The Mayor called the meetinG to order. On a motion by Commissioner Brown,
seconded by Commissioner Turner and carried, the minutes of the meet ing of July 17th
were approved.
The liayor..Cor.unissioner now announced a Public Hearing would be held on the
proposal to widen ~i1ssouri Avenue. from Grove Street to Cleveland street, and asked
if there were any objections. There being no objections, the City Attorney read a
resolution which would authorize the ilnprovement. On a motion by Comm1ssioner Drew,
which was seconded by Cor.unissioner Turner and unanir.J.o' sly carried, the resolution
was adopted.

The Mayor now announced a publ~c hearing on the proposal to install a Sanitary
Sewer on Bay Esplanade, 500 feet North from Clearwater street,and asked if there were
any objecti~ns to the proposed ~provement. There being no objections, the City
Attorney submitted a Resolution which 'Would authorize the improvement. On a motion
by Commissioner Casler, which was seconded by Commissioner Turner and unanimously
carried, the Resolution was adopted.
The Mayor-Commissioner announoed a, Public Hearing on the proposal to install a
Sanitary Sewer on Somerset Street from Mandalay Avenue to Bay Esplanade, and inquired
if there were objections. ~lr. Robert Nodine~ representin~ Adon L. Smith and the
Estate of JosePh P. Reynolds, offered objections on belmlr of his clients. stating
that their properties were now sel'ved by an already existing Sewer on Mandalay Ave.
for wh1ch they had paid. Mr. Robert Hansen addressed the Commies! on .favoring the
proposal. Conunissioner Casler moved that the Resolution read by the City Attorney be
adopted, subject to the necessary funds being deposited by the property owners, ex-
cepting the two objectors. The motion was seconded by Commissioner Turner and carried
unan imously.
Attorney Charles 111. Phillips reported to the Commission that his Client, Mr"
E. H. Spaulding, had found it would not be practical for hfm to lease a part of
Seminole Street Dock due to the Liab~lity Insurance requirements and the costa of
neoessary repa1rs, anc thanked the COIIDllisaion for its efforts and indulgence. He
stated that if the dock should be developed in the future, his client would 11ke to
submit a new proposal. Commissioner Drew moved that the Cit~' Manager be instructea
to submit a report of prov1sions, now in e.ffect, as to liability insurance and to
make recommendations .for the dock's best usage. The motion was seconded by Com-
missioner Casler and carried.

Con~issioner Brown, for the Beach Lesee Committee, reported that the Committee
had met with Mr. Everingham and hie Attorney, Mr. John Polhil1, relative to the draft-
ing of a new lease but had not 'been able to come to an agreement. Mr. Polhill told
the Commission he thought a satisfactory agreement possible, and suggested further
meetings and an extension of time, without prejudice to the City's rights, to October
1st. Commissioner Dr~w said that since no new proposal had been subnitted, he could
see nothing to warrant 8 change in the City's prosent pos1tion. No further action
was taken.

Commissioner Drew reported that the Committee appointed to study Ordinance #4~1.
relative to the cutting of curbs did not have its report ready at this time.
lJr. B. J. Driver.. as Attorney for C. F. }.lcK1nne~', requested that the Conunission
authorize the acceptance of 5q% of tne face amount of the taxes, plus $25.00 recording
costs, as payment in full of City ta~eB on Lota 1-6 inclusive and Lots' 9-14 inclusive
of Block I, Brooklawn Subdivision. COl~issioner Casler moved that the settlement pro-
posed b~ acaepted. The motion was seconded by Commissioner Turner and carried. Can-
missioner Drew. voted "'NO'''.
Acting C1ty Mana~er Middleton reported that Stewart benches (wood and metal)
could be 1nstal1ed in Coachman Park at a coat of $1400.00. He s~ted the C1ty had
only 1 Bet o~ forms for casting ooncrete ends for heavy benche&, and if edd1tio~1 fo~a
had to be purcha5~d they would cost $75.00 eaoh, and if' sufficient h&avy benches wen

