY THE CITY COMMISsImt OF THE CITY OF CLEARWATER:
SECTION 1. That the ordinances of the City of Clearwater of a general
and permanent nature, as codified in the rollowing chapters~ namely~ Chapters
1 to 33, both inolusive, are ordained as general ordinances and are adopted as
"The Code of the City of Clearwster, Florida, 1950".
. SECTION 2. That all the provisions of "The Code ot the City of Clear-
water, Florida, 1950", shall be in to~ce and effect on and after the 20th day
of November, 1950, and all ordinanoes of a genersl and per.manent nature, adopted
by the City Commission in force on August 1, 1950, and not contained in nThe
Code or the City ot Clearwater, Floridan, are hereby repealed from and after the
20th day of November, 1950, exoept as hereinafter provided.
SECTION 3. That the repeal provided ror in the preceding section of this
ordinance shall not affect any offense or act committed or done o~ any penalty
or torreiture incurred or any oontract or right established or accruing be~ore
the 20th day of November.. 1950; nor shall such repeal affeot any ordinance or
resolution promising or Sl~rantaeing the payment of money for the City or auth-
oriZing the issue of bonds of said City or any evidenoe of said City's indebted-
ness, or any contract or obligation assumed by said City; nor shall s aid repeal
affeot the administrative ordinanoes or resolutions of the Commission not in
oonflict or inconsistent with the prOVisions of this, Code; nor shall it effect
any right or f~nchise conferred by any ordinance or ~esolution of the Commis-
sion on any person or corporation; nor shall it affect the annual appropriation
ordinance; nor shall it affect any ordinance f~xing salaries of city officers
and employees.; nor shall it affect the Building Code; nor shall it a.ffect the
Electrical Code; nor shall it affect the Plumbing Code; nor shall it street an,.

The meeting was called to order bq the Mayor. It vraa moved by Coaunissioner
Brawn th�at the minutes of the neeting of October 30th be approved in accordance
with the copy thereof Purniahed each member in writing and that their reading
be dispansed with. The motion was seconded by Commiasioner Caslar and carried.
The City Manager submitted a letter addressed to him lr� the Director oP
Public Relations o� the Philadelphia N�tional League Baseball C1ub, suggest3,ng
that the •right field wall at the ball parl: be moved back 30 to 40 Peet. Com-
missioner Cagler moved that the matter be referred to a Corrmiittee Por a report

charter boat skippara and dock masters to discuss a propasal for the use of �he
Citg Dock during tha emc�rgency created by the City oP Clsarwater in �oristructing
new docks on C7.ear�zater Beaciie
This proposal is based on the policy of protecting the investments of the
dock owners and the charter b�at mer., and the continuation of their sstablislied
businesses. Both the Sportsman Dock and the Iaiperial Dack have been s�3dely ad-
vertised in tiais territary over a lon� ger�iod oP years a.nd since �hese two docks
handle the greatest percontage of the i;hartar boat buainess, we �eel that th�
innestmen� of Capto Wright of Sportsman Dock and hir. �uiac Newma.rt oi' Islpsr3�1 Dock,
should be equslly representad on tho Citg Dock.
The Gharter boat captains have like�ise been �.dentiPied with their separate
docks �lso Pc�r a long p�riod oP time and have carried the idantit9 oP the3r docks
in their o�vn adv�rtis3ng and each c�ptain has a big iollowing and ia entitled to
continue hi� business under the title of his respeative docko
We, theraPore, reconunend that each docl�naster be assigned �n even number
oP slips on the City Dock to be designated as his temporary dock dur3ng the emer-
gency, and that those charter boat captains who have been actively angaged at
their reapective doeks for a long period oP time, six months or mor�, should be
pezsnitted to w9rk under their orvn docl�aster, namely the Imperial Dock boats to
be managed by bir. 4iac Newman and tha Sportsman Dock boats to be m�anaged by Cap�.
Fred 1Yright, and that each docl�nastgr be permitted to arranga for separate tele-
phones and separate a�vertising and to continus their respective bus3nesses on
the same basis aa thay have been doing unciar their previoua leases with one ex-
csption, which is detailed below.
Since it has '�een or e�ill be necessary Por thd C�.ty to replace and instalZ
new p3ling and r�pair the City Dock to make it useable for this busine9s, it is
proposed that the charter boat msn who have been pa�ring six dollars per month
for their slips at their respective docka, now pay this same amnunt as doak
rental to tha City and that each doci�nastar be permitted to charge ten percen�
cammission as theg have been doing in the past, P.or cherter parties nn the boats
operating under �:is dock managemez�t.
We f�e1 th�t the income fron� the approximetely sixteen slips for charte�r
boats at six do].lars per month, ahould go to the City to reim'�ursa them for the
dock improvementso It is understood that the dock businesa �ill continue to be
handled in a digniPied and businesslike manner without sidewalk or dock aoli-�
citatian.
The exeepti�n mentioned above is this: tNe underaband tha� the doc�nasters
covered by thia plan, a�ill not be charged Por the rental oP their present loca�ions
during the conatruction period and therePore, having no investment in proper�q on
tl�e City Dock, t2zs slip rett�als ahould go to the City as outlined above.
We hane not included the three open �rt� boats in the fiPteen or sixt�on
chsrter boat slipa. These are the Mias Elsie, the Jeannette and the Katrina. V�e
feel there� will be ampl9 room Por these boats on ths wes� end of �he Gity 7?�ek
bu� they would be mar�e.ged bg their prasent dockmasters and their clock rental
ahould also revert to the city.

The City hlanager submitted the contracic with V�. H. Armston Conpany based
on its bid made for the construoiion of Part I and Part II of the Cauaevray

the Plational Surety Company of New York, New York in like amourat. It tvas moved