Aoting City Manager Middleton submitted the City Manager's report on repairs
made on Grove street, aa requested at the meetin~ of July 17th. The report showed
total expenditures o~ $327.55. Commissioner Drew moved that Betty Lane be re-
surfaced between Drew and Cleveland Streets, at an esttmated cost of $1800.00. The
motion waa seoonded by Commissioner Brown and carried. Con~lssioner Brown moved
that the City Manager be instructed to mske a report to the Commission of repai1"s
costing up to $300.00. The motion waa seconded by Commissioner Casler and carrIed.
CODunissIoner Casler moved that the Commission appropriate $750.00 toward the
cost of Widening Douglas Avenue, as requested by the County Commission. The motion
was seconded by Oommissioner 'furner and carried.
Mrs. Genevieve KUnnen, Mr. Robert Hanson and others present InquiTSd as to
what had been done about the petition for installinp, a Sanitary Sewer on Cypress St.
It was brou~~t out that two property owners had agreed to pay tor the inetal1ation
abutting their own and the Church property, which would require no Public Hearing;
however since it was now proposed to install the sewer for the entire block, a
Public Hearin~ would be necessary. Mr. Jack Ransom ar;reed to get signatures on a
petition and deposits from interested pI'operty owners. C01l1Il11ssioner Drew moved that
a Public Hearing be held on the matter, at the next Regula~ meeting of nhe Co.mmIssion.
Th,e motion was seconded by Commissioner Casler and carried.
Mr. Harper Mercer, owner of the Clearwater Bay Motel, addressed the Commission.
He complaine::i of the prevalence of small slgns, in the area adjoining hls property,
announcin~ the rates per room and rates per person for rental units. The City. Attorney
said that in his opinion such signa were what are lmown as '''point of purchase' signs
and were per.missab1e under existing ordinances; further that he believed any new
Ordinance p~ohibiting such signs would probably be unconstitutional. By consent. the
City Attorney was instructed to investigate the possibility of prohibiting certain
types of signs by ordinance.
City Attorney Krentzman submitted an Ordinance which would authorize the issuing
of $115,000.00 in Yacht Basin Reverme Certificates, reading the Ordinance in ~11.
On a motion by Commissioner Turner, which was seconded by Commissioner Casler and
carried, the Ordinance was passed on the first reading~ Upon roll call, Mayor-
Commj,sl3ioner Sargeant, and Commissioners Brown, Casler, Drew and Turner voted "Aye1t.
There were none opposed. Commissioner Casler moved that the Ordinance be passed on
the second readin~, by' title only. Commissioner Drew seconded the motion and it
carried. Voting Ar,e' were Me.yor Sargeant, Commissioners Brown, Casler, Drew and
Turner. Voting ~No' none.

The City Attorney reported that Mr. Walter Thomas, owner of the property at the
intersection of Osceola Ave. and Pierce Street had been notified of the City's in~
tent10n to appropriate the Eastern 15 Ft. of the property for widening Osceola; that
a copy of the Resolution had been mailed to Mr. Thacker, attorney for Mr. T.hama~,
and that the occupant of the premises had also been notified of the intention to
appropriate. The City Attorney submitted a Resolution authorizing condemnation pro-
ceedings, which was unanimously adopted on a motion by Commissioner Casler, which
was seconded by Commissioner Drew.
On a motion by Connnissioner Casler, which was seconded by Commissioner Turner
and carried, the Commission authorized the issuance of a Quit Claim Deed to Dixie M.
Hollins, covering Lot 12, Block 3 of Clearwater Cemetery, less that certain grave
space occupied by J. T. Howel1.
A.t this tinte Mayo:r Sargeant announced his wish to retIre and asked that Com-
missioner Drew take the chair. Commissioner Casler moved that CommIssioner Drew ba
elected as Acting Mayor-Commissioner for the remainder of the meeting. The motion
was seconded by Corr~issioner Turner and carried, whereupon Commissioner Drew assumed
the chairmanship.
The City A.ttorney now read an Ordinance which would authorize the issuing of
$125,000.00 in Utility Revenue Certificates. Commissioner Brown moved that the
Ordinance be passed on the first reading. The motion was seconded by Commissioner
Turne~ and carried. On roll call, Commissioners Brown, Casler, Drew and Turner voted
"Aye". There were none opposed.
On a motion by Commissioner Casler, which was seconded by Cammissioner Turner
and carried, the Co~mission approved the request by the Chief of Police for tho in-
stallation of a ventilation syst~m ln his offioe.
Acting City Manager Middleton informed the Commission that the A. C. L. and
Seaboard Railroads plan certain restrictions as to clearance of buildings on sidings
and suggested the City have sonle representative present at the hearings to be held
hI Tampa on August 8th, 9th and 10th. Commls3ioner Turner moved that the Aoting City
Manager be author1zed to attend the hearings. The motion was seconded by Commissioner
Brown and carried.

Gentlemen:
This ia to request a hearing before you at your next meetinr" if' possible. The
purpose of said h~aring 1s to request a settlement of back taxes on oerta1n property
oMled by Mr. C. I". McKinnoy.
The facts of the situation are as follows: The property in question is lots' 1.
to 6 inclusive and lots 9 to 14 inclt1sive~ Block I, Erooklawn Subd1v1sion. The ta~s
in question date back to 1033, the last year tho property was oarried on the city tax
rolls, it being sepa~ted from the city in February or 1034.
The property was or little value when M~. McKinney secured it~ being unimproved
scrub. Since then, however, there has been an effort made to ~prove same. Mr. Mo-
Kinney is desirous of olearing these taxes up, but feels tha t the filntount hoW owing on
all the property involved, $247.60, 1s beyond his ability and therefore requests that
the connnission accept an offer of $.50 on the dollar in settlement of said taxes, 1n
lieu or the face value of taxes.

This street, like many others, consists of marl placed on un-graded sand,
previously been mixed with gas plant tar. The resulting surface oxidizes
the action of the traffic and the weather beco~e8 rull of large pot holes
generally ia badly deteriorated.
The above work consisted of breaking up the existinr, surface and re-mixing with gas
plant tar - adding a small amount of marl so as to take care of the holes and weak spo'tfF..

The NI�yor ca118d the meeting to order. On a motion by Corimissioner �rov�n,
seconded by Comrnissioner Turner and carried, the minutes o£ the meeting oP July �7th
were approved.
The Mayor-Cormnissioner now announced a Public Hearing wnuld be held on the
propoaa2 to widen Missouri A�venue, faom Grove S:treat to Cleveland Street,and asked
if ther6 were an5 objections:. There being no objections, the City Attorney read a
resolution which would authorize the improvemento Ott a motion by Commissioner Drew,
which was seconded by Cormiissioner Turner and unanimously carried, the resolu'tion
was adopted.
The Mayor now announced a gublic hearing on the propoaal to install a Sanitary
Sewer on Bay Eaplan�de, 500 feet Norti�. from Clearwater �treet,and a.sked if there vrere
any ob3ections to the proposed iraprovement. There being no objections, the City
�:�torney aubm�.tted a Resolution which vtould authorize the improve�ent. On a motion
by Co�nissio�er C�sler, v�hich was secdnded by Cornmissioner Turner and unanimously
carr'Ced, the Resolution was �dopted,

The hiayor-Commissioner announeed a� Public Hearing or� the proposal to install �
Sanita�ry Sewer on Sonerset StreeL Prom fiIandalay Avenue to Bay Esplanades and inquired
if tlxere were objection�. A'ir. Robert Nodine, representing Adon L. Smitr and the
Estate of Joseph P. Regnolds, offered objections on be�alf' of his olient�, stating
that their properties were now served by an already existing Sewer or �iandalag Ave.
for w�ich they had paid� Mr. Robert Hansen addressed the Commysaion favorir_g the
proposal, Commissioner CasZer moved that the Resrslution read by the Cit� Attoxney be
adopted, subject to the necessary fund� being deposited bg the prop�rty owners, ex-
cepttng the two objectars. The motion was seconded by Conanissioner Turner and carrie�
unanimously.
Attorney Ch�zrles aie Phillips reported to the Com�nission that his Client, bIr.
E. H. Spaulding, had found it would not be practical for him to leasa a part of
Seminole Street Dock due to the Liability Insurance requirements and the cost� of
necessary repaSrs, and t2�anked the Cammission for its ef£orts and indulgence. He
stated that if the dock should be developed in the iitture, his clier_t s�ould like to
submit a ner� proposal, Commissioner Drew moved that the City I�anager be insta�zetecE
�o submit a report of provisions, now in effect, as to liability insurance and to
make recommendations for the dock's best usage. Tha motion v�as seconded by Com_
mise3.oner Casler and carried.
Commissioner Brown, for the Beach Lease Committee, repor�ed that the Coimnittee
had met with Ntr. Ev9ringham and his Attorney, bTr. John PoThill, relative to the draft-
ing of a xiew lease but had not been able to come to an agreemen't. h�r�. Polhill told
the Com�isi33on he thought a s�tiafactory agreement possible, and suggested furtner
meetings and an extension of time, withou�t pre�udice to the City�s ri�hts, to October
lst. Gormnisswoner Drsw sa3.d that since n� new proposal had been subraitted, he coulel
see nothing to warrant a change in the City's present position. No further aation
vras taken.
Commissioner Drew moved that Utility bills for the Youth bTaritime Center be
paid to the present time, b�* the City, and tho IIti.lity a.ccounts made current. The
motion was seconded by Corunissioner �asler and aarried.
Commissio�er Drew reported that tha Corrmsittee appointed to study Ordinance ��il,
relative to the cutt3ng os" curbs did not have its report ready at this time.
n1r, B. J. Drives, as Attorney for C. F. NIcKinnay, requssted that the Commission
authorize the acceptance of 500 of the face amount of the taxe9, plus �25,00 recordin�

said that in his opini�n sizch si�ns were vvhat are lmown as �"point of purck�ssa' signs
and were permissable under e�ist3ng ordinancas; further �hat he belienediany new
Ordinanee prohibitir� such signs would probably be unconstitutionall,. By consent9 the

� copy nf the Resolution had been mailed to Mr. Thacker, attorney for L�Tr. Thama�,

appropriate. The Gity t,ttorney submitted a Resolutiar, authorizing condemnation pro-
ceedings, vrhich was unanimously adopted on a motion by Commiss.ioner Casler, which

On a motion by Cammissioner Casler, v�hich was seconded by Commissioner Turne�

At this time Mayor Sargeant announced his wish to retire and asked that Com-

ownecl by Nr. C. F. NtcKinney.
The fact9 of the situation are as Pollows: The proper�y in queation is Iots� 1
to 6 inclusive and lots 9 to 14 i�clusive, Block I, ;9rookZawn Subd3vision. The ts�e�
in question date back to 1933, the last year tho propertp w�as carried on the city ta.x
rolls, it being separated from the city in February of 193��
Tiie proporty v�as of 13ttle valus when 1dr. MeKinney secured it, being unimproved
scrub. Since then, rowever, there has been an effort made to ixx�rove same. btr. hIc-
Kinney is desirous of clearin� these taxes up, but feais tY,at the amount now aw.ing on
a�l -the prcperty involved, �247.Eq is beyond his ability and therefore requesta that
th� corruaission aacapt an ofPer of �`�50 on the dollar in settlement of said taxes, in
lieu of the faae value oi ta�ces.
